How to Compare Construction Bids for a Public School Project

Compare public-school construction bids in the order required by the controlling solicitation: identify the governing jurisdiction and procurement method, screen each submission for material responsiveness, verify responsibility, tabulate prices on the stated basis, apply only disclosed evaluation criteria, and document the award decision. The lowest number is not automatically the lawful winner. In a sealed low-bid process, the usual result is the lowest responsive bid from a responsible bidder; a disclosed best-value or multistep process can produce a different result.

Because school-procurement rules vary by state, country, funding source, project type, and delivery method, use this as a defensible review sequence—not as a substitute for the invitation for bids (IFB), request for proposals (RFP), applicable statutes, board policy, or procurement counsel.

1. Start with the rules that control this project

Before opening a spreadsheet, identify the legal and contractual framework. A public school district may be following state public-works law, a local procurement code, grant conditions, a bond-finance requirement, or a framework agreement. The solicitation should tell you which rules and award method apply.

Confirm the jurisdiction and funding conditions

  • Record the state, country, school district, funding source, and any state-agency review or approval.
  • Determine whether the work is new construction, a renovation, maintenance, repair, equipment purchase, or a combined project. California guidance, for example, treats construction and maintenance as separate categories that can use different procurement routes.
  • Check whether federal, state, or other grant terms impose domestic-preference, labor-standard, bonding, insurance, reporting, or disadvantaged-business requirements.
  • Read current district policies and board rules in addition to state law. California’s Department of Education warns that district and county procedures can add restrictions.

Do not transfer a dollar threshold or award formula from another jurisdiction. California’s Department of Education page reviewed October 6, 2026, gives examples of non-CUPCCAA public works over $15,000 using formal sealed bids, CUPCCAA construction tiers reaching a $220,000 formal-bid threshold, and a separate $119,100 threshold for certain equipment, materials, supplies, services, and non-public-project repairs. It also states that payment bonds are required for California public-works projects of $25,000 or more under the cited law. Those figures are California examples, not national rules.

Identify the procurement method

Mark the method on the evaluation worksheet before reviewing prices:

Method What normally controls the comparison What the evaluator must not do
Sealed low bid The price measure stated in the IFB, after responsiveness and responsibility determinations. Choose a higher bid because it seems preferable unless the governing rules authorize that result and the solicitation discloses the basis.
Best value Published price and non-price factors, weights, scoring rules, or a stated evaluation judgment. Introduce an undisclosed preference, score, or weighting after seeing the bids.
Multistep sealed bidding A qualifications or technical step followed by price bids from eligible respondents. Compare price submissions from firms that did not pass the required first step.
Framework or prequalified competition The framework’s call-off rules, quality requirements, and pricing instructions. Apply an ordinary IFB formula when the framework specifies a different one.

Maryland’s school-construction regulations illustrate why scope matters: they cover specified public-school projects, including projects over $50,000 with Interagency Commission planning or funding approval or specified state review. The rules are not a nationwide template. England’s Department for Education school-buildings framework, published March 23, 2026, is an England-only framework with its own quality and pricing appendices; it does not govern a U.S. district.

2. Build a solicitation-based compliance checklist

Responsiveness asks whether the bid materially conforms to the solicitation. Start with a checklist copied from the actual IFB or RFP, including every form, deadline, attachment, and instruction. The following items are common checkpoints, not universal statutory requirements.

Submission and signature checks

  • Was the bid delivered by the stated date and time, through the required portal, sealed package, or other format?
  • Is the bid signed by an authorized representative, with the required corporate name, address, tax details, and contact information?
  • Did the bidder acknowledge every issued addendum in the prescribed manner?
  • Are all required schedules, certifications, affidavits, non-collusion statements, references, and disclosure forms present?
  • Was bid security, a bid bond, or another required guarantee submitted in the correct amount and form?

Scope and price checks

  • Are the base bid, alternates, unit prices, allowances, and additive or deductive items completed exactly as requested?
  • Does the bid include required labor, materials, equipment, testing, permits, and closeout obligations?
  • Are there exclusions, qualifications, substitutions, conditions, or exceptions that the solicitation did not permit?
  • Does the schedule meet the required commencement, milestone, substantial-completion, and final-completion dates?
  • Are licenses, registrations, certifications, insurance evidence, and bonding information supplied when required at bid time?

Oregon’s Procurement Manual describes a responsive bid as one that “unequivocally commits to the requirements of the ITB.” It treats material deficiencies as non-correctable. Maryland allows correction or waiver of some minor irregularities but prohibits waiving material defects affecting price, quantity, quality, or delivery. A missing non-material clerical item may be handled differently from an unsigned bid, an unacknowledged material addendum, or an impermissible scope exception.

Separate material defects from clerical errors

For each issue, write four facts: the solicitation clause, what the bidder submitted, why the difference could affect competition or performance, and the rule or delegated authority governing correction. Do not let a bidder revise a price, scope, delivery commitment, or other material term after opening unless the applicable rules expressly permit it. If the solicitation is ambiguous, pause and obtain a documented legal or procurement determination rather than solving the ambiguity ad hoc.

3. Determine bidder responsibility after the compliance screen

Responsiveness and responsibility are different findings. A perfectly completed bid can come from a contractor unable to perform; an experienced contractor can submit a materially defective bid. Evaluate responsibility only under criteria authorized by the solicitation and governing law.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Evidence commonly used for responsibility

  • Legal capacity: active license, registration, authority to contract, and eligibility to perform public work.
  • Financial and operational capacity: bonding capacity, insurance, cash flow or financial information permitted by the rules, current workload, and ability to obtain required materials.
  • People and equipment: proposed project manager, superintendent, key trades, subcontractor capacity, facilities, and equipment needed for the schedule.
  • Relevant experience: comparable school, occupied-campus, phased, hazardous-material, or technically complex projects, as relevant to the scope.
  • Past performance and integrity: documented performance, safety or compliance history where legally usable, contract defaults, litigation disclosures required by the solicitation, and references.
  • Execution ability: understanding of phasing, site logistics, schedule controls, quality assurance, commissioning, and closeout.

Use consistent evidence for every bidder. Cleveland’s school-construction process describes a project-specific review of material requirements, experience and finances, prior performance, facilities, management skills, and ability to execute. Oregon lists resources, similar-performance history, integrity, legal qualification, and required information among responsibility factors.

Handle apparent low bids carefully

An unusually low price is a reason to verify scope understanding and responsibility, not a reason to rewrite the bid. Check arithmetic under the solicitation’s correction rule, confirm that required alternates and unit prices were included, and request only the clarifications permitted by the procurement. Do not invite a bidder to add omitted work or repair a material qualification through negotiation in a process that forbids negotiation.

4. Create a like-for-like bid tabulation

A bid tabulation is the audit trail for the numerical comparison. Put one bidder per row and use the solicitation’s price components as columns. Preserve the bid-opening record before making any permitted arithmetic correction.

Suggested column How to use it
Bidder and bid identifier Use the legal entity name and the submission or envelope identifier.
Responsiveness status Record pass, reject, or pending determination with a clause reference.
Base bid Enter the amount exactly as submitted, then show any rule-permitted correction separately.
Alternates in stated order List each additive or deductive alternate as its own column; do not reorder or select them informally.
Unit prices Show the unit, quantity basis, and extended amount only when the solicitation uses them in evaluation.
Allowances and owner-provided items Display them as instructed; do not silently normalize one bidder’s treatment against another.
Evaluated total Calculate only the formula disclosed in the solicitation, identifying which alternates are included.
Responsibility status Record the evidence reviewed and the authorized finding.
Notes and approvals Link each exception, clarification, correction, recommendation, and approval to its record.

Cleveland’s process identifies the apparent low bidder from the base bid and alternates and tabulates sealed bids before a project-specific responsibility analysis. Follow the project’s alternate-selection instruction: some IFBs evaluate a base bid only, some identify a combination that fits an appropriation, and some require alternates to be accepted in a stated priority order.

Arithmetic corrections and scope normalization

Apply only corrections expressly allowed by the solicitation or law, such as a stated rule for reconciling a unit-price extension or a written-word and numeric mismatch. Show the original amount, correction, authority, date, and reviewer. Do not add a contingency, inflation factor, assumed labor burden, or “normalization” adjustment that bidders were not told about. If one bidder omitted an item that the documents required, treat the omission under the responsiveness rules; do not insert an estimated amount merely to make the table look comparable.

5. Apply price and non-price criteria exactly as disclosed

Lowest-price sealed bidding

After ineligible bids are removed and responsibility is established, compare the price measure defined by the IFB. The result is commonly the lowest responsive bid from a responsible bidder, subject to required approvals, funding, and any lawful tie-breaking or preference provisions. Oregon cautions that “the results of the bid opening are limited to the apparent low bidder, which may or may not be awarded the contract.”

Best-value evaluation

Use only published factors, weights, and scoring instructions. Possible factors include evaluated price, conformity to specifications, delivery or completion time, relevant experience, competency and responsibility, project-team capacity, past performance, service capability, minority-contractor utilization plans, and other stated elements. Maryland’s regulation expressly says the local education agency may not evaluate a bid for a criterion that is not disclosed in the IFB. Its listed best-value factors are an example of a project-specific rule, not a universal scorecard.

Life-cycle costing

Some procurements evaluate acquisition, operation, support, maintenance, and disposal costs rather than purchase price alone. Oregon permits life-cycle costing when the solicitation explains the method and requests the information needed to apply it. If those instructions are absent, do not create an ownership-cost model after bids arrive.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Schedule and quality claims

Give schedule, technical approach, or quality credit only where the solicitation explains how those claims will be assessed. Distinguish a mandatory minimum completion date from a scored acceleration proposal. Require evidence in the form and level of detail stated in the solicitation, and give bidders an equal opportunity to address the same requirement.

6. Write the recommendation and obtain approvals

The recommendation should allow someone who did not attend the bid opening to reconstruct the decision. Assemble the following record:

  1. The final IFB, RFP, addenda, questions and answers, and applicable procurement authority.
  2. All bids or proposals received, including the time and method of receipt.
  3. The completed bid tabulation with original figures, permitted corrections, alternate treatment, and evaluated totals.
  4. The responsiveness checklist and written findings for each rejected or conditionally reviewed submission.
  5. The responsibility review, supporting evidence, reference checks, and any responsibility determination.
  6. The price or best-value evaluation, including calculations, scores, weights, and evaluator sign-offs when applicable.
  7. The recommended award, any required justification for rejecting a lower bid, funding confirmation, conflict disclosures, and approval signatures.
  8. Notice, protest, debriefing, records-retention, and contract-execution actions required by local rules.

Oregon identifies bid responses, a completed bid tabulation, and written justification for rejecting lower bids as core ITB award documentation. Cleveland describes subsequent district and commission approval in its own process. Confirm who has authority to award, whether the governing board must act, and when a notice of intent or protest period begins.

7. A practical decision path

  1. Freeze the rule set. Save the controlling solicitation, addenda, jurisdictional rules, funding conditions, and approval requirements.
  2. Classify the procurement. Mark sealed low bid, best value, multistep, or framework method; identify construction versus maintenance or another purchase.
  3. Log every submission. Preserve receipt time, package condition, portal record, and bid-opening information.
  4. Screen responsiveness. Check deadline, signature, addenda, security, licenses, forms, prices, exceptions, and schedule against the solicitation.
  5. Resolve materiality. Escalate uncertain defects; do not permit an unauthorized post-opening change.
  6. Tabulate without invention. Enter base bid, stated alternates, unit prices, allowances, permitted corrections, and evaluated total using the published formula.
  7. Review responsibility. Apply the same authorized capability and past-performance checks to eligible bidders.
  8. Evaluate disclosed factors. Use the stated price measure, weights, scoring, life-cycle method, or qualification sequence.
  9. Prepare the award record. Explain the result, any rejection of a lower bid, required approvals, and protest or notice steps.
  10. Retain and communicate. Keep the complete file and issue notices using the timing and content required by the governing rules.

8. Common mistakes and how to correct them

Mistake Why it creates risk Safer correction
Assuming every public school project uses the lowest bid Best-value, multistep, framework, and life-cycle methods can use different rules. Identify the method and award formula in the solicitation before evaluating.
Using another state’s threshold Thresholds depend on jurisdiction, project type, date, and funding. Verify current local law and district policy; cite the governing provision in the file.
Treating responsiveness and responsibility as one test A material submission defect and an inability to perform require different findings. Complete a compliance screen, then conduct the authorized responsibility review.
Changing the alternate combination after seeing prices It can create an undisclosed evaluation method. Follow the stated order, formula, and funding constraint.
Scoring an appealing but undisclosed factor Maryland expressly bars evaluating criteria not disclosed in the IFB. Do not score it; seek a lawful clarification or cancel and resolicit if necessary.
“Normalizing” omissions with estimates The adjustment changes the competition and may conceal a nonresponsive bid. Apply the solicitation’s omission and materiality rule without inventing a price.
Accepting a verbal explanation as a cure It may alter a material term after opening. Document only clarifications allowed by the rules and preserve the original bid.
Recording only the winner An incomplete file cannot show equal treatment or defend a protest. Retain all bids, checks, calculations, findings, and approvals.

9. What a defensible comparison looks like

A defensible comparison is reproducible. Another reviewer should be able to start with the same solicitation, follow the same eligibility screen, recreate the tabulation, see why each defect was material or minor, verify the responsibility evidence, and reach the same recommendation under the published criteria. The file should show not only who appeared low at bid opening, but why that bidder was—or was not—eligible for award.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the governing documents do not answer a material question, stop and obtain a written determination from the district’s procurement authority or counsel. That is safer than silently borrowing a rule from another state, country, project type, or delivery method.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
