How to Choose the Right Liability Limits for a Construction Business

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no universal liability limit for every contractor. Choose limits by first satisfying the written requirements of each contract, then measuring your own worst credible losses, completed-work and subcontractor exposures, vehicle use, and any professional services. Have a commercial insurance agent or broker who understands construction compare the declarations, endorsements, exclusions, attachment terms, and self-insured retentions—not just the largest number on the certificate.

This guide is U.S.-focused general information. The appropriate limits can change with your state, trade, project owner, contract wording, annual revenue and payroll, loss history, subcontracting model, and policy language. It is not an individualized coverage recommendation.

Start with the contract, but do not stop there

Your first limit is usually the one the project owner, general contractor, lender, public agency, or prime contract requires in writing. Pull the insurance section and list every requirement separately rather than copying a single figure into your application.

Build a requirement checklist

  • General liability per-occurrence limit.
  • General aggregate limit.
  • Products-completed-operations aggregate, if separately specified.
  • Additional-insured wording, including whether coverage must be automatic, ongoing, or completed-operations.
  • Primary and noncontributory wording and waiver-of-subrogation requirements.
  • Certificate of insurance format, notice provisions, policy dates, and acceptable insurer rating.
  • Required limits for business auto, workers’ compensation, professional liability, pollution, or other lines.
  • Any project-specific umbrella or excess requirement and the policies that must sit underneath it.

Ask the contracting party to clarify ambiguous language before binding coverage. A certificate of insurance summarizes information; it does not amend the policy, add an insured, broaden an exclusion, or guarantee that a claim will be paid. The actual policy and endorsements control.

A contract requirement is a floor, not a risk analysis

Meeting a minimum can make you eligible to bid while leaving the company exposed to a loss substantially larger than that minimum. Conversely, buying a very high limit on a narrow policy may not help if the loss falls under an exclusion or a different coverage line. Use the contractual limit as the starting point, then test whether your balance sheet could withstand a severe claim and whether the insurance responds to the exposures you actually create.

Understand what each liability limit does

Commercial general liability (CGL) limits are not one shared bucket. The per-occurrence limit is the most the policy will pay for a single covered occurrence, subject to the policy’s terms and other applicable sublimits. Aggregate limits cap what the policy will pay for covered claims during the policy period. One large loss can approach the occurrence limit; several unrelated claims can consume the aggregate before the policy expires.

Limit or feature What it answers Questions to ask
Each occurrence How much can be paid for one covered accident or event? Could one injury, fire, collapse, or property-damage event exceed this amount?
General aggregate How much can be paid for covered claims in total during the policy period, apart from any separate aggregate? How many claims could your operations generate in one year, and how quickly would the limit be eroded?
Products-completed-operations aggregate How much is available for covered bodily injury or property damage arising from products or work after completion? Could a defect, water intrusion, or installation failure cause claims months or years after handover?
Per-project or per-location aggregate endorsement Whether the aggregate is restored or separately applied by project or location, if the endorsement says so. Does the contract require the aggregate to apply separately to each project, and does the policy actually provide that?
Self-insured retention What amount you must fund before an umbrella or certain coverage responds. Can the business pay the retention immediately, including for defense or multiple claims?

The California Department of Insurance explains that CGL can have separate limits for general liability and products-completed operations and that an aggregate can be exhausted during the policy period. Treat those as distinct planning issues, not interchangeable numbers.

Why completed operations deserve special attention

A project does not stop creating liability when the crew leaves. A failed flashing detail can allow water into a building; an improperly installed railing can injure a later occupant; a defective component can damage other property. Review the products-completed-operations wording, its aggregate, the policy’s definition of when work is complete, and any time or location restrictions. Confirm that subcontracted work is treated consistently with your contracts and endorsements.

Map the exposures that should drive your limit

Prepare an exposure schedule for the agent and underwriter. A useful schedule connects each activity to the people, property, time period, and policy line that could respond.

Work type and severity

  • Identify your trades: structural work, roofing, excavation, concrete, electrical, plumbing, demolition, restoration, or specialty installation.
  • Separate routine small jobs from projects involving occupied buildings, hospitals, schools, high-rise structures, public infrastructure, or neighboring property that cannot be shut down.
  • Note operations involving cranes, lifts, hot work, underground utilities, traffic control, temporary works, or water diversion. These can increase the severity of one occurrence even when frequency is low.
  • Record annual revenue, payroll, employee count, geographic territory, project size, and the largest contract value. These figures affect underwriting and may be used for audit or premium adjustment.

People and property affected

Ask who could be injured and whose property could be damaged: employees of other contractors, tenants, visitors, passersby, adjacent owners, the project owner, and the completed structure itself. CGL generally addresses covered third-party bodily injury and property damage, but it is not a promise to pay the cost of correcting your own defective work. Have counsel or your broker explain how the policy’s “your work,” “your product,” and damage-to-impaired-property provisions apply to your contracts.

Subcontractors and contractual transfer

List every subcontracted operation and the controls you use: written indemnity, additional-insured endorsements, certificates, minimum limits, and current policy dates. Require subcontractors to carry coverage appropriate to their work and verify the actual endorsements when the contract requires them. Your own CGL does not automatically make every subcontractor’s loss harmless, and a certificate alone does not prove that a transfer of risk works as intended.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Claims history and financial capacity

Provide several years of loss runs, open-claim details, reserves, and corrective actions. A company with a clean record may still face a high-severity exposure; a company with frequent smaller claims may need to protect its aggregate and cash flow. Decide what retained loss the business can fund without missing payroll, debt payments, or project obligations. That amount helps determine deductibles, self-insured retentions, and whether a higher limit is practical.

Choose the primary CGL limit and structure

Compare quotations on identical assumptions. A lower premium can reflect a narrower form, a higher retention, a lower completed-operations aggregate, a restrictive endorsement, or an exclusion that matters to your trade.

Compare the numbers side by side

Comparison What to verify Why it matters
Per-occurrence limit Limit, defense-cost treatment, and any sublimits. One severe event can consume the available amount.
General aggregate Total annual limit and whether it applies per project or location. Multiple claims can exhaust capacity before renewal.
Products-completed-operations aggregate Separate amount, definition of completion, and duration of exposure. Claims can arise after the work is finished.
Deductible or retention Per claim, per occurrence, or another basis; defense inside or outside the limit. The same headline limit can produce very different cash obligations.
Endorsements and exclusions Additional insured, contractual liability, residential or multifamily restrictions, subsidence, height, roofing, hot work, pollution, and designated operations wording. Coverage depends on the form, not the certificate’s summary.

Use a scenario test instead of a single guess

  1. Write a plausible maximum single occurrence for your work, including emergency response, legal defense, medical damages, property repair, and business interruption claims made by third parties where covered.
  2. Write a plausible annual claim pattern: for example, one serious injury plus several smaller property-damage claims and a completed-operations claim.
  3. Compare those amounts with the occurrence, general aggregate, and completed-operations aggregate. Test both a quiet year and a year with several claims.
  4. Decide how much loss the company can retain and how much must be transferred to insurance. Document assumptions so the limits can be revisited when operations change.

Do not treat a construction contract’s stated minimum as evidence that it matches your scenario test. It only tells you what that contracting party requested.

Decide whether umbrella or excess insurance is needed

Commercial umbrella or excess insurance adds limits above scheduled underlying liability policies. The California Department of Insurance describes the concept this way: “A commercial umbrella covers the amount of loss above the limits of a basic liability policy.” The protection remains subject to the umbrella’s insuring agreement, exclusions, attachment terms, and retention.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Umbrella versus excess

Excess insurance typically increases limits over a specifically identified underlying policy and may follow that policy’s terms closely. An umbrella can provide broader protection in some circumstances, but it can also contain its own exclusions and conditions. The label alone does not establish that every gap is covered.

Check the attachment schedule

  • Which underlying policies are scheduled: CGL, business auto, employers liability, watercraft, or another line?
  • What underlying limits must remain in force, and what happens if they are reduced, cancelled, or exhausted?
  • At what dollar amount does the umbrella attach, and is there a self-insured retention for an uncovered underlying exposure?
  • Does the umbrella recognize the additional-insured, contractual-liability, completed-operations, and territory requirements in your contracts?
  • Are defense costs inside or outside the umbrella limit, and are there aggregate caps or reinstatement provisions?

Ask the broker to show an actual claim path: which policy responds first, when the underlying limit is exhausted, whether the umbrella pays defense or indemnity, and what retention you fund. Buying an umbrella without confirming these mechanics can create a false sense of security.

Use contract examples carefully

Requirements vary by owner and procurement. A 2026 U.S. Small Business Administration landscaping solicitation lists $1,000,000 of general liability per occurrence and a $3,000,000 aggregate, along with additional-insured status and certificates of insurance. Those figures describe that landscaping solicitation; they are not a universal construction standard, a statutory requirement for every contractor, or proof that the same limits fit another trade or project.

Before bidding, obtain the current solicitation or contract, including exhibits and insurance specifications. Confirm whether the limits are required per project, whether completed operations must be maintained after substantial completion, and whether the owner requires a specific endorsement edition or wording.

Account for exposures CGL does not replace

Business auto

Company vehicles, hired and non-owned vehicles, employee deliveries, and trailer use can create a serious liability claim outside the CGL’s intended structure. Review who drives, which vehicles are titled or rented, cargo and equipment transport, radius of travel, and any contract requirement for auto liability limits. Coordinate the auto limit with the umbrella’s scheduled underlying policies.

Workers’ compensation and employers liability

Employee injuries are generally handled under workers’ compensation and employers-liability arrangements, not by treating CGL as a substitute. Verify state requirements and the limits shown on the workers’ compensation policy with a licensed professional.

Professional services

If the business designs, engineers, surveys, specifies products, provides construction management, or gives advice for a fee, errors-and-omissions or professional-liability exposure may exist. A CGL policy is not automatically a professional-liability policy. Describe those services accurately and obtain a separate quote or written coverage analysis when appropriate.

Pollution, cyber, and specialized risks

Asbestos, lead, mold, fuel, contaminated soil, environmental releases, payment or data systems, and other specialized exposures may be excluded or tightly limited under CGL. Determine whether a separate pollution, cyber, or specialty policy is needed instead of assuming the general liability limit solves the problem.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A repeatable process for selecting limits

  1. Collect the documents. Assemble every current contract, bid specification, subcontract, certificate request, policy declaration, endorsement, loss run, payroll and revenue estimate, vehicle schedule, and project list.
  2. Extract requirements. Create a spreadsheet with one row per project and columns for occurrence, aggregate, completed operations, additional insured, primary and noncontributory wording, waiver of subrogation, auto, workers’ compensation, professional liability, pollution, and umbrella requirements.
  3. Describe operations precisely. Tell the broker what your crews and subcontractors actually do, where they work, the largest height or depth, occupied-site conditions, hot work, traffic exposure, and whether you design or advise.
  4. Model credible losses. Estimate a severe single event and a multi-claim year. Include defense, emergency stabilization, third-party property damage, medical damages, and completed-operations timing where relevant.
  5. Set a retention ceiling. Choose the largest deductible or self-insured retention the company can fund promptly without impairing payroll, bonding, debt service, or active projects.
  6. Request comparable quotes. Ask for the same occurrence and aggregate limits, the same underlying schedule, and a side-by-side list of exclusions and endorsements. Require written explanations for differences.
  7. Test the umbrella. Trace at least one bodily-injury claim, one property-damage claim, and one auto-related claim through the underlying policy and umbrella. Confirm attachment, exhaustion, and any self-insured retention.
  8. Check contract compliance before binding. Have the broker review the proposed endorsements and certificate language against the actual contract. Do not rely on a generic certificate template.
  9. Document the decision. Record why the selected limits fit the contract floor, modeled exposures, retained-loss capacity, and growth plans. Keep the analysis with the renewal file.
  10. Revisit after change. Recalculate when you enter a new trade, add design services, take on larger projects, work in a new state, buy vehicles, increase subcontracting, suffer a significant loss, or change ownership.

Common mistakes and how to correct them

Buying the cheapest policy that meets the certificate request

Problem: The quote satisfies a headline number but contains an exclusion or aggregate that does not fit the work. Correction: Compare forms and endorsements, not only premium and certificate limits.

Assuming one aggregate is unlimited for every project

Problem: Several claims or multiple projects draw on the same annual capacity. Correction: Confirm whether a per-project or per-location endorsement exists and what the contract actually requires.

Ignoring completed operations

Problem: The business plans only for accidents during active construction. Correction: Review the products-completed-operations aggregate, completion definition, subcontractor wording, and any required post-completion period.

Using a certificate as proof of coverage

Problem: The certificate omits an exclusion, does not create additional-insured status, or shows a policy that has since changed. Correction: Obtain and review the policy and endorsements; ask the broker to confirm compliance in writing.

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Adding an umbrella without checking underlying policies

Problem: The umbrella does not schedule a required policy, attaches at the wrong amount, or imposes a retention for a gap. Correction: Review the schedule, attachment point, exclusions, defense provisions, and retention with the broker before purchase.

Calling professional work “just construction”

Problem: Design, engineering, inspection, or paid advice falls outside the intended CGL grant. Correction: Describe those services and arrange professional-liability analysis separately.

How to maintain the decision at renewal

Do not renew by copying last year’s limits. Compare new projects, contract language, revenue, payroll, vehicles, subcontractor percentages, loss experience, and completed-work obligations with the prior year. Ask whether the aggregate has been eroded by reported claims, whether an endorsement has changed, and whether the umbrella still matches the underlying policies.

Use an agent or broker experienced with your type of construction business and insurers that routinely underwrite construction risks. Give that professional the complete contract and policy set, not just a certificate. The final choice should show a clear connection between contractual requirements, actual exposures, policy wording, and the loss the company can responsibly retain.
