How to choose a contractor for a public-sector building project

Choose the contractor whose bid best satisfies the requirements and delivers the strongest permitted value for money—not automatically the contractor with the lowest price. A defensible public-sector award starts by defining the project, eligibility conditions, published evaluation criteria and scoring method before bids are opened, then applying that method consistently to every qualifying tender.

The exact route, thresholds, terminology and evidence requirements depend on the agency, contract value, project scope and governing procurement rules. Use the current solicitation and local regulations as the controlling documents; guidance from Singapore, the UK, Scotland, New Zealand and Victoria illustrates principles rather than creating one universal procedure.

Start with the procurement rules, not the bidders

A public building contract is a procurement decision made under the tender documents and the law applying to the agency. Before a market approach, identify the approved procurement route, delegated authority, required notices, evaluation records, conflict-of-interest controls and any applicable thresholds. The project team should also decide who may answer bidder questions, how clarifications will be issued and who has authority to recommend and approve the award.

Do not copy another jurisdiction’s process and assume it applies locally. Singapore’s Building and Construction Authority (BCA), UK authorities operating under the Procurement Act 2023, Scotland’s construction handbook, New Zealand Government Procurement and Victorian public-sector guidance use related concepts but different rules and terminology. The current invitation to tender and the regulations governing your agency take precedence.

Define the project before you assess a tender

Ambiguous requirements make a fair comparison impossible. Prepare a requirements baseline that every bidder receives at the same time. It should be sufficiently developed to show what must be built, the constraints under which it must be delivered and how compliance will be demonstrated.

Describe the required outcome

  • Scope, drawings, specifications, surveys, interfaces and existing-condition information.
  • Functional performance, capacity, durability, accessibility, security and operational requirements.
  • Required completion milestones, possession dates, commissioning, handover information and post-completion obligations.
  • Site constraints such as working hours, occupied facilities, traffic, utilities, environmental controls and stakeholder access.
  • Applicable building, planning, technical, health and safety and public-sector standards.

Separate mandatory requirements from desirable outcomes. A mandatory requirement should have a clear pass/fail test; a desirable outcome can be scored only if the solicitation explains how it will affect the award.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set the conditions for participation

State the minimum conditions a supplier must meet before its bid is evaluated on quality and price. Depending on the applicable framework, these may include legal eligibility, financial and economic standing, relevant experience, professional qualifications, insurance, licensing, health and safety capability, proposed key staff and capacity to perform the work. The UK selection pathway, for example, directs authorities to consider selection and economic and financial standing matters. These are possible areas of assessment, not a universal checklist for every project.

Choose an evaluation method that can be explained

Write the scoring model before bids arrive. Define the criteria, subcriteria, scoring scale, pass marks, calculation method, treatment of taxes and options, and how non-compliant bids will be handled. Describe the evidence expected for each criterion and disclose the method in the tender documents. Scotland’s Construction Procurement Handbook specifically stresses giving bidders advance notice of the criteria and scoring.

Do not introduce a new preference after opening bids—for example, deciding only then that an incumbent’s familiarity deserves extra points. If a factor matters, include it in the published method and make it relevant to the project’s requirements.

Build a transparent evaluation framework

A useful framework connects each criterion to a project risk or outcome. The following structure is a starting point; use only factors permitted by your rules and actually published in the solicitation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Evaluation area Evidence to request Question the evaluators answer
Price or stated cost measure Completed pricing schedule, rates, assumptions, options and exclusions What is the evaluated cost under the tender’s stated calculation?
Technical solution Method statement, design response, programme logic, temporary works and interfaces Does the proposed solution meet the specification and address site constraints?
Contractor and team capability Relevant project examples, qualifications, organisation chart, key-person commitments and resource plan Can the named organisation and assigned team deliver this work at the required scale and complexity?
Schedule and delivery approach Baseline programme, critical path, procurement lead times, sequencing and recovery approach Is the promised completion date credible, and are dependencies controlled?
Health and safety Project-specific risk assessment, controls, competence arrangements and incident-management approach Does the plan control the hazards created by this project and site?
Quality Inspection and test plans, quality assurance system, commissioning and defect-management process How will the contractor demonstrate that the completed building meets requirements?
Whole-life, social or environmental outcomes Only the outcomes and measures stated in the tender, such as energy, carbon, maintainability or approved social-value commitments Does the offer produce the published outcomes without conflicting with core requirements?
Risk and commercial assumptions Risk register, qualifications, exclusions, departures, dependencies and proposed risk ownership What evidenced risks could change cost, time, quality or operability?

Do not assign weightings merely because a template uses them. The lawful weights and pass marks are those in the actual solicitation. If the tender gives equal treatment to several criteria, score them as stated; if it specifies a price-quality formula, follow that formula exactly.

Check eligibility and capability before detailed scoring

First determine whether each tender is eligible under the stated conditions. Keep this stage distinct from comparative scoring so a bid does not gain quality points for evidence that was required as a minimum condition.

Legal and regulatory status

Confirm the supplier’s legal identity, authority to contract, required registrations or licences, insurance and any declarations required by the procurement documents. Record the source and date of each verification. If a consortium or subcontracting arrangement is allowed, check the responsibility and evidence requirements for every named party.

Financial and economic standing

Use the financial tests specified in the solicitation, which may include accounts, credit information, turnover, liquidity or parent-company support. Apply the same test to every bidder and protect commercially sensitive information. A financially strong balance sheet does not, by itself, prove that the proposed team can deliver a complex building; it is one part of the stated assessment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relevant experience and past performance

Ask for projects that demonstrate relevance to the building type, value, complexity, occupied-site conditions or technical systems actually involved. Verify references against the published questions rather than accepting an unstructured list of famous projects. New Zealand Government Procurement advises balancing the value of past performance against the risk of excluding innovative new suppliers. Treat experience as evidence of capability, not an automatic preference for incumbency.

People and resources

Check the availability and qualifications of the proposed project director, site manager, design leads, specialist trades and safety personnel. Require bidders to identify commitments to other projects and the point at which substitutions need approval. A strong corporate record is not enough if the people named in the bid will not be assigned to this project.

Delivery plan and risk controls

Test whether the programme, procurement plan, logistics, design management, commissioning strategy and risk register are specific to the site. Look for dependencies that the bidder has simply assumed away. Ask whether the plan explains how the contractor will recover a delayed approval, late long-lead item or interface with an occupied public facility.

Compare qualifying bids on the published factors

After eligibility checks, evaluate every qualifying bid against the same evidence questions and scoring definitions. Singapore’s BCA describes a price-quality scoring framework for specified public construction tenders; UK guidance directs authorities to evaluate public works using the published award criteria for the most economically advantageous tender. Both examples reinforce the same discipline: the method announced to bidders is the method used at award.

Use independent scoring before consensus

  1. Give each evaluator the same tender, clarification log, scoring guide and conflict-of-interest declaration.
  2. Have evaluators score independently and cite the exact page, drawing, schedule or reference supporting each score.
  3. Meet to reconcile material differences. Change a score only when the discussion identifies a documented interpretation or calculation error, and record the reason.
  4. Apply any arithmetic, price-normalisation or pass/fail rules exactly as stated in the tender.
  5. Have the evaluation chair check that no undisclosed factor, personal preference or bidder contact influenced the result.

Distinguish evidence from assurance

A polished method statement is not proof of capacity. Prefer specific, verifiable evidence: a programme tied to quantities and lead times, named personnel with availability, references that answer the required questions, and risk controls linked to site hazards. Where a claim is unclear, use the clarification process allowed by the procurement rules; do not let one bidder rewrite its offer while others are held to their original submissions.

Record risk, not just scores

Two bids can receive similar technical scores while exposing the agency to very different delivery risks. Record material qualifications, exclusions, dependencies, unresolved design assumptions and proposed risk ownership. If the published method permits a risk adjustment or commercial assessment, apply it as written. If it does not, do not invent a private adjustment after opening.

Why the lowest price is not always the right award

Lowest price can be the correct result when the specification is complete, quality is assured through pass/fail requirements and the stated method is price-only. It is not automatically best value for a building whose performance depends on design integration, safety, commissioning, maintainability or reliable delivery.

Scotland’s Construction Procurement Handbook states: “The purpose of a tender exercise is to identify the bid that is most likely to meet the tender requirements and which represents the best value for money for the public sector.” The statement does not authorise an agency to choose whatever it considers attractive; it means value must be judged through the disclosed requirements and criteria.

Whole-life considerations can matter where the tender permits them. A slightly higher evaluated price may be justified by measurable benefits such as lower operating cost, greater durability, safer maintenance access or reduced environmental impact—but only when those benefits are relevant, evidenced and evaluated under the published method. Never compare a bidder’s unpriced promises with another bidder’s priced commitments.

Jurisdiction examples and their limits

Jurisdiction or guidance Principle illustrated Important scope limit
Singapore BCA, 2026 Price-quality (PQM) scoring is described for specified public construction tenders. The cited application covers workheads CW01 General Building and CW02 Civil Engineering at an estimated construction cost of S$3 million or more; this is Singapore-specific, not a general public-construction threshold.
United Kingdom, Construction Playbook, 2022 Public works bids should be evaluated for the most economically advantageous tender using published award criteria. UK terminology and legal duties have changed under the Procurement Act 2023; use the current procurement documents and regulations for the contracting authority.
Scotland, Construction Procurement Handbook, 21 December 2018 Criteria and scoring should be disclosed in advance, with the aim of identifying the bid most likely to meet requirements and provide public-sector value. The handbook does not replace the current rules or tender documents for another authority or jurisdiction.
New Zealand Government Procurement Past performance can inform selection, but excessive emphasis can exclude innovative new suppliers. Apply the balance required by the particular procurement and its published conditions.
Victoria and other public-sector systems Government examples commonly connect clear requirements, transparent criteria, capability checks and value-for-money decisions. The route, thresholds, mandatory documents and award terminology must be checked in the current Victorian or other applicable rules.

A practical evaluation sequence

  1. Confirm authority and route. Identify the agency’s governing rules, contract value, funding conditions, approval gates and the current form of tender.
  2. Freeze the requirement. Complete the scope, drawings, specifications, programme, site information, mandatory standards and handover obligations to the level needed for comparable bids.
  3. Separate minimum conditions from scored criteria. List legal, financial, technical and capacity requirements that are pass/fail, then list the factors that will distinguish qualifying offers.
  4. Write the scoring guide. Define each score, evidence threshold, calculation, pass mark and treatment of options, taxes, alternatives and departures.
  5. Publish the method. Put the requirements, conditions, criteria, scoring and submission instructions in the tender. State how questions and clarifications will work.
  6. Secure the evaluation team. Appoint people with relevant technical, commercial, operational and safety knowledge. Obtain conflict declarations and control access to bids.
  7. Complete eligibility checks. Verify legal status, financial standing, licences, insurance, references, personnel and other stated conditions consistently.
  8. Score the technical and quality responses. Use independent assessments tied to evidence, then document any consensus changes.
  9. Evaluate price or cost. Apply the published price definition and formula, checking arithmetic and ensuring that all bidders are treated consistently for options and assumptions.
  10. Assess permitted whole-life or outcome factors. Consider only the social, environmental, operational or lifecycle measures announced in the tender and supported by evidence.
  11. Review risks and compliance. Confirm that the leading bid has not failed a mandatory requirement and that its qualifications, exclusions and dependencies have been handled as the method requires.
  12. Prepare the award recommendation. Show the applied criteria, scores, evaluated cost, material risks, approvals and reasons the recommended bid represents the best permitted outcome.
  13. Complete required approvals and notifications. Follow the agency’s standstill, notification, debrief and record-retention obligations before signing.

Common mistakes and how to correct them

Changing the rules after bids arrive

Problem: Evaluators reward an attractive feature that was never disclosed or quietly change the meaning of a score.

Correction: Return to the published criteria. If the tender is materially defective, obtain procurement-law advice about the lawful remedy rather than improvising an award method.

Using price as a proxy for competence

Problem: The cheapest figure wins despite unrealistic staffing, exclusions or an unworkable programme.

Correction: Test the bid against the stated technical, capability, schedule, safety and risk requirements before comparing totals.

Making experience an incumbency test

Problem: Requirements are written so narrowly that only the current contractor can qualify.

Accepting generic safety or quality plans

Problem: A corporate manual receives credit even though it does not address the site’s hazards or interfaces.

Correction: Require project-specific controls, responsibilities, inspection points, commissioning steps and escalation routes, then score against the disclosed standard.

Ignoring the assigned team

Problem: The company has an impressive record, but the named project team is unavailable or inexperienced.

Correction: Evaluate the people and resources committed to this contract, and make substitutions subject to the contract controls stated in the tender.

Failing to preserve an audit trail

Problem: The final recommendation contains scores but no evidence or explanation.

Correction: Retain the requirements baseline, published tender, questions and answers, declarations, individual scores, consensus notes, calculations, reference checks, approvals and award rationale in accordance with the agency’s retention rules.

What a defensible award decision contains

The decision record should allow an independent reader to reconstruct the outcome without relying on an evaluator’s memory. It should identify the applicable rules and solicitation, confirm eligibility, show how each published criterion was applied, explain evaluated price or cost, identify material risks and departures, document approvals and state why the recommended bid is most likely to meet the requirements and provide the best value allowed by the method.

That record also supports a fair debrief. Explain the published criteria and the bidder’s own strengths and weaknesses without disclosing another supplier’s confidential information. A clear record protects the agency, gives unsuccessful bidders useful feedback and makes the eventual construction contract easier to administer because the promised scope, team, programme and outcomes are explicit.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
