Choose a lawyer who regularly handles your kind of construction contract dispute, represents your side of the project, understands the governing law and required forum, and can explain a realistic process and budget. Interview at least two candidates, verify their license, discipline history, conflicts and insurance, identify the lawyer who will actually run the file, and bring the complete contract and project record to the first meeting.
Why construction-specific experience matters
A construction contract dispute combines contract interpretation with project delivery, payment administration, scheduling, notice requirements, site conditions, technical evidence and industry practice. A general business litigator may be excellent at pleadings and trial, but still lack experience with the documents and expert analysis that determine whether a construction claim succeeds.

Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches- Party role: owner, developer, general contractor, subcontractor, designer, surety or insurer.
- Project type: commercial building, residential development, infrastructure, industrial, public works or another relevant sector.
- Contract family and delivery method: stipulated-price, cost-plus, design-build, construction manager, unit-price, integrated project delivery or a form used by your industry.
- Claim type: nonpayment, delay, acceleration, defective work, differing site conditions, change orders, termination, design responsibility, warranty, indemnity, lien, bond or insurance issues.
- Procedure: negotiation, mediation, arbitration, statutory adjudication, court litigation, appeal and enforcement.
The American Bar Association’s construction-law resources cover contract drafting and interpretation, payment provisions, discovery, arbitration, mediation, litigation and trial practice. That range illustrates why “construction lawyer” should mean sustained subject-matter work, not merely a lawyer who accepts an occasional building case.

What counts as meaningful experience
Ask for matter examples in categories rather than confidential names or settlement amounts. A useful answer identifies the project type, contract structure, party represented, claim theory, forum and result achieved procedurally. A lawyer who can explain how schedule analysis, payment certification, notice provisions and expert evidence affected comparable matters is demonstrating more relevant experience than someone who only lists construction law on a website.
Specialization labels are not uniform across the United States. Arizona, for example, has a construction-defect specialization pathway requiring seven years of admission, three immediately preceding years in Arizona, substantial construction-defect litigation or alternative-dispute-resolution work, specialized education, peer reviews and tested knowledge. That is a jurisdiction-specific standard, not a universal certification requirement. Treat any designation as one credential to verify, not a substitute for asking about your exact dispute.
First, protect deadlines and evidence
Before you start comparing firms, identify anything that can expire. Review the contract and applicable law for notice-of-claim, notice-to-cure, payment, lien, bond, limitation, repose, mediation, arbitration and hearing deadlines. The controlling periods vary by project location, governing law, contract wording and claim type, so obtain local advice promptly when a deadline may be running.
Recommended Free Tools
Preserve evidence immediately. Issue a practical litigation hold to the people involved and prevent routine deletion of relevant email, messaging, cloud files and site photographs. Keep originals and record where each file came from.
- Signed agreement, exhibits and every incorporated general, special and supplementary condition.
- Amendments, addenda, clarifications, proposals and approved change orders.
- Payment applications, pay estimates, invoices, waivers, withholding notices and account statements.
- Schedules, updates, baseline programmes, daily reports, meeting minutes and productivity records.
- Requests for information, submittals, drawings, specifications, field directives and inspection records.
- Emails, letters, text messages and other communications concerning performance, delay, defects or payment.
- Dated photographs, videos, weather records, delivery tickets and site-access logs.
- Expert reports, testing, commissioning records, punch lists and repair estimates.
- Insurance policies, certificates, notices, bond instruments and claims correspondence.
- A dated chronology separating agreed facts, disputed facts, decisions and resulting costs.
Do not annotate originals with speculation or delete unfavorable material. Give counsel the complete record, including documents that appear harmful; surprises discovered late can damage credibility and increase cost.
Build a qualified shortlist
Start with the state or local bar, a verified referral service, professional construction-law organizations, trusted architects, engineers, quantity surveyors, claims consultants or project counsel, and lawyers who regularly appear in the relevant courts or arbitration forums. A referral panel can provide an efficient starting point. American Bar Association-approved referral programs publish objective panel requirements and complaint mechanisms, but the ABA cautions that it does not individually review every lawyer’s qualifications.

Shortlist lawyers who satisfy the basic geographic and procedural requirements before discussing strategy in detail. Confirm that the firm can appear where the contract requires and can handle any related state, federal, public-contract or administrative proceeding. If the project crosses state or national borders, ask whether local co-counsel will be needed and who will coordinate it.
Initial screening questions
- How many matters substantially like this have you handled in the last several years?
- Have you represented my side of the transaction in disputes involving the same contract type or delivery method?
- Have you handled this claim type through the forum specified in my contract?
- Will you personally lead the matter, and who will do the day-to-day work?
- What experts or analyses are likely to be required?
- What information would you need before giving a preliminary assessment?
Do not select a lawyer solely because the firm is large, the partner is famous or the office is nearby. The relevant test is whether the proposed team has handled the legal, technical and procedural combination your dispute presents.
Interview at least two candidates
The State Bar of California advises consumers to comparison-shop by finding two or more candidates and contacting them for brief interviews. Multiple interviews expose differences in issue-spotting, communication, staffing and fee practices before you commit. Give each candidate the same core facts and documents so the comparisons are meaningful.
Questions that reveal fit
- “What are the strongest and weakest parts of my position?” A useful answer identifies unfavorable contract language, notice problems, proof gaps and factual uncertainties without promising an outcome.
- “What would you do in the first 30 days?” Listen for deadline review, preservation, contract analysis, a damages or defense model, witness interviews and a forum plan.
- “Which comparable matters have you taken to mediation, arbitration, adjudication, trial or appeal?” Ask what the lawyer actually did, not merely whether the firm appeared on the file.
- “What experts and project records will be needed?” Delay, disruption, defects and valuation commonly require different technical disciplines; the lawyer should explain the likely evidence rather than automatically ordering every possible report.
- “Who will handle the file each week?” Obtain names, roles, expected response times and the partner’s review points.
- “What assumptions underlie your preliminary budget?” Ask which facts, discovery volume, expert work, motions or hearings could materially change it.
- “What authority will you need to negotiate or settle?” Make sure the engagement preserves your decision-making authority and explains how settlement proposals will be reported.
The California State Bar warns consumers to be wary of any lawyer who guarantees results. Construction disputes depend on contract text, proof, experts, credibility and procedural rulings; a responsible lawyer can describe scenarios and risks, not promise a verdict or settlement.
Verify credentials, conflicts and protection
Before signing, independently confirm that the proposed lead lawyer is admitted and active in the relevant jurisdiction and check available disciplinary records. Ask whether the firm has handled conflicts clearance against every project participant, consultant, insurer, lender and related entity. A conflict discovered after work begins can force an expensive change of counsel.
Ask whether the firm maintains professional-malpractice insurance and whether any limitation or exclusion could affect this engagement. Referral-panel requirements may include malpractice coverage, but panel membership is not an individual certification of competence.

Verify the actual team
- Identify the lead partner, supervising lawyer, associate, paralegal and any outside experts.
- Ask what work will be delegated, outsourced or performed by a different office.
- Confirm who can give legal advice when the lead lawyer is unavailable.
- Ask how the firm secures confidential project, pricing and trade-secret information.
- Request a written explanation of document retention and the process for returning your files.
Ask for references only when appropriate and with respect for confidentiality. A lawyer should not disclose another client’s protected information merely to win your business.
Match counsel to the contract’s dispute procedure
Read the dispute-resolution clause before interviewing counsel. Mark the governing-law, venue, notice, negotiation, mediation, arbitration, adjudication, service, consolidation, joinder, emergency-relief and attorney-fee provisions. These terms can determine who decides the dispute, which evidence can be obtained, how quickly it proceeds, whether related parties can be joined and what appeal or enforcement route exists.
What to ask about the clause
- Is a written notice required before a claim, and what must it contain?
- Are negotiation or mediation conditions precedent to arbitration or suit?
- Which institution, rules, seat, language and number of arbitrators apply?
- Does the clause permit emergency measures, a bond claim, a lien action or court injunction while arbitration is pending?
- Can subcontractors, designers, sureties, insurers or owners be joined in one proceeding?
- What discovery, depositions, expert disclosures and hearing procedures are available?
- Where must the case be filed, and what law governs interpretation and remedies?
- Does the prevailing-party or indemnity clause shift attorney fees?
The American Arbitration Association states that construction arbitrators are selected for subject-matter expertise, qualifications, familiarity with applicable law and reputation. Ask whether your lawyer has worked with the administering institution, selected or challenged arbitrators, handled emergency procedures and managed the discovery limits and award-enforcement issues that the clause creates.

No forum is automatically best. The contract, governing law, urgency, amount at stake, need for technical evidence, confidentiality, enforceability and relationship among the parties should drive the decision.
| Path | Where it can fit | Questions for counsel |
|---|---|---|
| Direct negotiation | Early fact and payment disagreements when the parties can communicate and preserve leverage. | What notice, reservation of rights and settlement authority are needed before discussions? |
| Mediation | Cases where a neutral may help bridge valuation, schedule or repair positions while the parties retain control of the outcome. | Is mediation required by the contract, and what documents, decision-makers and expert presentations will make it productive? |
| Arbitration | Disputes covered by an arbitration clause or a later agreement to arbitrate, often before a decision-maker with construction experience. | What are the governing rules, discovery limits, emergency options, cost structure, award remedies and enforcement risks? |
| Statutory or contractual adjudication | Jurisdictions and contracts that provide a rapid interim decision, commonly for payment or progress disputes. | What strict notice and timetable rules apply, and how will the interim result interact with later arbitration or court proceedings? |
| Court litigation | Cases requiring subpoenas, broad joinder, public-law remedies, injunctions, a jury or judicial review where arbitration is unavailable or unsuitable. | Which court has jurisdiction, what motions and discovery are available, and what appeal and fee rules apply? |
A lawyer should explain trade-offs rather than steer every matter toward the forum the firm prefers. Ask for a written procedural map showing prerequisites, likely stages, decision points and the consequences of missing each step.
Compare engagement terms and costs
There is no reliable universal “average cost” for a construction dispute. Fees depend on the project record, claim value, number of parties, experts, discovery, emergency applications, hearing length, jurisdiction and whether the matter settles. A consultation or referral-program price is a local program rule, not a market-wide fee promise.

Obtain a written engagement letter before substantive work begins. It should state:
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →- Scope of work and the matters excluded, such as separate lien, bond, insurance or appellate proceedings.
- Hourly rates by lawyer and staff, or the formula for any alternative fee.
- Retainer amount, trust-account treatment, replenishment trigger and consequences of nonpayment.
- Expense treatment for filing fees, travel, transcripts, consultants, experts, e-discovery and copying.
- Staffing assumptions, supervision and whether outside vendors may be used.
- Budget by phase: investigation, notice or pre-suit work, mediation, pleadings, discovery, experts, dispositive motions, hearing or trial, and appeal.
- Reporting frequency, invoice detail and the process for approving material budget changes.
- Settlement authority, communication expectations, document retention and termination rights.
- Conflicts procedures and the firm’s professional-liability coverage.
Questions that make budgets comparable
- What work is included in the initial retainer, and what event triggers a new phase?
- Which assumptions determine the estimate: number of parties, document volume, depositions, experts or hearing days?
- What expenses are billed at cost, marked up or paid directly by the client?
- How quickly will you warn me if actual fees are departing from the budget?
- Can the firm offer staged authorization so that investigation precedes expensive discovery?
Compare proposals on scope and assumptions, not just the lowest hourly rate. A lower rate can cost more if the lawyer lacks construction fluency, duplicates work or needs outside counsel to correct an early procedural mistake.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Assess communication and working trust
Construction disputes can last through several project cycles and require frequent decisions about notices, access, repairs, payment, experts and settlement. After each interview, record whether the lawyer listened, explained strengths and weaknesses plainly, identified uncertainty, answered direct questions and set realistic response times.
Ask how urgent messages are triaged, who covers holidays, how often status reports are sent and whether meetings can include your project manager, estimator, insurer or board. Clarify who may speak with experts and opposing parties. Good communication is not constant availability; it is a dependable system that prevents missed deadlines and surprises.
Bring an organized project file
The Oklahoma Bar Association describes the contract and its incorporated conditions as the first mediation materials. Give counsel a clean index and a short chronology rather than an unstructured data dump. Separate documents by issue and preserve metadata where it may matter.

A practical handover format
- Create a one-page project summary with parties, contract value, dates, current status and the relief sought or defended.
- Attach a contract index identifying every incorporated document and amendment.
- Build a dated event chronology with a source document for each major event.
- Prepare a payment ledger showing invoiced, paid, withheld and disputed amounts.
- Prepare a schedule narrative identifying baseline dates, critical-path events, claimed delay and mitigation.
- Label photographs and videos with date, location, photographer and issue shown.
- List witnesses by role and knowledge without coaching their recollections.
- Identify insurance, bond, lien and notice documents and the date each was sent or received.
- Keep a damages or defense spreadsheet whose assumptions can be traced to records.
Do not send privileged communications to outsiders or add unnecessary recipients to email chains. Ask counsel how to preserve privilege while collecting technical advice and communicating with insurers or consultants.

Use a decision scorecard
After the interviews, score each candidate against the same criteria and write down the evidence for every rating. A simple comparison prevents a charismatic presentation from outweighing a poor procedural fit.
| Criterion | Evidence to compare |
|---|---|
| Construction expertise | Comparable contracts, delivery methods, defects, payment, delay or termination matters. |
| Party-role and project fit | Experience representing your position and working with your project’s technical disciplines. |
| Governing law and forum | Admission, local procedure, contract forum, administering institution and enforcement experience. |
| ADR and litigation capability | Specific work in negotiation, mediation, arbitration, adjudication, trial and appeal as needed. |
| Staffing and responsiveness | Named day-to-day lawyer, supervision, coverage, response standards and reporting. |
| Conflicts and insurance | Completed conflicts check, active license, discipline review and malpractice coverage. |
| Fee clarity and control | Written scope, phase budget, retainer terms, expense rules and change-approval process. |
| Trust and judgment | Clear discussion of weaknesses, uncertainty, settlement authority and realistic outcomes. |
Choose the candidate with the strongest overall fit, not necessarily the most aggressive prediction or the cheapest initial estimate. Keep the unsuccessful proposals and interview notes for your records, but do not circulate confidential material unnecessarily.
Warning signs that should stop the selection
- The lawyer guarantees a win, a particular settlement or a specific timetable.
- The firm will not identify who will actually perform the work.
- The lawyer dismisses notice, lien, bond, limitation or arbitration deadlines as routine.
- The proposed strategy ignores the governing-law or dispute-resolution clause.
- The lawyer cannot describe comparable matters without changing the subject.
- The firm avoids a written scope, budget assumptions or retainer terms.
- Conflicts are treated as an afterthought or the firm will not explain its clearance process.
- The lawyer pressures you to sign before you can review the engagement letter.
- The consultation is dominated by criticism of other lawyers rather than analysis of your documents.
What to do after hiring
Confirm the engagement in writing, provide the indexed record, identify the people authorized to instruct counsel and calendar every known deadline. Agree on a first-phase plan: contract and forum analysis, preservation, required notices, interviews, expert scoping and an initial budget. Do not contact the opposing party, insurer, surety or project consultant about disputed facts without following counsel’s communication plan.
Expect the assessment to change as documents and expert evidence arrive. A careful lawyer should update the strengths, weaknesses, budget and settlement range when material facts change. You remain responsible for business decisions such as whether to fund repairs, continue performance, preserve a project relationship or accept a settlement; counsel supplies legal advice and explains consequences.
The decision in one sentence
Hire the construction lawyer who can prove relevant work for your party role and project, map the contract’s governing law and procedure, present both risks and options without guarantees, offer a named and responsive team, and put scope, staffing and budget controls in writing.
