Do not decide from the road’s name, its village purpose, or the number of trees you can see. A reliable answer requires the complete proposed alignment, parcel-level revenue and forest records, the project’s history, and a check of the official PARIVESH proposal record. If any part of the project uses land legally treated as forest for a non-forestry road use, the project agency must establish whether prior approval is required under the current Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 and whether a specific statutory exemption applies before construction or widening begins.
The steps below are a screening method, not a substitute for a determination by the competent forest authorities. Until the alignment, land status and applicable legal category are confirmed, the clearance question remains unresolved.

What determines whether a rural road needs clearance?
Forest-clearance screening is project-specific. The relevant question is not simply “Does this village have forest?” It is whether the defined project footprint overlaps land that is legally treated as forest and, if so, whether the proposed use is a non-forestry use covered by the current law or an applicable exemption.
The footprint includes more than the finished carriageway. It can include widening, hairpin bends, cut-and-fill slopes, retaining structures, drains, culverts, construction access, spoil or dumping areas, borrow areas, approaches and other associated works. A route that appears narrow on a sketch can therefore have a materially larger area for screening.

Visible tree cover is only one physical condition. Legal status may arise from revenue records, forest notifications, demarcation records or other government classifications even where a parcel looks open. Conversely, a green-looking parcel is not automatically legally classified as forest. The two questions must be checked separately.
Step 1: Fix the complete road alignment
Start with a version-controlled map or geospatial file that shows the entire proposal, not just the centreline. The project agency should be able to identify the start and end points, chainage, proposed width, construction limits and every associated component.
Include all components that can affect the land requirement
- Formation width, carriageway and shoulders.
- Widening, realignments, switchbacks and temporary diversions.
- Cut slopes, retaining walls, breast walls, drains and cross-drainage works.
- Bridges, culverts, approach roads and safety works.
- Construction yards, access tracks, material storage and spoil or dumping sites.
- Any land needed for utilities, approach works or future stages included in the same proposal.
Freeze the alignment before asking authorities to classify it. If the line changes later, the parcel list and area calculation may no longer describe the project that will actually be built.

If there are two feasible corridors, map both. A comparison can show whether one option avoids forest land, reduces the unavoidable forest area or eliminates associated works that would otherwise trigger additional overlap. The lower-cost or shortest route is not automatically the route with the simplest approval path.
Step 2: Check land status parcel by parcel
Overlay the fixed alignment and its full construction footprint on the cadastral or parcel records used by the revenue and forest departments. Ask the relevant revenue office and forest division to identify every affected parcel and the extent of overlap.
Evidence to request
- Parcel or khasra identifiers and the recorded ownership or management entry.
- The legal forest classification shown in the applicable record.
- Forest notifications, reservation records, demarcation documents or other orders affecting the parcel.
- The forest division and range or beat jurisdiction for each overlap.
- The calculated area of forest land and non-forest land separately.
- Any earlier diversion, approval, rejection, violation or restoration proceeding involving the same land or road.
A government road-proposal Form A Part II illustrates the level of specificity needed: it identifies the district and forest division, states the legal status and gives the proposed forest area. Treat that as the model for the evidence your own screening should establish, not as a decision for a different road.

Separate legal status from physical appearance
Walkover photographs, satellite imagery and tree counts can help describe impacts, but they cannot replace the legal record. An undemarcated or apparently unused parcel still requires the authorities to determine its status. Do not label land “non-forest” merely because it is rocky, cultivated, sparsely vegetated or already disturbed.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsStep 3: Search PARIVESH for the project record
Use the official PARIVESH portal to find whether a proposal exists and what status is recorded. Search with more than one identifier because a road may appear under a project name, an agency name or a proposal number.
Search sequence
- Search the road or package name, including spelling variants used in government documents.
- Search by proposal number if the agency or forest division has supplied one.
- Filter by Himachal Pradesh, district and the responsible department or agency.
- Open the record that matches the alignment, area and project description; do not rely on a similarly named road.
- Note the proposal description, stated area, dates, forest division, application stage, decisions and the latest status entry.
- Save the record date and the documents displayed with it. Recheck the status immediately before work is authorised because an old announcement is not proof of a current approval.
PARIVESH can establish that a case has been filed and show the status recorded in the system. It does not, by itself, prove that an unlisted road is exempt or that a differently described alignment is covered by an existing approval. Match the portal record to the parcel and alignment documents.
Step 4: Identify the legal route and any exemption
Where the footprint includes land legally treated as forest and the road use is non-forestry, ask the project agency and competent forest authorities to apply the current Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980, its rules and the applicable guidance. The authority must decide whether prior approval is required and whether a specific statutory exemption fits the actual project category and location.
Do not infer an exemption from a road being short, serving only villages, funded by a public body or intended for a public purpose. Those facts may be relevant to the classification, but none of them independently proves that approval is unnecessary. The applicable category must be established for the defined project and its associated works.
Questions to put in writing
- Which parcels are legally treated as forest, and under what record or notification?
- Does the proposed use fall within the non-forestry provisions of the current Act?
- Is a statutory exemption claimed? If so, what exact category and conditions apply?
- Is prior approval required before any site preparation, widening, dumping or other associated work?
- Which authority will record the determination and process the proposal on PARIVESH?
- Does an earlier approval cover this alignment, or would a revised alignment require a new or amended proposal?
Keep the response with the alignment drawing and parcel schedule. A verbal assurance that “village roads are allowed” is not a project-specific legal determination.

Step 5: Check the project history, including existing roads
An existing track or partly built road does not settle the clearance question. Check whether the road was constructed under an approval, whether the present proposal widens or changes the original footprint, and whether any compliance or violation matter is pending.
A 2025 Advisory Committee record concerned prior approval for non-forestry use of 1.9 hectares of undemarcated protected forest for a Public Works Department road in Bilaspur district. The committee sought details of action taken concerning the violation. The example shows why undemarcated status and an already-built road do not remove the need for formal review.
If work has already started, stop extending the footprint until the responsible agency obtains written direction from the competent authorities. Preserve the as-built survey, photographs, work orders and land records; do not attempt to regularise an uncertain situation by describing a larger project as maintenance.
How to compare alternative alignments
When alternatives exist, ask the designers and forest officials to compare them using the same measured footprint and the same parcel records.
| Decision factor | What to measure | Why it matters |
|---|---|---|
| Legal forest overlap | Parcels and hectares intersected by the complete construction footprint | Shows whether the route enters land requiring statutory screening. |
| Land-status certainty | Availability of current revenue, notification and demarcation records | Unclear status can delay classification even when the physical impact appears small. |
| Unavoidable area | Minimum forest area after testing feasible route options | Government proposal records commonly justify the area as the bare minimum required. |
| Associated works | Cut-and-fill, dumping, approaches, drains, utilities and temporary access | A corridor that looks clear can create additional overlap through its supporting works. |
| Project history | Earlier approvals, rejected proposals, violations or pending cases | Past work or a similarly named proposal may not cover the current alignment. |
| Approval path | Applicable Act category, exemption conditions and PARIVESH status | Determines what must be obtained before construction proceeds. |
Document why the selected route is preferred. If a route avoids legally classified forest with comparable engineering and safety performance, that fact can be important to the authority’s review. Do not claim that an alternative eliminates clearance unless the parcel records and competent authority confirm it.
What Himachal Pradesh records illustrate
A 1.5358-hectare proposal
One Himachal Pradesh Form A Part II road record identifies 1.5358 hectares of proposed forest area: 1.5286 hectares of unprotected forest and 0.0072 hectares of unclassed forest. The record recommends that the area is the bare minimum required. These figures demonstrate why a screening file must distinguish legal categories and quantify the actual overlap. They do not determine another road’s status.

A village-connecting road
Another Himachal Pradesh record describes a road connecting villages surrounded by forest land and recommends the proposal under forest-conservation law. Its reasoning is specific to that project. A local road is therefore not automatically exempt merely because it serves nearby residents.
2,183 projects in a status report request
In 2024, an Advisory Committee directed the state to provide a status report on 2,183 road projects following High Court directions. The requested report was to distinguish proposals already approved from cases yet to be processed. The figure is the committee record’s count of projects covered by those directions; it is not a count of projects proven to need clearance and not a count of projects still awaiting approval.
Why statewide percentages cannot answer a parcel question
In the same 2024 committee record, the Himachal Pradesh PCCF and HoFF submission stated that 66.16% of the state’s geographical area was included in the stated forest-area figure, while 27.33% had forest cover above 0.10% canopy density. These are different measures: one concerns a reported forest-area classification and the other concerns physical forest cover. Neither substitutes for checking the legal status of the parcel crossed by a particular road.

- Signed alignment plan and geospatial file with coordinates or chainage.
- Plan showing the full right-of-way and all temporary and permanent associated works.
- Parcel schedule with district, village, identifiers, ownership and recorded land status.
- Area calculations separating forest, non-forest and each legal forest category.
- Notifications, demarcation records and correspondence from the revenue office and forest division.
- PARIVESH search results, proposal number and the latest status or decision documents.
- Sanction, work-order and funding records identifying the project agency and scope.
- Evidence of earlier construction, approvals, inspections, notices or compliance directions.
- Maps and photographs used to describe the site, clearly labelled as supporting evidence rather than proof of legal status.
Use one consistent project name and area throughout the file. Differences between the drawing, parcel schedule, proposal form and portal record are a common reason for an authority to seek clarification.
When construction can proceed
Proceed only after the project agency has a written, project-specific determination from the competent forest authorities and has completed any required approval path. The determination should identify the alignment, parcels, area, legal status, applicable category or exemption and conditions that apply to associated works.

A practical decision tree
- Is the complete footprint fixed? If no, finish the alignment and associated-works plan before screening.
- Does any parcel have a legal forest classification or unresolved forest status? If yes, obtain the revenue and forest records and measure the overlap.
- Is the proposed use a non-forestry road use under the current law? Ask the competent authority to classify it; do not self-certify.
- Is a specific exemption asserted? Obtain the exact legal category and written conditions, then test the complete project against them.
- Does PARIVESH show a matching proposal and current status? If no, ask the agency and forest division whether a proposal is required or whether another record covers the work.
- Has the authority confirmed that the project may proceed? If no, do not start or expand construction.
Common mistakes that create avoidable risk
- Checking only the road centreline and ignoring slopes, dumping and approach works.
- Using a district-level forest statistic instead of parcel records.
- Counting trees and treating that count as a legal land classification.
- Assuming that a small area, public purpose or village connectivity removes the approval requirement.
- Relying on an old press release or an unrelated PARIVESH entry with a similar name.
- Calling new widening or reconstruction “maintenance” without checking whether the footprint changes.
- Starting earthwork while the agency is still waiting for a status report or clarification.
- Failing to update the proposal after changing the alignment, width or associated works.
The safest record is a traceable chain from alignment, to parcel, to legal status, to portal case, to written determination. That chain gives the agency and the authorities the same factual project to review.
Frequently Asked Questions
How often should I recheck a PARIVESH status?
Check it when the project file is prepared, whenever the alignment or area changes, and immediately before authorising work. Record the date of each check because a past status may not describe the current proposal.
What should I do if revenue and forest records disagree?
Do not choose the more convenient entry. Ask the relevant revenue office and forest division to reconcile the parcel identity, notification or demarcation record and legal classification in writing, then attach that clarification to the project file.
Free tools Windows power users keep installed
One-click scans. No signup required.
Does an earlier approval automatically cover a new road package?
Only if the competent authority’s record clearly covers the same alignment, parcels, area and scope. A new widening, diversion or associated work may require a revised review.
Who should make the final project-specific determination?
The project agency should assemble the evidence, but the legal classification and approval or exemption route must be confirmed through the competent forest authorities and the applicable PARIVESH process.
What if construction has already begun without a clear determination?
Stop extending the footprint, preserve the drawings and as-built evidence, and seek written directions from the competent forest authorities. An existing road does not by itself prove that prior approval was unnecessary.
