Before you buy, ask the authority that regulates the parcel to assess it against the project you actually intend to build. Confirm legal-lot status, zoning, access, utilities and wastewater, site constraints, and the permit path; then get written parcel-specific answers where available. A parcel number, tax bill, deed, or attractive acreage does not establish that a lot can support your home or project.
What “buildable” means for your project
Buildability is not a universal label attached to a piece of land. It depends on the parcel’s legal history, the proposed use, local land-use rules, physical site conditions, access, available services, and the approvals required in the jurisdiction that governs it. A lot may be legally recognized but unable to accommodate a particular house, or a use may be allowed while site constraints leave little room for construction.

Fairfax County Land Development Services captures the distinction in its guidance: “A ‘valid’ lot may not be a ‘buildable’ lot.” The practical question is not simply whether land appears on a map or has a tax account. It is whether the specific project you plan to build can satisfy the applicable rules and obtain the required approvals on this parcel.

Requirements vary by city, county, special district, and other land-use authority. The process below is a general U.S. due-diligence workflow, not a parcel determination, title opinion, survey, environmental delineation, engineering finding, utility commitment, or permit decision.

Gather the parcel information officials need
Start with enough identifying information to ensure that you and the agency are discussing the same land. Ask the seller for the parcel number, street address if one exists, legal description, recorded plat, deed, title materials, and any prior land-use or permit records. Describe the project specifically: for example, a single-family home, manufactured home, accessory structure, or another intended use.
Find out which agency has permitting authority. A parcel viewer or assessor map can help locate the land and identify a likely jurisdiction, but it is only a starting point. A county boundary does not necessarily mean the county is the only authority whose rules apply. Requirements can differ within the same county, and special land-use jurisdictions may cover only defined areas. Contact the planning or permitting authority responsible for the site and provide the parcel ID and project description.
Check whether the parcel is a legal lot
Ask planning staff whether the parcel was legally created and whether it needs a lot validation, legality study, certificate, or other formal determination. If the parcel’s history is unclear, request the agency’s procedure for reviewing the chain of title and subdivision records. Do not treat an assessor parcel number, tax assessment, title report, deed description, or survey description as proof of legal parcel status.
Santa Cruz County’s Community Development & Infrastructure guidance specifically cautions that a parcel is not necessarily legal merely because it has an assessor’s parcel number, taxes have been levied, a title report has been completed, or a deed or record of survey describes it. Those documents may be useful records, but the planning authority’s determination is the relevant answer to whether the lot meets local legal-creation requirements.
Separate this question from whether the lot can support your project. A favorable legal-lot determination does not by itself establish that zoning allows the intended use, that the site has a usable building area, or that required utilities and permits are available.
Test the proposed use against zoning and recorded restrictions
Give the zoning authority the intended use rather than asking only whether the parcel is “buildable.” Confirm whether that use is allowed in the zone and whether it requires a separate approval. Then ask which dimensional standards and conditions apply to this lot and proposal.

- Lot dimensions: minimum area, width, frontage, and density standards, if applicable.
- Building limits: setbacks, height, and lot-coverage requirements.
- Mapped or adopted rules: overlays, critical-area requirements, flood-related rules, or other zoning provisions that affect the site.
- Prior decisions: conditions attached to earlier approvals that could affect future development.
Minimum acreage alone is not a reliable pass-or-fail test. Jackson County, Iowa, states in its zoning FAQ that meeting the minimum lot size does not automatically mean a property is buildable. Its standards are local examples, not national thresholds; use the rules for the jurisdiction where your parcel is located.
Check recorded covenants, deed restrictions, easements, and plat notes as a separate track from public zoning review. Private restrictions can be more limiting than county rules. Have the relevant documents reviewed rather than assuming that zoning permission overrides a restriction recorded against the property.
Determine whether access is both legal and usable
Confirm that the parcel has recorded rights to reach a public road or another authorized route. Review the deed, recorded plat, rights-of-way, and easements; a visible track or driveway is not by itself proof of a legal access right. Establish whether the road is public or private and, for a private road, what maintenance obligations apply.
Ask the responsible agency whether the proposed entrance or driveway needs an access permit and what access conditions apply to the project. Also check whether emergency vehicles can reach the proposed building site under the applicable requirements. Legal access to the parcel boundary and practical access to a safe building location are related but distinct questions.
A licensed boundary survey may help locate boundaries, encroachments, rights-of-way, and easements. If you are comparing a seller’s sketch or a parcel map to the land, do not assume it identifies the precise area available for construction.

The building envelope is the part of the site that may remain available after the applicable boundaries, setbacks, easements, buffers, access needs, and environmental constraints are considered. Ask the agency what rules affect the proposed location and have those limits plotted against reliable parcel information. A survey and, depending on the site, professional environmental, engineering, or geologic review may be needed to understand the usable area.

This step can change how an apparently large lot compares with a smaller one. Acreage says how much land is included in a parcel; it does not show how much is available for a compliant building, driveway, and related work. Ask about the project’s full footprint and associated site work, not only the house location.
Verify water, wastewater, and other utilities
Contact each relevant service provider about the proposed building site, not just whether a line or service appears nearby. Ask whether service is actually available, what extension route or easements may be required, what connection charges or capacity conditions apply, and what timing the provider can confirm. A utility connection near the road is not a commitment to serve the lot.
Ask about water and sewer first, then check electric, gas, and any other services the project needs. If public water or sewer is unavailable, contact the responsible health authority about well and onsite wastewater requirements. Consult a qualified septic designer about parcel-specific feasibility and the approvals relevant to your intended use. A general conversation or map view is not a substitute for required review or approval.
Keep provider responses in writing where possible. Record who answered, what location and project they assessed, any stated conditions, and what remains to be confirmed. This helps distinguish a service that is available now from one that depends on future extensions, approvals, or construction.
Screen for flood, wetland, slope, and other site constraints
Review available information for floodplain, wetlands, streams, shoreline, protected or critical areas, steep slopes, and geologic hazards. Treat map layers as screening tools: they can flag questions, but they do not necessarily provide the formal determination needed for a permit or transaction decision.
Baldwin County, Alabama, explicitly explains that online wetland maps are not a formal wetland delineation or jurisdictional determination. If a map or site condition raises a concern, ask the responsible agency whether you need a formal delineation, jurisdictional decision, floodplain determination, geologic report, grading review, or another permit or technical evaluation.

Check the proposed building area and related work. Depending on local rules and the site, floodplain review may address grading, driveways, fill, or other work as well as the building footprint. Ask which agency handles each issue and what documentation it needs before you rely on a map or seller’s description.

Ask for the right written decision before closing
There may not be one document that answers every buildability question. Ask the responsible jurisdiction which written determination or application can resolve each outstanding issue, what plans and supporting records it requires, and whether it can assess the specific project before you own the land. A general inquiry may not answer a question that requires a detailed proposal or permit application.
Pre-purchase applications are not universally available. Maine’s Land Use Planning Commission says that, within its service area, a buyer with a purchase and sales agreement may submit a building-permit application before purchase. That is a jurisdiction-specific option, not a general rule for other locations. Ask your own authority what it permits and what status or agreement is needed to apply.
Where possible, obtain written answers tied to the parcel ID and a clear project description. If an official cannot make a definitive finding without a formal application or professional study, ask for the applicable process, required materials, and the question that remains open. A verbal indication should not be treated as a permit or final approval.

A practical comparison for multiple lots
When comparing candidates, use the same project description and request the same categories of information for each one. There is no universal cost, probability of approval, or minimum acreage threshold that can rank lots without regard to local rules and site conditions.
| Compare | What to establish |
|---|---|
| Legal status and use | Whether the parcel was legally created, whether your intended use is allowed, and what written agency determination or approval remains necessary. |
| Potential building area | How setbacks, easements, buffers, flood constraints, and other site limits affect the area available for the proposed building and related work. |
| Access | Whether access is legally recorded and physically usable; road ownership and maintenance; driveway requirements; and emergency access conditions. |
| Services and wastewater | Whether water, sewer, electricity, gas, and other needed services can serve the proposed site, plus any extension, easement, or capacity conditions; well and septic feasibility when needed. |
| Site investigations | Which survey, soil, septic, slope, flood, wetland, geologic, or engineering reviews are needed for this parcel and proposal. |
| Approval path and certainty | Required permits and conditions, the records and plans each agency needs, likely sequencing, and what written response is available before closing. |
Compare documented answers rather than asking only which parcel has more acreage or a lower asking price. An unresolved approval or utility question is a real difference between candidates, even when both appear similar on a map.
Questions to send to the planning or permitting authority
- Was this parcel legally created, and is a lot validation or other determination needed?
- For the project described, is the intended use allowed here, and which zoning standards or recorded approval conditions apply?
- What setbacks, overlays, easements, buffers, or mapped constraints affect the proposed building location and site work?
- What evidence is needed to establish legal and emergency access, and are driveway or entrance approvals required?
- Which providers or agencies should confirm water, wastewater, and utility availability for the proposed site?
- Do available hazard or environmental maps indicate that a formal study or agency determination is needed?
- What application or written determination can answer the remaining questions, and can it be submitted before purchase?
- What plans, records, survey, or professional reports must accompany that request?
Include the parcel ID, legal description if available, intended use, and a clear description or sketch of the proposed location. Ask the official to distinguish what is confirmed from what would require an application, site study, or another agency’s decision.
Common mistakes that create false confidence
- Relying on a tax or parcel record: an assessor record identifies land for assessment purposes; it does not by itself establish legal lot status or development eligibility.
- Checking zoning but not the site: an allowed use does not resolve access, wastewater, utility, environmental, or dimensional constraints.
- Assuming proximity means availability: a road, water line, or utility nearby does not establish legal access or a service commitment to the building site.
- Treating online maps as final: map layers can help identify issues but may not be the formal delineation or determination an agency requires.
- Asking an overly broad question: “Is it buildable?” may not produce a useful answer without a parcel identifier and a concrete project proposal.
- Waiting until after closing: a required study, application, or utility extension can take time and may change the economics or feasibility of the purchase.
When to bring in professionals
Use the agency’s response to identify the right expertise rather than buying a generic product or ordering every possible study. A licensed surveyor can help resolve boundary and easement questions; a qualified septic designer can assess onsite wastewater issues; and environmental, geologic, or civil engineering professionals may be appropriate when the parcel or agency review calls for that work. The necessary qualifications and accepted reports depend on local requirements.
Professional findings support due diligence but do not replace decisions reserved to the relevant authority. Confirm in advance which professional credentials, scope of work, and report format the agency will accept.
What a careful buyer should have in hand
Before making an irreversible commitment, assemble the parcel records, agency responses, provider information, and any technical evaluations needed to understand the proposal. Identify unresolved questions explicitly, along with the application or review that would answer each one. If the available evidence does not establish that your project can proceed, treat buildability as unconfirmed rather than assuming the gap will resolve favorably.
