A luxury or hotel brand on a residence does not prove that the development is legally approved, adequately funded, or protected against construction defects. Before you sign or pay, verify the exact project with the local planning and building authority, confirm the developer’s real-estate registration and project-specific escrow account, match approved plans to the unit being sold, and obtain completion evidence before handover. A locally licensed property lawyer and an independent building inspector should review the contract and the physical work.
The documents and remedies differ by jurisdiction. The checks below show how to build an evidence trail that applies to the specific plot, developer, sales entity and branded operator—not merely to a marketing name.

Why the brand name is not enough
A branded residence may use a hotel, fashion or luxury mark under a licence or management agreement. That commercial relationship does not itself establish planning permission, a building permit, lawful off-plan sales, protected deposits, construction quality or a continuing obligation for the brand to operate services after completion.
Legal responsibility normally sits with the registered developer and the entities named in the land, planning, sales and management documents. The regulator’s project record, approved plans and payment controls are stronger evidence than a brochure, artist’s impression or statement that a famous operator is “behind” the scheme.

Start by treating the purchase as two separate questions: is this project legally permitted and properly financed? and what remedies do I have if the developer is late, changes the design or delivers defective work? The first question is answered by public authority records and project documents. The second is answered by the sale contract, disclosure statement, warranty and insurance terms.
1. Establish the exact project and governing jurisdiction
Identify the law that governs the land and sale before requesting documents. The authority, permit names, escrow rules, warranty scheme and buyer remedies may change between countries, states, emirates, municipalities and project types.

Create a project identity record
Write down the following details exactly as they appear in official documents:
- Legal developer name, corporate registration and registered address.
- Plot, parcel or title reference and the municipality or planning area.
- Project registration number or official Project ID.
- Name of the sales entity receiving reservations or installments.
- Name of the branded operator, hotel manager or licensor.
- Building, tower, phase, unit number, floor and parking or storage allocation.
- Broker’s licence and the name of the entity that will sign the sale contract.
Abu Dhabi’s real-estate regulator, the Abu Dhabi Real Estate Centre (ADREC), says registered projects receive an official Project ID and appear on a public register. Use that type of regulator record to confirm that the project exists in the legal system and that the seller’s description refers to the same phase and plot.
Resolve identity mismatches before paying
Stop if the brochure, reservation form, bank instructions and regulator record use different developer names, project phases or plot references. A brand may license its name to several developments, while a developer may create separate legal entities for each phase. Ask the seller to explain every mismatch in writing and have your lawyer verify the answer against title and corporate records.
2. Verify planning, building and specialist approvals
Request copies of the approvals issued for the exact project and compare them with the unit being offered. Do not rely on a claim that an application has been “submitted” or that approval is expected.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesCore approvals to request
- Planning or development permission identifying the site, permitted use, floor area, height and number of units.
- Building permit and the approved architectural, structural and services drawings.
- Fire-safety design approval and later fire inspection sign-off where required.
- Environmental, infrastructure, traffic or utility approvals that apply to the site.
- Amendments, revised drawings and authority conditions issued after the original approval.
- Permits for construction stages or specialist systems where the jurisdiction requires them.
Consumer Affairs Victoria advises buyers to check permits with the local council and warns that owners can remain responsible for ensuring permits were obtained. That is why a buyer should ask the issuing authority—or an authorised professional acting for the buyer—rather than accepting a developer’s summary.
Match the approval to the marketed product
Check that the approved use permits residential occupation, hotel or serviced-apartment operations, short-term letting and any promised amenities. Compare the approved unit count, layouts, balcony areas, parking, pools, restaurants and shared facilities with the sales plan. A material difference can affect lawful use, service charges, financing and resale.
Ask whether the project is being built in phases and whether the permit covers the whole master development or only one building. The completion of a lobby or show apartment does not prove that the tower, common areas, utilities or access roads serving your unit are approved.

Check amendments and material changes
Obtain a dated list of amendments and the latest approved drawings. Your contract should explain when the developer may change layouts, materials, amenities, unit areas or operating arrangements, how significant changes are disclosed, and whether you can cancel or claim compensation. Keep the version of every plan that was attached to the contract; later marketing material is not a substitute for the agreed specification.

3. Confirm lawful off-plan sales and a project-specific escrow account
For an off-plan purchase, the payment path is a central construction protection. Ask the regulator for the project’s escrow-account number and the name of the licensed bank. Confirm directly that the account belongs to the same project and phase, not to a general developer account or a different tower.
What to verify with the bank and regulator
- Obtain the escrow account number, bank name and project or registration reference from the regulator or official project record.
- Compare those details with every reservation, deposit and installment instruction.
- Ask whether the account is legally restricted to this project and whether the sales entity is authorised to collect funds.
- Confirm how construction milestones are certified and how releases are approved.
- Pay only to the verified project account; do not substitute a personal account, broker account or unrelated corporate account.
- Keep bank confirmations, receipts and the payment schedule with the signed contract.
Dubai Land Department describes the escrow account as a mechanism intended to regulate building and construction processes and protect investors’ rights. Its project-status service relies on the latest approved technical audit. Abu Dhabi’s rules require buyer payments into a licensed project escrow account and provide for milestone-based releases supported by certified progress updates.
Understand what escrow does—and does not—guarantee
Escrow controls the destination and release of money; it does not guarantee that the building will be completed on the promised date or that every defect will be repaired. Read the law and contract for cancellation, refund, suspension and enforcement rights if progress stops. Ask what happens to interest, administrative charges and amounts paid to a seller before the escrow account was opened.
Regulation-specific financial security
Abu Dhabi Real Estate Centre material describes a bank guarantee of at least 20% of total construction cost in a specified regulatory circumstance. That figure is not a universal requirement for every development: ask the regulator or lawyer which rule applies to this project and what the guarantee covers.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →4. Track construction independently
Do not treat a sales update or branded launch event as proof of progress. Compare physical work with the regulator’s latest technical audit, certified milestone report or equivalent official update.
Build a progress file
- Save each regulator status report with its publication date.
- Record the stated construction percentage, certified milestone and expected next inspection.
- Photograph site progress from lawful public vantage points and date the images.
- Compare the installed structure, façade, services and common areas with the approved drawings.
- Ask why a reported milestone does not match visible work, and request a written answer.
Dubai directs buyers to project-status tracking based on the latest approved technical audit. Abu Dhabi requires certified progress information before escrow drawdowns. These controls are useful only if you check the current project record rather than an old screenshot supplied by a broker.
Warning signs of stalled or diverted work
- Installment demands arrive before the corresponding milestone is certified.
- The payment recipient changes without a regulator-confirmed explanation.
- Construction percentages rise while the site shows no corresponding structural or services work.
- Approved drawings are unavailable, repeatedly replaced or inconsistent with the sales plan.
- The developer refuses access for an independent inspection or will not identify the certifying professional.
5. Require completion evidence before handover
A promised handover date is not the same as legal permission to occupy. Before accepting keys, require the municipality or regulator’s completion or occupancy certificate and the inspection records that support it.
Handover documents to collect
- Completion or occupancy certificate for the building and, where applicable, the individual unit.
- Final fire-safety and life-safety approvals.
- Utility connection and commissioning confirmations.
- Evidence that common areas, lifts, access routes and promised facilities have been inspected and accepted.
- As-built plans, equipment manuals, warranties and emergency procedures.
- Unit area measurement and a schedule of outstanding works.
ADREC describes a Completion Certificate as the final document authorising handover of units after construction is finished and inspections are passed. If the developer offers “early access,” “soft opening” or furniture installation before the certificate, ask your lawyer whether occupation is lawful and who bears the risk of injury, utilities, insurance and unfinished common areas.

Use a staged snagging inspection
- Arrange an independent building surveyor or inspector before signing the handover form.
- Inspect structure, waterproofing, windows, doors, finishes, plumbing, electrical systems, ventilation, fire systems and appliances.
- Test shared facilities and compare them with the approved plans and specification.
- List each defect with a location, photograph, severity and proposed remedy.
- Have the developer sign the snagging schedule and set dates for correction.
- Record any reservation of rights before accepting possession; do not sign a statement that all works are complete if they are not.
Consumer Affairs Victoria notes that a buyer can commission a private building surveyor’s assessment. The inspector’s report is not a substitute for an occupancy certificate, but it creates independent evidence for defects and unfinished work.
6. Read the disclosure statement and sale contract line by line
Have a locally licensed property lawyer review documents before you pay a non-refundable reservation fee. Canada Mortgage and Housing Corporation’s condominium guidance states: “Consult with your lawyer before signing any documents.”
Commercial and operational terms
- Estimated construction start and completion dates, plus the definition of practical or legal completion.
- Permitted residential, hotel, serviced-apartment and short-term-rental uses.
- Who owns and manages common areas, parking, amenities and back-of-house facilities.
- Service-charge assumptions, reserve contributions, utilities, taxes and brand or management fees.
- Minimum-stay, rental-pool, furnishing and owner-occupancy rules.
- Brand licence duration, operating standards, replacement rights and what happens if the operator leaves.
Risk-allocation terms
- Developer rights to alter area, layout, materials, views, amenities or surrounding phases.
- Notice and consent requirements for significant changes.
- Delivery extensions, force-majeure wording and compensation for delay.
- Buyer termination, refund and interest rights if the project is cancelled, materially changed or seriously delayed.
- Defect-notice deadlines, access for repairs, dispute forum and governing law.
- Assignment, resale, mortgage and title-registration conditions.
Australian Capital Territory guidance emphasises development and management information and updates about significant changes. CMHC advises buyers to examine disclosure statements, warranty scope and occupancy-delay rights. Use those principles as a checklist, then apply the statute and contract rules of the project’s own jurisdiction.
7. Identify construction protections after handover
Ask for the legal name, provider, coverage and duration of every protection. Do not assume that a luxury brand supplies a warranty or that an escrow account covers post-completion defects.
Protections to ask about
- Statutory new-home or structural warranty.
- Developer or builder workmanship warranty.
- Owner-builder insurance or latent-defect insurance.
- Deposit protection if the project fails before completion.
- Completion insurance or a substitute-contractor mechanism.
- Defect-retention fund and the process for accessing it.
- Common-area warranty and the owners’ association’s enforcement rights.
Dubai Land Department’s current FAQ states that Article 14 of its Escrow Account Law requires 5% of the total amount paid into escrow to be retained for one year after project completion to address defects. That is a Dubai rule with a stated one-year period, not a general standard for branded residences elsewhere.
Alberta lists home-warranty, deposit-protection, title and home-completion insurance among available protections and states that home-warranty insurance is mandatory for new homes sold in Alberta. The scope, exclusions, claim deadlines and responsible party still need to be confirmed for the individual property.
Check the claims procedure
- Find the notice period for visible defects and the longer period, if any, for latent or structural defects.
- Identify the address or portal for submitting a claim and the evidence required.
- Confirm whether the developer, builder, insurer, owners’ association or escrow administrator must respond.
- Ask how emergency defects such as water ingress, loss of power or unsafe fire systems are handled.
- Record inspections, correspondence and repair appointments; preserve the right to appoint an independent expert.
8. Verify the brand and management promises separately
No universal branded-residence standard proves that a hotel or luxury brand will continue providing services after handover. The promise must appear in the signed brand licence, hotel-management agreement, owners’ association documents and fee schedule.
Questions for the operator documents
- What services are mandatory, optional or merely marketed as an intention?
- How long does the brand licence last, and can it be terminated or transferred?
- Who may replace the operator, and what vote or consent is required?
- What service levels, staffing, maintenance and reserve funding are promised?
- How are brand fees, management fees and pass-through costs calculated?
- What remedies apply if the operator fails to provide contracted services?
A brand’s withdrawal may not invalidate the property title or building permit, but it can materially change rental income, fees, amenity access and resale expectations. Treat those consequences as contract issues and obtain advice before relying on them in your financial model.

Property lawyer
Ask the lawyer to verify title, planning and building approvals, developer authority, project registration, escrow instructions, disclosure completeness, change rights, delay remedies, termination, defect liability, warranty insurance, dispute forum and the brand-management documents. Request a written list of missing or inconsistent documents, not only a verbal opinion.
Building surveyor or inspector
Before handover, commission an independent inspection covering the unit and accessible common areas. Confirm the inspector’s licence, insurance, scope and reporting method. Ask for a follow-up inspection after repairs and retain the final report with the signed snagging schedule.
Financial and tax advice
Where the residence includes rental management, a rental pool or foreign ownership, obtain local tax and financial advice. Test the budget using the contract’s actual service charges, management fees, reserve contributions and vacancy rules rather than projected returns in marketing material.
10. A practical document-control checklist
Keep a secure folder containing:
- Project registration or official Project ID record.
- Title or plot reference and developer corporate details.
- Planning permission, building permit, approved drawings and amendments.
- Fire, environmental, utility and specialist approvals.
- Escrow confirmation, bank details, payment schedule and receipts.
- Regulator technical audits or certified milestone reports.
- Disclosure statement, sale contract and every incorporated plan or specification.
- Brand licence, management agreement, owners’ association rules and fee schedule.
- Completion or occupancy certificate and inspection sign-offs.
- Warranty, insurance, retention and deposit-protection certificates.
- Independent legal opinion, inspection reports, snagging schedules and repair records.
Use dated filenames and preserve superseded versions. If a dispute arises, the sequence of approved plans, notices, payments and inspections can be as important as the final document.
Comparing two branded developments
When choosing between projects, compare evidence rather than brand prestige. The following framework keeps the comparison focused on legal and construction risk.
| Comparison area | Evidence to compare |
|---|---|
| Permits and registration | Project register entry, plot reference, planning approval, building permit and latest approved drawings. |
| Escrow and progress | Project-specific account, licensed bank, milestone-release process and latest certified construction percentage. |
| Completion readiness | Inspection status, utilities, common-area acceptance and availability of the completion or occupancy certificate. |
| Developer security | Legal developer identity, track record, financial guarantees and completion or deposit protection. |
| Disclosure quality | Delivery dates, permitted uses, material-change rights, delay remedies, termination and defect procedures. |
| Warranty and insurance | Provider, covered elements, duration, exclusions, retention and claim deadlines. |
| Inspection access | Right to use an independent surveyor, pre-handover access and documented snagging process. |
| Brand obligations | Licence term, management duties, fees, replacement rights and remedies in signed agreements. |
A development with a stronger brand but weaker records is not the safer choice. Give greater weight to verifiable authority records, protected payments, enforceable remedies and independent inspection access.
Red flags that justify pausing the purchase
- The seller will not provide a project registration number or official authority contact.
- Permits are described as “in process” after deposits are requested.
- Installments must be paid to an account that does not match the regulator-confirmed escrow details.
- The contract incorporates plans or specifications that were never supplied.
- Material changes are allowed without notice, consent, refund or termination rights.
- There is no clear completion certificate, warranty provider or defect-notice procedure.
- Independent legal or technical review is discouraged or denied.
- Brand services are promised in advertising but absent from the signed licence or management documents.
Pause payments and obtain written clarification when a red flag appears. If the seller cannot cure the issue with authoritative documents, ask your lawyer about cancellation and recovery options before signing anything further.
What a properly verified purchase file should show
By signing, you should be able to demonstrate that the exact project and developer are registered, the planned use and design are approved, deposits go to the correct escrow account, progress is independently traceable, and the contract states what happens after delay, change or defect. Before handover, you should hold the completion or occupancy certificate, inspection sign-offs, an independent snagging report and written warranty and insurance information.
That evidence does not eliminate development risk. It gives you a documented basis for deciding whether the risk is acceptable and for enforcing your rights if the project fails to deliver.
