Before signing, verify the exact legal entity, licence and regulatory history; request contract-relevant financial information; test whether cash, financing and current workload can support your project; validate required insurance; and have an independent construction lawyer review the agreement. The precise checks and protections depend on your jurisdiction, contract type, project value and the entity named in the contract.
What financial health means for a building contract
For a homeowner, financial health is the builder’s practical ability to keep paying workers and suppliers, continue your project through its milestones and meet obligations when they fall due. A company can show an annual profit and still run short of cash during a particular build if materials, payroll and subcontractor bills arrive before your progress payments.

Your assessment therefore needs more than a credit score or one balance sheet. Look at near-term liquidity, debt maturity, overdue payables, existing commitments, work in progress, financing, claims and the capacity approved or recognised by the relevant regulator. No source establishes a universal current-ratio, debt-ratio or credit-score cutoff that predicts successful completion for every builder and jurisdiction.
1. Identify the legal entity that will be responsible
Start with the name that will appear on the contract, not merely the trading name on a sign or website. Match that legal name and business or registration number with the official licence or builder-directory record. Confirm who owns the land, who obtains approvals, who contracts with you, and who hires and pays trades.

Ontario’s Home Construction Regulatory Authority warns that project role labels can obscure responsibility and advises consumers to review the builder’s directory profile. Use its guidance when working in Ontario: Hiring a Builder or Contractor in Ontario. A director’s personal licence, a brand name and the company taking your deposit may be different legal persons. If the contract names a subsidiary or related company, ask why and obtain advice before signing.
2. Check licences, principals and public history
Search the official licensing directory for active status, conditions, disciplinary findings and regulatory history. Record the licence number and the legal entity exactly as displayed, then check that the proposed signatory has authority to bind that entity.
Research the named owners, officers and directors, how long the business has operated, relevant completed projects, current projects and independent references. Ask references whether work stopped, payments to subcontractors were delayed, variations were clearly documented and defects were dealt with after handover.

Ask an independent lawyer whether a litigation, judgment or insolvency search is appropriate in your jurisdiction. A dispute alone does not prove that a builder cannot perform; its relevance depends on the parties, amount, status and connection to your project. NSW consumer guidance provides licence, reference, insurance and contract checks in its step-by-step guide to choosing a tradesperson or builder and its contract checklist for work worth more than $20,000.
3. Request financial evidence that matches the project
For a material contract, make a written request for information proportionate to the project’s value and duration. You may not have an automatic right to a private company’s accounts, so ask what evidence the builder can lawfully provide and what independent assurance is available if it will not disclose full statements.

| Information to request | What it helps you assess |
|---|---|
| Current interim balance sheet and income statement | Recent assets, liabilities, revenue, expenses and changes during the year rather than a dated snapshot |
| Recent completed-year financial statements | Trends in profitability, net assets, debt and operating performance across more than one period |
| Cash-flow forecast covering your contract period | Whether cash and committed finance can cover payroll, materials and subcontractors before your next payment |
| Financing arrangements and available facilities | How the builder expects to fund short-term gaps and whether facilities are committed, conditional or near expiry |
| Aged accounts-payable report | Whether suppliers and subcontractors are being paid on time and whether overdue balances are accumulating |
| Current contracts and work in progress | How much capacity is committed, the timing of cash inflows and the risk that another project will compete for resources |
| Contingent liabilities and claims | Exposure from litigation, guarantees, tax liabilities, leases, creditor demands or other obligations not obvious from a headline profit |
| Independent accountant’s review, audit or certification | What an independent professional has actually checked and the limits of that assurance |
These categories mirror the information identified for contractor-capacity assessments in the U.S. federal procurement rule DFARS 232.072-2. That procurement standard is a useful diligence model, not a rule giving a homeowner a right to private records. It states: “The unwillingness or inability of a contractor to present reasonably requested information in a timely manner, especially information that a prudent business person would be expected to have and to use in the professional management of a business, may be a material fact in the determination of the contractor’s responsibility and prospects for contract completion.” Treat that as an illustration of why disclosure matters, not as a consumer-law test.
If the builder refuses or cannot provide reasonable information, ask for a specific explanation and alternative assurance such as a bond, guarantee, insurer confirmation, staged payment structure or accountant’s letter. Unwillingness is a risk signal to investigate with an adviser; it is not proof that the builder is insolvent.
4. Test liquidity, debts and workload together
Ask the builder to explain the cash timing of your project: when deposits and progress payments arrive, when major materials must be ordered, the expected payroll peak and the contingency for delays. Compare that schedule with available cash and committed financing, not just annual revenue.
Review near-term debts and overdue payables. A builder that is profitable on paper may still be unable to pay a critical supplier when the next delivery is due. Ask whether any key subcontractor has stopped work, required cash on delivery or filed a payment claim.
Then compare existing work in progress and the pipeline with the people, subcontractors, equipment and approved capacity available. Victoria’s Building and Plumbing Commission describes this type of capacity assessment in its Minimum Financial Requirements for domestic builders. The Victorian regime considers debts payable when due, adjusted net tangible assets and maximum construction capacity.

For the Victorian scheme, the page states that, for maximum construction capacity up to $20 million, a builder must have adjusted net tangible assets of at least 5% of approved capacity unless the Commission determines otherwise. The page says these minimum financial requirements started applying to specified domestic builders on 1 July 2026. This is a local regulatory threshold, not a general rule for builders elsewhere and not a guarantee that an individual project will finish.
5. Validate project-specific insurance before paying
Obtain the actual certificate, notice of cover or policy evidence for your project. Check the named builder and legal entity, site address, contract amount, policy dates, covered events, exclusions, eligibility conditions and the process for making a claim. Do not rely on a logo, verbal assurance or an expired certificate.
Independently validate the document through the official government checker or the insurer using contact details you source yourself. NSW guidance on protecting yourself in case of builder insolvency explains checking required cover and warns consumers not to pay before the necessary protection is in place for eligible contracts. Its companion guidance also lists insurance and contract checks: NSW contract checklist.
Insurance is a backstop with eligibility and claim conditions. It does not demonstrate that the builder has strong cash flow, and cover may not respond to every loss, every contract type or every payment made outside the required process.
6. Make the contract and payment schedule limit your exposure
The written agreement should define the scope, contract price or variation method, approvals, start and completion dates, milestones, deposit, progress claims, retention if applicable, defects and warranties, termination rights and responsibility for permits and subcontractors.

Link each progress payment to a clearly completed stage or documented materials delivered to the site. Require photographs, invoices, inspection records or a payment schedule that lets you verify value before releasing funds. Avoid paying substantially ahead of work completed; large early payments can leave you financing the builder’s other obligations.
In the NSW home-building context covered by the government guidance, the maximum deposit before work starts is stated as 10% of the total contract price. The same guidance cautions that an early, separate payment for plan preparation may not receive the same protection. These are NSW rules and protections for their stated contract context; check the law that applies to your location and project before relying on any percentage.
Ensure the contract explains what happens if approvals are delayed, a milestone is disputed, the builder becomes insolvent, or either party terminates. Identify who owns materials paid for but not yet installed and how you receive plans, permits, warranties and other project records if the relationship ends.

Use the same questions and documents for each candidate. A numerical “financial-health rating” built from incomplete public data can create false precision, so compare the evidence across these dimensions:

A builder with less impressive marketing but transparent records, realistic scheduling and a payment plan tied to completed work may present less exposure than a larger firm that will not explain its cash position or current commitments.

Warning signs that require follow-up
- The contract names a different company from the licence, insurance certificate or quote, with no clear explanation.
- The builder pressures you to sign immediately, requests a large payment before work starts or proposes payments unrelated to measurable stages.
- Financial information is several years old, incomplete, inconsistent between documents or unavailable without a credible reason.
- Suppliers or subcontractors report persistent late payment, cash-on-delivery demands or frequent replacement during active jobs.
- The builder cannot explain how your project fits alongside current work, staffing and material lead times.
- Insurance documents contain a different legal entity, site, contract value or coverage period, or cannot be independently verified.
- References describe unresolved defects, abandoned work, unexplained variations or difficulty obtaining records.
One warning sign may have an innocent explanation. Several that point to the same cash, identity or capacity problem justify pausing the contract and obtaining professional advice.
When to involve a construction lawyer or accountant
Have a construction lawyer review the actual contract before signing, especially where the project is high value, the entity structure is complex, the builder proposes unusual deposits or guarantees, or the termination and insolvency clauses are weak. Ontario’s regulator expressly recommends independent construction-law advice and suggests asking a lawyer whether a litigation search is appropriate: HCRA guidance.
An accountant can help interpret cash-flow forecasts, debt maturity, related-party balances, contingent liabilities, work-in-progress assumptions and the distinction between tangible assets and goodwill. Ask what level of assurance an accountant’s report provides: an audit, review, compilation or a limited certification answer different questions.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteProfessional review is particularly valuable when the builder will not provide full accounts but offers a parent guarantee, personal guarantee, bond or staged-payment alternative. The adviser can test whether that protection is enforceable, adequately funded and triggered by the events that matter to your project.
Local rules must stay local
The official material cited here comes from Ontario, New South Wales, Victoria and U.S. federal procurement. Their terminology and legal protections are not interchangeable.
- Ontario: use the HCRA directory and guidance to check the builder, project roles, references, contract terms and need for legal advice.
- New South Wales: follow the state’s licence, insurance, deposit, payment-stage and insolvency-protection requirements for the contract type and value covered by the guidance.
- Victoria: the Building and Plumbing Commission’s financial-requirement and capacity rules apply to specified domestic builders under the stated scheme and dates.
- United States federal procurement: DFARS identifies financial information relevant to government contracting officers; it does not impose a homeowner disclosure entitlement.
Before transferring money, confirm which statute, regulator, warranty or insurance scheme governs your address and contract. If you are unsure, obtain local legal advice rather than importing a deposit limit, capacity threshold or claim process from another jurisdiction.
A practical decision before signing
- Match the contract entity to the official licence, registration and insurance records.
- Check principals, regulatory history, references and any appropriate litigation or insolvency searches.
- Request current and historical statements, a contract-period cash forecast, financing, aged payables, liabilities and current work commitments.
- Ask how the builder will fund your project between payment milestones and how its workload fits available staff and subcontractors.
- Validate project-specific insurance independently before paying.
- Rewrite the payment schedule so every release corresponds to documented work or materials, and confirm local deposit limits.
- Have a construction lawyer review the agreement and an accountant assess financial information where the project exposure warrants it.
Proceed only when the legal identity, financial evidence, capacity, insurance and payment protections are consistent with the size and risk of your project. If a material gap remains, document the explanation and obtain independent advice before signing or paying.
