How to budget for planning levies when buying land or building a home

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Budget a planning levy only after you identify the exact parcel, the responsible planning authority and the adopted instrument that applies to your proposed development. There is no dependable national or universal per-home rate. A contribution may be calculated per dwelling, square metre, net developable hectare or development cost, and may be payable in cash, land or completed works. Obtain the authority’s written calculation and payment trigger before you exchange contracts, set a construction budget or assume an exemption.

What a planning levy is and why it matters to your land budget

“Planning levy” is a convenient umbrella term, not one legal charge used everywhere. Depending on location, the obligation may be called a development contribution, infrastructure contribution, community infrastructure levy, local infrastructure contribution, development charge, planning agreement contribution or a condition attached to a permit or consent. The legal name, calculation and enforcement mechanism come from the relevant jurisdiction and local authority.

These contributions generally fund infrastructure needed to support growth. Examples described in New South Wales include parks, community facilities, roads, footpaths, drainage and traffic-management works. Other systems can fund comparable infrastructure through a different instrument or combine a cash levy with land dedication or works-in-kind.

The amount can affect more than the purchase price. It may change the cash you need at settlement, the deposit required before a permit or consent is issued, the viability of a subdivision, the timing of service connections and the amount available for building works. Treat it as a separate project cost until the authority confirms exactly what applies.

The eight-step method for estimating a levy before you commit

1. Identify the parcel and the authority

Start with the legal address, lot and plan number, title reference or other parcel identifier. A suburb name is not enough where boundaries, growth areas or adjoining councils meet. Confirm which council or planning authority has jurisdiction over the land and whether the site lies inside a contribution-plan, infrastructure-plan or levy area.

Ask the authority to confirm the parcel in writing. Include the intended use, number of dwellings, approximate floor area, subdivision proposal and any staging. A rate found for a nearby property can be wrong if that land sits in another catchment, development precinct or charging area.

2. Find the current adopted instrument

Obtain the current adopted contribution plan, planning-scheme schedule or charging schedule. Then check the title, planning certificate, prior permits and council records for a planning agreement, permit condition, recorded obligation, deferred payment or credit. A negotiated obligation can sit beside a published schedule rather than replacing it.

In New South Wales, councils administer local contributions. State guidance on local infrastructure contributions advises contacting the relevant council about the specific plan and rate. The main mechanisms include section 7.11 contributions, section 7.12 contributions and planning agreements. In England, Community Infrastructure Levy (CIL) can apply only where the charging authority has approved and published a charging schedule. Do not rely on a draft plan, an old web page or an agent’s summary as the adopted legal basis.

3. Match the project to the rate basis

Read the definitions, maps and worked examples in the adopted instrument before multiplying anything. Confirm the land-use category, dwelling or lot count, gross or net floor area, net developable area and any development-cost definition. Some schedules use different rates for a house, apartment, retail space, industrial space or a subdivision.

Possible basis What you must confirm Common budgeting error
Per dwelling, unit or lot Qualifying dwelling type, approved count, staging and any small-dwelling rules Using a headline per-home figure for a different housing category
Per square metre Gross or net floor area, included and excluded spaces, measurement date Applying the rate to the wrong area definition
Percentage of development cost Which costs are included, valuation method, evidence required and statutory cap Multiplying a percentage by the land price when the schedule uses building cost
Per net developable hectare Deductible constraints, roads, reserves, waterways and the approved developable-area plan Using the gross title area
Land or works in kind Land value, location, design, construction standard, approval and handover requirements Assuming a land dedication or road works have no budget cost
Combination Which components are cumulative and whether credits or offsets apply Counting one infrastructure item twice or omitting a second instrument

Do not calculate from a promotional estimate or a generic calculator. Ask the authority to state the formula, the inputs it accepted and the schedule version used.

4. Confirm the event that makes payment due

Liability and payment are not always tied to settlement or building completion. Depending on the system, the trigger can be a planning permit, development consent, subdivision approval, building consent, service connection, occupation, completion or another defined milestone. Ask whether an invoice is issued automatically, whether a bond or bank guarantee is accepted, and whether staged payment is available.

New Zealand councils may require a development contribution at resource consent, building consent or certificate-of-acceptance stage, at the specified project-information-memorandum stage for some small-dwelling projects, or when a service connection is made. The applicable council policy controls the actual trigger.

5. Separate similarly named charges

Make separate lines for the planning or development contribution, building-consent fees, inspection fees, utility connection charges, infrastructure agreements, road-opening permits and any national building levy. A planning contribution is not automatically a substitute for those costs.

New Zealand illustrates the distinction clearly. The national building levy is calculated from the value of consented building work. Building-consent charges can also include a separate building research levy plus inspection and certificate fees. These amounts are different from a council development contribution and can become payable at different stages.

6. Record indexation and possible future changes

Write down the schedule or plan name, adoption date, rate year, indexation method and the date on which your estimate was checked. Ask which version applies when the liability is assessed, not merely when you sign the contract. A project delayed from permit to construction can cross an indexation date or a new charging schedule.

Victoria states that development-contribution-plan amounts are indexed on 1 July using the method in the applicable plan and publishes annual maximum community infrastructure levy figures. A written estimate should therefore show both the current amount and the rule that could change it before payment.

7. Test relief, credits and offsets before relying on them

Ask about exemptions, credits for existing lawful development, offsets for infrastructure you provide, staging, hardship provisions and review or appeal rights. Obtain the application form, evidence list and deadline. A potential relief is not part of your base budget until the authority confirms it.

England’s self-build CIL relief demonstrates why procedure matters. Qualifying applicants must meet the relevant conditions, including occupation of the home as a principal residence for at least three years, and submit the specified evidence and notices. Missing a declaration or starting work before approval can defeat the relief even if the project appears eligible.

8. Keep a dated, transparent allowance

Maintain a worksheet containing the parcel identifier, authority contact, instrument, calculation basis, inputs, rate version, indexation rule, trigger, written response and date checked. Show the confirmed base amount, a separate uncertainty or contingency line and the cash date. Reconfirm before exchange or settlement, permit issue and commencement if the rate can be indexed or the scope may change.

How different jurisdictions describe the charge

The following examples show why a local answer is essential. They are comparisons, not universal allowances.

Jurisdiction Instrument or term What it can fund or require Calculation and timing points
New South Wales Section 7.11, section 7.12 and planning agreements administered by councils Local infrastructure such as parks, community facilities, roads, footpaths, drainage and traffic management Plan and council determine the rate, basis and trigger. Section 7.12 has a maximum of 1% in most areas; that is a ceiling, not a universal charge.
Victoria Development Contribution Plans (DCPs), Infrastructure Contribution Plans (ICPs) and community infrastructure levies Infrastructure identified in the applicable plan; some plans can require land as well as money Rates may be per dwelling, area or net developable hectare and are indexed under the plan. The Victorian guidance states: “All levies are $ per net developable hectare.” That wording applies to the specified Victorian ICP guidance, not every levy.
England Community Infrastructure Levy (CIL) charging schedule Infrastructure identified by the charging authority CIL applies only after an authority has approved and published a charging schedule. Liability, commencement notices and relief procedures affect when money is due.
New Zealand Council development-contribution policy Growth infrastructure required to support additional demand Policy can connect payment to resource consent, building consent or certificate of acceptance, a specified project-information memorandum, or service connection.

Current figures that need careful qualification

Victoria: annual and future-program examples

For Victoria’s development-contribution-plan system, the Department of Transport and Planning published a maximum community infrastructure levy of A$1,590 per dwelling for 2026–27. It is a jurisdiction-specific maximum, not proof that every Victorian home pays that amount.

The same department states a future Train and Tram Zone Activity Centre infrastructure-contribution-plan charge of A$11,350 per dwelling. Its guidance says the program is planned to commence for planning permits from 1 January 2027 in 10 pilot centres and from 1 July 2027 for the expanded set of 48 centres. This future program may not apply to your parcel; confirm whether the site is inside a named centre and which permit date controls.

New South Wales: the 1% ceiling

Current New South Wales guidance says the section 7.12 levy maximum is 1% in most areas. That figure is a statutory ceiling for the relevant system, not a universal rate for all development and not necessarily the amount payable on a particular site. The adopted plan, development value and applicable exemptions still have to be checked.

New Zealand: the separate national building levy

From 1 July 2024, the New Zealand Ministry of Business, Innovation and Employment set the threshold for the separate building levy at NZ$65,000 including GST for new consent applications. The rate from that date is NZ$1.75 for each NZ$1,000, or part of NZ$1,000, of consented building-work value, including GST. This is a building levy, not a council development contribution. Confirm rounding, refunds and the value accepted on the consent because those rules affect the invoice.

Build the cash-flow model, not just a headline estimate

Put each obligation on the date it could consume cash. A simple model should contain these columns:

Worksheet field Entry to capture
Parcel and authority Legal identifier, council or charging authority, officer and date contacted
Instrument Plan, schedule, planning agreement, permit condition or policy name and version
Project inputs Dwellings, lots, floor area, net developable hectares, development cost and staging
Calculation Formula, rate, units, credits and the authority’s written result
Escalation Indexation method, next index date and possible replacement schedule
Trigger Consent, permit, subdivision, service connection, commencement, occupation or completion
Payment form Cash, land, works, bond, instalments or a combination
Other charges Building levy, consent, inspection, certification, utility and agreement costs
Allowance Confirmed base, separate uncertainty amount and the date the allowance is reviewed

Use the confirmed formula rather than a single percentage of the land price. For example, if an authority confirms a per-dwelling rate, the base calculation is the confirmed rate multiplied by the chargeable dwelling count, adjusted for credits and staging. If it confirms a per-hectare rate, use the authority’s approved net developable area. If it uses a cost percentage, document the defined cost base and valuation date. Keep taxes such as GST in the same treatment used by the authority so your cash figure is comparable with the invoice.

What to ask before signing a land contract

  1. Which authority has jurisdiction over this exact lot and plan?
  2. Is the land inside a contribution plan, infrastructure plan, CIL charging area or other levy area?
  3. Which adopted document and rate version apply on the likely consent or permit date?
  4. What land-use category and measurement definitions apply to my proposed home or subdivision?
  5. How many dwellings, lots, square metres or net developable hectares are chargeable?
  6. Does an existing house, previous consent or earlier contribution create a credit?
  7. Is there a planning agreement, title restriction, permit condition or deferred obligation?
  8. What event creates liability, and when must payment clear?
  9. Can payment be staged, bonded or made through land or works in kind?
  10. Which exemptions, offsets or review rights exist, and what must be filed before work starts?
  11. How will the amount be indexed if settlement, permit issue or construction is delayed?
  12. Will the authority provide a written estimate tied to the parcel and the described project?

Common budgeting mistakes and how to correct them

Using a suburb-wide or national allowance

Rates can change across council boundaries, catchments and plan areas. Replace the broad allowance with a parcel-specific written response.

Applying the wrong measurement

Gross title area, net developable hectare, gross floor area and chargeable floor area are not interchangeable. Ask the authority to confirm the measurement drawing or definition.

Ignoring non-cash obligations

Land dedication, drainage, roads, intersections or other works can require design, construction, supervision, maintenance and handover costs even when the published rate is expressed as land or works rather than cash.

Assuming an exemption is automatic

Relief may require an application, declaration, evidence, owner occupation or a deadline before commencement. Price the full charge until approval is documented.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Freezing the estimate at contract exchange

Indexation and a changed dwelling count, floor area or staging can alter liability. Add review dates before settlement, permit issue and commencement.

When specialist advice is justified

Ask a planning or development-contributions professional to review the file when the authority identifies a planning agreement, multiple overlapping instruments, a large subdivision, land or works in kind, a disputed developable-area calculation, staged permits or a potential appeal. The useful deliverable is a written schedule showing the legal basis, formula, trigger, assumptions, relief position and cash-flow dates. Professional advice should supplement, not replace, confirmation from the authority administering the charge.

Final budgeting decision

Before buying land or finalising a home-building budget, obtain a parcel-specific answer from the responsible authority, preserve the adopted plan or schedule version, calculate the charge using its definitions, separate every other consent or building levy, and reserve cash for the actual trigger date. A transparent allowance with a dated written basis is safer than a generic percentage or per-home guess, particularly where rates are indexed, plans change or relief depends on procedural compliance.
