How to Apply for a Building Permit in Germany

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

To obtain a building permit (Baugenehmigung) in Germany, submit a complete application to the Untere Bauaufsichtsbehörde (lower building supervisory authority) responsible for the property. The exact form, documents, professional-signature rules, fees and procedure depend on the state (Land) and municipality. Construction, alterations and changes of use generally require approval, although state building codes provide exemptions and simplified procedures. Confirm the correct route and checklist before any work starts.

When do you need a Baugenehmigung?

German building law is administered under the building code of the Land where the property is located. As a result, there is no single nationwide list of projects that always need a permit. The scope, location and intended use of the project determine the procedure.

As an Amazon Associate I earn from qualifying purchases.

Projects that generally require approval

  • Constructing a new building or extension.
  • Changing the structure, load-bearing system, external appearance or significant internal layout of an existing building.
  • Changing the use of a building or room, such as converting a dwelling to commercial premises or an office to a residence.
  • Projects that affect fire safety, access, parking, drainage, environmental protection or neighbouring rights.

Even work that appears minor can need approval if it changes use, affects structural safety or falls within a protected area. Starting without the required approval can lead to a stop-work order, enforcement measures or a demand to restore the property.

Exemptions and simplified procedures

Every Land has exceptions for specified low-risk or small projects. Some projects are exempt from a formal permit, while others use a simplified review in which the authority checks a narrower set of requirements. An exemption does not remove other obligations: planning rules, structural safety, fire protection, heritage restrictions and neighbour rights can still apply.

Ask the local authority to classify the proposal before commissioning final drawings. The authority may require an ordinary permit, accept a simplified procedure, confirm that a permit exemption applies or recommend a preliminary building inquiry (Bauvorbescheid) for a disputed planning question. Obtain the answer in writing and keep it with your project records.

Find the correct authority

Applications go to the lower building supervisory authority for the property’s address, not to a federal ministry. Depending on the area, this office may be part of a district administration, an independent city administration or a municipal building department. State and federal service portals can help you identify it, but the property address controls jurisdiction.

Information to confirm before preparing forms

  • The office’s full name, postal address and case contact.
  • Whether the municipality accepts electronic applications, paper applications or both.
  • The current Land application form and document checklist.
  • Required file formats, drawing scales, signatures, translations and number of copies.
  • The applicable fee schedule and accepted payment method.
  • Whether a pre-application meeting or preliminary inquiry is advisable.

Web pages and forms change. Check the authority’s current instructions immediately before filing rather than relying on a form saved from an earlier project.

Choose the right application route

The route affects the amount of documentation, the scope of the authority’s review and the risk of having to redesign the project. Eligibility is determined under the Land’s building code and local planning rules.

Route When it may fit Review and documents Cost, timing and risk
Ordinary building permit New construction, substantial alterations or projects outside an exemption Full application with plans, descriptions, calculations and project-specific technical evidence; the authority carries out the applicable reviews Usually the greatest document burden; fees and timing depend on project scope and local schedules
Simplified permit procedure A project eligible for the narrower review defined by the Land Still requires the official form and core plans; the authority checks only the matters assigned to the simplified route, while the applicant remains responsible for unreviewed requirements May reduce review time and fees, but does not eliminate technical or legal responsibility
Permit exemption A project expressly listed as exempt in the applicable Land code No conventional permit decision, but drawings, structural proof, planning compliance and other records may still be necessary No permit fee may be charged; an incorrect assumption can create enforcement and rework risk
Preliminary building inquiry An uncertain planning or design question that should be resolved before a full application Targeted documents and clearly framed questions; it is not a construction authorization Adds a separate step and fee, but can reduce the risk of designing a project that cannot be approved

Ask the authority which route is legally available, rather than selecting the shortest route solely to save time. A simplified review or exemption can leave you responsible for requirements that the authority does not examine.

Decide whether you need an authorized designer

Many Länder require application documents to be prepared or signed by a bauvorlageberechtigte architect or engineer (a professional authorized to submit building documents). The professional-signature rules and exceptions differ by Land and by project type. Confirm the rule with the authority before drawing the package yourself.

What the authorized designer does

  • Translates the brief into drawings and a code-compliant design.
  • Coordinates structural, fire-safety, energy, drainage and accessibility information where required.
  • Signs or electronically authenticates the documents in the form accepted by the authority.
  • Responds to technical questions and revises plans during the review.

Even where self-filing is legally possible, a designer can reduce errors in site plans, building lines, floor-area calculations and technical coordination. Agree in writing who is responsible for each specialist report and for answering authority requests.

Assemble the application package

The authority’s checklist for the property and route is controlling. The following items are typical, but not every project needs every document and the required format varies by Land and municipality.

Document What it establishes Practical points
Official building-application form Applicant, property, project description and declarations Use the current Land form; provide the exact parcel and address data and all required signatures
Site or cadastral plan Parcel boundaries, neighbouring buildings, access and the proposed position Obtain the prescribed plan from the competent cadastral source; show dimensions, setbacks and access at the required scale
Architectural drawings Floor plans, sections, elevations, dimensions, heights, rooms and uses Follow the authority’s scale, legend, page-size and file-naming rules; identify existing and proposed conditions clearly
Building or project description Materials, construction method, use, number of occupants and relevant systems Keep the description consistent with every drawing and calculation
Calculations and area schedules Floor areas, volumes, site coverage, usable areas and other planning metrics Use the definitions required by the applicable code; explain assumptions where an area is unusual
Structural documents Load-bearing concept, stability and, where required, verified structural calculations The authority or Land may require an authorized structural engineer or a separate verification
Fire-safety documentation Escape routes, fire compartments, materials, access for emergency services and fire systems Scope depends on building class, use, height and local requirements
Project-specific technical evidence Energy, water, drainage, environmental, traffic, accessibility or other requirements Include only what applies, but obtain confirmation when the project is near a regulated threshold
Ownership or authorization evidence Right to apply or consent to act for the owner Provide it if the form or authority requests it, especially where the applicant is not the registered owner

Large, unusual or sensitive projects may need additional reports. Examples include a heritage assessment, environmental or nature-protection documentation, a water-law approval, a traffic or access statement, a specialist fire-safety concept, contamination information or evidence concerning neighbouring structures. The authority will tell you which agencies must be consulted, but supplying a missing report early can prevent a completeness request.

Application process: a practical sequence

  1. Define the project. Record the full property address and parcel references, the work to be carried out, the intended use, dimensions, number of units or occupants and any change from the existing use.
  2. Identify the authority. Use the federal or state service portal and confirm the lower building supervisory authority for that address.
  3. Ask for route confirmation. Describe the project briefly and ask whether an ordinary permit, simplified procedure, exemption or preliminary inquiry applies. Ask for the current checklist and fee information.
  4. Check planning constraints. Determine whether a development plan, special land-use designation, heritage status, environmental restriction or access issue affects the site. Request a preliminary inquiry if a central planning question is unresolved.
  5. Engage the required professionals. Appoint a bauvorlageberechtigte architect or engineer when the Land requires one, and commission structural, fire-safety or other specialists where the project calls for them.
  6. Download current forms. Use the authority’s latest application form, declarations and technical templates. Do not substitute a form from another Land or an archived version.
  7. Prepare coordinated documents. Complete the site plan, drawings, building description, calculations and applicable technical evidence. Check that areas, heights, uses and names match on every page.
  8. Complete signatures and authorizations. Obtain the owner’s authorization and professional signatures or electronic authentication required for the chosen route.
  9. Submit through the accepted channel. Upload the files to the authority’s designated portal or deliver the required paper set. Follow instructions for file size, naming, copies, plans and fees.
  10. Keep proof of filing. Save the complete submitted package, upload confirmation or stamped receipt, correspondence and the date of payment.
  11. Pay assessed fees. Pay using the method and deadline stated by the authority. A fee invoice may be issued after the application is checked or during the procedure.
  12. Answer requests promptly. If the authority identifies missing documents or asks for revisions, send a coordinated response and an updated plan index. Ask which version supersedes the earlier document.
  13. Wait for the required decision. Do not begin regulated work until the written permit is issued or the authority has confirmed that a lawful exemption applies and all other conditions are satisfied.

Electronic versus paper filing

Digital filing is not uniform across Germany. Some authorities provide an online building portal; others require paper plans, a mixed submission or a particular electronic signature. A normal email attachment is not necessarily a valid application. The authority’s portal instructions determine what counts as filed.

For an electronic submission, preserve the confirmation screen, reference number, uploaded file list and any qualified signature record. For paper filing, deliver the specified number of sets and obtain a dated receipt. In either case, keep an immutable copy of exactly what was submitted; later revisions should be clearly dated and versioned.

Fees and approval time

How fees are calculated

There is no reliable Germany-wide fee or approval-time average. Fees follow the relevant Land and municipal schedules and can depend on the project cost, building type, scope, floor area or the particular procedure. Preliminary inquiries, exemptions, specialist reviews and additional approvals may have separate charges. Professional design and engineering fees are separate from the authority’s permit fee.

Ask for the current fee basis when you request the checklist. A low-fee route is not necessarily cheaper overall if an incomplete package causes redesign, extra consultant work or a second submission.

How long approval takes

Timing starts to become meaningful only when the authority has a complete, usable package. Missing plans, signatures or technical reports can lead to a completeness request and extend the process. Consultations with planning, fire, environmental, water, traffic or heritage agencies add variables that differ by project and locality.

Hamburg’s official guidance gives an estimate of one to three months after complete submission for the relevant procedure. That figure is specific to Hamburg and must not be treated as a Germany-wide promise. Other Länder and municipalities set different processes, workloads and statutory periods.

Special approvals and agencies

A building permit may incorporate the results of other reviews, or you may need a separate approval. Discuss the following early when they apply:

  • Hard hat clip- attaches for easy access
  • Quick dry time with reduced smearing and marking
  • Heritage: Listed buildings and protected areas can require heritage consent for alterations, materials or appearance.
  • Environmental and nature protection: Trees, habitats, protected species, contaminated land or conservation areas can trigger additional evidence or permissions.
  • Water and drainage: Groundwater, wells, flood risk, discharge, watercourse proximity and sewer connections may involve a water authority.
  • Traffic and access: New driveways, visibility, road works, parking and emergency access can require transport or road-authority input.
  • Fire safety: Building use, height and occupancy can require a specialist concept, additional escape-route proof or fire-service consultation.
  • Energy and building performance: The project may need energy-related evidence under the current rules, prepared in the form the authority accepts.
  • Land-use and neighbours: Development-plan provisions, boundary distances, rights of way and effects on neighbouring properties can determine whether the design is approvable.

Do not assume that filing a building application automatically replaces every other consent. Ask the authority which approvals it coordinates and which you must obtain separately.

What to do when the authority asks for changes

A completeness letter is not necessarily a refusal. It usually identifies missing documents, signatures, explanations or technical corrections. Read each item literally and have the designer coordinate one response so that a revised drawing does not contradict an unchanged calculation or description.

  • Use the authority’s reference number and answer in the requested format.
  • Provide a document index listing new, replaced and unchanged files.
  • Mark revisions on drawings and retain the previous version in your project archive.
  • Ask whether the response is sufficient before sending a second, unrelated redesign.
  • Record every condition attached to an eventual approval and give it to the contractor.

If the authority indicates that the chosen route is unavailable, stop work on final detailing and ask whether a preliminary inquiry or a different permit procedure is appropriate. Starting construction while an application is incomplete does not create a right to approval.

Common filing mistakes and fixes

Problem Why it causes delay Fix
Application sent to the wrong municipality The office lacks jurisdiction and must redirect or reject the filing Confirm the lower building supervisory authority using the exact property address before preparing the final set
Old or foreign-Land form Required declarations and fields do not match local rules Download the current form and checklist from the competent authority
Missing professional signature The application is not formally complete where professional authorization is required Have the bauvorlageberechtigte architect or engineer sign or authenticate the submission
Inconsistent dimensions or uses Reviewers cannot establish what is actually proposed Run a cross-document check of site plan, drawings, calculations and description before filing
Assuming an exemption covers every issue Structural, fire, planning or heritage duties may still apply Obtain written route confirmation and retain the technical evidence required for the exempt work
Starting work after a portal upload Submission is not the same as approval Wait for the written permit or documented lawful exemption and comply with all conditions
Ignoring external approvals Another agency can object or require a separate consent later Ask at the outset about water, environmental, traffic, heritage, fire-safety and energy requirements

Final pre-filing checklist

  • The project scope and intended use are stated consistently.
  • The responsible lower building supervisory authority has been confirmed.
  • The route—ordinary permit, simplified procedure, exemption or preliminary inquiry—has been checked under the applicable Land code.
  • The current local form, checklist, fee information and filing-channel instructions are in hand.
  • A bauvorlageberechtigte professional has signed where required.
  • The site or cadastral plan, drawings, project description and calculations are complete and coordinated.
  • Structural, fire-safety, energy, water, environmental, traffic, heritage and accessibility evidence has been considered for the specific project.
  • Owner authorizations, signatures, file formats, paper copies and translations meet local instructions.
  • A complete copy, receipt or electronic confirmation will be retained.
  • No construction will start before the required written approval or confirmed exemption is legally effective.

Because German building-permit administration is local and Land-specific, the safest approach is to verify the route and current checklist with the authority for the property, then submit one coordinated package through its accepted channel.
