call-off contracts

How road maintenance frameworks work and how contractors are selected

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A road-maintenance framework is a pre-agreed procurement arrangement that creates an eligible supplier pool and rules for awarding later contracts. Contractors first compete for a place on the framework; when a particular repair, inspection, winter-service or renewal package is needed, the authority awards a separate call-off contract using the method set out in the framework documents. A place on the framework is not a promise of work or a guaranteed share of spend.

What a road maintenance framework does

A framework answers the purchasing question: which suppliers may deliver defined road-maintenance work, for which authorities, under what terms, and how will each future job be awarded? It is not normally the contract for every repair. The contract for a particular requirement is the call-off (also called a task order in some arrangements).

The legal details depend on the country and the framework wording. The direct-award and further-competition explanation below follows UK Procurement Act 2023 guidance from the Cabinet Office. New Zealand road-agency guidance is used to explain delivery-model choices. The framework agreement, call-off documents and applicable local law always control.

Cabinet Office, UK government, Module 5: Frameworks and dynamic markets

What the framework documents define

  • Scope: the services and works that can be bought, such as routine inspections, pothole repairs, winter operations, incident response or asset renewal.
  • Lots: geographic areas, technical disciplines, contract sizes or combinations of these.
  • Eligible users: the contracting authorities, agencies, councils or other bodies permitted to use the arrangement.
  • Term and capacity: the framework period and any limits or conditions on later awards.
  • Commercial terms: the core contract terms, pricing mechanism, payment rules, risk allocation and performance requirements.
  • Award method: direct award, further competition (often called a mini-competition), or another objective method stated in advance.

Those choices determine whether a future job fits the framework at all. A road authority cannot use a framework as a general-purpose route for work outside its scope or invite suppliers in a way that contradicts the agreed rules.

How a framework operates from planning to delivery

  1. Define the requirement and market structure. The authority decides the assets, locations, work categories, lots, likely users and contract period. It also decides how much flexibility is needed and which terms can be standardised.
  2. Run the framework procurement. Suppliers submit tenders and evidence against the published conditions and award criteria. The authority assesses those tenders and appoints the suppliers that meet the framework requirements.
  3. Identify a job within scope. A need arises, such as a resurfacing package, emergency response, drainage programme or winter-service operation. The authority checks the relevant lot, geography, value and technical scope.
  4. Select a framework supplier. It applies the call-off mechanism written into the framework. Depending on the arrangement, that may be a permitted direct award or a competition among the capable appointed suppliers.
  5. Award and manage the call-off. The selected contractor signs the job-specific contract or receives a task order. The call-off sets the detailed programme, site information, outputs, price, payment, risk, reporting and remedies.
  6. Monitor performance and close the work. The authority measures delivery against the call-off, manages changes and defects, verifies payment and records performance for future procurement decisions where the rules allow.

Framework appointment and call-off award are therefore two separate decisions. A contractor can be fully compliant and still receive no work if no suitable requirement is awarded to it.

How contractors get onto the framework

Competing at framework stage

The initial procurement normally tests whether a supplier can deliver the framework’s anticipated work. The tender may assess technical method statements, relevant experience, personnel, health and safety, quality systems, environmental controls, financial standing, capacity, social-value commitments and price or pricing schedules. The precise criteria and weighting must come from the procurement documents; they should not be assumed from another authority’s framework.

Winning a place means the contractor is an eligible supplier for the relevant lot or lots. It does not mean the contractor has won a specific road, a minimum annual value or every work package in its region. A supplier may be appointed to several lots, one lot or none, depending on its tender and the authority’s structure.

Showing capability for the actual call-off

At call-off stage, the authority still needs evidence that the supplier can meet the particular requirement. A framework may require confirmation of availability, a price or rate application, a programme, traffic-management approach, specialist resources, emergency response arrangements or site-specific methodology. The supplier must stay within the framework’s terms rather than renegotiate the procurement route as if it were a new open tender.

How the authority selects a contractor for each job

Method How it works When it is possible under the UK guidance What contractors should watch
Direct award The authority selects one appointed supplier without asking all capable suppliers to submit fresh bids. Only where the framework provides the necessary core terms and an objective supplier-selection mechanism. The framework documents must support this route. Check the objective rotation, ranking, geographic, capacity or other mechanism; a preference formed after the need arises is not a substitute.
Further competition The authority invites the capable suppliers in the relevant lot to submit proposals for the requirement and evaluates them. Where the framework requires or permits competition for the call-off. Prepare a compliant response to the call-off scope, timetable and criteria; the authority may refine, but not replace, the framework award criteria.

Direct award is not an informal choice

Direct award can be efficient for urgent, repetitive or tightly specified work, but it must follow the framework’s documented mechanism. Examples of objective mechanisms might include a published ranking, rotation, location, demonstrated capacity or a formula linked to rates and performance. The exact mechanism must be established by the framework; an authority cannot invent one after seeing the job.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Further competition (mini-competition)

Where the call-off uses competition, all suppliers capable of meeting the requirement in the relevant lot should be invited under the UK guidance. The authority evaluates responses consistently against the criteria used to award the framework, with permitted refinement for the specific requirement. It cannot introduce wholly new award criteria that change the basis on which suppliers secured their framework places.

A contractor’s call-off response should map each requirement to evidence: method, resources, programme, price, risk controls, traffic management, environmental measures and mobilisation. Missing a mandatory item can make a technically strong bid non-compliant.

Framework route versus maintenance delivery model

These concepts are often confused. A framework is a procurement route and set of rules for buying future work. A delivery model describes how responsibility for planning, prioritising and carrying out maintenance is organised. The same delivery model can be purchased through different routes, and a framework can support more than one operational model.

Delivery approach Typical allocation of responsibility Questions for an authority
Multiple providers Several contractors perform defined areas or work types, allowing capacity and market participation to be distributed. How will boundaries, interfaces, emergency cover and consistent standards be managed?
Single provider One contractor coordinates a broad programme for the client, subject to the contract’s performance and governance requirements. Is the market deep enough, and are concentration, resilience and benchmarking risks acceptable?
Framework panel The client retains control of the work programme while shortlisted suppliers compete for individual work packages. Can the client run timely competitions and provide sufficiently clear scopes?
Performance or alliance model Responsibilities, incentives and collaboration are arranged around shared outcomes rather than only discrete work orders. Are the parties able to share data, manage collective risk and operate the required governance?

New Zealand road-agency guidance uses these kinds of models to show that there is no universally best structure. The appropriate choice depends on the authority’s objectives, market capacity, internal skills, asset geography, desired flexibility, risk appetite and administrative resources.

What road work can be included

Authorities commonly divide work into packages so that the scope and performance measures match the need. A framework may include one or several of the following:

  • Reactive maintenance: unplanned response to defects, hazards, damage or public reports.
  • Cyclic maintenance: work carried out at defined intervals, such as resurfacing-related treatments or scheduled asset servicing.
  • Renewals: replacement or refurbishment of road and roadside assets when condition or life-cycle planning requires it.
  • Incident and severe-weather response: rapid mobilisation for collisions, flooding, storms, snow or other disruptive events.
  • Lower-complexity enhancements: defined improvements that sit within the framework’s stated limits rather than a major standalone project.

The call-off must still identify the actual sites, quantities, standards, access constraints, traffic arrangements, programme and acceptance requirements. A broad framework description does not by itself authorise every conceivable variation of work.

What public-authority examples show

Transport for London

Transport for London’s London Highway Maintenance and Projects Framework illustrates a shared route with user discretion. TfL describes regional call-off contracts for core cyclic and reactive maintenance. Task orders can also cover additional maintenance, capital renewals and lower-complexity enhancements. Boroughs may use the framework at their discretion, and each borough’s own contract specifies the details of its call-offs. The example demonstrates that making a framework available to other authorities does not force those authorities to use it or guarantee a particular volume.

National Highways

The Maintenance and Response 2 procurement notice illustrates a different way to structure scope: seven location-based lots combined with services including cyclical maintenance, reactive maintenance, incident response, severe-weather and winter operations, roadside-technology maintenance, and selected renewals such as road markings, lighting, signs and fencing. It is a live procurement example, so its details can change; it should not be treated as a template or as a statement of universal practice.

How contractors should read a framework opportunity

Before bidding for a place

  • Confirm that your geographic coverage, equipment and workforce match the relevant lot.
  • Separate mandatory pass/fail requirements from scored criteria and price schedules.
  • Check whether the framework requires named key personnel, minimum turnover, certifications, response times or subcontracting controls.
  • Understand the likely call-off mechanism before pricing: direct allocation and repeated competitions create different workload and revenue uncertainty.
  • Review the draft call-off terms for payment periods, inflation, compensation events, defects, bonds, insurance, traffic management and data obligations.

After appointment

  • Keep the framework information current, including contacts, accreditations, capacity and geographic availability.
  • Build a response library mapped to the framework criteria, but tailor every call-off submission to its actual sites and risks.
  • Track lot boundaries, expiry dates, extensions and any maximum-value or scope restrictions.
  • Record clarification questions and answers; they may change how a call-off requirement must be interpreted.
  • Price mobilisation, traffic control, night work, disposal, utilities coordination and weather risk explicitly rather than assuming they are incidental.

Common mistakes and how to avoid them

Assuming a framework place guarantees work

It does not. Treat the place as eligibility for future awards under stated rules. Forecasting should use only the information the authority actually commits to, not an indicative pipeline presented as guaranteed volume.

Assuming every job requires a mini-competition

Some frameworks require further competition; others permit a properly documented direct award. Read the award mechanism and any lot-specific instructions. Applying the wrong method can make an award challengeable or leave a contractor working under an invalid assumption.

Using new criteria at call-off

For a competitive call-off under the UK guidance, criteria may be refined to fit the requirement but not replaced with unrelated criteria. Contractors should challenge an apparent departure through the clarification process and, where necessary, the applicable procurement remedies.

Confusing the framework with the operational contract

Rates, service levels, response times, site risks, payment milestones, defects and change control belong in the call-off documents unless the framework expressly fixes them. A contractor should not mobilise on the assumption that a general framework description answers those job-specific questions.

Ignoring jurisdiction

UK Procurement Act guidance is not a universal procurement code. A council, state agency or road authority elsewhere may use different terminology, thresholds, challenge periods or award rules. The governing legislation and the framework documents take priority over any general explanation.

A practical decision checklist for authorities

  1. Define the assets, work categories, locations, likely values and emergency requirements.
  2. Decide whether one provider, several providers or a panel best fits the market and the client’s management capacity.
  3. Design lots that are large enough to be deliverable but not so broad that capable suppliers are unnecessarily excluded.
  4. State eligible users, term, scope limits, core terms, pricing method and performance measures.
  5. Choose and publish the call-off mechanism, including any objective direct-award formula or further-competition rules.
  6. Align call-off criteria with the framework award criteria and explain any permitted refinement.
  7. Plan governance for safety, traffic management, environmental compliance, data, payment, defects and disputes.
  8. Explain clearly that framework appointment does not guarantee a contract unless a specific commitment is legally made.

Frequently asked questions

Is a framework itself a maintenance contract?

Usually it is the agreed procurement structure and terms for later awards. The job-specific call-off or task order is the contract that defines the work the contractor must deliver.

Can a contractor be on a framework and never receive a job?

Yes. Appointment creates eligibility, not an automatic award or guaranteed workload. Work depends on the authority’s requirements, the relevant lot and the documented call-off method.

Can an authority outside the original organisation use the framework?

Only if the framework identifies that authority or category of user as eligible. Transport for London’s example shows that an available shared route can still be discretionary for participating boroughs.

What should a contractor do if a call-off appears to use the wrong selection method?

Raise a precise clarification promptly, identify the framework clause or applicable rule, and obtain specialist procurement advice where the issue could affect eligibility, fairness or a potential challenge. Do not rely on an informal assurance that conflicts with the published documents.

Bottom line

A road-maintenance framework creates the supplier pool and the rules; each call-off creates the particular job. Contractors are selected first for framework appointment and then, when work arises, by the stated direct-award mechanism or a compliant competition. The safest approach is to read the scope, lots, eligible users, core terms and award method together, and to treat every jurisdiction’s framework documents and procurement law as controlling.
