In the United States, a new commercial nuclear power plant must pass separate but connected reviews of its site, safety case, environmental effects, and construction before it can operate. The U.S. Nuclear Regulatory Commission (NRC) oversees reactor licensing. Depending on the licensing route, a developer may obtain construction authorization first and an operating license later, or pursue a combined license that authorizes construction and permits operation only after specified conditions are met. Site approval and an environmental review do not, by themselves, authorize a plant to run.

How is a nuclear power plant site chosen?

A developer first evaluates whether a location can support the proposed facility and whether the site’s safety, environmental, and emergency-planning issues can be addressed. Site selection is therefore more than finding land large enough for a plant: the applicant must develop information about the location and the proposed project that regulators can use to evaluate the risks and impacts.

The NRC’s review of a proposed site can consider its boundaries, geology and natural hazards, nearby population, alternative sites, planned reactor type and capacity, cooling systems, expected discharges, accident consequences, and emergency plans. The exact information depends on the application and the proposed facility. The NRC’s pre-application guidance describes the early exchanges through which applicants can discuss these issues with the agency.

What an early site permit does

An early site permit (ESP) lets a developer seek NRC resolution of site-related issues before choosing a specific reactor design. That can separate some location questions from the later decision about what plant to build. It does not amount to permission to construct or operate a reactor: the project still needs the applicable reactor licensing authorization and reviews.

According to the NRC, an ESP is initially valid for no less than 10 and no more than 20 years, and may be renewed for a further 10 to 20 years. Those periods describe the permit’s validity, not how long a plant takes to develop or build. The NRC explains site permits and their role in the nuclear power plant licensing process.

What permits are needed to build a nuclear power plant?

The central federal decision is an NRC license under one of two frameworks: 10 CFR Part 50 or 10 CFR Part 52. They organize construction and operating authorization differently. Neither route dispenses with NRC safety or environmental review, and an early site permit is an optional way to address site issues in advance rather than a substitute for the project’s reactor license.

Question Part 50 Part 52
How is authorization staged? The applicant first seeks a construction permit, then a separate operating license. A combined license (COL) consolidates authorization to construct with conditional authority to operate.
When are design and facility details addressed? The two-license sequence separates construction authorization from the later operating-license decision. The NRC reviews the application and safety information for the proposed facility. The COL application addresses the specific site and proposed facility as part of the combined licensing framework. Part 52 also provides for early site permits and certified designs that can resolve some matters in advance.
What happens before operation? The applicant must obtain the operating license after the construction permit; construction permission alone is not permission to operate. The licensee must complete the license’s required inspections, tests, analyses, and acceptance criteria. The Commission authorizes operation only after the required verification is complete and the criteria are met.
What flexibility does the route offer? Separate construction and operating decisions preserve a staged licensing sequence; the applicant must still satisfy the requirements for both authorizations. Advance approvals and a combined license can provide predictability by resolving matters earlier, but the path still depends on the approved design and facility information and remains subject to NRC oversight.

This comparison describes the structure of the routes, not a guarantee that one is faster or easier. The timing of design commitments and the treatment of proposed changes depend on the application and applicable NRC requirements. A change during construction that affects the approved design or licensing basis may require NRC review or approval; a combined license does not make approved requirements optional. The NRC’s new-reactor regulations and guidance and its combined-license application information describe the licensing framework.

Advance approvals can resolve selected issues, not the whole project

Part 52 includes early site permits and certified designs as ways to address certain site or design matters ahead of a particular construction project. Their practical value is that a later application may be able to rely on issues already resolved through the relevant approval, subject to its terms and the NRC’s requirements. They do not eliminate review of the specific proposed plant, the site-specific environmental questions, or the conditions that must be met before operation.

How do safety and environmental reviews work?

Licensing review has connected but distinct components: safety review, environmental review, and hearings. They examine different questions. A safety analysis addresses whether the proposed facility and its site meet nuclear safety requirements. Environmental review considers effects of the project beyond the plant boundary, including land, water, wildlife, and other federally relevant topics. These reviews inform the licensing decision; neither is simply a construction inspection.

Safety review

The applicant submits a safety analysis report and information about the proposed site and facility. NRC staff evaluate the safety case against applicable requirements. The level of detail and the specific design information depend on the licensing application and route. The agency’s overview of the licensing process explains how safety review fits into licensing.

Environmental review

For covered applications, applicants submit environmental reports. NRC staff conduct the agency’s environmental review and may coordinate with federal and state environmental agencies. This review considers impacts beyond the facility boundary, rather than treating the plant site as the only relevant area. The NRC outlines the process in its environmental review process and its environmental review guidance for applicants.

For the NRC’s stated schedule, environmental review is estimated at approximately 24–36 months, as described on the agency’s page checked in 2026. That estimate covers the environmental review process—including scoping, a draft environmental impact statement (EIS), a comment period, and a final EIS. It is not a forecast for the entire licensing effort, project development, construction, or commercial operation.

Generic analysis and site-specific questions

The NRC’s NUREG-2249, published in April 2026, describes a generic EIS approach for new reactors using a technology-neutral plant parameter envelope and a site parameter envelope. The purpose is to analyze environmental issues common to many projects generically, so later reviews can concentrate on questions that depend on a selected location. Generic analysis does not remove the need for site-specific environmental review. The NRC’s NUREG-2249 page provides the report information.

Hearings and public participation

Hearings are a distinct part of the licensing process alongside safety and environmental review. They provide a formal avenue for issues relevant to the licensing decision to be considered. The existence of a hearing does not replace the technical reviews, and completing an environmental document does not itself grant construction or operating authority. The NRC’s licensing backgrounder describes these connected parts of review.

Can construction start before the plant has an operating license?

Yes, construction can be authorized before a plant has authority to operate. Under Part 50, the NRC can issue a construction permit first; the operating license is a separate later authorization. Under Part 52, a COL authorizes construction and provides conditional authority to operate, but the licensee cannot begin operating merely because the COL has been issued.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a Part 52 combined license, the license specifies inspections, tests, analyses, and acceptance criteria (ITAAC). These requirements verify that the plant has been built in accordance with the license and is capable of operating as licensed. The Commission authorizes operation only after the required verification is complete and the criteria are met. This makes the distinction practical: construction authorization allows work to proceed under the license, while authorization to operate depends on completing the applicable verification and satisfying the conditions.

How long does it take to get a nuclear power plant approved?

There is no single timetable in the NRC figures that covers site selection, licensing, construction, and the start of commercial operation. The agency’s approximately 24–36-month estimate applies to its environmental review process, not the entire project. Application preparation, other licensing reviews, construction, and completion of operating conditions are separate parts of the overall schedule.

License terms are also different from project schedules. The NRC states that a combined license runs for 40 years from the specified Commission finding that the acceptance criteria have been met; it can be renewed for 20 years. The 40-year term therefore does not simply begin on the day construction starts or when the license is issued. The NRC’s combined license information describes the term and its starting condition.

Where DOE environmental procedures fit

The Department of Energy (DOE) and the NRC have different roles. DOE’s NEPA procedures govern DOE’s own environmental decisions; they are not a replacement for NRC reactor safety review or NRC licensing. The DOE’s procedures page, dated July 13, 2026, says its procedures reflect the 2023 Fiscal Responsibility Act amendments to NEPA, Executive Orders 14154 and 14301, the Council on Environmental Quality’s rescission of its NEPA regulations, and the Supreme Court’s May 29, 2025 decision in Seven County Infrastructure Coalition et al. v. Eagle County, Colorado. DOE’s current NEPA implementing procedures are the relevant reference for DOE actions.

DOE announced an advanced-reactor categorical exclusion in February 2026, describing coverage for authorization, siting, construction, operation, reauthorization, and decommissioning, and later revised its procedures. A categorical exclusion under DOE procedures concerns DOE’s NEPA process; it does not itself authorize a commercial reactor under NRC rules. For the current DOE position, consult the DOE page on the advanced nuclear reactor categorical exclusion together with the current procedures page.

What the approval sequence means in practice

For a project team, the key is to keep the decisions separate: establish whether the site can be approved, determine which licensing route and design approvals apply, complete safety and environmental review, obtain the construction authorization, and satisfy the operational conditions. The sequence can be summarized this way:

  1. Screen and characterize the site. Assemble information on hazards, population, cooling, discharges, alternatives, and emergency planning relevant to the proposed facility.
  2. Choose how to address site and design questions. The developer may seek an early site permit before selecting a reactor design, and Part 52 provides for certified designs as advance approvals.
  3. Apply under Part 50 or Part 52. Part 50 stages construction and operating licenses; Part 52 uses a combined license with conditions and verification requirements.
  4. Complete parallel licensing reviews. NRC staff review the safety case and environmental information, with hearings forming a separate connected part of the process.
  5. Build only under the granted authorization. The authorization and approved licensing basis govern construction; proposed changes may trigger NRC review or approval.
  6. Meet the operation conditions. Under a Part 52 COL, complete the specified ITAAC verification and obtain the Commission’s authorization before operating.

This is a U.S.-specific explanation of commercial nuclear plant licensing. Other countries have different regulators, environmental procedures, and approval sequences.
