For a National Highway project, land acquisition follows the National Highways Act, 1956, while compensation is determined by reference to the First Schedule of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act). The process involves a government-appointed Competent Authority for Land Acquisition (CALA), project notifications, a compensation determination, and—if the amount is disputed—a possible objection before an arbitrator. The rules may differ for state highways and locally administered roads, so first establish which authority and statute apply to the project affecting your land.
First identify which road and acquisition law apply
“Road-project land acquisition” is not one uniform process across India. The clearest national framework described by the Ministry of Road Transport and Highways (MoRTH) applies to National Highways: acquisition is carried out under the National Highways Act, 1956, and compensation is determined by reference to the RFCTLARR Act’s First Schedule. The RFCTLARR Act came into force on 1 January 2014.

A state highway or locally administered road may have a different acquiring authority, notification route, or state-specific rules. Do not assume that a National Highway procedure or compensation explanation applies just because the project is a road. Check the project’s own notification and identify the statute and authority named in it before assessing your position.
National Highway acquisition at a glance
- Acquisition law: National Highways Act, 1956.
- Acquisition authority: CALA, appointed by the Central Government under section 3(a) of the National Highways Act.
- Compensation framework: First Schedule of the RFCTLARR Act, 2013.
- Compensation dispute route described by the government: an objection before an arbitrator under section 3G(5) of the National Highways Act if the owner does not accept CALA’s amount.
How the National Highway acquisition process works
The National Highways Act supplies the acquisition procedure; the RFCTLARR Act supplies the compensation schedule used for National Highway land. Keeping those roles separate helps make sense of notices and awards: the fact that the acquisition proceeds under one statute does not mean that compensation is calculated under that statute alone.

1. The Central Government appoints a CALA
The Central Government appoints a Competent Authority for Land Acquisition under section 3(a) of the National Highways Act. CALA is the authority identified by MoRTH for the acquisition process. The specific officer or office responsible for a parcel is a project-level matter; check the relevant project record rather than assuming that a particular local office is responsible.
2. Project notifications mark legally significant stages
Notifications are central to understanding where an acquisition stands. A notice or publication is not the same thing as a final compensation award, and a question about the effect of a notice is distinct from a dispute over the amount offered for a particular parcel.
One especially important stage is a notification under section 3D. A MoRTH reply published by the Press Information Bureau on 28 November 2019 says that land notified under section 3D vests in the Central Government free from encumbrances. This is a significant legal consequence of the notification, not merely an administrative update. For a particular property, verify the notification’s project, location, parcel description, and publication details against the land records and the relevant authority’s records.

People often ask what “3A” or “3G and 3H” mean in land acquisition. The material available here establishes the role of section 3(a) in appointing CALA, the vesting consequence of a section 3D notification, and the objection route under section 3G(5). It does not establish a complete, parcel-by-parcel explanation of every notice or payment step associated with sections 3A, 3G, or 3H. Read the actual notice and current statutory text rather than inferring its effect from a section number alone.
3. CALA determines compensation
For National Highway acquisition, the Union government says compensation is determined in accordance with the First Schedule of the RFCTLARR Act. The amount for an individual parcel cannot be worked out from a headline percentage alone: the parcel’s valuation, land classification, assets, interests, and the actual award all matter.
4. Compensation is deposited and paid through the process
MoRTH describes BhoomiRashi as a web utility developed to digitize and automate land acquisition. The ministry also says it is integrated with the Public Financial Management System for depositing compensation into accounts of affected or interested persons. This describes the system’s intended functionality; it does not establish that a particular parcel’s notification, award, or payment is current. Check the relevant project record for the status of an individual case.

5. A compensation disagreement can proceed to arbitration
If an owner does not accept the amount determined by CALA, the government’s 27 July 2022 parliamentary reply says the owner may file an objection before an arbitrator under section 3G(5) of the National Highways Act. The reply says section 3G(6) applies the Arbitration and Conciliation Act, 1996 to that arbitration and characterizes the proceeding as quasi-judicial. The award and the circumstances of a particular dispute matter; the general route does not by itself establish a case-specific deadline or outcome.

MoRTH’s 2019 description states that 100% solatium is payable on the sum of the land market value after application of the factor and the value of assets on the land. That is a statement about the components on which solatium is described as payable; it is not a prediction that every owner will receive a particular total, nor does it let a reader calculate an award without the parcel’s valuation and other relevant facts.
For a useful review of an award, separate the questions rather than treating the total as an unexplained figure:

- What land and interests does the award cover?
- What land classification and market-value determination has been used?
- How has the applicable factor been applied?
- What assets on the land have been valued?
- How does the stated solatium relate to the land value and asset value described in the award?
- Does the award address rehabilitation and resettlement or infrastructure amenities where they are applicable?
These are review questions, not a substitute calculation formula. The official material cited here does not calculate an individual award or resolve every valuation issue that may arise under state-level rules or in a particular parcel’s circumstances. A landowner should compare the actual award and supporting project records, not extrapolate an amount from the 100% figure alone.

Compensation for land is not the only matter that may arise. A government reply published in 2019 says that, where needed, CALA determines compensation under the RFCTLARR Act’s First Schedule, rehabilitation and resettlement (R&R) under its Second Schedule, and infrastructure amenities under its Third Schedule.

The same reply characterizes displacement and dislocation in the required National Highway right-of-way as limited and says that few families require R&R. That is the government’s general characterization, not a finding about an individual household. A family’s eligibility cannot be decided from that general statement; it depends on the relevant facts and the determination for the project and affected people.

What to check if your land is affected
Use the project’s own documents to establish the facts before drawing conclusions about ownership, compensation, or payment. BhoomiRashi is described by MoRTH as a digitization utility, but a portal description is not proof of the status of an individual parcel.
- Identify the road category and authority. Determine whether the project is a National Highway, state highway, or local road. Find the statute, notification, and acquiring authority named in the project documents.
- Match the notice to your land. Compare the notification’s project and parcel details with your land records. Note the section cited, publication details, and whether the document concerns a notification, a compensation determination, or another stage.
- Locate the CALA determination or award. Review the amount and the supporting valuation information, including the land, interests, and assets covered. Do not treat the solatium percentage as the full calculation.
- Check whether R&R or amenities are addressed. Where relevant to the affected family or property, look for the determinations under the RFCTLARR Act’s Second and Third Schedules.
- Verify payment status independently. MoRTH describes BhoomiRashi’s integration with the Public Financial Management System for deposits. Confirm the actual project and payment record rather than inferring payment from the system description.
- If you dispute the amount, examine the applicable objection route promptly. For National Highway compensation, the government identifies an objection before an arbitrator under section 3G(5). Check the current law, award, and case-specific requirements before acting.
Why the same compensation answer may not fit every road project
A National Highway case and a state or local road case can differ at the first step: the governing statute and acquiring authority. They may also differ in notices, award process, valuation rules, R&R determinations, and dispute route. A comparison based only on a headline solatium percentage can therefore be misleading.
For National Highways, the official framework described here pairs the National Highways Act acquisition procedure with compensation determined by reference to the RFCTLARR Act’s First Schedule. For another road category, establish the governing legal route from that project’s notification and rules before applying this explanation. Land records, the actual award, amendments, judgments, and state-specific requirements can affect a particular case.

This overview explains the official National Highway framework and the government’s stated compensation and dispute provisions; it does not determine any owner’s entitlement, calculate an award, establish a deadline, or confirm a current portal entry. Those answers require the applicable project notification, current law, land and asset records, and the CALA award. For an individual dispute, have the actual documents reviewed by a qualified professional familiar with the relevant jurisdiction and current law.
