Benjamin Scales’s career follows a practical path from delivering materials and using construction tools to investigating building failures and explaining technical evidence in legal disputes. Based in Galveston, Texas, he is described by Building Enclosure as a litigation support specialist, subject matter expert and educator at WH Coltzer. His work connects building science with questions about roofs, stucco, windows, waterproofing and other parts of the enclosure that separates an occupied space from the weather.
The profile by Lindsay Lewis reports that Scales has more than 22 years of experience. That is a biographical claim attributed to the profile, not an industry statistic or an independently verified measure of performance.

A construction career that became forensic work
Scales did not begin in a courtroom. Lewis’s profile traces his early work to delivering materials to jobsites, followed by hands-on tool work. He later operated a contracting business before moving into expert-witness work. Each stage supplied a different view of construction: logistics showed how materials reach a project, installation revealed how assemblies are actually built, business ownership exposed scheduling and cost decisions, and forensic practice required him to explain evidence to people who may not share a construction background.
Scales describes that range as being “in just about every seat at the table—from installer to courtroom testifying expert.” The wording appears in the Building Enclosure profile and should be understood as the source’s account of his career, rather than as an independently audited employment record.

Why the transition matters
Building-enclosure disputes often involve several plausible explanations. Water may enter through a roof, a window opening, a stucco crack, a flashing transition or a waterproofing detail. A visible stain identifies a symptom, not automatically the entry point or the person responsible. Someone who has installed and managed construction work can recognize how drawings, materials, sequencing, workmanship and maintenance interact; forensic work then adds a disciplined process for documenting those conditions.
That combination is the central idea in Scales’s profile. The goal is not simply to identify damage. It is to determine what failed, how the failure developed, which evidence supports each conclusion and what repair approach addresses the underlying condition.
What building-enclosure investigation looks for
The enclosure is the collection of roof, wall, window, door, flashing, sealant, waterproofing and related components that control rain, air, heat and moisture at the building perimeter. In a forensic investigation, investigators look for patterns that connect an observed condition to a possible mechanism. The profile mentions thermal patterns, moisture trails, cracks and stains as clues that can help tell that story.

Clues are evidence, not conclusions
A moisture trail can show where water traveled after entering, but gravity and capillary movement may carry it away from the original opening. A crack can be related to movement, material behavior, installation or age; its presence alone does not establish which explanation is correct. A stain can remain after a source has been corrected. Thermal differences can indicate changing moisture or heat flow, yet a thermal image does not by itself identify a code violation or prove a particular party caused damage.

For that reason, observations are normally combined with photographs, drawings, field measurements, construction documents, repair history and information from people who occupied or maintained the building. The sources describe Scales’s work as forensic analysis, ASTM field testing, commissioning and expert reporting, rather than as a single-device inspection.
Methods and what each contributes
| Method or record | What it can reveal | What it cannot establish by itself |
|---|---|---|
| Visual review of thermal patterns, moisture trails, cracks and stains | Locations and patterns that merit closer investigation | The complete source, chronology or responsibility for a failure |
| Thermographic imaging | Differences in surface temperature that may help locate anomalies | A definitive diagnosis without corroborating observations and testing |
| Field instruments for on-site material testing | Measurements taken at selected locations in the assembly | Conditions outside the tested areas or every possible failure mechanism |
| Enhanced photography | Detailed visual documentation of conditions and interfaces | Hidden conditions that were not exposed or otherwise measured |
| Building and failure diagrams | A clear representation of assemblies, pathways and reported failure locations | Proof that a diagrammed pathway is the only cause |
| ASTM field testing | Test results produced under the applicable field procedure | A universal answer when the test area, timing or procedure does not represent the disputed condition |
| Commissioning | Evidence that specified systems or assemblies were reviewed and operated or performed as intended during the commissioning process | A guarantee that later damage cannot occur |
WH Coltzer’s Forensic Architecture page lists thermographic imaging, various field instruments for on-site material testing, enhanced photography, building diagrams and failure diagrams among its tools and expertise. Those are descriptions of the company’s stated capabilities. They do not, on their own, verify the result of a particular Scales investigation.
Where a thermal camera fits
A thermal imaging camera is the relevant physical-product category mentioned by the sources. It can help an investigator see temperature patterns that are difficult to recognize in ordinary photographs. The evidence does not identify a make or model, establish that consumer equipment is suitable for professional forensic work or endorse a retailer. Equipment selection depends on the building, the measurement objective, environmental conditions and the qualifications of the person interpreting the images.

How the findings serve a building dispute
Scales’s role sits between technical investigation and legal decision-making. Owners may need to understand why a building is wet, uncomfortable or deteriorating and which repair options are realistic. Attorneys need a defensible explanation that can be tied to documents, observations and test results. Insurers may need to distinguish a covered event from a construction defect, maintenance issue or long-running condition, subject to the terms of the applicable policy. An expert report cannot decide those legal questions, but it can clarify the physical facts on which the questions depend.

Questions an investigation is intended to answer
- What condition or failure is documented?
- How could water, air, heat or moisture have moved through the assembly?
- Which observations and tests support the proposed mechanism?
- What project documents, construction sequences or maintenance records bear on the condition?
- What repair or further investigation could address the problem?
The profile frames this work as helping owners, attorneys and insurers understand what failed, how it happened, who may be responsible and what repairs could address it. “Who may be responsible” is an investigative question, not a finding that any particular person, contractor or manufacturer is liable.
WH Coltzer’s stated expert-witness scope
WH Coltzer says its expert-witness practice includes technical document review, reports, presentations and coordination with legal counsel. The company lists building-assembly failures, code compliance, construction defects, delays, construction costs and economic damages among the areas its experts address. This establishes the employer’s published service scope; it does not establish a specific case outcome, a particular Scales opinion or the court’s acceptance of any testimony.
Accountability, testing and commissioning
Education is a recurring theme in Lewis’s profile. Scales is quoted as saying, “The next phase in energy efficiency is accountability.” The point is that design intent and promised performance need a way to be checked in the finished building. Energy or moisture goals that are never measured are difficult to manage, diagnose or improve.

You can’t manage what you don’t measure.” In practice, verification can mean checking whether installed work matches requirements; testing can produce observations or measurements under a defined procedure; and commissioning can organize review of systems and their intended operation. The exact scope depends on the project documents and the service being performed. These activities reduce uncertainty, but they do not eliminate future defects or replace maintenance.

The profile summarizes Scales’s message to subcontractors as “airtightness comes first.” Airtightness is important because uncontrolled air movement can transport moisture and affect energy performance. It is one part of enclosure performance, not a substitute for water-management details, drainage, flashing, material compatibility or workmanship review.

Why education matters in expert work
An expert must translate technical observations into language that a project owner, attorney, adjuster, judge or jury can follow. Teaching can help develop that explanatory discipline, while field experience helps keep explanations tied to how assemblies are designed and built. Neither teaching nor affiliation proves that an opinion is correct; the opinion still has to be supported by the project evidence and the applicable technical requirements.

How to read an enclosure expert’s report
Readers evaluating a report—whether they are owners, counsel or claims professionals—can look for a clear chain from observation to conclusion. A useful report should identify where and when conditions were observed, distinguish direct measurements from assumptions, explain the limits of access and testing, and show how alternative explanations were considered.
- Define the question. Identify whether the assignment concerns water entry, air leakage, thermal performance, a construction defect, delay, cost or another issue.
- Document the assembly. Gather drawings, specifications, submittals, change orders, inspection records, maintenance history and repair invoices that describe what was intended and what was installed.
- Record conditions. Use photographs, diagrams, notes and measurements to locate symptoms and relevant interfaces, preserving the date and location of each observation.
- Test proportionately. Select field testing or other investigation that can distinguish among the plausible mechanisms, and state what the test area and procedure cannot answer.
- Connect cause and remedy. Explain how the evidence supports a failure mechanism and why a proposed repair addresses that mechanism rather than only covering the visible symptom.
- Separate technical and legal conclusions. Describe physical causation and repair implications while leaving legal responsibility and damages determinations to the appropriate decision-makers.
This structure also makes disagreements more productive. A competing expert can challenge a measurement, an assumption, a test location or an interpretation instead of arguing over an unsupported conclusion.
The limits of a career profile
Lewis’s article is the principal source for Scales’s personal chronology, the reported experience duration and the quotations attributed to him. WH Coltzer’s pages describe the organization’s methods and service categories. Neither source, as presented, supplies a catalog of court cases, quantified repair savings, independently measured building-performance improvements or a judicial assessment of a particular opinion. Those details should not be inferred from the existence of an expert-witness practice.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteThe distinction is useful for anyone considering an investigator. A professional biography can explain experience and focus. A hiring decision still requires checking the person’s current availability, relevant project experience, credentials, conflicts, proposed scope, deliverables, fees and ability to meet the applicable litigation schedule.
What Scales’s path shows construction professionals
Scales’s progression illustrates why enclosure expertise is often built across several roles rather than in a single job title. Material delivery teaches the realities of site logistics. Tool work exposes installation details. Running a contracting business adds responsibility for people, sequencing and commercial decisions. Expert testimony demands that technical judgments be documented, explained and tested under scrutiny.
For project teams, the practical lesson is to treat performance as something to verify throughout design, installation, commissioning and occupancy. For dispute teams, it is to preserve the evidence that allows someone to reconstruct what happened: records, photographs, test results, diagrams, repair history and clear descriptions of observed conditions. That is the bridge between a building’s symptoms and a credible explanation of its failure.
