New York construction workers may qualify for different programs depending on what happened, whether the work was public or private, their legal classification, wage history, and the dates involved. A work-caused injury or illness generally points to workers’ compensation; an off-the-job condition may qualify for disability benefits; family-care and bonding needs may qualify for Paid Family Leave; unemployment insurance can help between jobs when the worker remains able and available to work; and covered public projects can require prevailing wages and fringe supplements.
Which New York benefit program fits your situation?
These programs do not provide the same type of help. Use the event that caused your lost work or leave as the starting point, then check the additional eligibility rules for your wages, medical facts, classification and project.

What benefits may be available if I’m injured or become ill because of work?
Workers’ compensation can cover treatment and lost earnings
New York workers’ compensation is the primary system for an injury or occupational illness arising from construction work. Depending on the accepted claim and medical findings, it can provide authorized medical care, payments replacing part of wages while disability prevents work, and benefits for eligible survivors when a work-related death occurs. The Workers’ Compensation Board’s worker information hub links to claim filing, medical-care and benefit guidance.

A construction worker should preserve the facts that connect the condition to work: the date and location, task being performed, witnesses, employer and project information, pay records, and medical reports. Tell the employer promptly and follow the Board’s official claim instructions rather than waiting for symptoms to resolve.
When lost-wage payments begin
The Board generally makes lost-wage benefits available when a work-related disability keeps a worker out for more than seven days. The first seven days are normally unpaid. If the disability lasts more than 14 days, benefits may be payable back to the first missed workday. For an accepted claim, the state says payments should begin within 18 days after the injury or within 10 days after the employer learns of it, whichever is later. Details can be found on Workers’ Compensation Lost Wage Benefits.
The injury date controls the statutory minimum
Benefit rates are tied to the date of injury or illness, not simply the date a claim is filed. For injuries or illnesses occurring from July 1, 2026 through June 30, 2027, the published minimum workers’ compensation benefit is $384.45 per week. The weekly maximum changes each July 1, so a worker with an earlier injury date can be subject to a different minimum or maximum. The individual rate also depends on average wages and the degree of disability.
What if my injury or illness happened off the job?
Disability benefits replace part of wages, not medical bills
New York disability benefits address eligible off-the-job injuries and illnesses. The state’s Introduction to the Disability Benefits Law describes a benefit equal to 50% of average weekly wages for the last eight weeks worked, capped at $170 per week, for up to 26 weeks of disability in a 52-week period. That $170 figure is the amount shown on the cited Board page; check the current page when applying because benefit rules can be updated.
Disability benefits are cash payments only. They do not pay doctors, hospitals, prescriptions or other treatment costs, so the worker remains responsible for arranging and paying for medical care through available health coverage or other means. A condition caused by work belongs in the workers’ compensation system instead, and the same period cannot be treated as both an off-the-job and work-caused disability.

Disability benefits and Paid Family Leave cannot overlap
New York does not allow a worker to collect disability benefits and Paid Family Leave simultaneously. Their combined use is limited to 26 weeks in a 52-week period. Plan the dates carefully when a medical leave is followed by family caregiving or bonding leave.

Can I take paid leave to care for family or bond with a child?
Qualifying reasons for Paid Family Leave
Eligible employees may use New York Paid Family Leave to bond with a newly born, adopted or foster child; care for a family member with a serious health condition; or assist family when a qualifying relative is deployed abroad for active military service. The program provides job protection, continuation of health insurance under the applicable terms and protection against discrimination or retaliation. The official Paid Family Leave frequently asked questions explain covered family relationships, notice and certification requirements.
Paid Family Leave is not a substitute for workers’ compensation when the worker is personally disabled by a job-site injury. It is also distinct from disability benefits: it pays for an approved family-related reason, while disability benefits address the employee’s own off-the-job medical condition.
2026 maximums and payroll contribution
For 2026, New York Paid Family Leave lists a maximum weekly benefit of $1,228.53 and a maximum total benefit of $14,742.36. The employee contribution rate is 0.432% of gross wages per pay period, capped at $411.91 for the year. These are 2026 figures; verify the program’s current tables and eligibility rules before scheduling leave or estimating deductions.
Can I get unemployment between construction jobs?
Ability and availability are essential
Unemployment insurance may apply when a construction job ends or a worker is between projects, provided the claimant meets New York’s wage, separation and continuing-eligibility rules. The worker must be physically able to work, available for work and follow the state’s certification and job-search requirements. A temporary layoff is not automatically disqualifying, but the claimant must report work, earnings and any refusal of suitable work accurately.

2026 base-period wage tests
For claims filed in 2026, the Department of Labor’s Before You File a Claim for Unemployment FAQs says wages must have been earned in at least two calendar quarters. The FAQ gives a minimum of $3,500 in one base-period quarter and requires total base-period wages of at least one and one-half times the high-quarter wages. The state’s instructions control which base period applies and how alternate wage calculations are handled.
Workers’ compensation and unemployment can sometimes coexist
Receiving workers’ compensation does not automatically bar unemployment insurance. A claimant may qualify for unemployment if still able and available to perform work, such as modified or different work. However, the combined weekly amount of workers’ compensation and unemployment cannot exceed the claimant’s average weekly wage in the unemployment base period. Report both benefits so the Department of Labor can apply the cap correctly.
What benefits come with a public construction project?
Prevailing wage has two parts
On covered public work, prevailing wage is the locality’s determined basic hourly cash rate plus supplements. Supplements are fringe benefits that can include medical or hospital care, pensions, compensation for occupational injury or illness, unemployment, life, disability or accident insurance, vacation and holiday pay, apprenticeship costs and other qualifying benefits. The applicable rate is not a statewide construction wage: it depends on the project’s locality and the worker’s trade or classification.
Before relying on a rate, identify the public entity, project location, contract coverage, trade classification and schedule effective for the work dates. The Department of Labor’s Article 9 Frequently Asked Questions explains public-work prevailing-wage requirements and supplements. Keep pay stubs and daily records so cash wages and fringe payments can be compared with the schedule.
Apprentice rates are restricted
For covered Article 9 work, the Department of Labor says only registered apprentices may be paid less than the journeyworker rate. An informal trainee designation or an unregistered apprenticeship does not create an exception. Confirm registration and the classification listed on the project’s prevailing-wage schedule.

Am I an employee or an independent contractor?
Construction work starts with an employee presumption
New York’s Construction Industry Fair Play Act took effect October 26, 2010. For workers’ compensation, disability benefits and Paid Family Leave, a construction worker performing services for a contractor is presumed to be that contractor’s employee, subject to the statutory test. Calling someone a “1099,” paying cash, or signing an independent-contractor agreement does not by itself defeat the presumption.
The contractor must establish all three independent-business criteria
The state notice says the employer must establish each of these conditions to treat the worker as an independent contractor:
- The worker is free from the contractor’s direction and control in performing the service.
- The service is performed outside the usual course of the contractor’s business.
- The worker has an independently established business capable of offering the service to the public.
Because a contractor’s ordinary business is commonly construction, the second criterion can be difficult to establish. The Workers’ Compensation Board coverage guidance and the state’s Construction Industry Fair Play Act notice warn that misclassification and off-the-books payment are unlawful. Misclassification can deprive a worker of coverage and shift liability to the business.
How do the programs interact?
Match the claim to the cause of the absence
Start by documenting whether the disabling event arose from work, occurred away from work, concerns a family member, or is simply a lack of available work. A back injury lifting materials on site is analyzed under workers’ compensation; a non-work illness may fit disability benefits; caring for a spouse with a serious health condition may fit Paid Family Leave; and a completed project with no current assignment may fit unemployment if the worker can accept work.
Check for conflicts before filing
- Do not collect disability benefits and Paid Family Leave for the same time period.
- Tell the unemployment program about workers’ compensation and any earnings; the combined weekly amount is subject to the base-period average-wage cap.
- Do not describe an off-the-job condition as work-related, or vice versa, merely to obtain a different payment. Medical records and employer reports should use the accurate cause.
- For public work, check prevailing-wage supplements separately from insurance or statutory benefits; a fringe listed on a wage schedule is not automatically the same as a workers’ compensation payment.
What should I do after a problem occurs?
- Write down the facts immediately. Record the date, time, location, task, symptoms, witnesses, supervisor, project owner and last day worked.
- Notify the employer through a traceable method. Keep a copy of the notice, incident report and any response.
- Obtain medical documentation. Tell the treating provider whether the condition is work-related and provide the employer and insurer information requested for a workers’ compensation claim.
- Preserve wage and classification records. Save pay stubs, time sheets, contracts, 1099 forms, schedules, project names, trade classification and apprenticeship registration.
- Use the correct state program. Follow the Workers’ Compensation Board process for a job-caused condition, the Disability Benefits Law process for an eligible off-the-job condition, Paid Family Leave instructions for family leave, or Department of Labor unemployment instructions after job loss.
- Track every deadline and payment. Note claim numbers, filing dates, medical appointments, certification weeks and communications with the employer, insurer and state agency.
Where can I verify my individual eligibility?
No general summary can decide a particular claim. Eligibility can turn on the legal employer, control over the work, wage history, medical proof, injury date, availability for work, family relationship, project coverage and the exact classification on a wage schedule.
- Use the Workers’ Compensation Board’s worker resources, benefits information and lost-wage guidance for a work injury or illness.
- Review the Board’s Disability Benefits Law page for an off-the-job condition.
- Check the current Paid Family Leave FAQ before arranging family leave.
- Use the Department of Labor’s unemployment FAQ for current wage tests and filing instructions.
- For public projects, consult the Article 9 FAQ and the project’s locality- and trade-specific prevailing-wage schedule.
Contact the relevant state program, your employer or its insurer with your claim details, and keep copies of every submission. Current agency instructions control if a figure, deadline or eligibility rule changes after publication.
