FAQ: Who Pays for Road Improvements and Historic Sign Relocation?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: Road improvements are usually paid from a combination of federal-aid, state and local transportation money. The program’s cost-share rules determine the federal portion, while the state transportation department, local government or other project sponsor supplies the nonfederal share and manages delivery. Moving a historic sign is a separate question: when a federal agency funds, permits, licenses or approves the work, Section 106 consultation produces a binding agreement that assigns the relocation and mitigation costs. A historic marker is not automatically treated like an outdoor-advertising sign, for which federal reimbursement is generally 75% under specific rules.

Why there is no single payer

“Who pays?” cannot be answered from the word highway or historic alone. The responsible payer is established by several facts that must be read together:

As an Amazon Associate I earn from qualifying purchases.

  • Who owns and operates the road.
  • Which federal, state or local program supplies the money.
  • Whether a federal agency is funding, permitting, licensing or approving the undertaking.
  • Whether the object is a historic property, a regulated outdoor-advertising sign or something else.
  • What the executed funding agreement, right-of-way documents and mitigation agreement require.

Federal-aid money is not an automatic promise to pay the whole construction bill. A federal program establishes its participation rules; the state or local sponsor normally provides the required match and remains accountable for the project. Likewise, Section 106 is a review and consultation duty. It does not create a universal federal percentage for moving every historic marker, nor does it make a state historic-preservation office the contractor.

How road improvements are commonly financed

Federal-aid programs administered through a state

The Surface Transportation Block Grant (STBG) program is a flexible source for preserving and improving federal-aid highways, bridges, tunnels and other public roads. It can also support bicycle and pedestrian facilities and certain transit-capital projects. Funds are apportioned to states by formula and made available through state transportation agencies. A city or county usually starts with its state department of transportation (DOT) or metropolitan planning organization (MPO) to determine eligibility and programming.

The federal share depends on the funding class and statutory rules. The project agreement identifies the eligible costs, the federal pro-rata share and the nonfederal match. The state DOT or local sponsor pays invoices, documents eligible work and seeks reimbursement under that agreement; the federal government generally does not pay contractors directly.

State-only and locally funded roads

A state may finance a road entirely with state transportation revenues, or a county, town or regional authority may use local taxes, bonds, impact fees or other local sources. If no federal money, approval, permit or license is involved, the federal Section 106 process normally does not apply. State historic-preservation statutes, local landmark ordinances, environmental permits, grant conditions or a road-owner policy may still require review and may assign relocation costs.

Property acquisition and early right-of-way work

Title 23 rules limit federal participation in acquired real-property costs to the federal pro-rata share applicable to the project’s funding class. A state can buy right-of-way early with state money. Later reimbursement may be possible when the property is incorporated into an eligible project and all statutory conditions are met. The acquisition file, appraisal, relocation benefits and the project’s authorization should therefore be checked before assuming that an early purchase is federally reimbursable.

Historic preservation and transportation-enhancement funding

Historic preservation can be an eligible transportation-enhancement activity. Even where a project is developed with a municipality, nonprofit or private partner, the state DOT or another eligible transportation agency remains responsible to the federal highway agency for the enhancement project. A Historic Preservation Fund grant can bring additional requirements, including Uniform Relocation Assistance and Real Property Acquisition procedures for federally assisted preservation undertakings by states and public subgrantees. The grant’s own eligible-cost and matching rules still control; preservation status by itself does not establish a particular payment split.

When Section 106 applies to a historic sign or marker

The federal trigger

Section 106 applies when a federal agency funds, permits, licenses or approves an undertaking. A highway project using federal-aid funds is a common example, but the trigger is the federal agency’s involvement, not simply the fact that a road is public. The agency must identify historic properties, consult with the State or Tribal Historic Preservation Officer and other parties, assess effects and seek to avoid, minimize or mitigate adverse effects.

Relocation can be an adverse effect

Moving a listed or eligible historic property can change its location, setting, feeling or association. National Park Service guidance treats relocation as an adverse effect in appropriate circumstances. The agency must therefore analyze whether the sign or marker is historic, whether the proposed move affects its historic characteristics and whether another design or construction approach could avoid or reduce the harm.

The agreement that assigns the work

When consultation resolves the effects, the parties may execute a Memorandum of Agreement (MOA) or Programmatic Agreement (PA). The Advisory Council on Historic Preservation describes an MOA or PA as a legally binding document that commits the agency to carry out the undertaking under its terms. It specifies the selected alternatives or mitigation measures, identifies the parties responsible for each measure and documents how compliance will be completed.

If the agreement requires dismantling, transport, conservation, a new foundation, interpretation or monitoring, the project sponsor normally includes those tasks in the construction or mitigation budget and hires the qualified professionals. One Federal Highway Administration programmatic-agreement example assigns the agency responsibility to relocate a historic house and contract a professional mover. That example illustrates the controlling principle: the executed agreement, not a nationwide default percentage, determines who performs and pays for the mitigation.

What the SHPO or THPO does—and does not do

State and Tribal Historic Preservation Officers participate in consultation, provide expertise and may sign or concur in an agreement. They generally do not become the payer merely because the resource is historic. The federal lead agency and the project sponsor implement the agreed measures, subject to the funding authorization and any conditions in the MOA, PA, permit or grant.

Historic markers versus outdoor-advertising signs

Federal outdoor-advertising rules are a different legal category from historic-property protection. Under 23 U.S.C. 131 and 23 CFR part 750, eligible acquisition, removal and relocation of regulated signs can receive federal reimbursement under specific conditions. A roadside historical marker is not automatically an outdoor-advertising sign; classification, ownership, location, listing or eligibility, permits and the project’s federal nexus must be established first.

Question Historic property or marker Regulated outdoor-advertising sign
Primary legal framework Section 106 and the project’s MOA, PA, permit or grant conditions when a federal undertaking exists. 23 U.S.C. 131 and 23 CFR part 750, plus state outdoor-advertising law.
Typical federal treatment No universal percentage. The agreement and eligible project costs control. Generally 75% federal reimbursement of eligible acquisition, removal and incidental costs legally incurred or obligated by the state.
Special historic or date-based rule Relocation is evaluated as a potential adverse effect; mitigation is negotiated. A narrow class of signs relocated before January 4, 1975 and later required to be removed can receive 100% federal participation.
Who may be responsible Lead federal agency, state DOT, local sponsor or another party named in the MOA or PA. State or project authority, sign owner and site owner according to the statute, regulation and state procedures.
Illegal sign Historic status does not decide legality. Removal of an illegal sign may be charged to its owner under applicable law; federal participation can be unavailable where the owner reimburses the state.

The 75% and 100% figures apply only to the outdoor-advertising reimbursement rules described above. They should not be applied to every historic marker, interpretive panel or road-improvement project.

Whether each item is federally reimbursable is a separate eligibility question. The funding agreement, approved estimate and applicable cost-share rule should identify what can be claimed and what remains the sponsor’s responsibility.

How to determine who will pay on a real project

  1. Identify the road owner and project sponsor. Confirm whether the facility belongs to a state, county, city, toll authority, federal land agency or another entity. Ask which agency signed the construction and funding agreements.
  2. Trace the money. Obtain the project number, programmed funding source and executed cost-share agreement. Determine the federal participation rate for that program and the required state or local match.
  3. Confirm the federal nexus. Ask whether federal funds, a federal permit, a federal license or a federal approval is involved. If not, identify the state or local preservation and environmental requirements instead.
  4. Establish what the sign is. Check ownership, location, title or eligibility for the historic register, state or local landmark status, outdoor-advertising permits and whether the sign carries commercial advertising.
  5. Read the effect finding. Request the environmental document and Section 106 determination. It should show whether the property is eligible and whether relocation is an adverse effect.
  6. Read the mitigation agreement. Obtain the executed MOA, PA or comparable commitment. Look for the party assigned to design, contract, fund, inspect and document the move.
  7. Review right-of-way and acquisition records. Compare maps, deeds, easements, appraisals and relocation-benefit determinations. A sign on private land can involve different rights and compensation from a marker in the public right-of-way.
  8. Ask about the post-move plan. Confirm who will own, insure, maintain, preserve and eventually repair the sign. A project can pay for the move while a different owner assumes long-term care.
  9. Get the payment decision in writing. Request an approved relocation estimate, authorization or change order showing the funding source, reimbursement treatment and any nonfederal share.

Common situations and likely outcomes

Federal-aid highway moves a county-owned historic marker

The state DOT or local sponsor manages the project. Section 106 consultation determines whether the marker is historic and whether the move is avoidable. If the MOA requires relocation, the sponsor usually contracts the work and charges eligible costs to the project subject to the program’s federal share; the agreement may assign some costs entirely to the sponsor.

A state-funded road widens around a local landmark

Without a federal nexus, Section 106 is not the governing federal process. State preservation law, a local landmark ordinance, a permit condition or the state’s own environmental procedure may require design changes or relocation. The state funding authorization and local agreement determine the payer.

A commercial billboard must be removed for a federally aided project

The outdoor-advertising statutes and regulations apply if the sign meets their definitions and permit requirements. The state may receive 75% federal reimbursement for eligible acquisition, removal and incidental costs, with the balance handled under state and project rules. If the sign is illegal, the owner may be liable for removal; if the owner reimburses the state, federal participation may be unavailable.

A historic sign also carries advertising

Do not choose a reimbursement category by appearance or age. The agency must determine whether the sign is a historic property, a regulated outdoor advertisement, both, or neither. Historic consultation and outdoor-advertising compliance can create separate obligations, and the project documents should explain how they interact.

When agencies disagree or a promised payment is missing

Start with the signed documents rather than informal statements. Compare the MOA or PA with the funding agreement, approved estimate and right-of-way file. Ask the project manager to identify the exact clause assigning each task and the account from which it will be paid. If the issue concerns federal-aid eligibility, request the state DOT’s written determination and, where appropriate, clarification from the Federal Highway Administration. If it concerns historic treatment, ask the lead federal agency and consulting parties to address implementation through the agreement’s dispute or amendment procedure.

Do not authorize demolition, removal or a move based only on a verbal assurance. A change in location, design or ownership can require an amendment, additional consultation, a new permit or a revised estimate. Preserve photographs, condition reports, title records and correspondence so the agency can demonstrate that the agreed treatment was completed.

Documents that answer the payment question

  • Executed federal, state or local funding and cost-share agreement.
  • Project authorization, estimate, amendments and change orders.
  • Right-of-way maps, deeds, easements, ownership records and appraisals.
  • Environmental document and Section 106 eligibility and effect finding, if a federal undertaking exists.
  • Executed MOA, PA or other mitigation commitment naming responsible parties.
  • Relocation design, professional estimate, procurement and inspection records.
  • Post-relocation ownership, maintenance, insurance and preservation plan.
  • Outdoor-advertising permit, inventory and removal determination when 23 U.S.C. 131 may apply.

Those records reveal whether the expense is a federal-aid project cost, a state or local match, a mitigation obligation, an acquisition payment, an owner responsibility or a cost that is not federally eligible.

What to ask the road agency

  • What program funds the road work, and what federal percentage and match apply?
  • Who is the lead agency and who signed the project agreement?
  • Is there a federal funding, permit, license or approval trigger for Section 106?
  • Has the sign been determined eligible for the historic register or protected under state or local law?
  • Which document requires the move, and which party is named to perform and pay for it?
  • Is the object regulated as outdoor advertising, and what permit or removal rule applies?
  • Who owns and maintains the sign after construction?
  • Which costs are eligible for reimbursement, and which are expressly nonfederal?

The practical answer

Expect a layered answer, not a single national rule. Road construction is commonly a federal, state and local funding blend administered by the state DOT or another eligible sponsor. A historic sign relocation tied to a federal undertaking is handled through Section 106 consultation and the binding MOA or PA, which assigns the mitigation work and its funding. Outdoor-advertising signs follow a separate reimbursement system that is generally 75% federal, with a narrow 100% exception for certain pre-January 4, 1975 relocations and additional rules for illegal signs. The executed funding, ownership, effect and mitigation documents determine the bill in the specific project.
