Employee or Subcontractor? How to Classify Construction Workers

Construction worker classification depends on the law and the real working relationship—not simply a subcontract, Form 1099, payment by the job, or ownership of tools.

A construction worker is not an independent contractor just because a contract calls them a subcontractor, they receive a Form 1099, or they bring their own tools. Classification depends on the actual working relationship, the law being applied, and the jurisdiction. Federal tax, federal wage-and-hour, and state or local rules can use different tests, so there is no single label or checklist that settles every case.

For a real construction relationship, start by identifying the legal question—such as tax withholding or overtime—and then examine how the work is actually organized. A written subcontract and the parties’ stated intentions are relevant evidence, but neither overrides what happens on the job.

First identify which law’s classification test applies

“Subcontractor” is a common construction-business term, but legal tests generally ask whether the worker is an employee or an independent contractor under a particular law. The answer can differ depending on whether the issue is federal employment tax, minimum wage and overtime under the Fair Labor Standards Act (FLSA), or a state or local law.

The Internal Revenue Service (IRS) uses common-law principles to decide employment-tax status. The U.S. Department of Labor (DOL) uses an economic-realities analysis for FLSA wage-and-hour rights. State and local laws may apply separate tests, including ABC tests or construction-specific provisions. A conclusion under one framework does not automatically decide the others.

  • State or local question: Which jurisdiction’s rules apply, and does it use a different or broader standard? Check the law governing the work and any applicable exception.

Because the title alone does not specify a state, locality, worker, or legal dispute, this guide gives a general U.S. overview rather than a classification determination for a particular person.

How the IRS evaluates construction workers for federal tax purposes

For employment-tax purposes, the IRS asks whether the business has the right to control what will be done and how it will be done. The inquiry looks at the entire relationship, including the parties’ actual practices. No one fact—such as a contract term, payment method, or ownership of tools—settles the result.

Behavioral control: who decides how the job gets done?

Look at whether the hiring business directs the details of the work, not merely whether it specifies the finished result. Relevant facts may include instructions about when, where, and how to work; training on the required methods; and whether the business supervises day-to-day performance. Detailed directions and ongoing training can support employee status, while genuine discretion over the methods can support the presence of an independent business. The whole arrangement still matters.

Construction work often involves coordination among trades and rules for a safe, orderly site. A schedule or site requirement should be considered in context: it may reflect coordination, or it may be part of close control over the worker’s methods and daily work. The label attached to a requirement does not decide its significance.

Financial control: is there a real business investment and chance of profit or loss?

Consider the worker’s investment, unreimbursed expenses, how services are offered to customers, how payment is calculated, and whether the worker can affect profit or loss through managerial choices. A defined bid, control over costs, and the ability to make business decisions can be relevant. Payment by the hour, by the day, or by the job is evidence to consider—not an automatic classification rule.

Tools are not a shortcut. The IRS notes that people in construction may spend thousands of dollars on tools and equipment and still be employees. Tool ownership matters only in the context of the worker’s broader investment and business activity: whether the worker bears meaningful costs, operates an independent business, offers services to the market, and has an opportunity to affect profit or loss.

Type of relationship: what do the agreement and actual dealings show?

The IRS may consider written terms, benefits, the expected duration of the relationship, whether the work is ongoing, and whether the worker’s services are a key part of the business. A written subcontract can help describe the arrangement, but its wording is not conclusive if the parties operate differently in practice. Calling someone a contractor, issuing a Form 1099, or omitting employee benefits does not by itself establish independent-contractor status.

How the FLSA looks at economic reality

For FLSA purposes, the DOL asks whether the worker is economically dependent on the potential employer for work or is in business for themself. Its 2024 regulation identifies six factors. The analysis considers the total circumstances; it is not a point system, and no single factor has predetermined weight.

  1. Opportunity for profit or loss based on managerial skill. Can the worker make meaningful decisions—such as negotiating work, managing costs, or choosing and coordinating a crew—that affect the business’s profit or loss? Merely working more hours or doing a job faster is not necessarily the same as exercising managerial skill.
  2. Investments by the worker and the potential employer. Compare investments in context, including their nature and whether they support an independent business. Owning some tools does not answer the question on its own.
  3. Permanence of the relationship. Is the relationship ongoing or indefinite, or is it genuinely limited to a defined project or period? A project-based arrangement is one fact, not a guaranteed contractor result.
  4. Nature and degree of control. Examine control over work, scheduling, supervision, and other relevant aspects of the relationship. DOL guidance says control exercised solely to comply with a specific applicable regulation does not weigh toward employee status under its 2024 analysis. That does not mean every safety rule or site requirement has the same significance; assess why it exists and how it is applied.
  5. Whether the work is integral to the potential employer’s business. Ask how the worker’s services relate to the business’s central work. The fact that a task is important to a construction project is not, by itself, a complete classification test.
  6. Skill and initiative. Consider whether the worker brings specialized skill together with business-like initiative, rather than relying only on technical ability to perform assigned work.

These factors should be considered together. Do not count how many appear to favor one side and treat the tally as a result.

What the federal rule’s current status means

As of October 12, 2026, DOL materials describe the 2024 rule as subject to litigation. The rule remains in effect for private litigation, while the Wage and Hour Division says it will not apply that analysis in investigations for specified matters and instead follows earlier enforcement guidance. DOL announced a proposed rule on February 26, 2026, to rescind the 2024 rule and replace it with a different analysis. A proposal is not a final rule.

This status is time-sensitive. Anyone making a current FLSA decision should check DOL’s latest materials and consider which analysis applies to the specific proceeding. The FLSA framework also does not determine status under other federal laws or state and local standards.

State rules may change the answer: California as an example

California illustrates why location matters. Its official guidance describes a presumption of employee status unless the hiring entity satisfies all three parts of the ABC test for laws where that test applies:

  1. The worker is free from the hiring entity’s control and direction in performing the work, both under the contract and in fact.
  2. The work is outside the usual course of the hiring entity’s business.
  3. The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed.

All three conditions must be met where the ABC test governs. California also identifies statutory exceptions, including certain construction-subcontract situations subject to conditions. An exception is not automatic merely because the parties use a subcontract; the applicable statutory provision and facts matter. California’s test should not be applied nationwide.

Other states and localities may use different standards, exceptions, or definitions. Identify where the work is performed and which law governs before relying on a federal conclusion or a rule from another state.

Evidence area Questions that may point toward employment Questions that may support an independent business
Schedule, methods, supervision Does the business set the worker’s schedule, give detailed instructions, train the worker in its methods, or supervise the day-to-day process? Does the worker decide how to perform the scope, organize the work, and exercise meaningful discretion over methods?
Investment and expenses Does the worker rely on the business for materials, equipment, and other operating support, with little meaningful exposure to costs? Does the worker make business investments, bear unreimbursed expenses, and manage costs in ways that can affect the result?
Pricing and profit or loss Is compensation essentially fixed for time worked, with little opportunity to influence earnings through business decisions? Does the worker bid or negotiate a scope, manage expenses, and have a meaningful chance of profit or loss through managerial skill?
Permanence and customers Is the relationship ongoing or indefinite, with the worker closely tied to one business? Is the engagement limited to a defined scope, and does the worker operate an established business serving or seeking other customers?
Connection to the business Is the work a continuing, central part of the hiring business’s operations? Does the worker run a distinct business that provides a defined service to the hiring entity as one customer?
Skill and initiative Does the worker mainly carry out assigned tasks without independent business initiative? Does the worker combine specialized skill with initiative in running an independent trade or business?
Applicable law Does a governing law presume employee status or require several conditions for contractor treatment? Does the relevant law permit independent-contractor status on the facts, and are any statutory requirements satisfied?

Interpret the evidence under each relevant legal test rather than treating the table as a universal checklist. For example, whether work is integral to a business is expressly one of the DOL’s FLSA factors, while the IRS groups its inquiry around behavioral control, financial control, and the type of relationship.

Construction examples: how the facts can point in different directions

A carpenter working under close direction

Imagine a carpenter who follows the general contractor’s detailed instructions, works on its schedule, uses company materials, performs continuing core work, and cannot take other clients. Those facts may point toward employee status under more than one framework. They are not enough to classify the carpenter without examining the complete arrangement, the law at issue, and the jurisdiction.

A specialist business hired for a defined scope

Now consider a specialist subcontracting business that bids a defined scope, controls its methods and crew, supplies substantial equipment, bears a chance of profit or loss, serves multiple customers, and operates an established business. Those facts may support independent-business status. No one of them—including the equipment, multiple customers, or written subcontract—settles the result by itself.

Jobsite safety and coordination

A general contractor may set site rules to comply with a specific applicable regulation, coordinate trades, or direct the detailed way a worker performs tasks. Those are not necessarily equivalent forms of control. Under the DOL’s 2024 guidance, control solely for regulatory compliance does not weigh toward employment; the reason for a rule and how the relationship functions should be assessed under the applicable test.

A practical process for reviewing a worker’s classification

  1. Write down the legal question. Specify whether you are evaluating federal employment taxes, FLSA minimum wage or overtime, or a state or local requirement. A single conclusion may not answer all of them.
  2. Identify the governing location and law. Determine where the work is performed and which federal, state, and local rules apply. Look for a state-specific test, presumption, or construction-related statutory exception.
  3. Describe what actually happens. Record who sets schedules, selects methods, gives instructions, supplies materials and equipment, supervises work, handles costs, negotiates scope and price, and decides whether the worker can serve other customers. Compare practice with the written agreement.
  4. Assess the full relationship under each test. For IRS tax purposes, organize the evidence under behavioral control, financial control, and type of relationship. For FLSA purposes, assess the six economic-realities factors and current agency posture. Apply any separate state or local test independently.
  5. Keep the explanation tied to evidence. Note facts supporting each possible classification and why they matter under the particular law. Do not rely on a factor count or on a label, tax form, payment method, or tools alone.
  6. Get advice for unresolved legal questions. A worker or business may ask the IRS for a federal employment-tax determination using Form SS-8 when federal tax status is unclear. That process does not decide FLSA wage-and-hour status or state-law classification; those issues require review under their own rules.

Why classification matters

For federal tax purposes, employers generally withhold income tax and the employee share of Social Security and Medicare taxes for employees, pay the matching employer share, and may owe unemployment tax. The IRS’s employment-tax framework is therefore not just a choice of contract terminology.

For workers covered by the FLSA, employee status can bring minimum-wage and overtime protections. Misclassification can leave an employee without applicable wage protections or tax withholding, among other legal consequences. The precise rights and obligations depend on coverage, the law involved, and the facts; this guide does not determine whether a particular worker is covered or owed a specific amount.

Common classification mistakes to avoid

  • Relying on a contract label. An agreement calling someone a subcontractor or independent contractor cannot override a working relationship that points the other way.
  • Treating a Form 1099 as proof. The form reflects how payments were reported; it does not decide whether the worker meets the legal test.
  • Assuming tools settle the issue. Construction workers may own expensive equipment and still be employees. Consider the worker’s full investment and business activity.
  • Assuming job-based pay makes someone a contractor. Payment method is one fact among many, not a substitute for the relevant legal analysis.
  • Using one test for every purpose. IRS tax treatment, FLSA rights, and state or local requirements do not necessarily align.
  • Counting factors instead of evaluating them. Both federal frameworks require attention to the overall circumstances, not a mechanical score.
  • Assuming a construction exception applies automatically. State exceptions can be limited and conditional; confirm the specific law and requirements.
