Nevada rules require approval for an individual sewage disposal system before a permit can issue for a structure that needs one, and Elko County’s homeowner guide says dwelling applications must include a septic construction permit from Nevada State Health. Site suitability, the required plan, and the local review process should be confirmed early—before fixing the house, well, driveway, or utilities in place.
What permits do I need for a septic system in Elko County?
The state rule sets the sequence: under Nevada Administrative Code §444.784, approval to construct, alter, or extend an individual sewage disposal system must be obtained before a building permit may be issued for a structure requiring that system. Elko County’s Homeowner Permitting Guide likewise directs dwelling applicants to include a septic construction permit from Nevada State Health with their submittal.
For residential septic approvals, the Nevada Division of Environmental Protection explains that authority rests with local health authorities or county building departments, not NDEP’s commercial OSDS permitting program. Its program page does not identify Elko’s residential application office, so use the county guide’s Nevada Health contact and confirm the current application route directly before filing.

How do I know if a property can support a septic system?
A parcel needs enough suitable space for the proposed system and its reserve absorption area while accommodating wells, watercourses, buildings, paving, utilities, and access. Soil and site conditions—including soil characteristics, depth to groundwater and bedrock, and percolation results—inform the design. A parcel that looks open on a map may still have competing constraints once these features and required system components are located.
Do not rely on setback figures borrowed from another county or state. The reviewed state rule specifies the information needed for the application, but it is not a complete Elko County residential setback chart. Confirm distances and site-specific requirements with the authority reviewing the application and the qualified professional preparing the design.

Ask about soil evaluation before choosing a test
NDEP’s technical-guidance index describes WTS-25 as suggested supporting data from an onsite soil evaluation, prepared under qualified supervision, that can be used instead of a percolation test for an OSDS construction, alteration, or expansion. That guidance is presented within NDEP’s commercial program; it does not establish that Elko accepts WTS-25 as an alternative for residential individual systems. Ask the current residential authority which test or evaluation it accepts and what qualifications it requires of the person conducting it.
What belongs on a septic site plan?
NAC §444.784 requires an application with applicant details, the property’s legal description and assessor’s parcel number, and a plot plan. The plan and accompanying materials give reviewers the information to assess the proposed layout against neighboring uses and site conditions. The rule calls for the following:

- Nearby wells and sewage systems; note vacant neighboring lots. Show watercourses within 500 feet, well locations and depths, water source, and distance to public sewer.
- Percolation-test and boring locations, along with proposed system components and their dimensions, including tank capacity, trench dimensions, and trench spacing.
- Underground utilities, structures, and paved areas; bedroom count; and the maximum slope over the absorption area.
- A reserve absorption area at least as large as the primary absorption area.
Include soil characteristics, depth to the water table and bedrock, percolation results, and design specifications with the plot plan. The exact parcel-specific format and any additional local submittal items should be confirmed with the reviewing authority.
Protect the reserve area
The reserve is not leftover space for a future shed, driveway, or other use that could interfere with the approved design. Keep it available and free of buildings, pavement, and uses that could compromise its function. Considering the primary and reserve areas together at the outset helps avoid committing the most workable part of the parcel to another use.

Which septic system type should I plan for?
Nevada’s OSDS program covers standard septic systems as well as alternative or experimental systems that use treatment units and absorption areas. The available sources do not establish which design Elko County will accept for a particular property, or compare local options. A design should follow parcel conditions and the reviewing authority’s requirements rather than assuming a particular system is available or suitable.
When discussing options with a qualified designer, compare the site constraints each can address, treatment approach, required footprint, operation and maintenance needs, and permit conditions. Confirm that the option is accepted for residential use at the parcel before basing construction plans on it.

What are common septic installation and operating problems?
NAC §444.784 identifies conditions that constitute system failure. These are useful warning signs, not evidence of how often failures occur in Elko County:
- Sewage on the ground.
- Sewage backing up into a building because the soil absorbs effluent too slowly.
- Leakage from a septic, dosing, holding, or collection tank or system.
- Effluent contaminating groundwater or surface water.
- Failure to comply with permit requirements.
Site planning and construction details matter because absorption performance depends on soil and the design, while wells and watercourses are important receptors to protect. Build to the approved design and permit. If a listed failure condition occurs, contact an appropriately qualified septic professional and the relevant health authority; do not treat sewage on the ground or a backup as a routine nuisance.
Confirm local details before committing to construction
The state requirements and county guide establish the broad approval sequence and plan content, but they do not provide a complete Elko-specific residential checklist. Before finalizing the dwelling layout or scheduling work, confirm the residential permit office, current application and design forms, accepted site-testing method, applicable parcel distances, fees, inspection hold points, and scheduling process with Nevada Health Authority and Elko County Community Development.
