Drainage depends on the site and whether the wall retains soil. Approval is not one single check: planning permission, building-regulations approval and Party Wall Act notice are separate questions. The answer changes with the wall’s height, construction, ground, location and intended use. A freestanding garden wall is not the same design problem as a wall holding back a bank or carrying a heavy gate.
Start by identifying what kind of wall you are building
“Boundary wall” describes a location, not a single type of structure. Before choosing a foundation or asking whether permission is needed, work out what the wall will do and where it will sit. The most important distinction is whether it is freestanding or retaining soil.

| Wall or site condition | Why it changes the decision | Practical next step |
|---|---|---|
| Freestanding garden wall on relatively ordinary ground | It is not holding back soil, but it still needs to be safely designed and built. Height, thickness and ground conditions matter. | Check the official garden-wall guidance and the applicable local approval rules. |
| Wall retaining higher ground | It must address soil pressure and water as well as its own weight. The government garden-wall guide expressly excludes retaining walls from its general advice. | Ask a competent wall designer or structural engineer to assess the wall and site, including drainage. |
| Wall on a slope or poor ground, or near trees or drains | Ground and nearby features may affect stability and foundation design. | Get site-specific advice rather than relying on a generic depth or detail. |
| Wall with piers, a heavy gate or other added load | The government guide identifies piers and heavy gates as cases outside its ordinary garden-wall advice. | Have the design and support assessed for the actual loading. |
| Wall on, astride or close to a shared boundary | Party-wall notice may be relevant independently of planning and building regulations. | Check the Party Wall Act procedure before starting covered work. |
The Department for Communities and Local Government’s 2013 circular on the safe design, construction and maintenance of freestanding boundary and retaining walls followed a fatal wall-collapse incident. It supports taking wall safety seriously; it does not establish a universal design or foundation size.
Do boundary walls need foundations?
A wall needs support designed for its height, thickness, construction, ground and loads. But the phrase “boundary wall” is not enough to calculate foundation depth or width. The official garden-wall safety guidance identifies inadequate or damaged foundations as possible causes of a leaning wall. It offers guidance for some ordinary garden walls, but tells readers to seek expert advice when a wall is outside that guidance or retains soil, has piers or supports heavy gates.

That means a figure taken from an unrelated plan, a product description or a neighbour’s wall should not be treated as a universal minimum. Two walls that look alike above ground can sit on different ground, have different loads or perform different jobs. A retaining wall also has a different structural demand from a freestanding wall because it must resist the ground it holds back.
When professional design is the prudent choice
- The wall will retain soil or sit beside a change in ground level.
- The site is sloping, has poor or uncertain ground, or has nearby trees or drains that could affect the design.
- The wall is higher than the ordinary-wall guidance covers, or incorporates piers, a heavy gate or another significant load.
- The wall is close to a neighbouring structure and excavation could affect its foundations.
- You cannot establish what supports an existing wall that is leaning or otherwise appears unsafe.
For these cases, ask a competent designer or structural engineer to assess the actual site and proposed wall. Do not start by choosing a foundation dimension and trying to make the site fit it.
Does a boundary wall need drainage?
There is no universal drainage detail for every boundary wall. Drainage matters particularly when a wall retains ground or when water movement affects the site, but the government sources do not prescribe a standard perforated pipe, gravel layer, outlet or spacing for all walls. A particular product or generic drawing cannot be assumed to solve the drainage problem.

For a retaining wall, water and drainage should be assessed as part of the site-specific design. Surface-water arrangements may also be affected by national sustainable-drainage standards, Approved Document H and local drainage or planning policies. Those documents concern drainage requirements; they do not provide a wall-specific construction section.
Questions to settle before construction
- Does the wall retain soil, and where will water move in relation to it?
- What surface-water requirements or local drainage policies apply to the property?
- Does the design need a drainage component, and if so, what component, outlet and maintenance access does the site allow?
- Could the proposed route or discharge affect neighbouring land or another drainage arrangement?
Do not assume that water can simply be directed onto a neighbour’s property or that a land-drain pipe is always required. The sources establish drainage as a design consideration, not a single approved product or outlet arrangement. Follow the site-specific design and local requirements.
Which approvals or notices might apply?
Check planning permission, building regulations and Party Wall Act notice separately. They are different processes, administered under different rules, and one does not replace another.

| Check | What it concerns | What the available guidance says |
|---|---|---|
| Planning permission | Whether the proposed wall’s location, height or circumstances require planning consent. | Sutton Council’s local guidance says permission is usually needed for a wall, fence or gate higher than 1 metre next to a public road, or higher than 2 metres elsewhere. |
| Building-regulations approval | Whether the work falls within building-regulations requirements. | Sutton says approval is not needed to put up a boundary fence, wall or gate, while emphasizing that it still must be safely built. This is local guidance, not a blanket rule for every structure or jurisdiction. |
| Party Wall Act notice | Specified building work at or on a shared boundary, on a party structure, or excavation near a neighbour’s foundations. | GOV.UK guidance for England and Wales describes situations where notice is required. This process is separate from planning permission and building-regulations approval. |
Planning permission: check the local rule, not just the height
The Sutton thresholds are an example from one local authority in England, not a UK-wide rule. Sutton says planning permission is usually needed above 1 metre next to a public road or above 2 metres elsewhere. It also notes an exception for replacing or taking down an existing wall, subject to possible conservation-area restrictions.

Check the wall’s exact position and height, whether the site is in a conservation area, whether listed-building controls are relevant and whether other site circumstances alter the answer. Do not treat Sutton’s thresholds as a guarantee that a wall of the same height is permitted elsewhere.
Building regulations: “no approval” is not “no safety duties”
Sutton’s guidance says building-regulations approval is not needed to put up a boundary fence, wall or gate. The same guidance stresses safe construction. Because this is a local-authority statement, do not stretch it into a national conclusion covering every retaining structure, a wall attached to a building or every UK jurisdiction. The government safety guidance separately warns that retaining walls and other cases outside ordinary garden-wall advice need expert consideration.

Party Wall Act: notice can apply even if other approvals do not
GOV.UK’s overview of the Party Wall etc. Act 1996 says notice is required for specified work including building on or at the boundary of two properties, work on an existing party wall or party structure, and digging near and below a neighbour’s foundation level. Its guidance covers England and Wales; it notes that Scotland has different rules.
Whether notice is needed depends on the proposed work and its relationship to the boundary, existing party structures and neighbouring foundations. If any of those may be involved, read the official guidance and establish the applicable procedure before excavation or construction. Do not assume that planning permission or a building-control answer settles the party-wall question.

- Define the wall’s function. Establish whether it is freestanding or retaining soil, and identify piers, gates or other loads.
- Check the site. Note the ground level on both sides, slopes, ground uncertainty, nearby trees and drains, and the position of neighbouring structures and foundations.
- Get a design where the simple guidance does not fit. For a retaining wall, an unusually high wall, poor or sloping ground, piers, heavy gates or uncertain support, have a competent professional assess the site rather than guessing foundation dimensions.
- Assess drainage with the design. Consider how water moves at the site and check relevant local drainage and planning requirements. Use drainage details only when specified for the actual conditions.
- Ask the local planning authority about planning controls. Confirm the applicable height threshold and any conservation-area, listed-building or other site-specific restrictions.
- Check building-regulations requirements separately. Treat Sutton’s statement as a local example, not a substitute for checking the rules that apply to your property and structure.
- Check Party Wall Act notice before work. This is especially important if building at the boundary, altering a party structure or excavating near and below a neighbour’s foundation level.
If the wall is already built, inspect it for warning signs
The government guide Your garden walls: better to be safe recommends periodic inspection. It discusses crumbling brickwork or mortar, leaning, nearby trees and insecure tops as signs that deserve attention. It also gives recommended maximum lean figures for certain wall thicknesses and advises expert help when those limits are exceeded. Those lean figures are inspection guidance for existing walls, not a foundation specification for a new one.

If a wall is leaning, crumbling or has an insecure top, do not treat a surface repair as proof that the underlying problem has been resolved. The guide identifies foundation failure among possible causes of lean and recommends checking foundations where a dangerous lean exists. If the wall retains soil or its support is uncertain, seek professional assessment before deciding on repairs.
The safety and construction guidance cited here is England government material dating from 2013. Sutton’s approval guidance is an England local-authority example. The Party Wall Act overview applies to England and Wales and distinguishes Scotland; drainage standards are general drainage guidance, not a boundary-wall design. Confirm current local requirements and obtain competent site-specific advice before construction.
