A work-related injury generally points to workers’ compensation; an off-the-job illness or injury may fit New York disability benefits instead. The New York State Department of Labor (DOL) decides every UI claim individually.
Choose the program by identifying what caused your income to stop: lack of work, a workplace injury, or a non-work-related disability. The programs have different eligibility rules and generally cannot pay for the same period.

What each New York benefit is designed to cover
“Worker benefits” is not one program. Construction workers may encounter three separate systems, administered under different rules. The event that caused the lost income is the starting point for deciding where to file.

Unemployment insurance
New York DOL describes UI as “temporary income for eligible workers who lose their jobs through no fault of their own” on its Apply for Unemployment Benefits page. UI is for a worker who can accept work now, not for a person whose medical condition prevents work. A claim requires an initial application and weekly certifications while the claim is active.
Workers’ compensation
Workers’ compensation addresses the medical and wage consequences of an injury or illness connected to the job. A construction worker who is unable to work because of a job-site injury should pursue the workers’ compensation process rather than treating UI as an injury benefit. If the worker later becomes medically able and available for other work, UI may be possible under the rules described below.
New York disability benefits
Disability benefits cover a qualifying injury or illness that did not arise from work. They are separate from UI and are not a substitute for workers’ compensation when the condition is work-related. A person cannot receive UI and disability benefits for the same period.

When a construction project or season ends
New York expressly identifies the end of temporary or seasonal employment as a situation that may qualify for UI. A project completion, winter shutdown or other scheduled end does not guarantee payment, but it is a reason to file when the other requirements are met. The DOL reviews the separation, wage history and ongoing availability for work.
That is different from voluntarily quitting or being discharged for misconduct. The DOL FAQ lists separations that may qualify and reasons that may disqualify; the result depends on the facts of the individual claim. Do not describe a project ending as a resignation, and do not assume a discharge automatically qualifies or disqualifies you.

If you worked in New York during the prior 18 months, DOL says you have the right to file a claim. The agency encourages filing even when you are unsure whether a former employer classified you correctly or whether the separation meets the rule. DOL, not the employer, makes the eligibility determination after receiving the claim and required information.
New York UI eligibility requirements for 2026 claims
For claims filed in 2026, the DOL FAQ states a wage test with three parts. These figures are year-sensitive; the $3,500 amount applies to 2026 claims and increased from $3,400 for claims filed in 2025. Check the current DOL page before relying on the numbers for a later claim year.
| Requirement | What the 2026 DOL FAQ says |
|---|---|
| Calendar quarters | You must have been paid wages in at least two calendar quarters in the base period. |
| High-quarter wages | You must have earned at least $3,500 in one base-period quarter. The high-quarter earnings used in the calculation are subject to a cap. |
| Total wages | Your total base-period wages must be at least 1.5 times your high-quarter wages. |
Meeting the wage test is necessary but not sufficient. You also must have become unemployed through no fault of your own, be ready, willing and able to work, and actively seek work. You must certify each week to receive benefits. A construction occupation, union status, job title or length of one project does not by itself establish eligibility or a benefit amount.
What “able and available” means in practice
You need to be physically and legally able to accept suitable work and available to begin it. A medical restriction that prevents you from working can shift the issue from UI to disability or workers’ compensation, depending on where the injury occurred. If you can no longer perform one specialized construction task but can accept other work, explain your actual restrictions and availability to DOL rather than answering inaccurately.
Active work search and weekly certification
After filing, follow DOL’s instructions for weekly certification online or by telephone. Certification is where you report whether you were ready and able to work, searched for work and had any earnings or other circumstances the agency asks about. Missing a certification or giving an incomplete answer can delay or affect payment. Keep a contemporaneous record of applications, contacts and dates so you can accurately answer any work-search question.

- Your Social Security number.
- An identification number if applicable.
- Your mailing address and telephone number.
- Employer names, addresses and other information for every employer during the prior 18 months, including contractors or subcontractors that paid you.
- Bank information if you choose direct deposit.
- Dates and facts about the project ending, layoff or other separation.
- Details of any workers’ compensation claim or current medical restriction.
Application steps
- Open the New York DOL application page and start a UI claim.
- Enter your identity, contact information and employment history for the prior 18 months.
- Describe accurately how the work ended. If a temporary or seasonal project concluded, say so; do not characterize it as quitting unless that is what happened.
- Provide wage and payment information requested by DOL. If a contractor disputes that you were an employee, still provide the facts and file if you worked in New York during the prior 18 months.
- Select a payment method and submit the claim.
- Complete every weekly certification on the schedule DOL gives you, reporting work, earnings, availability, job-search activity and any workers’ compensation payment.
DOL may request additional documents, statements or medical information. Respond by the deadline shown in the notice. Filing does not promise approval; it starts the agency’s review.
Can you collect UI while receiving workers’ compensation?
Receiving New York workers’ compensation does not automatically bar UI. DOL says a worker may still be eligible if physically able and available to work. This situation commonly arises when a worker is receiving compensation for a prior injury but can perform another job or has returned to work capacity while the original claim continues.
The payments are not automatically available at full value. The combined weekly amount of workers’ compensation and UI cannot exceed the worker’s average weekly wage in the base period, and DOL may reduce the UI payment. You must notify the Telephone Claims Center about the workers’ compensation claim and provide the information DOL requests.
Documents DOL may request
- A copy of the workers’ compensation file.
- A physician’s statement that you are able to work.
- Information about the amount and dates of workers’ compensation payments.
- A clear description of the work you can accept despite any restrictions.
Do not hide the workers’ compensation claim or assume that an employer’s statement settles the issue. DOL makes the determination and may adjust UI after reviewing medical evidence, wage records and availability.

What if the injury or illness happened off the job?
New York disability benefits may replace part of wages lost because of an off-the-job injury or illness that prevents work. The Workers’ Compensation Board’s current guidance states that the benefit is 50% of average weekly wages for the last eight weeks worked, up to a maximum of $170 per week, for no more than 26 weeks in any 52-consecutive-week period.
Those figures describe the disability program, not UI, and they do not promise that every applicant will receive the maximum. Eligibility, medical proof, coverage and the timing of the disability claim still matter.
Disability beginning after unemployment
The Workers’ Compensation Board says that when a person has been unemployed for more than four weeks and is receiving UI when the disability begins, the Special Fund for Disability provides benefits and no waiting period applies. UI and disability benefits cannot be paid for the same period. Report the date your disability began and stop or change UI certification as instructed so the same weeks are not claimed under both programs.
If the condition is work-related, use the workers’ compensation route instead. If it prevents all work, you generally cannot satisfy UI’s ready-and-able requirement during the disabled period.

The Construction Industry Fair Play Act took effect in New York on October 26, 2010. The Workers’ Compensation Board states that a person providing services to a contractor is presumed to be the contractor’s employee for workers’ compensation, disability benefits and Paid Family Leave purposes, subject to the statutory independent-contractor test.

The cited framework has two parts, and the employer must establish all listed criteria for a construction worker to qualify as an independent contractor. This presumption is important when a contractor says a worker was “1099,” self-employed or outside coverage. It concerns coverage and classification under those laws; it does not automatically decide UI eligibility. UI has its own wage, separation and availability analysis.
If a former employer says you were not covered or refuses to provide employment information, preserve contracts, pay records, time sheets, text messages and project dates. File with DOL if you worked in New York during the prior 18 months and explain the facts. DOL and the Workers’ Compensation Board make their own determinations under their respective statutes.
Which route fits common construction situations?
| Situation | First issue to evaluate | Important qualification |
|---|---|---|
| Fixed-term project ends as scheduled | UI may be available because temporary employment ended. | You still need the 2026 wage test, no-fault separation, ability to work and active work search. |
| Seasonal work ends for the off-season | File a UI claim and report the seasonal separation accurately. | DOL decides the claim; seasonal status alone is not approval. |
| Layoff for lack of work | UI may fit if you remain available for work. | Provide the actual layoff reason and continue weekly certifications. |
| Discharge or resignation | Expect a fact-specific separation review. | Quitting and discharge for misconduct can be treated differently from a project ending. |
| Work-related injury prevents work | Workers’ compensation is the injury program. | UI requires ability and availability; do not claim UI for weeks you cannot work. |
| Work-related injury, but medically able to accept other work | Workers’ compensation and UI may both be relevant. | Disclose the claim; combined weekly payments cannot exceed the base-period average weekly wage, and UI may be reduced. |
| Off-the-job illness or injury prevents work | New York disability benefits may fit. | UI and disability benefits cannot cover the same period. |
| Contractor says you were an independent contractor | File and let the agencies determine status. | The Fair Play Act presumption applies to specified programs and does not by itself decide UI. |
Common mistakes and how to avoid them
Waiting for certainty before filing
Workers often delay because a contractor disputes employment status or because they are unsure whether a seasonal ending counts. New York DOL encourages a person who worked in the state during the prior 18 months to file. Submit the claim, answer fact questions precisely and provide documents when requested.
Using the wrong program for a medical condition
UI is not a general injury payment. If you cannot work because of a job injury, pursue workers’ compensation. If the condition is off the job, examine disability benefits. If you are receiving workers’ compensation but can work, disclose it and document your ability to accept work.
Assuming the 2026 wage number is permanent
The $3,500 one-quarter threshold applies to claims filed in 2026; the DOL FAQ identifies $3,400 for 2025 claims. Check the current DOL FAQ for the claim year rather than copying an old number from a form, social-media post or prior application.
Failing to certify or report payments
Weekly certification is required for payment. Report earnings, workers’ compensation, disability payments and changes in availability. Incomplete or contradictory answers can produce a questionnaire, delay or adjustment.
Promising yourself a specific payout
The official material does not provide a construction-worker-specific approval rate, average UI payment or guaranteed duration for a particular project type. Pay history, the base-period calculation, separation facts, work availability and agency findings control the result. Do not rely on occupation alone to estimate approval or amount.
