For construction work covered by federal OSHA, employers must provide or ensure access to personal protective equipment (PPE) that protects against the job’s hazards and properly fits each affected worker. That includes women and anyone whose body shape or size is not accommodated by standard equipment. OSHA’s construction fit rule took effect January 13, 2025, and makes explicit the agency’s existing interpretation of employers’ fit obligations.
What the federal OSHA fit rule requires
Under federal OSHA, PPE must be safely designed for the work and fit the employee who wears it. A correct fit is functional: the equipment must provide the needed protection without being so small or large that it creates a safety or health hazard. Standard sizing is not enough if it does not fit a particular worker.
The requirement is not a mandate for one women-specific kit. PPE should be selected for the hazards of the task and the individual who will use it. Nor does a women’s label or color establish that a product is protective or fits correctly. OSHA’s final rule calls properly fitting PPE “a critical element of an effective occupational safety and health program.” Read OSHA’s 2024 construction PPE final rule.
This is a summary of federal OSHA requirements. State-plan jurisdictions and other countries may have different rules; check the requirements that apply at the worksite.

How employers should select and check PPE
- Identify the hazards. Choose PPE for the exposures that remain after applicable hazard controls are considered. Construction PPE can include head, eye, face, hand, foot, hearing, respiratory, and fall-protection equipment. PPE does not replace other required controls. OSHA’s general construction guidance describes common categories and uses: Personal Protective Equipment.
- Make suitable sizes and models available. If standard equipment does not fit, provide an alternative that does. Consider the worker’s actual size and body shape rather than assuming that a standard or nominally women’s size will work.
- Evaluate fit during the work. Have the employee try the equipment and check whether it stays in place, protects the relevant area, and allows the task to be performed safely. Workers are often best positioned to notice fit problems or interference. Follow manufacturer instructions; if they do not address fit, relevant consensus standards can provide guidance.
- Check compatibility across the full set. A hard hat, eye protection, hearing protection, respirator, harness, gloves, and other items may be worn together. Confirm that one item does not dislodge, block, or undermine another.
- Act on reports of poor fit. Discomfort by itself does not prove an OSHA violation, but it can signal a fit problem. Ill-fitting PPE may fail to protect, interfere with tools, snag in machinery, create a trip hazard, or discourage use. Investigate the specific concern and reassess the fit and equipment.
- Maintain and replace PPE. Keep required equipment adequate, sanitary, and properly maintained. Even if an employee voluntarily supplies their own PPE, the employer remains responsible for ensuring it is adequate and maintained.
Match equipment to the hazard and the worker
Gloves
Choose gloves for the material and task, not simply by size or appearance. OSHA’s construction Quick Card says gloves should fit snugly and gives examples: heavy-duty rubber gloves for concrete work, welding gloves for welding, and insulated gloves and sleeves for electrical hazards. Gloves that are too loose can interfere with work or create an entanglement risk. OSHA Construction PPE Quick Card.
Footwear
OSHA’s Quick Card recommends slip-resistant and puncture-resistant soles for construction footwear and describes safety-toed footwear for crush hazards, such as heavy equipment or falling objects. Assess the actual hazard and the worker’s fit; not every construction role requires the same protection. If the task calls for it, compare options such as women’s safety-toe work boots by their protective specifications and fit—not the label alone.

Head, eye, and face protection
Select eye or face protection for anticipated exposures such as flying particles, chemical hazards, or electrical hazards. Use hard hats where workers face falling objects, impacts with fixed objects, or electrical contact. Check that each item fits and remains compatible with the other PPE being worn.
Fall-protection harnesses
Harness fit is individual. OSHA’s final rule discusses harness sizing and configurations intended to fit varied body shapes and says employers and distributors should work with employees to identify a harness that fits properly and protects against the hazards at hand. Check the actual harness and its instructions, and follow the fall-protection requirements applicable to the work; a generic size label is not a substitute for evaluating fit.

Hearing protection
In high-noise areas, such as work involving chainsaws or heavy equipment, OSHA’s Quick Card points to earplugs or earmuffs. Select equipment for the exposure and confirm it can be worn correctly alongside other PPE.
Who pays for required construction PPE?
Under 29 CFR 1926.95(d), employers generally must provide required PPE at no cost and pay for replacement, unless an employee lost or intentionally damaged it. The construction standard has specific exceptions, including non-specialty safety-toe footwear and non-specialty prescription safety eyewear when the employer permits off-site wear. The footwear exception can apply to steel-toe shoes or boots; it does not mean employers may shift the cost of every type of required protective footwear to workers. A practical comparison checklist
When more than one item could address a hazard, compare each option against the same criteria:
- Does it protect against the identified hazard and suit the task?
- Can the individual worker obtain a proper fit in the actual model?
- Does it interfere with tools or movement, or create snag, trip, or other new hazards?
- Does it work with the other PPE worn at the same time?
- Do the manufacturer’s directions and relevant standards support its fit and use?
- Who is responsible for the cost under the applicable OSHA rule?
What OSHA’s figures do—and do not—show
OSHA’s 2024 regulatory analysis estimated $5,475,450 in potential one-time costs and $279,065 in annual recurring costs associated with clarifying the rule. The estimates included employer time to become familiar with the revision and, for affected employers not already providing properly fitting PPE, locating or acquiring alternative sizes. They are estimates of regulatory costs, not measures of injuries or the prevalence of poor fit among women construction workers.

OSHA also reported 51 citations for improperly fitting PPE in general industry and shipyards from 1994 through 2021. That figure is not a count of construction citations and does not measure women’s injury rates. The rule and its analysis are available in OSHA’s final rule.
