Construction Contractor Risks and Considerations on U.S. Nuclear Projects

Nuclear construction contractors must understand how safety significance, the licensee’s QA program, procurement controls, oversight, and site access shape their project obligations.

For a construction contractor on a U.S. Nuclear Regulatory Commission (NRC)-regulated commercial nuclear power project, the central risks are performing work that affects safety-related functions without the required quality controls, failing to produce reliable evidence of compliant work, unclear responsibility for oversight and corrective action, and workers not being ready for site access. The project’s licensing basis, licensee quality assurance (QA) program, contract, work scope, and site procedures determine the obligations that apply to a particular contractor; NRC rules provide a regulatory floor, not a substitute for those controlling documents.

What risks should a nuclear construction contractor assess first?

Start by identifying what the work does and what project controls govern it. A contractor should not assume that all site work has identical QA requirements—or that work outside a safety-related classification has no project-specific controls. The licensee’s QA program and the contract determine how applicable requirements flow down to the contractor’s scope.

Procurement and material control Purchased material, equipment, and services can introduce quality issues if requirements, supplier controls, traceability, or records are inadequate. Which suppliers are approved for this scope? What procurement requirements, receipt inspections, identification, and records are required?
Construction processes and personnel competence Some processes may require qualified personnel, approved procedures, and controlled records under the project QA program. Which processes require qualification or procedure approval? How are qualifications and procedure revisions verified?
Inspection, testing, and records Required checks must be performed and documented so the work can be reviewed and its acceptance supported. What are the inspection, witness, or hold points? Which records must be retained and turned over?
Nonconformances and corrective action Uncontrolled deficiencies can undermine the acceptability of work and indicate that controls are not working. How must a deficiency be reported, evaluated, and dispositioned? Who can approve rework or use-as-is, and what follow-up is required?
Site access and workforce readiness Access authorization requirements apply to contractors, subcontractors, and vendors providing services to a licensee; site processes can affect workforce availability and schedule. What screening and onboarding lead time applies? Which workers require unescorted access?
Other project obligations Occupational safety, environmental, labor, insurance, radiation protection, and emergency-response responsibilities depend on the site, jurisdiction, hazards, and contract. Which regulator and jurisdiction govern, and which party is assigned each obligation in the contract and site procedures?

What QA requirements may apply to nuclear construction contractors?

The NRC defines QA as “all planned and systematic actions that are necessary to provide adequate confidence that a structure, system, or component will perform satisfactorily in service.” Its QA framework treats quality as a managed process supported by procedures, records, inspections, corrective actions, and audits—not simply a quality manual or a final inspection.

Appendix B to 10 CFR Part 50 must be implemented for activities affecting safety-related plant equipment. Licensees develop and control their QA programs, and their program descriptions explain how applicable Appendix B requirements will be met. The contractor’s specific duties depend on how the licensee’s program and the contract apply those requirements to its work. Obtain the current approved procedures and applicable contract documents before mobilization; do not infer the required controls from a general description of nuclear QA.

Build traceability into procurement and execution

NRC QA inspection examples include findings involving purchased material, equipment, and services, procurement-document control, and special processes. In practice, the project QA program may require controls such as supplier qualification, approved procurement requirements, material identification and traceability, receipt inspection, qualified personnel, controlled procedures, inspection points, and retained records. Confirm which controls apply to the scope rather than assuming one universal checklist.

Before ordering or installing an item, establish how its requirements will be communicated to suppliers and how the contractor will demonstrate that the delivered item and work meet them. During field execution, workers and supervisors need the current approved procedure, a clear method for recording required checks, and a defined route for raising questions or unexpected conditions. Records should be produced as work occurs, in the form and under the controls required by the project.

Plan for deficiencies before they occur

Agree on the project process for identifying, reporting, evaluating, and dispositioning nonconforming work or material. The process should make clear who may authorize rework or a use-as-is disposition, what approvals and records are required, and when corrective action or an effectiveness check is called for. A field crew should not make an informal change to a controlled requirement or conceal a discrepancy by completing additional work before it is evaluated.

How should contractors organize responsibility and oversight?

Quality controls need owners with enough authority to identify problems and get them resolved. Define responsibilities at each interface: licensee to prime, prime to subcontractor, and contractor to supplier. The project should establish who approves procedures and changes, who performs or witnesses inspections, who controls records, who evaluates deficiencies, and how concerns are escalated.

The NRC says it reviews and inspects QA programs for suppliers, architect-engineering firms, laboratories, and licensees, and inspects to determine whether licensees and their contractors are meeting agency requirements. Contractor status does not place work beyond regulatory oversight. The NRC’s inspection focus includes whether QA plans, instructions, and procedures for safety-related activities have been implemented—not merely whether documents exist.

Management oversight should therefore check that controls operate in the field, detect recurring problems, and ensure corrective actions address their causes. In its summary of NUREG-1055, the NRC attributed major historical quality-related problems to failures or inability of some utility managements to implement effective systems for controlling project aspects. That is a historical conclusion, not evidence of the current frequency of such problems, but it illustrates why management systems and oversight matter alongside individual workmanship.

What does NQA-1 mean for a contractor?

NQA-1 is a quality assurance standard for nuclear facility applications, but a contractor should not assume that a particular edition automatically governs its project. NRC Regulatory Guide 1.28, Revision 6, endorses NQA-1-2017, NQA-1-2019, and NQA-1-2022 for QA implementation during design and construction of nuclear power plants and fuel reprocessing plants, with exceptions and clarifications. The project’s licensing basis, licensee QA program, contract, and applicable procedures determine what is adopted and how it applies to a contractor’s scope.

Ask the licensee or prime contractor which standard, edition, exceptions, clarifications, and implementing procedures are incorporated into the work. Treat the standard as a reference within the project’s governing QA framework, not as a replacement for that framework or the contract.

How can site access affect contractor staffing and schedule?

NRC access authorization requirements apply to contractors, subcontractors, and vendors providing services to a licensee. A contractor should identify which roles require site access, what level of access each worker needs, and which site-specific screening and onboarding steps must be completed. The applicable site process determines eligibility and lead time; do not promise a mobilization date based only on an assumed standard timeline.

Coordinate access readiness with the work sequence and staffing plan. Confirm local requirements with the licensee or site access organization, and account for the possibility that a worker who is qualified for the construction task may not yet be authorized for the required site access.

Which obligations require project-specific confirmation?

The NRC-focused requirements discussed here concern U.S. commercial nuclear power projects under NRC regulation. “Nuclear project” can also mean a Department of Energy facility, a fuel-cycle facility, a non-power application, or a project in another country; the governing regulator and requirements may differ.

For any specific job, confirm the controlling requirements in the licensee’s QA program, prime contract, subcontract, site procedures, licensing basis, and applicable regulator rules. Occupational safety, radiological work controls, environmental permits, labor compliance, insurance, contractual remedies, and emergency response cannot be allocated reliably without knowing the project location, type, scope, and governing documents. Establish which party owns each requirement before work begins rather than treating it as a universal contractor obligation.
