Construction Contractor Compliance Checklist for Hiring and Paying Workers

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: Before you hire or pay anyone on a construction job, document the real working relationship, apply the correct employee or independent-contractor tax treatment, record hours and wages accurately, and check whether the contract or funding source triggers prevailing-wage and certified-payroll duties. A 1099, a contract label, an hourly rate, or a job title does not decide every legal question.

This is a U.S. federal-baseline checklist for contractors, owners, payroll staff, and hiring managers. State, local, workers’ compensation, licensing, collective-bargaining, and project-specific rules can add obligations; those requirements must be checked for the places where the work occurs and for each contract.

1. Classify the real relationship before choosing how to pay

Classification is the first control point because different laws use different tests. The Internal Revenue Service (IRS) evaluates federal tax status through behavioral control, financial control, and the type of relationship. The U.S. Department of Labor (DOL) uses an economic-realities analysis for Fair Labor Standards Act (FLSA) coverage. A person can be treated one way for one legal regime and differently for another, so do not collapse the tests into a single checklist.

The IRS warns: “It is critical that business owners correctly determine whether the individuals providing services are employees or independent contractors.” It also states: “There is no ‘magic’ or set number of factors that ‘makes’ the worker an employee or an independent contractor and no one factor stands alone in making this determination.”

Use the IRS tax test for federal payroll treatment

Document facts in three groups:

  • Behavioral control: who directs what work is done, how it is done, when it is done, where it is done, and what tools or instructions are used.
  • Financial control: who supplies equipment and materials, pays business expenses, makes investments, bears unreimbursed costs, sets prices, and can realize a profit or loss.
  • Relationship facts: written contracts, benefits, permanence, termination rights, and whether the service is a key part of the company’s regular business.

No single factor is decisive. Keep a written explanation of the facts considered, the conclusion reached, and the date of review. Revisit the determination when the scope, supervision, tools, payment method, or length of the engagement changes.

Use the DOL economic-realities analysis for FLSA questions

For minimum-wage and overtime coverage, the DOL’s March 2024 fact sheet identifies factors including the worker’s opportunity for profit or loss, investments by the worker and business, permanence, the nature and degree of control, whether the work is integral to the business, and the skill and initiative involved. The central question is whether the worker is economically dependent on the business or is operating an independent business.

The DOL announced a proposed classification rulemaking on February 26, 2026. Proposed rules can change before final action, so check the DOL’s current FLSA classification guidance and the effective rule when you make a decision.

Construction examples are illustrations, not shortcuts

IRS Publication 15-A for 2026 contrasts a supervised worker paid wages while the company supplies materials and insurance with an established roofing business that bids a fixed job, carries its own insurance, hires its own workers, and accepts responsibility for repairs. Those examples show how facts can point in different directions; they do not replace an analysis of your actual arrangement.

Evidence to collect for every worker

  • Scope of work and who controls the means and methods.
  • Work schedule, job-site rules, safety direction, and supervision.
  • Tools, equipment, vehicles, materials, insurance, and licenses supplied by each party.
  • Whether the worker advertises, bids, serves multiple clients, hires helpers, and can accept or decline projects.
  • How the worker is paid, who bears rework risk, and whether the relationship is ongoing.
  • Written agreement, invoices or timesheets, and records supporting the conclusion.

2. Set up tax treatment to match the determination

Once the facts support a classification, configure payroll and accounts payable accordingly. Do not select a payment method first and then build a classification rationale around it.

Issue Employee Independent contractor
Federal income-tax withholding Generally withheld from wages using the employee’s Form W-4 and payroll procedures. Generally no employer withholding from ordinary business payments, subject to exceptions.
Social Security and Medicare Employee share is withheld; the employer generally pays a matching share. Payments generally do not use employee withholding or an employer matching payroll-tax process; the worker handles self-employment obligations.
Federal unemployment tax Employer generally pays applicable unemployment tax on covered wages. Ordinary contractor payments generally are not treated as employee wages for this purpose.
Payment records Payroll register, wage statements, tax deposits, and employee time and wage records. Contract, invoices, payment ledger, and information-return records when required.
Misclassification exposure Failure to withhold or pay employer taxes can create liability. Calling an employee a contractor can create back taxes, interest, penalties, wage claims, and project-payment problems.

Obtain the tax forms and identification information required for the classification you reached, and reconcile payroll or contractor ledgers to the actual work performed. A contract clause saying “independent contractor” cannot override facts that show employee status.

3. Complete the hiring file before the first shift

Verify employment authorization

DOL construction guidance identifies Form I-9 completion and maintenance as a hiring responsibility. Use the current U.S. Citizenship and Immigration Services instructions, current form edition, document lists, completion deadlines, and retention rules. Keep I-9 records in a secure system separate from routine personnel files when practical, and restrict access to staff with a legitimate need.

Collect role and pay information

  • Legal name, address, contact information, and emergency contact according to your business process.
  • Job title, expected duties, primary work location, supervisor, start date, and anticipated duration.
  • Pay rate or salary basis, pay frequency, and any agreed allowances or deductions.
  • Expected schedule, workweek definition, travel time policy, and project or cost-code assignment.
  • Required licenses, certifications, training, and site-safety orientation.

Do not use a job title such as “subcontractor,” “foreman,” or “laborer” as proof of legal status. The duties and working conditions matter.

4. Build an accurate time-and-wage record system

For covered nonexempt employees, the FLSA requires records of hours worked and wages earned. A construction system should capture each workday, the defined workweek, regular and overtime hours, pay rate, job classification where relevant, gross wages, deductions, and payment date. Keep records in a form that can be produced to an investigator, auditor, project owner, or payroll reviewer.

Define the workweek and overtime rule

An FLSA workweek is a fixed, recurring period of seven consecutive 24-hour days. It stands alone; hours cannot be averaged across two weeks. Covered nonexempt employees generally receive one and one-half times their regular rate for hours over 40 in that workweek. State law, a collective-bargaining agreement, or a contract can require more protective treatment.

Capture construction-specific time data

  • Record start and stop times or total daily hours, including time spent on required job-site activities.
  • Separate hours by project, cost code, and labor classification when a contract or wage determination requires it.
  • Record travel or training time when legally compensable under the applicable rule.
  • Require the worker and an authorized reviewer to correct and approve edits, preserving an audit trail.
  • Reconcile time records to payroll before payment and investigate missing, rounded, or duplicate entries.

Paper construction worker time cards or timesheet forms can be a practical input tool, but the form itself does not establish compliance. Electronic or paper records must still be complete, accurate, retained for the required period, and supplemented when project rules demand additional information.

5. Check the contract and funding source for prevailing-wage duties

Before mobilization, read the prime contract, subcontracts, wage determinations, funding provisions, and incorporated labor standards. Covered Davis-Bacon and Related Acts work generally requires contractors to pay laborers and mechanics who work directly at the site at least the applicable locally prevailing wage, including listed fringe benefits.

These duties can apply even when a contractor calls a person an independent contractor or pays on Form 1099. The payment label does not remove covered work from prevailing-wage or certified-payroll requirements. Determine which labor classifications match the actual duties, what base wage and fringe amounts apply, and whether fringe benefits are provided in cash, through a bona fide plan, or by an allowed combination.

Questions to answer before the first covered pay period

  • Is the project federally funded, federally assisted, or otherwise covered by a state or local prevailing-wage law?
  • Which wage determination and edition are incorporated into the contract?
  • Which classifications apply to each task, and is a conformance process needed for an unlisted classification?
  • Are fringe benefits required, and how must their value be documented?
  • Does the contract require weekly payroll, a particular electronic system, signatures, supporting statements, or owner review?
  • Which subcontractors must submit payroll and compliance certifications to you?

6. Operate a certified-payroll workflow when required

For covered Bipartisan Infrastructure Law construction projects subject to Davis-Bacon requirements, DOL’s FAQ says certified payroll is due weekly within seven days of the regular pay date for that weekly period. That deadline is specific to the covered projects described in the FAQ; do not apply it automatically to every private job or public contract. Confirm the individual contract and funding recipient’s instructions.

Weekly process

  1. Close the workweek: collect approved daily hours by project and labor classification.
  2. Apply the wage determination: verify base wage, fringe benefit treatment, and any approved conformance.
  3. Calculate pay: include regular and overtime calculations, deductions, and fringe values required by the contract.
  4. Review exceptions: investigate missing signatures, classification changes, unusually low hours, unexplained overtime, or subcontractor discrepancies.
  5. Certify accuracy: the person signing should know that the wage, classification, and hours information is accurate.
  6. Submit and retain: send the report through the required channel by the contract deadline and retain the submission confirmation and supporting records.

Keep a separate calendar for each project’s regular pay date and submission deadline. A late or inaccurate certified payroll can delay payment and trigger corrective-pay obligations even when ordinary payroll was processed.

7. Add state, local, and project-specific checks

Federal rules are only the baseline. Depending on the worker’s location and the job, additional requirements may cover state minimum wage and overtime, paid sick leave, meal and rest periods, final-pay timing, wage notices, workers’ compensation, unemployment registration, business licensing, contractor licensing, local tax, background-check restrictions, heat or safety rules, and public-works reporting.

For each work location, identify the responsible agency, registration deadlines, required notices, record-retention periods, and payroll-tax accounts. Then read the project’s labor, insurance, bonding, site-access, drug-and-alcohol, and subcontracting clauses. If workers cross state lines or work at multiple sites, map which rule applies to each work period rather than assuming the home-office rule controls.

8. Compare workers and projects using the same decision grid

Decision axis Questions to document
Legal test Which regime is being applied—IRS tax, FLSA, prevailing wage, state law, or contract labor standards—and what facts support the result?
Control and economics Who directs the work, supplies tools, bears costs, can profit or lose, serves other clients, and carries rework risk?
Payment and reporting Will the person run through payroll or accounts payable, and what tax forms, withholding, or information returns follow?
Hours and wages Is the worker covered by minimum-wage and overtime rules, and what daily, weekly, classification, and pay records are required?
Project coverage Is the job private, state or local public, federally assisted, or covered by Davis-Bacon or another wage law?
Location Which state, county, city, or tribal jurisdiction adds registration, wage, leave, insurance, or reporting duties?

This grid is for consistent documentation, not for ranking one worker type as preferable. Reperform it when a worker moves from a private project to public work or when the relationship changes.

9. Common failure modes and corrective actions

“We issued a 1099, so the person is a contractor.”

Why it fails: tax and wage laws examine facts, not the form used to pay. Correction: complete the IRS and DOL analyses, document the evidence, and adjust payroll or payment treatment before the next pay cycle.

“The contract says independent contractor, so no overtime is due.”

Why it fails: a label cannot defeat an economic-realities analysis. Correction: evaluate control, investment, permanence, profit or loss, integration, and skill under the applicable rule.

Why it fails: a blank, altered, or incomplete form is not an accurate record. Correction: define the workweek, capture all compensable time, preserve approvals and edits, and reconcile records to payroll.

“Public-work rules apply only to employees.”

Why it fails: covered Davis-Bacon duties can reach laborers and mechanics performing covered site work even when paid on Form 1099. Correction: review the wage determination and certified-payroll clauses for every person performing covered work.

Why it fails: state and local rules vary and may be more protective. Correction: maintain a jurisdiction matrix and obtain advice for unusual arrangements, multi-state work, or union and public contracts.

10. Resolve uncertain cases before they become payroll liabilities

When facts remain genuinely mixed, do not guess based on the cheapest or simplest payment method. The IRS allows either the business or the worker to submit Form SS-8 for a federal employment-tax determination. The process can take time, so continue documenting the relationship and obtain qualified legal or tax advice when multiple regimes, public funding, or substantial back-pay exposure is involved.

An SS-8 determination addresses federal employment-tax status; it does not automatically decide FLSA coverage, state-law status, workers’ compensation, or a project’s prevailing-wage obligations. Analyze each applicable regime separately.

11. A practical pre-hire and pre-pay checklist

  1. Identify the worker, role, job location, project, and funding source.
  2. Document behavioral control, financial control, and relationship facts for the IRS analysis.
  3. Document economic-realities factors for FLSA purposes where coverage is relevant.
  4. Choose payroll or contractor-payment treatment only after the analysis.
  5. Complete Form I-9 and required hiring records for employees using current USCIS instructions.
  6. Set the workweek, pay frequency, rates, classifications, and approval chain.
  7. Implement daily time capture and a process for corrections and approvals.
  8. Check federal, state, and local wage, tax, insurance, licensing, and notice requirements.
  9. Read the project’s wage determination, fringe, certified-payroll, and subcontract clauses.
  10. Calendar payroll dates, certified-payroll deadlines, tax deposits, and record-retention dates.
  11. Review exceptions each pay period and escalate uncertain classifications or missing records.

Use this checklist as a control system, not as a one-time onboarding form. The relationship, project, and governing rules can change during a build, and the records should show when and why your treatment changed.
