Construction Contract Records Checklist for Proving Claims in Arbitration

There is no universal document list that proves every construction claim. Build a claim-specific file that connects the executed contract and required notices to a dated project chronology, schedule or technical impact, and traceable cost calculation. The contract, governing law, arbitration rules, and any public-agency procedure determine which records, deadlines, recipients, and remedies apply.

Start with the claim elements, not a generic document pile

An arbitrator must be able to follow a logical chain: what the contract required, what happened, whether the other party was responsible, whether the required notice and procedure were followed, what work or time was affected, and how the amount claimed was calculated. Organize records around that chain instead of submitting an undifferentiated project archive.

Claim or issue Records usually needed What they should establish
Unpaid work or changed scope Contract scope, drawings, specifications, change request, direction, pricing, quantity records, payment applications and responses The original obligation, the change, authorization or refusal, performed work, valuation and payment status
Delay or time extension Baseline and updated schedules, delay notices, daily reports, meeting minutes, access records, correspondence and schedule analysis The event, affected activities, responsibility, critical-path effect, mitigation and compensable time
Disruption or lost productivity Planned-versus-actual labor and equipment records, work-area and sequencing records, instructions, photographs and expert analysis The difference between planned and actual working conditions and the resulting loss
Defect, damage or backcharge Inspection and test records, nonconformance notices, photographs, correction directions, invoices and proof of payment The condition, contractual responsibility, causation, corrective work and reasonable cost
Payment, retainage or setoff dispute Applications, pay estimates, ledgers, waivers, invoices, payment evidence, quantity measurements and backcharge records Amounts earned, paid, withheld, disputed and the contractual basis for each adjustment

The categories overlap, but each document should have a defined job. A document that cannot be tied to a contract provision, event, witness, schedule activity or cost line may still provide context, yet it should not be treated as proof of an element by itself.

1. Assemble the contract and procedure file

Make one controlled file containing the agreement that governs the disputed work and every document incorporated into it. Preserve the version that was executed or otherwise became effective, not merely the latest file found in a project folder.

  • Amendments, change orders, construction change directives, field instructions and written authorizations, each with its effective date and version.
  • The arbitration clause or separate agreement to arbitrate, together with the institutional rules and any procedural order issued in the case.
  • Claim, answer, counterclaim, scheduling orders, terms of reference and other pleadings or procedural filings that define the issues.
  • A requirements sheet listing notice deadlines, required recipients, permitted delivery methods, substantiation requirements, administrative-exhaustion steps and retention duties.

Read the notice and dispute clauses before deciding what belongs in the claim file. Some contracts require notice within a stated period, a particular form, delivery to named officials, or a detailed cost and time submission. Missing a procedural step can affect entitlement even when the underlying event occurred.

What a filing checklist can and cannot tell you

The Construction Industry Arbitration Commission (CIAC) in the Philippines publishes a filing checklist that includes party information, a factual narration, issues, arbitrator nominees, the construction contract, the agreement to arbitrate and documents establishing the circumstances of the case. For government contracts, it also identifies communications with the highest authority used to exhaust administrative remedies. Those are CIAC requirements and examples, not a universal checklist for private arbitration or another country.

2. Create a contemporaneous chronology

A chronology should let a neutral reader reconstruct the project without relying on memory. Use records made by people with direct knowledge and identify the date of the event separately from the date a later summary was prepared.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Daily reports and site diaries, including labor, equipment, work locations, quantities, access conditions, instructions, disputes and resolutions.
  • Weekly and monthly progress reports, statements of working days and other recurring status reports.
  • Dated photographs and videos showing site conditions, progress, restricted access, damage, corrective work or the status of affected activities. Keep original files and useful date and context information.
  • Distributed meeting minutes, coordination notes, field instructions, requests for information and responses, submittals, inspections, tests and nonconformance or correction records.
  • Letters, email, text messages, notices and attachments, together with evidence of delivery and receipt.
  • Weather, utility, permit, traffic, geotechnical or other external-condition records when they bear on the event or its impact.

For every important entry, record who created it, when it was created, what the author personally observed and where the original is stored. Keep later spreadsheets, witness summaries and claim narratives distinguishable from records made at the time.

Daily records and direct knowledge

TxDOT describes its daily work report as the official record of what occurs on a project and advises recording work performed, critical-path work, events, directions, disputes, resolutions, correspondence and issues from someone with direct knowledge, at or near the event. Its manual specifies recording no later than the third day after an event. That timing is TxDOT guidance, not a universal rule of arbitration admissibility; use the timing and content requirements in your own contract and procedure.

3. Prove notice, change and entitlement

Separate the evidence showing that an event occurred from the evidence showing that the contract makes the other party responsible for its consequences. Keep the complete notice sequence, including responses and silence where the contract assigns significance to non-response.

  • Initial notice of the event or dispute, supplemental notices and the final claim submission.
  • The contract provision invoked, date of occurrence or discovery, recipient, delivery method, delivery proof and response for each notice.
  • Change-order requests, proposed pricing, owner or engineer responses, approved orders and construction change directives.
  • Records showing whether work proceeded before written authorization, who directed it and whether an objection or reservation was made.
  • RFIs, field directions, inspection records and meeting evidence showing the condition, interpretation, instruction or refusal at issue.
  • Mitigation, resequencing, alternative-work and recovery records, plus the other party’s participation or response.
  • For public work, administrative claims, agency determinations, dispute-board materials and exhaustion communications required by the applicable process.

The American Bar Association’s delay guidance emphasizes following contractual written-notice and substantiation requirements. Caltrans provides a California public-works example using an initial, supplemental and full-and-final Potential Claim Record process; its manual warns that failure to follow the specified process may waive a potential claim and bar arbitration under that system. Do not import Caltrans forms, deadlines or waiver consequences into a different contract.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Build the schedule and delay record

A delay claim generally requires more than a notice saying that the project was late. The proof must connect a defined event to affected work, responsibility and a measurable time consequence.

  • Original or baseline schedule and every accepted or relied-upon update, retaining native files where available.
  • Version dates, actual start and finish dates, activity logic, constraints, calendars, resource assumptions and records explaining changes in assumptions.
  • Delay notices and logs identifying the event, affected activities, responsible party, mitigation, resequencing and alleged critical-path effect.
  • Time-impact or other schedule analysis appropriate to the contract, facts and issues, with assumptions and source data identified.
  • Evidence of acceleration or disruption, including labor and equipment hours, productivity records, work-area access, stacking, out-of-sequence work and recovery efforts.

The ABA identifies schedules and updates, daily reports, minutes, RFIs, change documents, delay logs, payroll and time-and-material records, diaries, inspections and cost invoices as common support for delay or acceleration claims. Select an analysis method that fits the available contemporaneous data and the procedure governing the arbitration; an attractive graphic cannot cure missing source records.

What to test before claiming delay

  1. Identify the contractual milestone or completion obligation and the approved baseline against which performance will be measured.
  2. Pinpoint the event with dated records and show when it began, ended or changed.
  3. Trace the event to activities in the schedule, including logic and constraints that existed before the event.
  4. Address concurrent events, contractor-controlled delay and mitigation or resequencing shown in the project records.
  5. Quantify the resulting days only after the schedule and responsibility analysis is complete.

5. Support quantum and payment

Every claimed amount should be reproducible from source documents. A summary spreadsheet is a guide to the evidence, not a substitute for it.

  • Calculations stating the amount, period, assumptions, exclusions, credits and the source document supporting each line item.
  • Separate schedules for direct cost, extended or general conditions, disruption or productivity effects, interest and other categories permitted by the claim and governing law.
  • Cost-audit or expert reports when appropriate, with underlying schedules and records available for verification.

GAR’s construction-arbitration guide identifies invoices, receipts, proof of payment and other cost documentation as evidence of actual costs and notes that an expert may present or assess sums in a large dispute. Caltrans project-record examples include cost analyses, calculations, payment materials and, in specified cases, independent audit review. Neither source establishes that every listed category is recoverable; the contract and governing law control damages.

Make the calculation auditable

Use stable document identifiers and a source column in every cost schedule. Explain allocation methods for shared labor, equipment, supervision and overhead. Flag estimates, allowances, credits and unsupported items instead of presenting them as incurred costs. If a subcontractor’s number is included, retain its invoice, underlying time or quantity records and proof of payment where relevant.

6. Preserve electronic evidence early

Electronic evidence is vulnerable to deletion, format changes and loss of context. Preservation should cover the original message or file, attachments, relevant metadata and the location from which it was collected.

  1. Identify custodians, devices, project platforms, email accounts, messaging channels, schedule systems and accounting repositories likely to contain relevant records.
  2. Issue a documented hold or preservation instruction when a dispute is reasonably anticipated, consistent with applicable law and company policy.
  3. Collect originals or forensic-quality copies where practicable, retaining native schedules, spreadsheets, photographs, videos and email attachments.
  4. Record collection dates, custodians, tools, transformations, file hashes or other controls used to show that the working copy matches the source.
  5. Separate privileged, confidential, personal and commercially sensitive material for review before production.
  6. Follow the arbitration procedural order for search, format, redaction, confidentiality and proportionality.

The American Arbitration Association’s construction materials describe 2025 e-discovery considerations addressing digital preservation, document production, sensitive or privileged information and proportionality. Those considerations do not replace the order in your case. Obtain qualified legal or e-discovery support when the volume, privilege issues or integrity questions exceed ordinary project administration.

7. Turn the file into a claim-by-claim proof map

Prepare a short proof map for every claim and counterclaim. This exposes missing evidence before witnesses are prepared and prevents one exhibit from being assigned more work than it can perform.

  1. Contract element: cite the provision, drawing, specification or incorporated requirement.
  2. Event chronology: list dated facts and the contemporaneous records for each fact.
  3. Entitlement: identify notices, responses, authorizations, reservations and any required administrative step.
  4. Impact: connect the event to schedule, technical, quantity, quality or productivity consequences.
  5. Quantum: show the calculation, period, assumptions, exclusions and source records.
  6. Witnesses: name the custodian, project participant or expert and the facts that person can establish from personal knowledge or analysis.
  7. Exhibits: assign descriptive titles, dates, authors, exhibit numbers and links to the controlled source files.
  8. Gaps: list missing records, likely custodians and requests to the opposing party or third parties.

The ABA’s prehearing guidance recommends presenting claims in separate sections and identifying the facts, exhibits and witnesses supporting each fact. GAR distinguishes documentary, fact-witness and expert evidence. Keep those categories clear: an expert can analyze a schedule or cost model, but the underlying project record still has to support the assumptions.

8. Reconcile competing records

Projects often contain conflicting daily reports, schedule versions, minutes and cost summaries. Do not simply choose the document favorable to your position. Assess each record using the same practical questions:

  • Was it created during or soon after the event, or only after the dispute arose?
  • Is the author identified and able to explain the facts from direct knowledge?
  • Does the date, version history and delivery evidence establish authenticity and sequence?
  • Does the record connect to a contract provision, schedule activity, quantity or cost line?
  • Can its statement be tested against independent records such as access logs, payroll, deliveries, photographs or payment data?
  • Was it preserved, searchable, exportable and produced with appropriate access controls?

Explain discrepancies in the proof map. A corrected report should remain available alongside the original, with the reason and date of correction documented. Do not overwrite an earlier schedule or replace an original photograph with an edited copy.

9. Jurisdiction-specific procedures require separate checks

Three published sources illustrate why a contract-specific review is essential:

Source Illustration Limit
CIAC Filing materials can include party information, facts and issues, arbitrator nominations, the contract, arbitration agreement and case documents; government matters may require exhaustion communications. Applies to the CIAC process and relevant Philippine proceedings, not every arbitration.
Caltrans California public-works administration uses an initial, supplemental and full-and-final Potential Claim Record process with specified consequences for noncompliance. Deadlines, forms and waiver consequences are tied to that system and contract.
TxDOT Daily work reports are treated as the official project record, with direct-knowledge and near-event recording guidance, including a three-day timing instruction. Recordkeeping guidance for TxDOT projects, not a universal evidentiary rule.

Before relying on any agency checklist, confirm the governing law, contract edition, project delivery method, dispute clause, public-works statute and arbitration rules. If the contract requires administrative review before arbitration, preserve the decision and every communication proving that step was completed.

10. Common recordkeeping failures and repairs

Only a post-dispute narrative exists

Repair: collect contemporaneous reports, messages, access records, photographs, schedules and payment data; identify which facts remain based only on recollection.

The notice was sent but delivery cannot be proved

Repair: preserve transmission logs, receipts, portal confirmations, attachments and the recipient’s response. Record the contract clause and deadline in the notice register.

There are multiple schedule versions with no explanation

Repair: retain native files, label each version by date and status, and document who issued it, what changed and which version was relied upon for the analysis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The claim spreadsheet has no source trail

Repair: add document identifiers, cost codes, quantities, dates, credits and a source link or file path for every material line.

Electronic files were collected without context

Repair: document custodians, collection method, metadata, transformations and access restrictions; preserve the original and a controlled working copy.

One witness is expected to prove everything

Repair: assign contract, event, schedule, cost and records-custody facts to the people with the appropriate knowledge, then use experts for analysis that requires specialized methods.

Final pre-hearing control list

  • The executed agreement and every incorporated document are identified and version-controlled.
  • Notice, change, authorization and administrative-exhaustion requirements are mapped to dates and delivery proof.
  • The chronology uses attributable, dated records and distinguishes originals from later summaries.
  • Schedule analysis identifies affected activities, responsibility, critical-path effect, concurrency and mitigation.
  • Each cost line has source records, assumptions, exclusions, credits and payment support.
  • Electronic material is preserved with attachments and relevant metadata, and privilege and confidentiality review is planned.
  • Every claim has an exhibit-and-witness map, and missing records have identified custodians and requests.
  • Exhibit descriptions are specific enough for an arbitrator to locate the document quickly.

The strongest arbitration file is not the largest one. It is a controlled, claim-by-claim record in which the contract, notice, event, impact, calculation and witness evidence point to one another without unexplained gaps.
