Possibly—but never assume a road buffer is either an automatic building ban or a simple setback. The answer depends on the legally measured road reserve, clear zone or planning buffer, the road’s classification, and which authority controls it. You may need both ordinary planning or building approval and separate consent from the road authority. A narrow exemption may be available, but it normally requires every stated condition and sometimes a certified safety assessment.
Before designing around a guessed distance, confirm the controlling map, measurement method and responsible authority in writing. Then have a survey place the proposed building, access and associated works against the actual restricted area.

What a road-buffer rule actually controls
“Road buffer,” “setback,” “road reserve” and “clear zone” are related terms, but they are not interchangeable. A road reserve is land legally set aside for a road and associated infrastructure. A clear zone is a safety area beside a road intended to provide recovery space for vehicles. A planning buffer or overlay can impose requirements on buildings, works, subdivision or land uses near a corridor. A setback is the measured distance a rule requires between a road-related boundary and a building or other work.

The controlling document may be a planning scheme, overlay, reservation, road-management law, permit notice or road-design standard. One rule may measure from the title boundary; another may measure from the edge of pavement, centreline or mapped reserve. Eaves, decks, retaining walls, driveways, drainage and temporary works may be treated differently from the main wall line. Ask the authority to identify the measurement line before you rely on a plan.

A restriction is not automatically a total ban
Authorities can sometimes approve work near a corridor subject to setback, access, sight-distance, drainage, construction-stage and operational conditions. Queensland guidance says structures or activities should be outside the defined clear zone, but recognises limited exceptions supported by an RPEQ-certified clear-zone risk assessment. That is a risk-based exception, not a general right to build inside the zone.
There is no universal distance
The required distance varies with the jurisdiction, road category, planning instrument, terrain and proposed use. Victorian buffer schedules can specify requirements for use, subdivision, buildings and works, application information and decision guidelines. A local schedule may permit one use after assessment while prohibiting another. A number quoted by a neighbour or found in an old plan is not evidence that the same number applies to your lot.
First identify the rule and the authority
The road’s classification often determines who must consent and which process applies. A local council may coordinate an ordinary local road, while a state transport department controls a classified highway or arterial. NSW’s section 138 process, for example, assigns the consent authority according to whether the road is classified. The title, planning map and road-authority map should therefore be checked together.

Questions to put in writing
- Is the land, proposed footprint or access inside a road reserve, clear zone, reservation or mapped planning buffer?
- What feature is the setback measured from, and which parts of the proposal count toward the measurement?
- What is the road classification and the coordinating road authority?
- Does the proposal require road-reserve consent, a driveway or access permit, a planning permit, a building permit, or referrals to other agencies?
- Are construction activities such as scaffolding, cranes, material storage, drainage connections or temporary fencing also controlled?
Request a written pre-application response rather than relying on a verbal indication that the site “looks far enough back.” Keep the response with the application because a later reviewer may interpret the map or road category differently.
When an exemption may apply
Exemptions are narrow. They remove only the approval or prohibition covered by the relevant instrument; they do not automatically remove planning, building, environmental, access, utility or workplace-safety duties.

Work demonstrably outside the controlled area
If a current survey shows the entire proposal outside the legally measured reserve, clear zone or mapped buffer, road-corridor consent may not be triggered. Ordinary planning and building rules still apply, and the authority may measure associated works—such as a driveway, retaining wall or drainage outlet—separately. Show the measured line and dimensions on the site plan instead of simply stating that the building is “outside the setback.”
Minor ancillary activities
Some notices or exemption provisions cover narrowly defined activities such as a mailbox, certain signs or mowing. The Queensland exemption guidance gives examples but makes clear that all conditions must be met and that other legislative requirements remain. An item that is exempt in one road category or location may require consent in another, so obtain the applicable notice and check each condition.

Queensland describes limited clear-zone exemptions where an RPEQ-certified risk assessment follows the department’s Road planning and design manual (RPDM), Volume 3, Part 6—Guide to Road Design. The assessment must address the actual site and proposal. Certification does not guarantee approval; it supplies evidence for the authority’s decision and may lead to conditions or redesign.
Existing-use or overlay-specific relief
A planning overlay may allow a compatible existing use or require an assessment rather than impose an absolute prohibition. The relief comes from the local schedule and its decision guidelines. Confirm whether the rule applies to a new building, an extension, a change of use, subdivision or only certain works. “Existing” status can be lost or limited if the proposal substantially changes the site.
Approvals that can stack
Road-authority consent is not a substitute for other approvals. A project can be acceptable to the road authority yet still fail a planning or building requirement, or the reverse.

| Approval or referral | Why it may be needed | Typical trigger |
|---|---|---|
| Planning approval | Controls land use, overlays, reservations, setbacks and decision guidelines. | Building, extending, changing use or subdividing land within a mapped control. |
| Building approval | Checks structural and building-code compliance. | A building or structural work, even when road consent is not required. |
| Road-authority consent | Protects road operation, safety, access and infrastructure. | Works in a road reserve or controlled corridor; in NSW, the applicable section 138 pathway depends on road classification. |
| Driveway or access approval | Controls vehicle entry, sight distance, drainage and conflicts with traffic. | New, relocated or modified access to the road. |
| Environmental, vegetation or utility approval | Protects regulated vegetation, waterways and underground or overhead services. | Clearing, excavation, drainage, service relocation or work in a protected area. |
| Construction safety controls | Protects workers and road users during the build. | Traffic management, plant, temporary occupation or materials near the road. |
Read every permit condition before mobilising. A consent to use part of a road reserve may limit hours, require traffic control, impose restoration obligations or prohibit storage even if the permanent building is approved.
Documents authorities commonly require
Submit a coordinated package. Incomplete drawings often cause a request for information or a referral to another authority.
| Document | What it should show |
|---|---|
| Current title and deposited plan | Legal boundaries, reservations, covenants and registered interests. |
| Easement and right-of-way information | Access, drainage and service rights that may constrain the footprint. |
| Boundary or feature survey | Road reserve, road edge, relevant centreline, levels, existing structures, services and the proposed building envelope. |
| Scaled site and architectural drawings | Setbacks to the legally measured line, eaves, decks, retaining walls, access, drainage and construction limits. |
| Structural engineering plans | Foundations, retaining structures and other elements that could affect the corridor or public safety. |
| Road-classification confirmation | The category of road and the responsible coordinating authority. |
| Traffic, sight-distance, clear-zone or transport-noise assessment | Safety and operational effects where the authority or planning instrument requires them. |
| Certified engineering or risk assessment | The professional evidence required by a specific exemption pathway, such as an RPEQ-certified clear-zone assessment in Queensland. |
| Other approval evidence | Planning, building, environmental, vegetation, driveway and utility approvals or applications. |
Make the survey answer the legal question
Tell the surveyor which boundary or line the authority uses. Ask for the road reserve and proposed control line to be labelled, not merely the cadastral boundary. Include dimensions to every projecting element that the rule might count. If the road edge, centreline or reserve boundary is uncertain, ask the authority whether it requires a particular survey datum or additional evidence.
Practical sequence from first enquiry to approval
- Collect the controlling maps and instruments. Ask the planning or building authority for zoning, overlays, reservation details, the relevant schedule and the setback measurement method.
- Confirm the road category. Check the road-classification map and obtain the name of the coordinating road authority. Do not send a classified-road application to a local office without confirming the referral path.
- Commission a site survey. Locate the title boundary, reserve, road edge or centreline used by the rule, existing features, levels and the proposed building envelope.
- Test the whole proposal. Place walls, eaves, decks, retaining walls, driveway geometry, drainage, services and temporary construction areas against the measured control line.
- Request written pre-application advice. Ask for the forms, referrals, drawings, engineering, traffic evidence and assessment criteria. Record whether separate applications are required.
- Redesign before filing if possible. Moving the footprint, changing access or removing a projecting structure may avoid an exemption request and reduce certification burden.
- File planning and building applications. Include the survey and the authority’s written advice so the assessment starts from a common set of facts.
- Apply for road consent separately when required. Attach the same coordinated plans and identify any work inside the reserve or controlled corridor.
- Answer information requests promptly. If an authority asks for a risk, sight-distance or structural assessment, provide the required professional certification rather than an informal explanation.
- Wait for all required consents. Do not excavate, occupy the reserve, install access works or start construction on the assumption that one approval covers the others.
- Control construction against the conditions. Give contractors the approved drawings, traffic requirements, working hours, restoration duties and no-go areas.
How to compare design options
When choosing between a compliant setback, an exemption request and a redesign, compare the proposal on the same six points:
- Measured distance: How close is each element to the legally defined reserve, buffer or clear-zone boundary?
- Authority: Which road classification applies, and how many agencies must sign off?
- Type of work: Is it a building, extension, access work, retaining structure or minor ancillary activity?
- Safety effect: Does it affect sight distance, vehicle recovery space, drainage, roadside infrastructure or traffic operations?
- Evidence burden: Will a survey suffice, or is traffic, structural or certified risk evidence required?
- Approval stack: Are planning, building, environmental, vegetation, driveway or utility approvals also triggered?
A footprint wholly outside the control line is generally the simplest pathway, but it still requires ordinary approvals. A minor exempt item may be possible only if every condition is met. A certified exception can preserve a constrained design, but it adds professional cost, review time and the risk of conditions or refusal. Treat those as different risk profiles, not interchangeable shortcuts.

Common failure modes and fixes
Using a neighbour’s setback
Different road classifications, overlays and historical approvals can produce different outcomes on adjoining lots. Fix: obtain the rule and measurement method for your parcel and have the survey tied to it.
Measuring from the wrong line
Measuring from the asphalt edge when the instrument uses the reserve boundary, or ignoring eaves and decks, can make an apparently compliant plan non-compliant. Fix: label the controlling line and all counted projections on the survey and drawings.
Assuming road consent replaces planning or building approval
Road-reserve permission addresses the road corridor, not the entire development. Fix: use a written approval matrix listing every application, referral and condition.
Treating an exemption as a blanket waiver
An exemption for a mailbox, sign or mowing does not authorise a dwelling, driveway or retaining wall. Fix: quote the exact activity and conditions from the applicable notice and ask whether other approvals remain.
Starting work while an application is pending
Unauthorised occupation or excavation can create enforcement, safety and restoration problems. Fix: mark the controlled area on site and prohibit work there until all required consents are issued.

Jurisdiction notes and current references
New South Wales
For works affecting a public road, the section 138 consent pathway distinguishes classified from unclassified roads and therefore the responsible consent authority. Confirm the classification before preparing the application and ask which drawings and referrals that authority requires.
Queensland
The Department of Transport and Main Roads states: “Any structure or activity must be located outside the ‘clear zone’ as defined in our Road planning and design manual (RPDM) (Volume 3, Part 6—Guide to Road Design).” Limited exceptions may rely on an RPEQ-certified clear-zone risk assessment. Exempt activities remain subject to other legislative requirements.

Victorian buffer schedules can regulate use, subdivision, buildings and works and can set application requirements and decision guidelines. The relevant buffer practice note was published on 15 April 2025. Check the current local schedule because controls and guidance can change.
Transport Victoria
Transport Victoria states: “You must obtain consent from the relevant coordinating road authority if you’re proposing to conduct works within the road reserve unless you are exempt under either the Road Management Act 2004 or the Road Management (Works and Infrastructure) Regulations 2026.” Verify the current permit page and regulation text before filing, because road-management requirements are subject to change.
What a defensible application looks like
An approvable package lets a reviewer answer three questions without guessing: where the legal control lies, what exactly you propose, and why the work will not create an unacceptable safety or operational effect. The survey, drawings and assessments should use the same boundary, scale and terminology. If an exemption is claimed, identify its precise clause or notice, list every condition and provide the evidence that each condition is satisfied.
Because no cross-jurisdiction approval rate or universal setback figure is established, the reliable answer for any particular lot comes from the current local instrument, a site-specific survey and written advice from the responsible authorities—not from a generic distance published for another road.
