Building Permit vs. Occupancy Certificate: What Each Document Means for Homebuyers

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A building permit authorizes specified construction or alteration work. An occupancy certificate—also called a certificate of occupancy, occupancy permit, or another local name—addresses the completed building’s legally recognized use or permission to occupy it. They are not interchangeable. A permit shows that an authority approved defined work to proceed; it does not, by itself, prove that the work was completed, passed every final inspection, or may legally be occupied. An occupancy document generally follows completion checks and identifies the use or occupancy status that the local authority recognizes.

Names, exemptions, stages, inspection requirements, and records vary by location. For a purchase, apply the rule of the authority responsible for the property’s address, not a definition borrowed from another city or country.

The difference in one table

Question Building permit Occupancy certificate or equivalent
What stage does it address? Proposed or authorized construction, alteration, change, or other specified work. The completed building, part of a building, or approved use after the authority’s required completion process.
What does it establish? That an issuing authority authorized the described work under the applicable rules. That the authority has recognized a legal use, occupancy type, or suitability for occupation, subject to local wording and conditions.
What does it not establish by itself? That the work was completed exactly as approved, passed final inspections, or is lawful to occupy. That the buyer owns good title, that every defect has been found, or that all work outside the certificate’s scope is approved.
When is it normally relevant? Before work starts and during construction or alteration. At completion, before occupation where the local law requires it, or when a use or occupancy status changes.
What must a buyer match? Address, building or unit identifier, approved plans, work description, and permit status. Address, covered floors or units, approved use, issue date, final or temporary status, conditions, and validity.

The precise legal effect depends on the issuing jurisdiction. New York City’s Administrative Code defines a permit as “an official document or certificate issued by the commissioner that authorizes performance of specified work or activity.” That is a city-specific definition, but it clearly illustrates the permit’s focus: authorization for identified work.

New York City’s Department of Buildings describes a Certificate of Occupancy (CO) as a document that “states a legal use and/or type of permitted occupancy of a building.” That description is also jurisdiction-specific, yet it captures the practical distinction a buyer needs to keep in mind.

What a building permit proves

Authorization for a defined scope

A permit is tied to a particular proposal: for example, a new structure, an addition, a structural alteration, a conversion, or work affecting fire safety or exits. The permit’s scope may cover only one floor, unit, outbuilding, system, or phase. It does not automatically authorize unrelated work elsewhere on the property.

Approval to proceed, not proof of completion

Issuance normally means the authority accepted the application and supporting plans sufficiently to allow the described work to proceed. Construction may still be incomplete, altered from the approved plans, awaiting inspections, or subject to correction notices. A permit marked issued, approved, or active is therefore different from a file showing final inspection and completion.

What to read on the permit

  • The exact street address and any parcel, building, unit, or floor identifier.
  • The applicant, owner, contractor, architect, engineer, or other responsible parties shown in the record.
  • The work description and approved use, including limits such as “interior alteration” or “addition.”
  • Issue, expiration, renewal, cancellation, or close-out information.
  • Referenced plans, amendments, inspection results, sign-offs, and outstanding violations.

If the home’s current layout or use exceeds the permit description, ask the authority whether separate permits or approvals should exist. Do not treat a permit for a kitchen alteration as evidence that a later basement conversion or additional dwelling unit is approved.

What an occupancy certificate proves

Recognition of a permitted use or occupancy

An occupancy document concerns the building as completed, or a defined completed portion of it. Depending on local law, it may identify residential, commercial, mixed, accessory, or other permitted use; the number or type of occupants; or the part of a building that may be occupied.

Completion evidence can be part of the process

Authorities commonly require a completion notice, documents, scrutiny, and one or more inspections before issuing a final occupancy document. Hyderabad and Delhi procedures, for example, describe post-construction submissions followed by review and inspection. These processes show why possession of an original permit is not the same as completion approval.

Final, temporary, provisional, and conditional status

Read the status exactly as issued. A final document generally indicates that the authority’s final requirements for that scope have been met. A temporary or provisional document may permit occupation while specified items remain unresolved. A certificate can also be limited to part of a building or contain conditions that affect use.

Is an occupancy certificate the same as a building permit?

No. The permit answers, “Was this specified work authorized?” The occupancy document answers, “What completed building or portion may be used or occupied under this authority’s records?” A permit can precede construction by months or years. An occupancy certificate, where required, normally follows completion checks.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The documents may be connected in one file: the occupancy review can compare the finished work with approved plans and permit records. They remain separate functions. A permit alone should not be described to a buyer, lender, insurer, or agent as proof of lawful occupancy unless the local authority expressly says that no additional occupancy document is required for that property.

Why the local rule controls

There is no universal requirement that every existing home have a document called an occupancy certificate. The same term can also carry different consequences in different jurisdictions. Use the authority responsible for the property’s address to determine which record is required, what exemptions apply, and whether an alternative completion document is used.

New York City

New York City says a building may not be legally occupied until the Department of Buildings has issued a Certificate of Occupancy or Temporary Certificate of Occupancy, subject to the department’s stated exceptions and local rules. Its public systems allow buyers to search permit and certificate records by address. Match the certificate’s legal use and covered areas to the home being sold.

New York City temporary certificates

A New York City Temporary Certificate of Occupancy (TCO) may be issued when the department determines that a property is safe to occupy but outstanding issues must be resolved before a final CO can be issued. The department states that a TCO typically expires 90 days after issue and may be renewed when issues remain. That 90-day period is a local procedural rule, not a universal deadline or a statistic about buyer risk.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a TCO, verify the issue and expiration dates, renewal history, conditions, covered floors or units, and the documented path to a final CO. The department advises a TCO holder to consult a registered architect or professional engineer about what is needed for final approval.

Philadelphia

Philadelphia lists certificates of occupancy for new construction, additions, alterations affecting exits or fire ratings, and changes in use or occupancy. It also lists existing one- or two-family homes with unchanged use among situations that do not require a CO. A buyer must therefore check the property’s history and the city’s stated exemption rather than assume that an older house is missing a required certificate.

Victoria, Australia

Victoria’s Building and Plumbing Commission explains that the building permit identifies whether a project needs an occupancy permit or a certificate of final inspection. An occupancy permit confirms that the building surveyor is satisfied the building is suitable for occupation and is needed before occupying a new building when required. For extensions or alterations to existing homes, the commission says a certificate of final inspection is issued instead. The local document may therefore be a final inspection certificate rather than an occupancy permit.

Hyderabad and Delhi, India

Authorities in Hyderabad and Delhi describe post-construction occupancy processes involving completion documents, scrutiny, and site inspection. These examples demonstrate that an occupancy certificate is part of a locally administered completion process, not a universal document that can be inferred from the existence of a building permit or from possession of the property.

Homebuyer due diligence: a practical sequence

  1. Ask for the complete file. Request every issued permit, approved plan or work description, inspection and completion record, and current occupancy, completion, or equivalent document that applies to the property.
  2. Search the official record. Use the building department, planning authority, or other responsible office’s address-based search where available. Compare the public record with the seller’s copies; do not rely solely on an unverified scan.
  3. Confirm identity. Check the street address, parcel or lot number, building and unit identifiers, floor, and any phase or portion of the structure covered by each record.
  4. Compare scope with reality. Walk through the home and compare additions, converted rooms, bedrooms, kitchens, accessory structures, and other material changes with the permit description and approved plans.
  5. Check the approved use. A residential certificate may not authorize a different use, additional dwelling unit, short-term accommodation, business activity, or change in occupant load. Confirm the use shown in the local record.
  6. Read the status and dates. Identify whether each record is issued, pending, expired, renewed, temporary, provisional, conditional, or final. Record any expiration date and unresolved condition.
  7. Trace completion. Look for final inspection results, completion notices, sign-offs, amended plans, and evidence that corrections were closed. An application or initial permit is not a completion record.
  8. Resolve discrepancies before relying on the document. If the address, floor area, use, or work description does not match the property, ask the authority in writing what record or approval is required and what remains open.
  9. Obtain professional advice where the issue is material. A local licensed architect, professional engineer, conveyancer, or property lawyer can interpret plans, inspections, and contract implications according to local practice.
  10. Make the contract reflect the finding. Where permitted by local law and advised by your lawyer, document who must obtain missing approvals, by what date, and what happens if the authority will not issue them.

How to compare the records you receive

Comparison point Questions for the buyer Warning sign
Stage Does this record concern proposed work, work in progress, or a completed building? Only an application or permit is supplied; no completion evidence appears.
Scope Which structure, unit, floor, room, use, or phase is covered? The document covers an addition, but the marketed home includes more unrecorded space.
Status Is it final, temporary, provisional, conditional, expired, or renewed? A temporary or expired document is presented as final.
Authority Which office issued it, under which code, and where can the record be verified? The seller cannot identify the responsible authority or the official file.
Outstanding conditions Are inspections, approvals, corrections, or deviations still open? The record refers to unresolved items without a documented completion path.

Can you move in without an occupancy certificate?

Sometimes, but only if the local rule allows occupation without that document or recognizes another document for the property. In New York City, the Department of Buildings states that legal occupation requires a CO or TCO, subject to its specific exceptions. In Philadelphia, some existing one- or two-family homes with unchanged use are listed as not requiring a CO. In Victoria, the required document depends on whether the project is a new building or an extension or alteration.

Do not infer permission from practical possession, utility connection, a sale contract, or a seller’s statement. Ask the responsible authority which document applies to this address and whether occupation is lawful while an application is pending. If a temporary or provisional document is involved, verify its current validity and conditions before closing or moving in.

Existing homes and recent renovations

Older homes

An older property may predate the current certificate system, fall within an exemption, or have records under a former address, parcel number, or terminology. The absence of a document in an online search is not conclusive until the authority confirms its record history and requirements.

Recent work

Recent additions, structural changes, bedroom conversions, basement work, fire-separation changes, or changes of use deserve separate review. Ask for the permit associated with each project and the final inspection or completion record. A current occupancy document may cover only the original structure or a particular phase.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Unpermitted or altered work

If the finished home differs from approved plans, ask the authority whether a revision, legalization, new permit, inspection, or certificate amendment is available. Do not assume that a later buyer can simply inherit the issue without consequences; the applicable response depends on local law, the type of work, and the authority’s enforcement process.

What to do when records are missing or inconsistent

  • Request a certified or official copy from the issuing authority if the seller has only an informal scan.
  • Ask the authority to confirm whether a certificate was ever issued, whether it has expired, and whether conditions remain open.
  • Have a qualified professional compare the approved plans with the existing building when the discrepancy involves structure, fire safety, exits, or additional floor area.
  • Ask your conveyancer or property lawyer how the issue affects representations, conditions, closing timing, insurance, financing, and resale in that jurisdiction. Those effects are not automatic and must be assessed locally.
  • Keep written responses, file numbers, plans, inspection reports, and explanations with your transaction records.

What these documents do not replace

Building records are one part of due diligence. A permit or occupancy document does not by itself establish ownership or good title, reveal every construction defect, confirm that boundaries are correct, or replace an independent property inspection. Title searches, survey information, environmental checks, insurance review, financing conditions, and a physical inspection address different risks and require their own records or professionals.

Likewise, an occupancy certificate is not a blanket warranty that every feature, appliance, repair, or later alteration is safe. Its scope is limited to the authority’s legal use, completion, and inspection process. Read the covered work and conditions rather than treating the document as a general building-quality guarantee.

Questions to settle before signing

  • What exact work was authorized, and does it match the home as marketed?
  • What document does this jurisdiction require before occupation of this type of property?
  • Is the document final, temporary, provisional, conditional, expired, or renewed?
  • Which floors, units, structures, and uses are covered?
  • Are any inspections, corrections, amended plans, or approvals outstanding?
  • Can the authority’s current record be verified by address or file number?
  • Who will resolve a missing or inconsistent record, and what contractual protection applies?

The practical decision

Match the permit to the work and the occupancy or completion record to the finished use. Verify both against the authority’s current file, then investigate every mismatch before committing to the purchase. Because terminology and exemptions differ, the responsible local building authority—and, where needed, a qualified local professional—is the final source for what the property may legally contain and occupy.
