Can Landlords Legally Place Cameras Inside Rental Properties?

Landlords usually cannot continuously monitor a tenant’s private rental unit. Location, notice, audio, consent and state law determine whether a camera is lawful.

Usually, no—not when a landlord continuously monitors the inside of a tenant’s exclusive rental unit. Bedrooms, bathrooms, living rooms, kitchens, home offices, private garages and other leased spaces generally carry a strong expectation of privacy. A hidden camera, a camera aimed through a window or doorway, or a device recording private conversations can create criminal, civil, lease and housing-law consequences.

There is no single nationwide rule that resolves every case. The result depends on the property’s location, the camera’s position and field of view, notice and consent, audio capability, the type of tenancy, and who can access or share the recordings.

The location is the first and most important question

A landlord’s ownership of a building does not automatically create a right to watch the people living there. Analyze the camera according to the space it captures.

Location Typical risk Why the facts matter
Tenant’s private bedroom, bathroom or apartment Very high The tenant has possession and a strong expectation of privacy. Hidden or continuous monitoring may support voyeurism, intrusion-upon-seclusion, harassment or other claims.
Shared hallway, stairwell, laundry room or lobby Fact-dependent A visible, narrowly aimed security camera may be permissible in some places, but audio, concealment, intrusive angles and tenant-specific monitoring can change the result.
Parking lot, exterior entrance, driveway or gate Often lower, but not automatically lawful The device must not capture private interiors, bathroom windows or other areas where occupants reasonably expect privacy.
Vacant unit during construction or turnover Usually different from an occupied tenancy A camera used temporarily for security or construction should be removed or disabled before the tenant takes possession.

“Outside” is not a complete answer. An exterior camera deliberately aimed through a tenant’s bedroom window may be more intrusive than a visible camera pointed at a parking-lot entrance.

Cameras inside a tenant’s exclusive rental unit

A landlord generally cannot treat an occupied apartment or leased house as a permanently monitored workplace or security zone merely because the landlord owns the property. This applies beyond bedrooms and bathrooms. Living rooms, kitchens, entryways, offices, private basements and other areas leased for the tenant’s exclusive use may also be private.

The risk is especially serious when the device:

  • is concealed in a smoke detector, outlet, clock, vent or other fixture;
  • records people sleeping, dressing, bathing or engaging in intimate activity;
  • captures visitors, children, medical care or private conversations;
  • tracks a tenant’s movements continuously;
  • has a microphone;
  • is used to enforce lifestyle rules, intimidate a tenant or retaliate against complaints; or
  • can be accessed by the landlord, staff, contractors, vendors or the public without meaningful controls.

A disclosed camera inside a private unit is not automatically lawful. Notice, consent and legal authorization are different things. A clause stating that “security cameras may be used on the property” may not clearly authorize a camera inside a leased bedroom, and a tenant’s supposed agreement may be challenged if the disclosure was hidden, vague or presented as a condition with no realistic alternative.

Shared spaces are different, but not automatically safe

Common areas such as shared hallways, stairwells, entrances, mailrooms, laundry rooms and parking facilities receive a different analysis. A visible camera serving a defined security purpose may be allowed in some jurisdictions, particularly when it is disclosed and aimed only at the shared area.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Connecticut’s Office of Legislative Research, for example, has described circumstances in which cameras in shared hallways and stairwells may be permissible under privacy and landlord-tenant law, while noting that voyeurism rules can apply depending on the facts. That is an example of state-specific analysis—not a nationwide permission slip. Read the Connecticut legislative analysis.

A common-area camera becomes more problematic when it:

  • records the inside of an apartment whenever the door opens;
  • is aimed at a tenant’s bedroom, bathroom or private window;
  • is hidden or disguised;
  • records sound;
  • focuses on one tenant rather than general building security; or
  • is used for harassment, retaliation or intrusive lifestyle monitoring.

Masking technology, a narrower lens angle or a different mounting position may prevent a hallway camera from recording inside a unit.

Hidden cameras can trigger criminal and civil liability

Concealment is a major aggravating fact, but it is not the only issue. State laws often prohibit secretly observing or recording people in places where they reasonably expect privacy. Potential consequences can include criminal charges, civil damages, invasion-of-privacy claims, intrusion upon seclusion, emotional-distress damages, lease violations and claims involving harassment or stalking.

North Carolina law, for example, addresses secretly peeping into a room and creating an image where a person has a reasonable expectation of privacy, and separately addresses recording private areas without consent. See North Carolina General Statute § 14-202.

New York’s unlawful-surveillance statute similarly addresses recording a person without consent in circumstances involving a reasonable expectation of privacy, including intimate or private areas. See New York Penal Law § 250.45.

These statutes illustrate the general risk, but they do not establish one rule for every state. Whether a particular device violates criminal law can depend on its location, purpose, content, consent, state definitions and the evidence available.

Audio recording creates a separate problem

A camera with a microphone may be legally riskier than a video-only device. State audio-interception laws can apply different consent standards. Depending on the jurisdiction and circumstances, recording a conversation may require consent from one participant or from every participant whose conversation is captured.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not assume that disabling video eliminates the problem. A microphone may continue recording conversations involving tenants, guests, children, contractors or neighbors. The analysis can turn on whether the recording was intentional, whether notice was adequate, whether anyone consented and whether the conversation was reasonably private.

“One-party” and “all-party” labels are useful starting points, not complete legal advice. Interstate conversations, consent language, civil remedies and state court decisions can complicate the analysis. Landlords should disable audio unless its use is clearly lawful, necessary and properly disclosed.

Landlord entry is not the same as permanent surveillance

Residential leases commonly allow a landlord to enter for limited purposes such as repairs, maintenance, inspections, emergencies, showing the property to prospective tenants or buyers, and complying with a court order. Those rights generally do not create a continuing right to watch a tenant’s daily life.

Massachusetts law illustrates the distinction by limiting a lessor’s entry during the lease term to specified purposes, including inspection, repairs, showing the property, court order, abandonment and certain end-of-tenancy inspections. Read Massachusetts General Laws chapter 186, section 15B.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Entry rules vary by state and city, but the practical distinction is important: a lawful inspection is temporary and purpose-limited; a camera can create continuous observation of an occupied home.

Is disclosure or a lease clause enough?

Not necessarily. A landlord should distinguish three separate concepts:

  1. Disclosure: the tenant is told that a device exists.
  2. Consent: the tenant affirmatively agrees to the specified surveillance.
  3. Legal authorization: applicable statutes and common-law rules permit the conduct.

These concepts are not interchangeable. Disclosure may be inadequate if it is vague, buried in fine print or provided after the tenancy begins. Consent may be ineffective or disputed where the camera is in a bedroom or bathroom, records intimate conduct, captures audio without legally sufficient consent, or is used for retaliation. Some conduct may be prohibited regardless of what a lease says.

A well-written building policy should identify each device’s location, field of view, audio status, purpose, access permissions, retention period and complaint process. It should never suggest that a general “security camera” clause authorizes monitoring inside a tenant’s private living space.

Short-term rentals have stricter platform rules

Airbnb’s policy is stricter than the legal minimum in many jurisdictions. Airbnb prohibits indoor security cameras and recording devices in homes, including hallways, bedrooms, bathrooms, living rooms, guest houses and shared areas in private-room listings, even when the device is turned off or disconnected. The policy took effect April 30, 2024. Read Airbnb’s indoor-camera policy.

Airbnb permits certain exterior devices when their presence and general location are disclosed and the devices do not monitor the listing’s interior or especially private outdoor areas. Read Airbnb’s exterior-device disclosure rules.

Airbnb’s policy is a private platform rule, not a landlord-tenant statute. Its stricter standard does not prove that every indoor camera is illegal under local law, and local law can be stricter than the platform’s policy.

What if the landlord lives in the same home?

Shared-home and rooming-house arrangements require closer analysis. A landlord may have more latitude to use a visible camera in an area genuinely shared by the landlord and occupants, but that does not automatically permit cameras in a tenant’s bedroom, private bathroom or exclusively rented room.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Identify what the occupant rented: an entire dwelling, an individual bedroom with shared facilities, a bed in a room, or a short-term stay. A missing written lease does not necessarily eliminate privacy rights. The tenant’s actual possession, the parties’ agreement and the camera’s location remain important.

What if the unit was vacant when the camera was installed?

A landlord may have legitimate reasons to use temporary monitoring during construction, repairs, turnover or vacancy. But a device that was acceptable while the property was vacant does not automatically remain acceptable after a tenant takes possession.

Before move-in, the landlord should:

  • remove or disable all temporary cameras;
  • disclose any device that will remain;
  • avoid recording prospective tenants, contractors or visitors without legally adequate notice or consent; and
  • document removal, deactivation and any retained equipment.

What a tenant should do after discovering a camera

Safety comes first. If the device appears to record intimate activity, is hidden in a private area or creates an immediate danger, leave the area if necessary and contact emergency services or local law enforcement.

  1. Do not immediately destroy or unplug the device. Removing it may destroy evidence or escalate a property dispute. Do not take risks to preserve evidence.
  2. Photograph and video it in place. Record its location, lens direction, wiring, brand, serial number, indicator lights and surrounding fixture.
  3. Write down dates and events. Note when it was found, who had access and whether it could capture private activity or audio.
  4. Preserve documents. Keep the lease, move-in notices, texts, emails, listing screenshots, maintenance records and building policies.
  5. Ask questions in writing. Ask who owns the device, what it records, whether audio is enabled, who can access recordings, where footage is stored and how long it is retained.
  6. Contact appropriate help. Consider local law enforcement, a tenant lawyer, legal aid or a state or local housing agency.
  7. Document retaliation separately. Preserve threats, eviction notices, rent changes, harassment or adverse treatment that follows a complaint.
  8. Do not hack into an account. Preserving evidence is different from accessing cloud footage or computer systems without authorization.

A tenant should also avoid publicly uploading footage that identifies other tenants or shows private activity without legal advice.

What landlords should do instead

For legitimate building security, the lower-risk approach is visible, narrowly targeted monitoring of exterior and genuinely shared areas:

  • Use visible cameras at entrances, gates, parking areas, package rooms and common facilities where lawful.
  • Provide specific written disclosure rather than relying on a vague lease reference.
  • Keep the field of view away from private windows, door interiors, bedrooms and bathrooms.
  • Disable microphones unless audio recording is clearly lawful and necessary.
  • Limit footage access by role and use strong account security.
  • Set a documented retention period and delete footage when it is no longer needed.
  • Maintain signage and a process for handling complaints and law-enforcement requests.
  • Review camera placement after construction, remodeling or changes to neighboring units.

Professional security installers can help with privacy masking, access controls, audit logs and retention policies, but hiring an installer does not transfer responsibility for unlawful placement or recording to the vendor.

A practical risk checklist

This checklist is a decision framework, not a substitute for state-specific legal advice:

More legally risky Generally lower risk
Bedroom, bathroom or private unit Exterior entrance or genuinely shared area
Hidden or disguised device Visible and clearly identified device
No notice or misleading notice Specific written disclosure before occupancy
Microphone enabled Audio disabled where legally appropriate
Camera aimed through a window or doorway Narrow field of view aimed at an entrance
Continuous monitoring of one tenant General property-security purpose
Unlimited or public access to footage Restricted authorized access
Indefinite retention Short, documented retention period

How to find the controlling rule in your state

For a definitive answer, identify the state and city where the property is located, then review the applicable:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • voyeurism, video-voyeurism and unlawful-surveillance statutes;
  • wiretap or electronic-communications laws governing audio;
  • landlord-entry, quiet-enjoyment and tenant-privacy rules;
  • anti-retaliation and housing-discrimination laws; and
  • short-term-rental, housing-program or building-specific requirements.

Hidden-camera discoveries, intimate images, audio recordings, threats, retaliation and immediate safety concerns justify prompt advice from a lawyer or legal-aid organization. Federal law may be relevant to particular communications or recordings, but it does not supply a simple nationwide answer to landlord-camera disputes.
