For most construction work, no. The general entitlement to use rebated (“red”) diesel ended for fuel used from 1 April 2022. A construction machine may use rebated fuel only when both its machine type and its actual purpose satisfy a specific legal exception in HMRC’s current Excise Notice 75. Being off-road, supporting a farm, or carrying a specialist attachment does not create an exemption by itself.

If no exception fits, use standard-rate fuel. Treat any exceptional licence as a narrowly controlled possibility, not as a general construction-sector concession.

What changed on 1 April 2022

Until the reform, many bulldozers, cranes, excavators and other off-road machines could run on rebated diesel. The rules changed for fuel used from 1 April 2022. Construction is no longer a qualifying purpose in the ordinary sense, so a contractor cannot continue using red diesel simply because machinery never travels on public roads.

The policy applies to rebated diesel and relevant rebated biofuels, including marked oils covered by the excise rules. The objective is to bring most users into the standard fuel-duty system and encourage more efficient machinery, cleaner alternatives or lower fuel consumption. HMRC’s 2021 policy paper described red diesel as fuel used by off-road equipment such as bulldozers and cranes in construction, which is why the sector was directly affected.

The change did not abolish every use of rebated fuel. It created a narrower set of qualifying machine-and-purpose combinations. Those combinations are the starting point for any compliance decision.

The legal test: machine type plus actual purpose

HMRC’s Excise Notice 75 uses a two-part test:

  1. What is the machine or vehicle? The statutory category and technical description matter.
  2. What is it being used for? The activity must match an expressly permitted purpose for that category.

Both parts must be satisfied. A vehicle registration category, an “agricultural” label, an off-road design or a business’s membership of an agricultural supply chain does not establish entitlement. The same machine may qualify for one job and fail for another, depending on what it is doing at the time.

For example, a machine owned by a farm may qualify while carrying out an eligible agricultural operation, but not while undertaking a commercial building project for a third party. Likewise, plant hired to an agricultural customer does not automatically qualify if the work itself is construction rather than an approved agricultural purpose.

HMRC’s notice is updated over time. The current notice shows a last-update date of 18 September 2026; use the machine-specific section in that live notice rather than relying on an older trade article or a remembered summary.

Which uses can still qualify?

The post-reform categories are broad descriptions, not a universal permission for every machine in the sector. The exact limits differ by machine type and activity.

Potentially qualifying area What a firm must establish
Agriculture The machine and its operation meet the statutory agricultural purpose, rather than merely supporting an agricultural customer.
Horticulture The work is horticultural within the legal definition and is performed by a qualifying machine.
Aquatic farming The activity is aquaculture or aquatic farming covered by the rules; ordinary civil engineering near water is not automatically included.
Forestry The machine is used for an eligible forestry operation, not simply on a site containing trees.
Arboriculture Since a 2023 amendment, certain non-vehicle machines and appliances used for arboriculture can qualify. Check the specific equipment and purpose in the current notice.
Railway vehicles The vehicle and railway use must fall within the railway provisions; general plant working beside a railway is not enough.
Non-commercial heating or electricity generation The premises, equipment and non-commercial use must meet the relevant conditions. Commercial site power can fall outside this category.
Golf-course maintenance The work must be maintenance of a qualifying golf course, using equipment covered by the rules.
Community amateur sports clubs Maintenance of qualifying club land may be permitted, subject to the statutory club and land conditions.
Travelling fairs and circuses The fuel use must be connected with a qualifying travelling fair or circus and the relevant machinery.
Marine use Marine provisions apply to specified vessels and purposes. Private pleasure craft have separate restrictions and should not be treated as a general marine exemption.

This list is deliberately high-level. Not every purpose in the first column is available to every type of vehicle or appliance. Read the relevant section of Excise Notice 75 and confirm the facts for the particular job.

Construction situations that commonly cause mistakes

“It is off-road, so red diesel is allowed”

Off-road status is not the test. A tracked excavator on a building site is still being used for construction, which is not itself a qualifying purpose. Road registration and road use are separate issues from entitlement to rebated fuel.

“The project supports agriculture”

Supporting an agricultural business does not automatically make a contractor’s work agricultural. Building a warehouse, access road, drainage system or livestock facility may remain construction work. Identify the machine’s actual task and compare it with the statutory wording; do not infer eligibility from the customer’s industry.

“The machine is specialist or low-use”

Specialist design, infrequent operation, high fuel consumption or difficulty obtaining white diesel does not create a routine exemption. Those facts may be relevant to an exceptional-licence application, but only within HMRC’s restrictive conditions.

“A mixed-use machine can run on red diesel”

Mixed use needs careful control. If a machine performs both qualifying and non-qualifying work, the business must be able to show which operations are eligible and manage fuel accordingly. When that separation cannot be demonstrated, using standard-rate fuel is the safer compliance position.

Exceptional rebated-fuel licences: a narrow route

HMRC may consider a licence in exceptional circumstances where essential machinery cannot obtain full-duty diesel. The conditions are cumulative and demanding. HMRC’s guidance indicates that the applicant must show:

  • the machinery’s use is essential and critical;
  • full-duty diesel is unavailable, rather than merely more expensive or inconvenient to source;
  • the applicant is an essential user or essential business;
  • there is no viable alternative; and
  • it would be unreasonable not to permit the use.

This is not a hardship exemption for ordinary construction operations. A contractor should not plan its fleet, tender pricing or fuel contracts on the assumption that a licence will be granted. Prepare evidence of the operational necessity, supply problem, alternatives considered and consequences of stopping the work, then seek HMRC’s decision before using rebated fuel under that route. Do not treat an application as permission while it is pending.

A practical compliance process for a construction fleet

  1. Build an equipment register. Record each machine’s make and model, technical category, ownership or hire status, fuel system and normal operating locations.
  2. Describe the actual tasks. Write the work in operational terms—such as trench excavation, site grading, timber harvesting or golf-course mowing—rather than using a broad label such as “plant hire.”
  3. Map each task to the current HMRC notice. Check both the machine section and the permitted-purpose section. Save the notice version and date used for the decision.
  4. Separate qualifying from non-qualifying work. For mixed-use equipment, define when and where a qualifying operation occurs and how fuel movements will be recorded.
  5. Choose the fuel before mobilisation. If the match is uncertain or fails, arrange standard-rate fuel for the project. Do not rely on a customer’s assurance or a supplier’s informal interpretation.
  6. Keep an audit trail. Retain fuel invoices, delivery records, machine logs, job descriptions, site dates, subcontractor instructions and evidence supporting any exception. Records should allow an auditor to connect fuel consumed with the qualifying machine and activity.
  7. Review changes. Recheck entitlement when a machine is reassigned, a contract scope changes, a new attachment is fitted, ownership changes or HMRC updates the notice.

Fuel suppliers can identify marked fuel, but they do not decide whether your use is legally entitled. The responsibility remains with the user and, where relevant, the person controlling the machine’s operation.

What to do when no exception applies

There are three defensible response paths:

Path When it fits Questions to answer
Use rebated fuel Only when the machine and actual purpose clearly satisfy a current exception. Can you cite the exact machine-and-purpose provision and support it with records?
Switch to full-duty fuel The normal route for construction work that does not qualify. Can the site reliably receive and store standard-rate fuel, and have tenders and budgets been updated?
Change the operation Where reducing fuel use or adopting a cleaner technology is technically and commercially viable. Will the alternative meet duty cycle, power, refuelling, safety and availability requirements?

The official material establishes these decision directions but does not provide a current price comparison, performance test or universal recommendation for a particular alternative. Assess total cost, site logistics, reliability, emissions and supply for your own fleet rather than assuming that one replacement works for every excavator, generator or crane.

Historical duty figures: useful context, not a current quote

HMRC’s 2021 policy paper reported the following figures:

Fuel treatment Figure reported by HMRC Qualification
White diesel (standard duty) 57.95 pence per litre Historical rate stated in the 2021 policy paper; not a current 2026 rate.
Rebated diesel 11.14 pence per litre effective duty Historical 2021 figure after a 46.81 pence-per-litre rebate; not a current rate.

Do not use those numbers in a present-day tender or savings calculation. Check the current duty rates and VAT treatment applicable to your purchase date and business circumstances.

Common compliance failures and corrections

  • Relying on a machine’s colour: red dye shows the fuel’s treatment, not entitlement. Correct the decision by documenting the legal purpose first.
  • Using an old exception list: rules and wording can change, and arboriculture was added for certain non-vehicle machinery in 2023. Correct this by checking the live notice.
  • Assuming all farm-related work qualifies: classify the operation, not the client. Correct the record with a job-specific description.
  • Mixing fuels without controls: unidentified tanks and shared bowsers make it difficult to prove which machine used which fuel. Use labelled storage, issue records and machine logs.
  • Treating an exceptional licence as automatic: a pending request is not approval. Obtain written permission before relying on it.
  • Ignoring subcontractors: contract terms should state who supplies fuel, who checks entitlement and who keeps records. A principal contractor should verify that site rules do not encourage unlawful use.

When to obtain specialist advice

Escalate the question before fuelling when a machine has several roles, operates across sectors, is hired with fuel included, uses a non-standard power unit, or is being considered for an exceptional licence. Keep the legal analysis separate from equipment procurement advice: HMRC determines tax entitlement, while manufacturers and engineers address technical suitability, safety and emissions performance.

For a UK-wide overview, start with HMRC’s current Using rebated fuels in vehicles and machines (Excise Notice 75), published 3 May 2023 and shown as updated 18 September 2026. Also consult HMRC’s guidance on the reform and the Finance Act 2022 provisions. Devolved or cross-border operations and the precise fit of a machine to an exception require case-specific checking.

Bottom line for construction businesses

Assume standard-rate fuel for ordinary construction unless you can prove a specific exception. Check the machine and its real purpose against the current HMRC notice, keep records that demonstrate the decision, and treat exceptional licensing as an extraordinary remedy requiring HMRC approval. Build full-duty fuel, efficiency measures and any cleaner-equipment assessment into fleet and project planning rather than waiting until a site is short of compliant fuel.
