Can a Resort Operate While Construction or Environmental Approvals Are Under Dispute?

Sometimes, but a pending dispute is not permission to operate. Whether a resort may open or remain open depends on the jurisdiction, the approvals it actually holds, the defects alleged, and the wording of any operative administrative or court order. A challenge to a permit is different from an order suspending that permit, stopping construction, prohibiting occupancy, or closing the business.

The safest answer for a particular property requires a current review of its permit file and every interim order. The Indian Supreme Court decision involving Seashells Beach Resort shows why: a court set aside permission to operate while serious approval and compliance objections remained unanswered. That result applies to that record and those local rules, not automatically to every resort in another country.

What decides whether the resort can operate?

Four questions control the practical answer:

  1. Which law governs? Resort licensing, environmental review, coastal restrictions, building control and court procedure are local matters. The country, state or province, municipality and protected-area status of the site all matter.
  2. Which approvals exist, and are they current? A resort may need separate permissions for land use, construction, environmental assessment, coastal or protected-area compliance, pollution control, occupancy, fire safety, tourism licensing and ongoing operations.
  3. What exactly is being challenged? A lawsuit may attack one permit, the entire project, a particular facility or alleged activity outside the approved plans.
  4. What does the latest enforceable order say? The operative document may be a permit suspension, administrative closure, stay, injunction, temporary environmental order, or an order limited to construction. Its scope and expiry date matter more than the fact that litigation exists.

Investment already made, expected employment and the inconvenience of closure may be arguments in an application for interim relief. They do not replace an approval that the governing law requires.

Construction permission is not operating permission

Project teams often treat “approved” as a single status. Regulators and courts usually do not. A construction authorization can allow specified works while leaving the operator unable to receive guests. Conversely, a tourism license does not legalize an unapproved building or discharge.

Permission or document What it generally addresses Why a dispute can still stop operations
Land-use or zoning permission Whether the site and proposed use conform to planning rules A resort may be in a prohibited zone or operating outside the approved use
Environmental assessment or clearance Environmental impacts, mitigation and conditions Construction or occupancy may be barred until conditions are met or the clearance is upheld
Coastal, shoreline or protected-area approval Special restrictions for sensitive land and waters Separate coastal rules can prohibit building or commercial use even where general planning approval exists
Pollution-control clearance Wastewater, emissions, solid waste and related controls Operating without the required clearance can trigger enforcement or closure
Building completion or occupancy certification Whether the completed works can lawfully be occupied Guest use may be unlawful before inspection, completion certification or a similar document
Fire and life-safety approval Emergency access, alarms, exits and fire protection Operating without it can create an immediate safety and enforcement risk
Tourism or business license Authorization to conduct the lodging or tourism business It does not cure defects in land, environmental or building approvals
Operating conditions and renewals Limits on capacity, hours, facilities and ongoing compliance A valid license can be suspended, expire or be breached by actual operations

The exact names differ by jurisdiction. The essential task is to map every required approval, its conditions, validity period, and any notice of suspension or revocation.

What a court challenge does—and does not—do

Filing a petition, appeal or judicial review normally starts a dispute; it does not automatically suspend the challenged permit. Some legal systems give a filing suspensive effect for particular permits, while others require a separate stay or injunction. Only local counsel and the actual procedural rules can establish which applies.

An order may have a narrow scope. It might stop new earthworks but allow maintenance, prohibit a particular building while leaving existing rooms open, or pause an agency decision without directing closure. Read the operative paragraphs, definitions, maps and dates. Headings such as “injunction” or “stay” are not enough to determine what staff may do on site.

Construction versus guest operations

Ask separately whether the order covers site preparation, structural work, utilities, fit-out, advertising, check-in, accommodation, restaurants, pools, beaches, events and wastewater discharges. A ban on construction does not necessarily answer the operation question, and an operating prohibition may leave only safety or preservation work permitted.

Interim orders can change quickly

Check the latest order after every hearing, appeal, administrative review or permit amendment. An earlier injunction may have expired, been narrowed, been stayed on appeal or been replaced by a closure notice. Staff should work from a dated compliance register, not an old email or a summary prepared before the last hearing.

India: what the Seashells Beach Resort decision illustrates

In Union Territory of Lakshadweep & Ors. v. Seashells Beach Resort & Ors., the Supreme Court of India reviewed a High Court direction requiring authorities to process outstanding clearances while allowing the resort at Agatti to run in the meantime. The administration raised objections concerning tourism licensing, coastal-zone and pollution-control clearances, land-use permissions and construction in a no-development zone. The parties disputed both the approvals and the facts about the site.

The Supreme Court set aside the direction permitting operation because the High Court had not adequately addressed the serious objections. The Court stated: “The resort could not be commissioned under a judicial order in disregard of serious objections that were raised by the Administration, which objections had to be answered before any direction could issue from a writ Court.”

The practical lesson is limited but important: a court should not use interim equitable relief to commission a resort while material regulatory objections remain unanswered. The decision does not mean every resort facing a challenge must close, nor that a resort may continue merely because no final judgment has been entered. It concerns that record, the applicable coastal rules and the specific interim order under review.

Philippines: why the type of interim relief matters

In Crisostomo B. Aquino v. Agua Tierra Oro Mina Development Corporation, the Supreme Court of the Philippines discussed preliminary injunctive relief in a resort-related dispute and distinguished it from a Temporary Environmental Protection Order (TEPO). The Court described requirements involving a prima facie right, an act violating that right and urgent necessity to prevent serious damage. It also explained that a TEPO has separate procedural requirements.

This decision demonstrates why the label and legal basis of an order matter. A preliminary injunction and a TEPO may require different evidence, procedures and findings. The Philippine standards cannot be imported as a universal test for a project in India, another country or another local court.

How to assess a specific resort

Use this sequence before advising management, contractors, guests or investors that operations are lawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Fix the site and jurisdiction. Record the country, state or province, local authority, coastal or protected-area designation, parcel numbers and the boundaries of the resort. A dispute may cover only part of a larger development.
  2. Build the approval inventory. Obtain every permit and license, including conditions, amendments, renewal dates, inspection records and correspondence. List land use, construction, environmental, coastal, pollution-control, occupancy, fire-safety, tourism and business permissions separately.
  3. Verify present status. Ask each issuing authority whether the document is active, suspended, revoked, expired, under appeal or subject to a compliance notice. Preserve written confirmations and the date checked.
  4. Read the filed challenge. Identify the relief requested, the provisions allegedly breached, the facilities and activities targeted, and whether the claimant seeks closure, a construction stop or only a new agency decision.
  5. Read every interim order in full. Mark the exact acts prohibited or allowed, the parties bound, geographic limits, exceptions for safety work, reporting duties and expiry or review dates. Do not rely on a press report or a lawyer’s one-line summary.
  6. Check later procedural events. Confirm stays, appeals, extensions, permit amendments, administrative reconsideration and subsequent court directions. The newest enforceable order controls.
  7. Compare actual operations with approvals. Check room count, occupancy, access roads, shoreline works, water abstraction, wastewater systems, generators, restaurants, events and other facilities against approved plans and conditions.
  8. Obtain local advice before opening or continuing. Qualified environmental or land-use counsel and permitting professionals can interpret local rules, communicate with authorities and design a lawful reduced-operation plan if one is available.

Common situations and the likely legal question

Situation Question that must be answered Risk if assumed incorrectly
Environmental clearance is challenged, but no stay is visible Does local law make the filing suspensive, or is a separate order required? Operating may still violate a statutory suspension rule even without an injunction
Construction is enjoined Does the order also prohibit occupancy, bookings or operation of completed areas? Continuing guest use can breach an order even if no workers remain
Tourism license is valid but occupancy certification is missing Can guests legally occupy the buildings under local building law? A business license may not cure an unlawful or unsafe building
Only one facility is disputed Is the order severable, or does it affect the entire project and shared systems? Operating other rooms may still rely on the challenged wastewater, access or utilities
Permit conditions are being appealed Are the conditions effective during appeal, and has the agency granted a stay? Ignoring conditions can create an independent enforcement basis
Authorities have not acted for months Does administrative silence equal approval in this jurisdiction? Delay and expenditure are not automatic authorization

Why delay and investment rarely settle the issue

Resort owners may argue that closure would waste capital, harm employees or disrupt guests. Those facts can influence a court’s balancing of interim relief, but they do not answer whether a mandatory permit exists or whether construction occurred in a prohibited zone. In the Seashells dispute, the Supreme Court rejected interim permission to operate while serious objections remained unresolved despite the equitable arguments presented.

A responsible operator should therefore treat commercial pressure as a reason to obtain a prompt legal determination, not as a substitute for one. Continuing to take bookings while the status is uncertain can increase guest claims, enforcement exposure and the difficulty of restoring the site.

Operational controls while status is disputed

If counsel confirms that some activity remains lawful, document the boundary in writing and translate it into site controls:

  • Freeze work and bookings covered by the order; identify permitted safety, maintenance or preservation tasks.
  • Restrict staff access to facilities outside the approved scope and brief contractors on the exact prohibited activities.
  • Maintain a daily log of occupancy, wastewater handling, construction activity and inspections where those matters are conditions of approval.
  • Display or retain the current permits and orders so managers can produce them during an inspection.
  • Set alerts for expiry, hearing dates, reporting deadlines and renewal windows.
  • Escalate any notice, inspection finding or verbal direction to counsel and the permit manager immediately; obtain written confirmation rather than relying on an informal statement.

These controls manage compliance; they do not create permission where the law requires an approval that is missing or suspended.

When a resort should not open or should pause operations

Opening or continuing operations is especially risky when an authority has issued a closure or suspension, a court order expressly prohibits commissioning or occupancy, a required environmental or occupancy approval has expired or been revoked, the project lies in a prohibited zone, or actual facilities exceed approved plans. The absence of a final judgment is not a safe harbor in any of those circumstances.

What a current answer can and cannot establish

No universal rule determines whether a resort may operate during a dispute. A reliable answer requires the identified jurisdiction, resort site, complete approval file and current orders. The Indian and Philippine decisions show how courts analyze interim relief in their own legal systems; neither decides the status of an unnamed resort today. For a live project, obtain advice from professionals qualified in the relevant jurisdiction and verify the position with the issuing authorities.
