Streamlining changes how a city or county reviews the land-use entitlement; it does not waive California Title 24 building standards, plan review, inspections, utility requirements, fire rules, setbacks, or final approval. For a qualifying accessory dwelling unit (ADU) or junior ADU (JADU), the entitlement and permit review is generally ministerial and the agency usually must act within 60 days after accepting a complete application in the statutory existing-dwelling scenario. For qualifying multifamily developments under the Streamlined Ministerial Approval Process (SMAP), commonly called SB 35 or SB 423, eligibility depends on the current California Department of Housing and Community Development (HCD) determination for the jurisdiction and on project-specific housing, site, affordability, labor, wage, coastal, and hazard rules.
The short answer: streamlined approval is not a construction permit
California uses several different approvals that are often described casually as “streamlined.” They do different jobs:
As an Amazon Associate I earn from qualifying purchases.
- A building permit authorizes physical construction after plans are checked against the California Building Standards Code (Title 24) and applicable local requirements. It leads to inspections and, ultimately, approval for occupancy or completion.
- A ministerial land-use approval means the agency applies objective standards rather than deciding whether a project is desirable through a discretionary hearing. It controls the entitlement or development-review stage.
- ADU/JADU ministerial processing is a statutory pathway for qualifying secondary units. It limits discretionary review, public hearings, and burdensome conditions, but the project still needs construction permits and inspections.
- SMAP under SB 35/SB 423 is a ministerial land-use path for certain multifamily housing developments. It is not a blanket exemption for single-family additions, repairs, or other home-improvement work.
California Health and Safety Code section 17922 adopts Title 24 requirements while preserving local authority over use zones, fire zones, setbacks, side and rear yards, and property-line requirements. In practical terms, a streamlined approval changes the review route; it does not erase the rules that make a building safe and legally buildable.
How the approvals fit together
A project can pass through several stages, and each stage has a different decision and document. Keeping them separate prevents the most common misunderstanding: treating a land-use approval as permission to start construction.

| Stage | What it decides | Typical evidence or output |
|---|---|---|
| Site and entitlement review | Whether the proposed use and form may proceed on the parcel under zoning and applicable housing laws. | Ministerial ADU approval, SMAP approval, planning clearance, or another entitlement record. |
| Building-plan review | Whether drawings and specifications comply with Title 24 and local construction requirements. | Reviewed plan set, correction comments, and an issued building permit. |
| Permit issuance | Whether the agency has received the required plans, fees, calculations, and supporting approvals to authorize work. | Building, electrical, plumbing, mechanical, grading, or other permits as applicable. |
| Inspections | Whether work installed in the field matches approved plans and code requirements. | Inspection approvals, correction notices, and reinspection records. |
| Final approval | Whether the permitted work is complete and eligible for final sign-off or occupancy. | Finaled permits, certificate of occupancy where required, or equivalent local completion record. |
An entitlement can be approved while a building permit is still pending because the plan set lacks structural calculations, energy documents, fire details, utility information, or other required material. Conversely, a complete building plan does not cure a zoning or entitlement problem.
What a normal California building permit does
For repairs, additions, conversions, new homes, and other construction, the building department verifies compliance with the version of Title 24 and locally adopted requirements that applies to the project. The exact package varies by city, county, scope, and site, but commonly includes architectural drawings, structural plans and calculations, energy compliance documentation, site and utility information, and trade-specific details.
Rules that remain in force
- Building and fire safety: structural design, fire-resistance, egress, alarms, accessibility where applicable, and other code provisions remain enforceable.
- Local zoning and site controls: use zones, fire-zone designations, setbacks, side and rear yards, and property-line requirements remain reserved to local jurisdictions under Health and Safety Code section 17922.
- Utilities and site feasibility: sewer or septic capacity, water service, drainage, grading, easements, and utility connection rules may affect whether the design can be permitted.
- Inspections: work generally must remain accessible for required inspections. Covering work before an inspection can lead to uncovering, delays, or corrective work.
Local fees, forms, staffing, and the exact sequence of plan review are jurisdiction-specific. A statewide description cannot establish the requirements for a particular parcel.
ADU and JADU ministerial approval
California’s ADU rules create a more predictable route when the application meets statutory conditions. HCD guidance says a qualifying application should not face excessively burdensome conditions, a public hearing, public comment, or discretionary decision-making. That does not mean every proposed unit qualifies, nor does it eliminate building-code review.
What “ministerial” means for an ADU
Ministerial review applies objective standards to the facts shown in the application. The agency is not supposed to hold a discretionary hearing or make a policy judgment about whether the neighborhood should have an ADU. The application can still be denied if it is incomplete, fails applicable statutory or objective local standards, conflicts with a valid site constraint, or falls outside the statutory pathway.

HCD identifies tools jurisdictions can use to facilitate ADUs, including prioritized processing, pre-approved plans, fee waivers or deferrals, and reduced impact fees. These tools improve administration; they do not replace the permit, plan, and inspection requirements for construction.
The 60-day rule and its limits
The cited California statutory text generally requires the permitting agency to approve or deny a qualifying ADU or JADU application within 60 days after receiving a completed application when an existing single-family or multifamily dwelling is on the lot. Under the statutory language, failure to act within that period can result in deemed approval.

Applications submitted with a new primary dwelling have different treatment, and an applicant-requested delay changes the timing. The clock also depends on when the agency accepts the application as complete. A submittal that is missing required plans, signatures, fees, or other material may not start the statutory period.
How to document an ADU application
- Ask the planning or building department for the current ADU/JADU checklist, forms, fee schedule, and submittal method.
- Submit the plans, site information, structural and energy documents, utility details, and fees required for a complete application.
- Obtain written confirmation of the date the agency determined the application complete. Keep the confirmation, plan set, receipts, and all correction notices.
- Record any delay you request and any agency notice identifying an exception or missing item.
- Track the 60-day period from the documented completeness date, while recognizing that the statute’s exceptions and deemed-approval language must be applied to the actual facts.
- After entitlement or ministerial approval, complete building-plan review, permit issuance, inspections, and final approval.
Can a city deny an ADU after 60 days?
The answer depends on whether the application was complete, whether the statutory pathway applies, and whether an exception changes the deadline. In the cited existing-dwelling scenario, the statute says the agency must act within 60 days and provides deemed-approval language if it does not. That is different from saying every late decision is automatically invalid in every circumstance.
- Check completeness first: the 60-day period is tied to a completed application, not merely the date of an initial upload or payment.
- Check the project type: a new primary dwelling combined with an ADU is treated differently from an ADU proposed on a lot with an existing dwelling.
- Check applicant-requested delays: a requested extension or pause can affect the deadline.
- Check the stated reason: an agency may still identify a failure to meet objective statutory, zoning, fire, setback, utility, or building requirements.
If the deadline appears to have passed, preserve the complete-application evidence and ask the city or county to identify the statutory basis for its action. For a dispute or a consequential project, obtain advice from a California land-use or construction attorney rather than relying on a general online explanation.

What SMAP, SB 35, and SB 423 actually cover
SMAP is a streamlined ministerial approval process for certain multifamily housing developments. HCD describes it as applying when a jurisdiction is not making sufficient progress toward its Regional Housing Needs Allocation (RHNA), subject to additional statutory and project requirements. It is not a shortcut for every housing project and does not apply simply because a proposal contains residential units.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteJurisdiction-level eligibility
HCD uses annual permit data and housing-element compliance to determine whether a jurisdiction is subject to SMAP and whether the applicable affordability tier is 10% or 50%. The current HCD determination must be checked; a prior-year status or a general belief that a city is “behind on housing” is not enough.
Project-level eligibility
Even in a covered jurisdiction, the specific project must satisfy the applicable statute and objective standards. The review can involve:
- site zoning and allowed residential density;
- objective design, height, setback, and site standards;
- the required affordability tier, which HCD identifies as 10% or 50% depending on the jurisdictional determination and applicable rules;
- housing-element and RHNA-related conditions;
- labor and prevailing-wage or related wage obligations that apply to the project;
- coastal-zone treatment and other geographic rules;
- hazard, environmental, flood, fire, and infrastructure constraints; and
- required preliminary and formal submittals and the agency’s completeness process.
SB 423 extends SMAP through 2036 and adds or clarifies labor and wage requirements, coastal-zone treatment, and other geographic and implementation rules, according to HCD’s 2026 fact sheet. Because those rules can change the result, a builder must use the current HCD materials and applicable statute for the filing date.
What SMAP does not waive
SMAP does not authorize a builder to ignore zoning standards that remain applicable, skip building permits, bypass Title 24, avoid inspections, or occupy a building without final approval. Its principal benefit is a ministerial land-use decision for an eligible multifamily project, not a construction-code exemption.

ADU ministerial review compared with SMAP
| Question | Ordinary construction permitting | ADU/JADU ministerial pathway | SMAP under SB 35/SB 423 |
|---|---|---|---|
| Primary function | Authorizes construction under Title 24 and local rules. | Streamlines qualifying ADU/JADU entitlement and permit review. | Streamlines qualifying multifamily housing land-use approval. |
| Review character | Local building and planning review as required. | Ministerial; qualifying applications should not receive discretionary hearing review. | Ministerial for qualifying projects. |
| Typical audience | Homeowners, contractors, and all construction types. | Homeowners and small housing providers. | Multifamily developers and builders. |
| Key conditions | Code, zoning, fire, setbacks, plans, and inspections. | Statutory ADU conditions, objective standards, and a complete application. | Current HCD jurisdiction determination, RHNA and housing-element status, site and zoning standards, affordability, labor and wage rules, and other statutory conditions. |
| Timing evidence | Local timing varies. | Generally 60 days after a completed application in the cited existing-dwelling scenario, subject to exceptions and deemed-approval language. | HCD and statute establish eligibility and certain review clocks; local implementation must be verified. |
| What remains afterward | Inspections and final approval. | Construction permits, inspections, and code compliance. | Building permits, inspections, and code compliance. |
Homeowner workflow: from project idea to final sign-off
Use the following sequence before ordering materials or setting a construction start date.
- Define the work precisely. Identify whether it is a repair, addition, conversion, new primary home, ADU, or JADU. A project’s label affects which pathway may be available.
- Identify the authority. Confirm the city or county responsible for planning, building, fire, utilities, and inspections. Some parcels are affected by special districts or separate utility agencies.
- Request the current checklist. Ask which plan sets, calculations, energy documents, fees, utility approvals, and inspections apply. Do not rely on a checklist from a prior project or prior code cycle.
- Screen the site. Check setbacks, fire-zone requirements, property lines, access, sewer or septic capacity, water service, drainage, easements, and any hazard constraints before finalizing design.
- Submit a complete ADU/JADU application if applicable. Obtain written completeness confirmation and preserve the date.
- Separate approvals in your records. Keep entitlement decisions, building-permit records, inspection results, and final approval as distinct files.
- Schedule inspections before covering work. Ask the building department which stages require inspection and how to request them.
- Do not occupy or close out informally. Obtain the local final approval or certificate required for the project.
Builder workflow: verifying SMAP before filing
- Check HCD’s current SMAP determination. Confirm whether the jurisdiction is subject to the process and which affordability tier, 10% or 50%, applies. Use the current determination rather than an old eligibility memo.
- Map the parcel against exclusions and site rules. Review zoning, objective standards, coastal-zone status, fire and hazard conditions, environmental constraints, infrastructure, and property-specific limitations.
- Test the project’s housing and affordability program. Document unit counts, income-restricted units, affordability periods or other required commitments, as applicable to the governing statute.
- Plan labor and wage compliance. SB 423 adds or clarifies labor and wage requirements. Confirm which obligations apply to the project’s size, funding, and construction method before bidding.
- Submit preliminary and formal materials exactly as required. Preserve delivery receipts, completeness dates, agency comments, revised plans, and responses.
- Track entitlement and construction separately. A ministerial SMAP approval is one milestone. Continue with building-plan review, permit issuance, inspections, and final approvals under Title 24 and local procedures.
- Escalate procedural problems carefully. If a jurisdiction appears not to follow applicable housing-law procedures, use HCD enforcement and technical-assistance resources and obtain project-specific legal advice.
Common mistakes and how to avoid them
“Streamlined” means no permit
Why it fails: entitlement and construction authorization are different decisions. Starting work without the required permits can create stop-work orders, correction costs, insurance problems, and resale or financing complications.
Better approach: obtain written confirmation of every required permit and the inspection sequence before mobilizing.
Assuming an ADU is automatically eligible
Why it fails: the ministerial pathway depends on statutory conditions, objective standards, a complete application, and site facts such as fire access, setbacks, utilities, and property lines.

Treating 60 days as a universal deadline
Why it fails: the cited period is tied to a completed application and a particular existing-dwelling scenario, with statutory exceptions and applicant-requested delays.
Better approach: identify the applicable fact pattern and preserve the agency’s completeness notice.
Assuming every housing project qualifies for SB 35 or SB 423
Why it fails: SMAP depends on an HCD jurisdictional determination plus project-level requirements for site, affordability, labor, wages, geography, and other conditions.

Better approach: run a current jurisdiction and parcel eligibility analysis before design and financing are locked.
Using an old code book or local form
Why it fails: California standards, HCD guidance, local forms, fees, staffing, and implementation practices change.
Better approach: confirm the current edition and forms with the responsible city or county. HCD identifies its ADU handbook as updated in March 2026, and its handbook page describes a December 2025 addendum summarizing changes effective January 1, 2026.
What to verify before relying on a streamlined path
- The responsible city or county and every involved utility, fire, or special district.
- The exact project category: repair, addition, conversion, new primary dwelling, ADU, JADU, or multifamily development.
- The current local checklist, forms, fees, plan requirements, and completeness procedure.
- Title 24 requirements and the local adoption or amendments applicable to the project.
- Setbacks, side and rear yards, property lines, fire-zone rules, access, utilities, sewer or septic, drainage, and hazards.
- For an ADU/JADU, the statutory conditions, completeness date, 60-day rule, and any exception or requested delay.
- For SMAP, the current HCD determination, 10% or 50% affordability tier, RHNA and housing-element status, labor and wage duties, coastal treatment, and project-level exclusions.
- The separate milestones for entitlement, building-plan review, permit issuance, inspections, and final approval.
Bottom line for homeowners and builders
A California streamlined approval is a faster or more constrained land-use review, not a construction exemption. Qualifying ADU and JADU applications are generally ministerial, with a statutory 60-day action period in the cited existing-dwelling scenario, but completeness and exceptions matter. SMAP under SB 35/SB 423 is aimed at eligible multifamily housing and requires a current HCD determination plus project-specific compliance; it is not available to every home project. In every case, Title 24, local fire and site rules, building permits, inspections, and final approval remain part of the path to lawful construction.
