Buying Land to Build a House: 10 Site Conditions That Can Change the Entire Project

Can you build a house on the parcel? You cannot answer that from a listing, a level clearing, or a utility line visible at the road. A buildable site must pass two separate tests: the relevant authority must allow your intended dwelling, and the land must physically support the house, access, drainage, water, wastewater and services at a cost your project can carry.

Before making an unconditional offer, investigate the ten conditions below with the planning authority, title office, utility providers and appropriately qualified local professionals. Rules differ by country, state, council and parcel; guidance from NSW, Somerset, Victoria, Western Australia and the Australian national housing guide illustrates the questions to ask, not a universal permit checklist.

What “buildable” actually means

Buildability is a parcel-specific conclusion, not a marketing label. Legal buildability asks whether a dwelling of the size and type you want is permitted, whether the parcel has dwelling entitlement, and which approvals, setbacks, overlays or covenants apply. Physical buildability asks whether a house, driveway and services can fit safely on the land and whether the ground, water, wastewater, drainage and access can be engineered within your budget.

Both tests must be satisfied. A parcel can be zoned for housing but fail a wastewater site assessment, lack lawful access, or have too little usable area after easements and flood constraints. Conversely, a physically attractive block can have no dwelling entitlement or a covenant that prevents your proposed use. NSW Government guidance on rural property purchases and the NSW Local Land Services checklist both recommend confirming approvals, zoning and dwelling entitlement before buying. Somerset Council’s self-build guidance and Planning Victoria’s rural-residential guidance likewise treat access, services, ground conditions and environmental constraints as parts of site assessment.

Use this order for due diligence

  1. Define the project. Write down the dwelling type, approximate floor area, number of storeys, likely driveway location, water and wastewater strategy, and budget for site works. A site that works for a compact single-storey home may not work for a large house, detached studio or extensive outbuildings.
  2. Obtain the planning and title records. Ask the local planning authority for zoning, dwelling entitlement, overlays, setbacks and approval pathways. Obtain the current title, plan and registered instruments, then have a conveyancer or property lawyer explain easements, covenants and rights of way.
  3. Confirm access and services in writing. Speak directly with road or access authorities and each electricity, water, wastewater and telecommunications provider. Ask for connection points, capacity, extension requirements, easements, lead times and one-time and recurring charges.
  4. Commission site-specific technical checks. Depending on the parcel, this may include a feature and level survey, geotechnical advice, flood or drainage assessment, environmental or contamination assessment, and an onsite-wastewater evaluation. A generic consumer test cannot replace an authority’s required assessment.
  5. Price the complete site package. Get local quotes for clearing, grading, retaining, foundations, drainage, access construction, utility extensions, water storage or treatment and wastewater installation. Compare the total project implication, not just the land price.

1. Zoning, planning permission and dwelling entitlement

Questions to ask the planning authority

  • Is a dwelling of your intended type permitted on this parcel?
  • Does the lot have a recorded or otherwise recognised dwelling entitlement?
  • What planning, building, environmental or other permits are required?
  • Which minimum lot sizes, setbacks, height limits, site-coverage rules or design controls apply?
  • Do rural, heritage, bushfire, flood, landscape, agricultural or other overlays change the approval path?

Ask for a written planning response or a formal property-information report where that service exists. A real-estate description saying “residential,” “potential homesite” or “STCA” (subject to council approval) is not an approval. NSW guidance specifically tells rural-land buyers to check zoning, approvals and dwelling entitlement; the applicable terminology and process will differ elsewhere.

Why entitlement is separate from zoning

Zoning describes the planning framework, while dwelling entitlement concerns whether this particular lot may contain a dwelling under the applicable scheme. Historic subdivisions, minimum-area rules, protected land, lot amalgamation requirements or previous approvals can affect entitlement. Do not assume that neighbouring houses prove your parcel has the same rights.

2. Title, easements, rights of way and other restrictions

Read the title and every registered instrument

Order the current title, deposited plan or survey plan and all referenced easements, covenants, restrictions and agreements. Have a conveyancer or lawyer interpret the legal effect. Look for rights of way, drainage and sewer easements, electricity or telecommunications corridors, shared-driveway obligations, building envelopes, no-build areas and covenants controlling materials, animals or additional structures.

Map legal constraints onto the design

An easement can cross the most convenient house site or driveway even when the service is not obvious on the ground. NSW guidance notes that easements and rights of way can affect rights even if they have not been used recently. Mark each corridor on a survey before choosing the house position. Confirm who may enter the land, what may be built over or near the corridor, who maintains it and whether written consent is needed for construction.

Also verify the boundary on the ground. A fence, track or cleared pad is evidence of occupation, not proof of the legal boundary or an enforceable access right.

3. Legal and physical access

Lawful access

Confirm that the parcel has a recorded connection to a public road or a legally enforceable right of way. Check whether access is shared, whether maintenance costs are allocated, and whether an authority requires a permit for a new or upgraded crossover. A track used by the seller may not be a legal access route for a new dwelling.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Construction access

Somerset Council advises assessing construction access, and Planning Victoria includes road access in site analysis. Walk the route with a builder or civil contractor and consider the largest delivery vehicle, concrete truck turning, crane reach, bridge or culvert load limits, gradient, width, overhead lines, wet-weather conditions and emergency-vehicle requirements. A narrow or steep route can require vegetation removal, retaining, drainage, widening or a temporary access road before house work begins.

Ask the road authority and the access owner about permits, sight-distance standards, culvert specifications and restoration obligations. Price these works separately from the house contract.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

4. Utilities and connection costs

Verify each service directly

Contact electricity, reticulated water, sewer, telecommunications and any gas or other relevant provider. Ask where the nearest connection point is, whether capacity is available, what extension or upgrade work is required, which party pays, whether an easement must be created and how long connection takes. Government guidance in NSW, Somerset and Western Australia all advises checking service access and costs rather than relying on proximity.

“Nearby” is not the same as connected

A pole, hydrant, pipe or fibre line at the boundary does not guarantee a connection. The line may be on the wrong side of a road, at insufficient capacity, outside the provider’s service area or subject to a new easement. Obtain a provider reference number or written estimate that identifies the parcel and the assumptions used.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Plan for the gap between services

If permanent power is unavailable during construction, include temporary power, water storage and site security. If a utility corridor crosses the proposed driveway, coordinate the crossing design before excavation. Treat one-time connection charges, trenching, meters, transformers, pumps and ongoing service fees as part of land due diligence, not as surprises after settlement.

5. Water supply

Identify the source and its obligations

Establish whether the home will use a public network, bore, rainwater, a spring, a shared system or hauled water. The responsible authority or provider can explain licensing, connection, storage, treatment and testing requirements. NSW rural-property guidance specifically flags water-table depth, quality and reliability for undeveloped land.

Test reliability, quantity and quality

For a private source, determine seasonal yield rather than relying on a single observation. Ask for records of bore depth, pump performance and laboratory water-quality results where available, then obtain current local advice about testing frequency and treatment. A source adequate for occasional irrigation may not meet household demand or firefighting requirements. Include tanks, pumps, filtration, disinfection, backup power and maintenance access in the design and budget.

Do not represent a neighbour’s bore or a visible creek as your legal or reliable supply. Confirm your own rights and approvals before purchase.

6. Sewer or onsite wastewater feasibility

Find out whether mains sewer is available

Ask the wastewater provider to confirm service availability and the approved connection point. If mains sewer is absent, ask the local authority which onsite-wastewater system types are accepted and what application, site evaluation, reserve area, setbacks and ongoing management requirements apply.

Why a “perc test” is not a universal answer

Readers often ask: “Is public sewer available, or does the parcel need a perc test, soil evaluation, septic permit, reserve area and health-department review?” Those terms describe processes used in some jurisdictions, not a universal checklist. A single infiltration or “perc” result does not by itself prove that an authority will approve a system. The required assessment may consider soil profile, slope, groundwater, setbacks, loading, treatment level, land area and a designated replacement or reserve area.

Protect the disposal area

Map the primary and reserve wastewater areas before fixing the house, driveway, pool, sheds or landscaping. Keep them clear of easements, flood-prone ground, wells, waterways and vehicle loading as required locally. Obtain a written feasibility opinion from a qualified wastewater designer or the relevant authority before your contract becomes unconditional.

7. Soil and subsurface conditions

What the ground can change

Soil composition, fill, rock, expansive clay, shallow groundwater, landslip risk and bearing conditions influence foundation type, excavation, retaining, drainage and construction sequencing. Somerset’s plot guidance, Planning Victoria’s rural-residential guidance and Western Australian consumer guidance all identify ground or soil conditions as material to site assessment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Commission advice that matches the design

Ask a qualified geotechnical professional what investigation is appropriate for your proposed house and site. The useful scope depends on the building footprint, slope, fill history and local requirements; this evidence does not establish one universal test or foundation threshold. Give the professional your concept plan so the advice addresses the actual building area, driveway and retaining rather than a random point on the parcel.

Budget for difficult findings. Rock removal, piering, engineered fill, soil improvement, dewatering or retaining can affect both cost and programme. Do not treat a seller’s statement that the land is “solid” as an engineering conclusion.

8. Slope, terrain, erosion and the usable footprint

Measure the whole working area

Map contours and levels for the intended house, driveway, parking, wastewater area, stormwater route and required setbacks. Planning Victoria lists slope and erosion among site-analysis considerations. YourHome notes that small, irregular or steep sites may require more creative design.

Compare design responses

  • A cut-and-fill platform may create a level floor but require retaining walls, engineered fill and erosion control.
  • A split-level or piered design can reduce excavation while increasing structural and access complexity.
  • A long, steep driveway can affect vehicle safety, drainage, emergency access and construction deliveries.
  • Irregular boundaries can leave less usable area than the headline lot size suggests.

Have a designer or surveyor test a preliminary building envelope before you commit. The relevant question is not “How many square metres is the parcel?” but “How much compliant, serviceable area remains after all constraints are drawn?”

9. Drainage, flood exposure, wetlands, waterways and groundwater

Start with official mapping and site evidence

Check current flood, wetland, waterway, drainage-line, groundwater and environmental maps with the relevant authority, then compare them with a site walk during or after rain if safe. Planning Victoria identifies flood plains, wetlands, waterways, drainage lines and proximity to groundwater bores as site-analysis matters. Somerset’s guidance also calls for planning rainwater and site drainage.

How water constraints affect the project

  • Flood levels or overland-flow paths may move the house, driveway, wastewater area or finished-floor level.
  • Wetlands and waterways can trigger buffers, environmental approvals or limits on clearing and earthworks.
  • High groundwater can complicate basements, foundations, septic disposal, stormwater infiltration and excavation.
  • Poor drainage can damage access and foundations even where the house pad itself is above mapped flood levels.

Ask a local civil, environmental or hydraulic professional what assessment the authority requires. Do not infer safety from a dry inspection on one day or from a map that has not been checked against current local controls.

10. Prior use, contamination, site work and total cost

Investigate the land’s history

Ask how the land was previously used and check relevant contamination or environmental records. Former workshops, intensive agriculture, fuel storage, waste disposal, imported fill, orchards or industrial activity can change the investigation and remediation needed. Planning Victoria identifies contamination in relation to past land use.

Price the work before you compare parcels

List every non-house item: demolition or removal, vegetation clearing, rock excavation, grading, retaining, erosion control, driveway and culvert works, stormwater, foundations, water storage or treatment, wastewater, utility extensions, surveys, reports, permits and professional fees. Western Australian consumer guidance advises obtaining a site-cost quote. The available guidance does not support one universal cost estimate, so use written local quotes tied to your parcel and concept.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make contingencies visible

Separate confirmed quotes from allowances and unknowns. Ask each consultant what assumption could invalidate the figure, such as a deeper rock layer, an upgraded transformer, a longer access route or a larger wastewater reserve area. A low land price can be outweighed by site works that are necessary before the first wall is built.

How to compare two parcels objectively

Score each parcel against the same five axes and record the evidence, outstanding questions and cost allowances. No source establishes a universal weighting; the right balance depends on your house, timetable, risk tolerance and budget.

Comparison axis Evidence to record Decision question
Legal certainty and restrictions Zoning response, dwelling entitlement, permits, overlays, title, easements and covenants Can the intended dwelling be approved on this specific lot?
Usable building area Survey, setbacks, easements, flood or wetland buffers, wastewater reserve and terrain Is there a compliant area for the house, driveway, services and future needs?
Water, wastewater and utilities Provider letters, connection points, capacity, private-source data and authority requirements Can essential services be delivered reliably and legally?
Access and constructability Legal access, road standards, route width, grades, bridges, turning and wet-weather conditions Can construction traffic and emergency vehicles reach the site?
Assessments, site work and connections Geotechnical, environmental, hydraulic and wastewater reports plus itemised quotes Does the total project cost remain viable with a realistic contingency?

Red flags that should pause an unconditional purchase

  • The seller or listing promises “buildable” but cannot provide a planning response or dwelling-entitlement evidence.
  • An access track is used in practice, yet no recorded right of way or maintenance arrangement can be found.
  • Utility lines appear nearby, but providers will not confirm a connection point, capacity or extension cost.
  • The only proposed wastewater area overlaps a setback, easement, flood-prone area or future driveway.
  • The site has unexplained fill, buried material, staining, unusual vegetation or a history of industrial or intensive agricultural use.
  • A steep or irregular block has no survey-based concept plan showing house, access, drainage and services together.
  • Important reports are conditional on assumptions that have not been tested, or consultants cannot inspect the actual building area.
  • The contract deadline expires before the authority and technical checks can be completed.

A practical pre-purchase file

Keep one parcel-specific file containing the title and plan, planning correspondence, overlay maps, access documents, utility responses, water information, wastewater advice, survey, geotechnical and environmental reports, drainage or flood information, quotes and a list of unresolved assumptions. Give the same concept plan and site address to every provider so their responses can be compared.

Before signing or allowing conditions to expire, ask your conveyancer about due-diligence, planning and finance clauses that give you time to obtain these answers. Approval names, testing methods, setbacks and service standards change by jurisdiction, so confirm current requirements with the relevant authority rather than copying a checklist from another region.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The decision: proceed, renegotiate or walk away

Proceed

Proceed when legal permission is documented, the building and service areas fit, access is lawful and practical, providers or technical professionals have addressed the major unknowns, and the complete site budget fits your financial limit with an appropriate contingency.

Renegotiate

Renegotiate when a known constraint has a definable remedy and cost, such as a driveway upgrade, utility extension or revised building footprint. Put the remedy, responsibility and timing in writing rather than relying on a verbal promise.

Walk away

Walk away when dwelling entitlement is absent or uncertain, lawful access cannot be established, essential water or wastewater arrangements are infeasible, or unresolved ground, flood, contamination or cost risks exceed what you can accept. The cheapest parcel is not the cheapest house if it cannot support a compliant, serviceable project.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
