The Building Safety Bill is no longer a Bill. It became the Building Safety Act 2022 when it received Royal Assent on 28 April 2022. The live question is how the Act is being brought into operation: which secondary rules have commenced, how the Building Safety Regulator is using its powers, when unsafe buildings must be remediated, and what qualifying leaseholders can be required to pay.

Implementation remains staged. The Act’s legal text is updated as provisions come into force, while government policy sets additional milestones for remediation and enforcement. The position below reflects the official legislation and policy position available in October 2026; commencement orders, regulations and parliamentary proceedings can change it.

What happened to the Building Safety Bill?

Parliament passed the Bill as the Building Safety Act 2022. Royal Assent was granted on 28 April 2022, so references to the “Building Safety Bill” now describe the Act’s origins rather than a Bill awaiting a final vote.

The Act is a framework statute. The government’s official explainer says that many detailed provisions would be implemented over the following two years through secondary legislation. In practice, commencement orders, regulations, guidance and regulator arrangements determine when particular duties apply. A provision appearing in the Act is therefore not necessarily an immediately enforceable duty in every building or for every duty-holder.

The revised legislation page states that the Act is up to date with changes known to be in force on 6 October 2026, while warning that further changes may be brought into force later. Anyone making a compliance decision should check the current version and the commencement instruments for the relevant provision, not rely on the original 2022 text alone.

How the new building-safety system is organised

The Act created three institutions that form the core of the new regime. Their responsibilities are related but distinct.

Building Safety Regulator

The Building Safety Regulator (BSR) oversees building safety and building performance, with particular attention to high-rise buildings. Its remit also includes improving competence and organisational capability among building-control professionals and people carrying out building work. That competence role matters beyond a single project: accountable organisations, building-control bodies and contractors must be able to demonstrate that safety-critical work is planned and carried out by appropriately capable people.

National Regulator of Construction Products

The National Regulator of Construction Products is intended to provide regulatory oversight of construction products. Product safety is a separate part of the system from the occupation and management of an individual building, but failures in product information or performance can affect design, remediation and enforcement decisions.

New Homes Ombudsman

The New Homes Ombudsman provides an additional route for complaints involving new-home developers. It sits alongside, rather than replacing, the statutory building-safety duties and enforcement mechanisms created by the Act.

These bodies do not make every risk disappear. The day-to-day responsibility still rests with the relevant duty-holder, which may include a landlord, an accountable person, a developer or a building-control organisation, depending on the issue and the building.

When will the Building Safety Act actually be enforced?

There is no single “enforcement day” for the whole Act. Different parts have different commencement dates, and some policy commitments still require regulations or further legislation. Enforcement is therefore best understood in three layers:

  1. Provisions already in force: these apply according to the current revised legislation and any applicable regulations.
  2. Secondary legislation and commencement: detailed requirements are activated through statutory instruments and related rules. The government has repeatedly described implementation as a programme rather than one event.
  3. Future policy milestones: remediation duties, escalation arrangements and a proposed levy have been announced, but the precise legal effect depends on the instruments that bring them into force.

For a live project, record the building’s height, use, ownership and duty-holders; identify the defect and the relevant Act provision; then check the commencement status and regulator guidance for that provision. A policy announcement is not a substitute for checking whether a legal duty has commenced.

What is the remediation timetable?

The Remediation Acceleration Plan update, updated 11 June 2026, provides the clearest forward timetable. It reported that remediation had started or finished in 2,490 of 11m+ buildings by the end of June 2025. That is the figure and denominator used in the Ministry of Housing, Communities and Local Government’s 2026 update; it should not be read as a completion rate for every building in the country without checking the report’s scope and definitions.

The same update proposes a legal duty to remediate and escalating enforcement. The milestones differ by height.

Building category Policy milestone Potential consequence Status to verify
Over 18 metres Remediation expected to be completed; a landlord that has not remediated by the end of 2029 must have a reasonable excuse to avoid the proposed offence. Without a reasonable excuse, criminal prosecution, unlimited fines and/or imprisonment are contemplated. Check the enacted duty, commencement date, definition of reasonable excuse and any transitional rules.
11–18 metres Buildings not remediated or scheduled by the end of 2029 are to be escalated. The update describes 2031 as the natural end date for completion, subject to the conditions in the policy. Escalation and enforcement are expected where progress or a credible schedule is absent. Confirm the final regulations, scope of defects and meaning of “scheduled”.
Other buildings No equivalent height-specific date is supplied in the cited update. Other statutory duties and building-specific enforcement can still apply. Assess the building under the current Act, regulations and guidance rather than assuming it is outside the regime.

Buildings over 18 metres

The proposed end-of-2029 milestone is aimed at landlords that have not completed remediation. The policy says a landlord that fails to remediate without reasonable excuse could face criminal prosecution, unlimited fines and/or imprisonment. Until the relevant legal duty and offence are confirmed in force, treat this as an announced enforcement direction rather than assume every detail is already a criminal offence.

Buildings between 11 and 18 metres

The policy treats these buildings differently. If a building has not been remediated or at least scheduled by the end of 2029, it is to be escalated. The update presents 2031 as the natural end date for completion, subject to the policy’s stated conditions. Owners should therefore keep a documented programme, not wait for 2029 to decide whether work is feasible.

Why a schedule matters

A schedule should identify the defect, investigations still needed, design responsibility, approvals, procurement, residents’ communications, funding route, start date, completion date and evidence of sign-off. A vague intention to investigate is not the same as a funded, dated remediation plan.

The Ministry of Housing, Communities and Local Government used unusually direct language in the update: “We are drawing a line. Avoidance is not an option: landlords must act now or face increasingly stringent penalties.” The statement describes the government’s enforcement policy; the precise penalties depend on legislation and regulations in force at the time.

Who pays for cladding and other defects now?

The Act changes the allocation of costs, but it does not make every leaseholder, landlord or developer liable in every case. The starting point is the statutory category of qualifying leaseholder and the type of defect.

Unsafe cladding

Government guidance says qualifying leaseholders are protected from all costs of remediating unsafe cladding. The protection is statutory, so a demand for cladding costs should be tested against the Act and the leaseholder’s eligibility rather than accepted or rejected solely on the wording of a service-charge invoice.

Non-cladding historical defects

The Act also provides robust protections for qualifying leaseholders against costs connected with historical non-cladding defects. The protection is not described as an automatic waiver of every charge. Eligibility, the building, the lease, the landlord or developer involved and the nature of the defect all matter.

Interim measures

Interim fire-safety measures, including waking watches, are expressly addressed in government guidance. A qualifying leaseholder may have protection against relevant costs, but the exact treatment depends on the statutory conditions and the building’s circumstances. Keep invoices, notices, risk assessments and records showing why an interim measure was introduced.

How to assess “qualifying leaseholder” status

“Qualifying leaseholder” is a statutory term, not a casual description of anyone who owns a flat. Check:

  • the building and its height or other statutory characteristics;
  • the lease and the relevant dates and terms;
  • whether the person or entity identified by the Act as a landlord or developer is involved;
  • the defect category, including whether it is cladding or another historical fire or structural defect; and
  • the statutory evidence and declarations required for the protection being claimed.

Because the tests are fact-sensitive, a leaseholder facing a substantial demand should obtain advice on the current legislation and preserve the documents used to calculate the charge. A managing agent’s label is not, by itself, a legal determination of qualification.

What enforcement tools can force work or payment?

Remediation orders

A remediation order can be used to require a party with the relevant legal responsibility to carry out remediation. It is a mechanism to compel work, not merely a request for voluntary cooperation. The building, defect and identity of the responsible party must fit the statutory conditions.

Remediation contribution orders

A remediation contribution order can require an eligible company or other liable entity to contribute financially to remediation costs. This is distinct from a remediation order: one is principally about carrying out work, while the other addresses payment. Both are tools for allocating responsibility where the statutory requirements are met.

Regulatory enforcement

The BSR and other regulators operate within their statutory remits. Their involvement may include oversight, competence expectations, building-control functions or escalation of non-compliance. Do not assume that reporting a defect to the BSR automatically transfers the building owner’s duty or guarantees funding.

What is the planned building-safety levy?

The Remediation Acceleration Plan says developers, local authorities, registered building-control approvers and the BSR should prepare for a levy planned to come into force on 1 October 2026. The policy material supplied for this article does not establish the final rate, calculation method, exemptions or collection process. Because the stated date is now in the past, organisations should check whether the necessary regulations commenced on that date, were amended or were delayed before budgeting or issuing a charge.

Is the Leaseholder Remediation (Building Safety) Bill law yet?

No. The Leaseholder Remediation (Building Safety) Bill [HL] remains a parliamentary proposal, not enacted law. Parliament’s stages page records first reading on 9 June 2026 and second reading on 11 September 2026. A Parliament news page dated 14 September 2026 said that committee stage had not yet been scheduled.

The Bill could change during committee scrutiny, later stages or amendments. Its title does not give it legal force, and it should not be cited as the source of a current leaseholder right. For a decision being made now, use the Building Safety Act 2022, the regulations in force and applicable guidance; monitor the Bill separately for possible future changes.

What each party should do next

Leaseholders and residents

  1. Ask for the building’s height, defect assessment, remediation plan and named duty-holder in writing.
  2. Separate cladding costs from other fire or structural defects and from interim measures such as a waking watch.
  3. Request the legal basis and calculation for any charge, and keep leases, notices, invoices and safety reports.
  4. Check whether the statutory qualifying-leaseholder tests apply before paying or disputing a demand.
  5. Ask whether a remediation order or contribution order is being pursued where a responsible party has not acted.

Landlords and accountable persons

  1. Confirm which buildings are over 18 metres, between 11 and 18 metres or outside those policy bands.
  2. Maintain a dated remediation programme with funding, procurement, resident communication and evidence of completion.
  3. Record any claimed reasonable excuse for delay and the steps taken to remove it.
  4. Review the current Act, commencement instruments and BSR guidance before relying on a policy summary.
  5. Prepare for the levy framework and retain records showing how any charge is calculated once regulations are confirmed.

Developers, building-control bodies and contractors

Developers and local authorities should identify buildings and projects affected by the remediation programme, while registered building-control approvers and contractors should review competence, organisational capability and product information requirements. The BSR’s competence focus means that demonstrating who was qualified, what decisions were made and which evidence supports them is part of responsible compliance.

How to keep the legal position current

Use three checks before making a decision. First, read the revised Building Safety Act text and note the “in force” date for the relevant provision. Second, check commencement orders and secondary legislation for the detailed duty, offence, exemption or calculation method. Third, check current BSR, government and Parliament updates for implementation dates, remediation guidance and changes to the proposed Leaseholder Remediation (Building Safety) Bill.

That process prevents three common errors: treating the 2022 Act as if every section started on Royal Assent; treating a government milestone as an already-commenced offence; and treating a Bill at second reading as a current legal right. The Building Safety Bill’s next chapter is therefore not another final vote on the original Bill, but the continuing work of commencement, remediation, supervision and enforcement under the 2022 Act.
