What happened at the Austin construction site?
According to an arrest affidavit summarized by KXAN’s report republished by AOL, coworkers found Cancel-Vargas unconscious inside a portable restroom at a construction site near East Cesar Chavez Street and Brushy Street. They had gone looking for him after he did not return to work. First responders attempted lifesaving measures, and he was pronounced dead at 1:05 p.m.
The Travis County Medical Examiner’s Office determined, according to the affidavit as described in the report, that Cancel-Vargas died from the toxic effects of fentanyl, hydroxyzine, methocarbamol and trazodone. The report does not establish that any one substance alone caused his death.
What investigators allege about the delivery
The affidavit reportedly says detectives reviewed calls and texts between Martinez and Cancel-Vargas on the morning of June 24. Investigators linked Martinez to the nickname “Tear Drop” using messages, previous investigations, court records and interviews with law enforcement officials familiar with him. The report says Martinez had tear-drop tattoos near his eye and had previously acknowledged using that street name.

According to investigators’ account in the affidavit, location data placed the two men in the same general area after Cancel-Vargas left the worksite and before he returned less than 15 minutes later. Investigators believe Martinez supplied drugs during that interval. These details are allegations reported through the affidavit, not findings established at trial.
The report says Martinez told investigators he had sold opiates since the early 1990s and acknowledged knowing fentanyl was dangerous. He reportedly acknowledged being Cancel-Vargas’s dealer but said he sold heroin, not fentanyl. Investigators reportedly interpreted a later statement as an admission that he dealt fentanyl. The distinction matters: the report describes Martinez’s account and the investigators’ interpretation separately.

Why prosecutors can bring a murder charge under Texas law
KXAN reported that the charge was filed under a provision added to Texas murder law by House Bill 6. The enrolled law took effect September 1, 2023. It includes a circumstance in which an actor knowingly manufactures or delivers a Penalty Group 1-B controlled substance in violation of the applicable delivery law, and a person dies after introducing any amount of that substance into their body.
The provision applies “regardless of whether the controlled substance was used by itself or with another substance, including a drug, adulterant, or dilutant.” That language addresses cases involving multiple substances; it does not by itself prove that a defendant made a qualifying delivery or that the other legal elements are satisfied. Prosecutors must establish the applicable elements in court. The full enrolled text of HB 6 is available from the Texas Legislature.

What is known about the case’s status
The cited report establishes that Martinez was charged, but it does not establish a later court outcome. A murder charge is an accusation, and Martinez is presumed innocent unless proven guilty. The account of the case here is based on the news report’s summary of an arrest affidavit; the affidavit itself and an official case record were not available in the cited material.
