A fence does not become the legal boundary of farmland just because it is old, straight, or has long enclosed the fields. The legal line comes from the property’s legal description and from the boundary and survey law of the state where the land is located. A long-standing fence can matter under certain doctrines, including boundary by acquiescence, practical location, and adverse possession, but only if that jurisdiction’s required elements are actually proven. If the exact line matters, get a licensed boundary survey first, and consult a local attorney if neighbors disagree.
Start with the legal description, not the fence line
Farmland is identified by its deed. The deed’s legal description, often tied to recorded plats, earlier surveys, and monuments set on the ground, is the starting point for where the title ends. A fence is a physical structure built by people at some point in time, and it may or may not follow that description.
Two sources are commonly used as shortcuts, and both have limits. County GIS parcel data and aerial photographs are useful for orientation. Carroll County, Illinois, states that its GIS boundary data are approximate and do not replace a legal survey, and it advises using an Illinois-licensed professional land surveyor to locate a property line.
Boundary rules are also state-specific. Oregon’s statutes, for example, describe recorded land by a legal description capable of being made certain, and its county-surveyor law addresses documenting the records and monuments used to establish or reestablish lines. Those are Oregon provisions. They show what a state’s framework looks like, not what applies in every state.

Why a fence is evidence, not proof
An Iowa Court of Appeals decision involving farmland shows the gap between a fence and a legal line. The court described the boundary as the section line, even though a curved fence had stood well away from it. The fence ranged from about 65 to 84 feet from that section line. The neighbor claiming the strip between them had to meet the requirements for boundary by acquiescence, and did not. The court was not persuaded that prior farmland owners knew the neighbors regarded the fence as the boundary and agreed to treat it that way for the required period. Nonuse of the strip and the fence’s existence were not enough on their own. This is one state’s decision, and it does not establish a rule for other states.
Survey practice points the same way. Virginia’s surveying standards call for nearby fences and improvements that cross a property line to be identified and dimensioned on a survey. A survey may therefore show a fence sitting on one side of the line, which is itself a sign that the fence and the legal line differ.

When long use can change the line
Several doctrines can allow long use to affect where a boundary is treated as lying. Each has its own elements, and the names are not interchangeable. The table below summarizes the core question each one asks. Confirm the exact requirements in your state before relying on any of them.

In the Iowa case, the claimant’s position failed on the proof of the acquiescence elements rather than on the fence’s appearance. That outcome is a reminder that a fence’s presence is only one fact in a larger record that includes the parties’ knowledge, conduct, and agreement, and the length of time that treatment continued.

No universal time period applies. The required duration, burden of proof, and necessary evidence depend on the doctrine and the jurisdiction. Any figure you find online should be checked against the current statute or case law of the state where the land sits.
Fence cost, repair, and removal are a separate question
Who pays for a fence, who maintains it, and whether it can be removed are not the same as who owns the land on either side. Oregon illustrates the split. Its 2025 Chapter 96 addresses partition fences, including cost sharing, repair, removal, and gates. Chapter 105 separately provides for an action to establish a disputed boundary. A rule that neighbors share fence costs does not make the fence the title boundary, and a maintenance agreement does not settle where the line lies.

Before assuming a fence is the boundary, identify which question you actually have: where the line is, who must maintain or pay for the fence, or whether someone has acquired rights through long use. Each question may be answered by a different body of law.
What to do if the line matters
- Pull the deed, the recorded plat, and any prior surveys for the parcel. Look for survey monuments on the ground and note where they are.
- Before you build, replace, or remove a fence near the suspected line, hire a land surveyor licensed in the state where the land is located to establish or retrace the boundary.
- Keep the survey, dated photographs, correspondence with neighbors, and any records showing how the fence has been treated over time.
- Do not move or remove a disputed fence based only on an online map or aerial image.
- For a disagreement over ownership, encroachment, or rights that may have arisen from long use, consult a local real-estate attorney. If the dispute is not resolved, ask counsel whether your state provides a court procedure for fixing the boundary.
- Once a survey has established the line, marking flags can make it visible during planning. The flags show the surveyed position; they do not establish the boundary.
Choosing a surveyor or an attorney
The two professionals answer different questions. A surveyor locates the line on the ground. An attorney advises on ownership, encroachment, and legal claims. Compare candidates on the points below, and do not assume any particular firm is suitable without checking.

How a court can fix the line
When neighbors cannot agree, some states allow a court to determine the boundary and order it marked on the ground. Oregon’s statute is one example:
“When any dispute or controversy exists between owners of adjacent or contiguous lands in this state, concerning the boundary lines thereof, or the location of the line dividing such lands, any party to the dispute or controversy may bring an action in the circuit court in the county where all or part of the lands are situated, for the purpose of having the controversy or dispute determined, and the boundary line or dividing line ascertained and marked by proper monuments upon the ground where such line is ascertained.”
