The headline’s “proposal” stage is over. On November 13, 2024, the Court issued nationwide directions in In Re: Directions in the Matter of Demolition of Structures (2024 INSC 866). Those directions do not bar every demolition. They allow the removal of unauthorized, non-compoundable construction, but only after a defined legal process, and they set out specific exceptions.
How a proposal became a final judgment
- September 2, 2024: While hearing a batch of petitions alleging that the properties of people accused of crimes were being demolished, the Court proposed pan-India guidelines and invited suggestions. Justice B. R. Gavai was reported as saying: “How can anybody’s house be demolished only because he is an accused? Even if he is a convict, it can’t be done without following the procedure as prescribed by law.” The bench also made clear it would not protect unauthorized construction or encroachment on public roads.
- September 17, 2024: Pending further hearing, the Court ordered that demolitions should not proceed without its leave. This was an interim order with exceptions for unauthorized structures in specified public places and for demolitions directed by a court. It was not the final procedure.
- October 1, 2024: The Court heard submissions on possible safeguards and reserved judgment, reiterating that accusation or conviction alone cannot be a ground for demolition.
- November 13, 2024: The Court delivered its final directions, which preserve lawful action against unauthorized construction through due process.
What the final directions require before any demolition
The judgment sets out a sequence of safeguards. Each step has to be completed in order, and a demolition that skips one falls outside the directions.
- Prior notice. Issue a show-cause notice under the applicable local law, or allow at least 15 days from service, whichever period is later. The notice goes to the owner or occupier by registered post and is affixed conspicuously to the structure. It must identify the alleged unauthorized construction, the specific violation and grounds, the reply documents required, and the details of the personal hearing.
- Digital record of service. Send a digital copy of the notice to the Collector or District Magistrate, which reduces the risk of backdated service. The Collector or District Magistrate is to designate a nodal officer and email address. Municipal and local authorities are to provide a digital portal for notices, replies and orders within the period the judgment specifies.
- Personal hearing and reasoned order. Hold a personal hearing and record its minutes. The final order must address the noticee’s arguments, explain any disagreement, assess whether the construction is compoundable, identify any unauthorized portion, and explain why demolition is the only available option.
- Time to appeal or comply. Do not implement the final order for 15 days from its receipt, including where the statute provides an appeal period. The owner or occupier must be given the chance to remove the unauthorized construction. Action may proceed only if that period expires without removal and the order has not been stayed.
- Inspection and recording. Before demolition, prepare an inspection report signed by two witnesses (panchas). Video-record the demolition and preserve the recording. Prepare a report naming the participating police and civil personnel, and send it to the Municipal Commissioner and the digital portal.
- Accountability. Non-compliance can lead to contempt proceedings and prosecution. If a demolition violates the directions, the responsible officers may be held personally liable for restitution at their own cost, as well as for damages.
Only construction found to be unauthorized and not compoundable may be demolished under this process. Where the law allows compounding, or where removing only the unauthorized portion is possible, the Court treats those options as the proportionate course.

- Unauthorized structures in specified public places, namely roads, streets, footpaths, areas abutting railway lines, and river and other water bodies.
- Cases in which a court has ordered the demolition.
These are exceptions to the directions themselves. They do not make every encroachment case exempt from every procedural requirement under every applicable law. A reader or official should check the specific structure and location against the list before assuming the exception applies.
Why the Court grounded the rule in constitutional principles
The judgment rests on the rule of law, separation of powers, natural justice, proportionality, public accountability, and constitutional protections, including the right to shelter as a facet of Article 21. The Court’s core reasoning is that the executive cannot declare an accused person guilty and impose punishment by demolishing their home. A demolition for a genuine municipal violation still has to be lawful and proportionate. In paragraph 72 of the judgment, the Court wrote:

“The chilling sight of a bulldozer demolishing a building, when authorities have failed to follow the basic principles of natural justice and have acted without adhering to the principle of due process, reminds one of a lawless state of affairs, where ‘might was right’.”
What the petitioners alleged and what the State said
The petitions arose from claims that State authorities had demolished, or threatened to demolish, residential or commercial property belonging to people named as accused in criminal cases. The State of Uttar Pradesh disputed the allegations and said the demolitions were carried out under applicable municipal laws. The allegations are the petitioners’ claims and the State’s position is the State’s. The Court’s directions are a statement of the law going forward, not a finding that each demolition described in the petitions was unlawful.

What is and is not established about the scale of punitive demolitions
No reliable national count of punitive demolitions is available from an original, official source, so no national figure or trend can be stated as fact. During the October 1, 2024 hearing, Solicitor General Tushar Mehta was reported by LiveLaw in 2024 as submitting that the cases described as punitive were “less than 2%” of demolitions. That was a party’s submission made during argument, not a finding of the Court and not a verified statistic.
This article also does not establish how the directions have been implemented state by state, or what enforcement outcomes followed. Those questions require official implementation records and later court proceedings. For the binding rules, the judgment in 2024 INSC 866 is the primary text to consult.
