Start with the title report or title commitment from when you bought the property, then check the deed’s legal description and the county recorder’s related easement documents and recorded plats. If you suspect a public utility easement, ask the utility provider or local planning office. A blank assessor map, online search, or current deed does not prove that no easement exists. For a parcel-specific answer or an accurate location on the ground, consult a title professional, licensed land surveyor, or attorney, depending on the question.
How to check for a utility easement
- Review your purchase title work. Find the preliminary title report, title commitment, or closing documents. These may list easements as exceptions and identify recorded instruments or maps to review. Report formats vary: Colorado Springs, for example, describes easement exceptions in the B-2 portion of its title report; do not assume that label applies elsewhere. Colorado Springs guidance.
- Read the deed’s legal description. Note any subdivision or parcel-map name, book and page, instrument number, and references to easements. A deed may refer to an easement without containing the full grant.
- Search the county recorder’s records. Look for separate easement instruments, earlier deeds, and recorded plats using the references you found. Search systems differ. Marin County says its online recorder index searches by names rather than address or parcel number, and documents recorded before 1973 require an in-person visit. Yolo County also describes name-based searches. Check your county’s own guidance for search methods, digitization, copying, and access limits. - Check recorded plats and planning records. Subdivision and parcel plats may show utility strips or contain easement notes. Assessor parcel maps can help identify a parcel, but they are not necessarily a complete easement record. Yolo County says easement information is not maintained on its assessor parcel maps. - Contact the utility or local jurisdiction. If a pole, line, pipe, or other infrastructure raises a question, ask the provider or city or county which easement or records may apply. - Get professional help for interpretation or location. A title professional can help trace recorded title documents; a licensed surveyor can help locate described lines or areas relative to property boundaries; an attorney can advise on legal effect or a dispute. What different records can tell you
Easements may be created or shown in deeds, separately recorded agreements, or recorded subdivision and parcel maps. A current deed or online parcel viewer may not include every relevant document. San Mateo County cautions that easements may not appear on record maps or the latest deeds, while Yolo County says its assessor parcel maps do not maintain easement information. A utility line and a legal easement are different questions
Seeing a pipe, wire, or pole does not by itself establish the easement’s recorded scope or legal status. Conversely, finding an easement document may not show its precise location on the ground. Easements may apply to areas above ground as well as below it. Before building, excavating, or changing a site, confirm the document’s location, purpose, and permitted uses with the responsible authority and appropriate professionals.
