Their vote went against council officers’ recommendation to support the application, but it was not the final decision: the state Development Assessment Panel (DAP) approved a revised scheme three days later, by 3–2.
What the council voted on
The application, DA23/0883 (DAP file DAP/23/02548), was lodged by Urbanista Town Planning for owners Affluent Property Investments and Snow Oak. The original proposal was for 43 dwellings across six storeys, with underground parking, at 39 Chester Avenue. The site is next to Our Lady’s Assumption primary school. Council officers had recommended that councillors endorse a responsible authority report supporting approval. Instead, councillors voted to oppose the proposal and recommend refusal to the state panel. The distinction matters: the 9–1 vote expressed the council’s position but did not determine the application.
Why councillors and residents raised concerns
Built form, scale and planning expectations
Councillor Damien Giudici said the proposal did not match the planned built-form outcome for the site and did not minimise direct overlooking of adjoining properties. He described privacy as a significant public concern. Separately, the City of Stirling’s 8 April 2024 design review raised concerns about the earlier plan’s repetitive six-level footprint, bulk and scale, and height and plot ratio beyond what the planning framework anticipated. Privacy concerns beside the school
Parents raised concerns about potential views into school grounds. Parent Ricky Cheung told PerthNow, “My biggest concern is privacy for our kids,” and said, “There has been no communication from the developers with parents.” These are his reported concerns; they do not establish that overlooking occurred or that communication did not take place in other forms.
The proponent’s case
Urbanista Town Planning director Petar Mrdja argued that the location was close to amenities and public transport and could set an architectural benchmark. He told PerthNow: “We’ve got a housing shortage. We’re close to a shopping centre, good amenities and public transport.” Those are the planner’s arguments for the development, rather than independently verified outcomes.

How the proposal changed before approval
PerthNow reported that the applicant amended the scheme before the DAP decision, removing one level and eight dwellings, reducing the rooftop terrace and increasing setbacks. The report described the approved version as 35 dwellings and six storeys. The reported changes distinguish the revised plan from the original 43-dwelling proposal; they do not by themselves establish how much any privacy concern was addressed.

The state panel’s decision overruled the council recommendation
On 9 May 2024, the DAP approved the revised scheme by a 3–2 vote. That state-panel decision followed the City of Stirling’s recommendation to refuse the application and meant the revised proposal was approved despite the council’s opposition. The two votes were made by different decision-making bodies and had different effects: councillors recommended refusal; the DAP made the approval decision.

What the reported decision does—and does not—establish
The available reporting documents the May 2024 decision sequence, the principal concerns raised about the earlier design, and changes reported before the DAP approval. It does not establish whether the building was subsequently constructed or what privacy conditions are experienced at the site. No conclusion about an actual completed building or its effects should be inferred from the planning debate alone.
