Possibly. In the United States, selling a tool secondhand does not by itself settle whether you could be held responsible if someone is hurt. The answer can depend on the state law that applies, whether you sold the tool privately or as part of a business, its condition and history, what you knew or said about it, and how it caused the injury. Federal product-safety rules also apply to secondhand sales, including occasional yard-sale sales.
What can affect your liability?
There is no single nationwide rule that answers every used-tool injury claim. A buyer or another injured person may bring a claim under a theory such as negligence, misrepresentation, warranty, or product liability, depending on the jurisdiction and facts. The name of the claim does not determine the result by itself.
- Your role in the sale: A one-time private sale may be treated differently from regularly selling tools as a commercial activity. State laws do not necessarily use the same definition of a seller.
- The tool’s condition and history: A defect, prior repair, alteration, or missing safety feature may be relevant, as may whether the tool was substantially changed after it left the seller.
- Your knowledge and statements: What you knew about a hazard, what you disclosed, and any claims you made about the tool can matter. The available sources do not establish one uniform nationwide test for these facts.
- The injury and its connection to the tool: A claim must be assessed under the law that applies to the particular injury and circumstances.
- The governing state law: The state examples below illustrate differences; they are not a survey of every state and cannot predict the outcome of an individual claim.
Why private sales and commercial resales may differ
Some state product-liability laws focus on whether the seller was engaged in the business of selling the product. That distinction means a rule written for commercial sellers should not automatically be applied to every occasional private sale—or assumed to exclude every private seller under all other legal theories.

Federal safety rules also apply to secondhand sales
Civil liability and federal product-safety restrictions are separate questions. The Consumer Product Safety Commission (CPSC) says its laws and regulations apply to people selling or distributing consumer products, including people holding yard sales and flea markets. Its resale guidance advises sellers to examine used products for safety and federal-law compliance.

The CPSC says secondhand sellers do not need a CPSC license and resellers do not need to test and certify products they resell. It nevertheless advises checking that products are safe and have not been recalled. The agency states that selling a recalled product is illegal. It also says resellers, including auction-site sellers, and people giving used products away cannot knowingly transfer products that do not meet applicable legal requirements. These federal rules do not resolve every possible state-law damages claim.
What to check before selling a used tool
These precautions can help you make a more informed sale, but they are not a legal safe harbor and cannot guarantee that you will avoid a claim.

- Identify the tool. Record the make and model so you can check information for the specific product rather than relying on a general search.
- Check current recall notices. Do not sell a tool that is recalled. If you cannot determine whether a safety issue or legal status has been resolved, pause the sale while you verify it.
- Inspect it for visible hazards. Look for missing guards, damaged cords, cracked housings, altered safety features, and improvised or undocumented repairs. An inspection does not establish that a tool is safe in every respect.
- Describe its condition accurately. Disclose known defects and limitations, and do not make safety or performance claims you cannot support.
- Keep a record of the transaction. Retain the listing, messages, and any information about repairs, modifications, or condition that you provided to the buyer.
Does an “as-is” sale protect you?
Do not assume that writing “as is” automatically eliminates product-safety duties or defeats a claim. The effect of a disclaimer or waiver depends on the applicable law and facts. The sources cited here do not establish a reliable rule that an “as-is” label is a complete defense across the United States.
