The Town’s 2026/2027 notice sets different requirements depending on whether the property is 2,000 m² or less or larger. Failing to comply can attract a fine of up to $5,000, and the Town may also recover the cost of work it performs.
Who must comply, and when?
The Town of Victoria Park’s 2026/2027 firebreak notice applies to landowners and occupiers under section 33 of the Bush Fires Act 1954. The notice was published on 24 September 2026. Required work must be completed by 31 October 2026 and maintained until 30 April 2027. What work is required for your property?
The land-area threshold determines whether you must treat vegetation across the whole property or install firebreaks in specified locations.

Properties of 2,000 m² or less
On a block at or below the threshold, the requirement applies across the land, rather than only to a perimeter strip. Remove inflammable matter while retaining the specified exceptions for living trees and shrubs, cultivated plants and lawn. Vegetation must be ploughed, cultivated or slashed to a maximum height of 50 mm. A brush cutter or string trimmer may be one way to slash vegetation; it is an example tool, not a product endorsed by the Town.

Properties over 2,000 m²
On a larger property, the notice calls for firebreaks at least 3 m wide and 3 m high, placed immediately inside the external boundaries and around buildings and storage areas for inflammable liquids or gas. These are both width and height requirements; a narrow strip or one with inadequate vertical clearance does not meet the stated dimensions. What counts as inflammable matter?
The notice’s definition includes dead plant material and other combustible material not associated with a structure or living garden. The exceptions for living trees and shrubs, cultivated plants and lawn apply to the small-property requirement; they do not make dead or discarded combustible material exempt.

Can you request a variation?
If it is impractical to comply with the standard requirements, apply to the Town in writing by 31 October 2026. A variation is limited to one firebreak period and expires on 30 April 2027. An application alone does not change your obligation: retain the Town’s written approval and follow the terms it grants. When is burning allowed?
The Town’s listed burning periods distinguish restricted burning, which requires a permit, from the prohibited period. The firebreak notice’s instruction to remove rubbish and discarded materials by means other than burning applies in addition to these seasonal restrictions.

What is the penalty for ignoring the notice?
The Town’s 2026 notice says the penalty for failing to comply is a fine of not more than $5,000. A person in default may also be liable for the cost of work the Town performs if the owner or occupier has not carried it out by the required date. Town of Victoria Park 2026/2027 Firebreak Notice
