How to Plan a Behavioral Health Treatment Center for Patient Privacy and Safety

A practical planning guide for aligning behavioral health services, safety assessments, privacy measures, and locally applicable facility requirements.

Plan the building around the care it must support: its service model, patient population, staffing, and daily workflows. Then assess environmental risks and privacy needs together, so design choices support treatment without treating a particular fixture, room type, or national guidance document as a universal building specification.

Start with the services and the people who will use the facility

Before developing a room schedule, define the center’s services, patient groups, operating hours, and staffing model. A project may serve one setting or combine several, and each can create different circulation, privacy, supervision, and support needs.

Care setting or service Planning questions to resolve
Inpatient psychiatric care How will admission, observation, treatment, medication workflows, and discharge operate for the intended patient population and acuity?
Residential treatment How will treatment and daily living, visitor participation, staff coverage, and quiet or retreat needs fit together?
Partial hospitalization, day treatment, or intensive outpatient How will arrivals and departures, group and individual sessions, waiting, and transitions between program activities work?
Outpatient care Where will private conversations take place, how will staff handoffs occur, and how can reception and waiting reduce unintended disclosure?
Crisis stabilization How will a person move from initial contact to response and a safe place for help, and how will the center coordinate with other services?

SAMHSA’s 2025 crisis-care framework uses the components “Someone to Contact,” “Someone to Respond,” and “A Safe Place for Help” to describe a crisis-care system. Its Certified Community Behavioral Health Clinic criteria address access, coordination, services, quality, and governance. These documents can inform operational planning; they do not substitute for local construction requirements.

Map the actual journeys through the building: arrival, intake, assessment, individual and group treatment, participation by family or support people, medication workflows, crisis response, observation, quiet or retreat, discharge, and transfer. Mark where confidential conversations occur, where information must pass between staff, and where a person might wait within earshot or sightline of others.

Turn the service model into a room and adjacency brief

Use the workflow map to develop a project-specific room schedule and adjacency plan with clinical leadership, facilities staff, and the design team. For each space, identify its users, activities, privacy needs, supervision needs, equipment, and access requirements. The available guidance does not establish a universal room count or room schedule; those depend on the service scope, population, operations, local standards, and professional design process.

Assess environmental safety in the context of care

For inpatient psychiatric care, CMS identifies ligature points and other environmental hazards as issues for assessment. CMS defines a ligature point as something that could be used to attach cord, rope, or another material for hanging or strangulation. Its examples include shower rails, coat hooks, pipes, radiators, bed frames, window and door frames, ceiling fittings, handles, hinges, and closures.

The assessment should look beyond an individual fixture. CMS materials also call attention to unsecured housekeeping or utility items, objects visitors might bring, windows that can be opened or broken, unprotected lighting, and staffing limitations that affect observation. A feature’s significance depends on the space, the people who may use it, and how the center operates.

Make the review a documented, multidisciplinary process

Bring clinical, facilities, environmental services, security, and design perspectives into a documented review. For each space and relevant hazard, record:

  • What the potential hazard is and who may be exposed to it.
  • How the space, fixtures, furnishings, and operating practices affect the risk.
  • What mitigation is selected, who is responsible for it, and how it will be maintained.
  • How residual risk will be managed, including any relevant observation or staffing considerations.
  • Who can approve corrective actions and how findings will be revisited when conditions change.

CMS says environmental risk assessment tools may help identify risks and document findings, but CMS does not require a particular tool. Its 2017 policy letter describes interim survey policy; do not assume that memo alone is a complete statement of current requirements. Check for later CMS guidance and the accreditation rules that apply to the project.

Evaluate controls as a system, not a product category

Ligature-resistant fixtures or behavioral health door hardware may form part of a risk-control plan, but selecting a product does not by itself establish that a space is safe. Evaluate product documentation and suitability for the specific use, installation, maintenance, and interaction with the rest of the environment. Consider whether hazards can be removed or mitigated, what risk remains, and who owns reassessment.

For settings other than inpatient behavioral health, The Joint Commission has an FAQ specifically covering residential, partial hospitalization, day treatment, outpatient, and intensive outpatient programs. Because requirements may depend on the current FAQ and applicable accreditation manual, confirm the current answer for the program in question instead of assuming every non-inpatient setting has the same assessment obligation.

Build privacy safeguards into spaces and workflows

HIPAA does not categorically require private rooms, soundproofing, or facility restructuring. HHS Office for Civil Rights guidance says covered entities must use reasonable administrative, technical, and physical safeguards against impermissible disclosure, taking the setting and reasonable practices into account.

That leaves meaningful design choices. Plan where reception, intake, counseling, group therapy, staff handoffs, and records access occur. Review sightlines and audibility, the spacing and arrangement of waiting areas, access to workstations and records, and procedures for conversations in shared spaces. HHS gives curtains or screens around common communication areas, and cubicles, dividers, or shields in high-communication areas, as examples that may reduce incidental disclosure.

Balance confidentiality with treatment and safety communication

Privacy controls should reduce unnecessary exposure without blocking appropriate clinical communication. HHS explains that mental and behavioral health information may be shared in certain circumstances to support treatment and safety. Establish staff procedures for handling conversations and records, and design handoff areas and workstations to support those procedures.

Use private rooms or acoustic treatment when the project’s clinical and operational needs support them, not because HIPAA universally mandates them. Likewise, a screen, curtain, or divider can be a practical safeguard in a particular workflow, but it does not guarantee HIPAA compliance.

Confirm which requirements govern this project

The right criteria depend on location, occupancy, facility classification, services, and accreditation goals. Before design development is finalized, have the owner and design team confirm the applicable jurisdiction and authority having jurisdiction, adopted building and fire codes, accessibility requirements, health-facility licensing rules, and accreditation criteria for the intended service model.

Keep the sources’ scopes distinct:

  • CMS: Its cited ligature-risk material concerns psychiatric settings and survey policy; verify current guidance applicable to the facility and services.
  • The Joint Commission: Its environmental-risk FAQ addresses named non-inpatient behavioral health settings. Confirm the current FAQ and applicable accreditation manual rather than generalizing beyond them.
  • HHS Office for Civil Rights: Its HIPAA guidance addresses privacy safeguards and impermissible disclosure, not a universal room or soundproofing specification.
  • SAMHSA: Its crisis-care framework and CCBHC criteria can inform program and operational planning; they do not replace adopted building codes or licensing rules.

The cited design references also have defined scope and dates: a 2017 FGI behavioral health design guide and a January 2021 VA guide for inpatient mental health and residential rehabilitation treatment program facilities. Treat them as references, not automatically current or universally applicable requirements. Ask the design professional and authority having jurisdiction to verify current editions and local adoption.

Use a project decision record to keep design choices accountable

As planning advances, record the reasoning behind decisions that affect privacy or safety. A concise decision log can help clinical, design, facilities, and compliance teams work from the same assumptions and identify unresolved issues before construction documents are finalized.

  • Service assumption: Which population, program, acuity, and operating workflow is this choice intended to support?
  • Risk or privacy need: What specific hazard or disclosure concern is being addressed?
  • Selected control: What environmental, operational, or procedural measure will be used?
  • Applicability: Is the basis a current legal or code requirement, licensing or accreditation criterion, or a design reference?
  • Ownership: Who will approve, install, maintain, train staff on, and reassess the measure?

This record is especially useful when a design reference, product choice, or operating assumption is being considered outside the jurisdiction or facility type for which it was written. Resolve applicability with the relevant design professional, compliance lead, and authority having jurisdiction before treating it as a project requirement.
