What Employers Must Know About Workplace Accommodations in Construction

Construction employers should assess ADA accommodation requests individually, based on essential job functions, current site conditions, objective safety evidence, and effective alternatives.

U.S. construction employers must consider reasonable accommodations for qualified applicants and employees with disabilities under Title I of the Americans with Disabilities Act (ADA). A changing jobsite does not create a blanket exemption: employers should assess the person’s work, essential functions, current site conditions, safety evidence, and effective alternatives individually. This is a federal overview, not a determination of any particular worker’s rights; state and local requirements may differ.

When does the ADA require an accommodation?

Title I prohibits discrimination against a qualified individual with a disability in hiring and other terms and conditions of employment. An employer may violate the ADA by failing to reasonably accommodate known limitations unless the employer can demonstrate that the accommodation would impose an undue hardship. The duty applies to qualified applicants as well as employees. See the EEOC’s employer guidance and the statutory text.

The question is not whether a person can do every task in every possible circumstance without assistance. It is whether the person is qualified for the job and can perform its essential functions, or enjoy equal employment benefits, with an effective reasonable accommodation. The ADA does not require removing an essential function or lowering legitimate performance standards. Employers should identify the job’s actual essential functions rather than assume that every task commonly associated with a trade or title is essential in every role.

How should employers handle an accommodation request?

When the limitation or an effective solution is not obvious, discuss the work-related barrier with the applicant or employee. The individual may suggest an accommodation; the employer should consider that suggestion alongside other options that could be effective. The aim is to identify a reasonable solution, not to require a particular form of words or treat the first proposal as the only possible answer. The EEOC describes the process in its employer guidance; the Job Accommodation Network (JAN) offers free individualized consultation for employers.

  1. Receive the request and clarify the barrier. Ask what work activity or employment benefit is affected and what change may help. Keep the conversation focused on the accommodation need and job-related information.
  2. Identify the essential functions. Review the real duties and performance requirements of the specific role, not just a generic job title or a list of occasional tasks.
  3. Assess the current work setting. Consider the actual project, terrain, structures, equipment, facilities, schedule, and expected changes—not assumptions about construction sites as a whole.
  4. Discuss possible options. Involve the worker in identifying effective approaches, including alternatives to the worker’s initial suggestion.
  5. Evaluate safety and feasibility. Use objective, individualized evidence to assess any safety concern and consider whether an accommodation can reduce or remove the risk.
  6. Select an effective accommodation and revisit it when facts change. A material change in the person’s duties or site conditions may affect whether the existing arrangement remains effective or whether another option should be considered.

What does a changing construction site mean for accessibility?

Temporary sites can present genuine accessibility challenges. The EEOC’s Title I technical assistance manual gives the example of a temporary construction site where changing terrain and structures might make physical access excessively costly or fundamentally alter the site. That example belongs within an individualized undue-hardship analysis; it does not exempt construction employers from considering accommodation.

Evaluate access in the context of the employee’s work. Depending on the job, relevant conditions may include routes around the site, work areas, necessary equipment, and employee facilities used for employment activities. The same site may pose different barriers for different roles, and conditions may shift as construction progresses. The practical question is whether an effective accommodation is feasible in the actual setting, not whether the site is generally described as temporary or changing.

How should employers assess safety concerns?

Employers may apply job-related safety qualifications, but a disability or diagnosis alone does not establish that a person presents a safety risk. Under the EEOC’s guidance, a direct-threat determination must be an individualized assessment grounded in current medical knowledge or the best available objective evidence. It must concern a significant risk of substantial harm, rather than speculative concern or generalized assumptions. Assess the specific job, person, and current conditions. Then consider whether an accommodation—such as a change in equipment, work arrangement, or task allocation that does not remove an essential function—could control or reduce the risk. Document the objective basis for the assessment and the options considered, rather than relying on assumptions about a diagnosis or on a general statement that construction work is dangerous.

What accommodations might be effective in construction?

Possible accommodations depend on the individual, job, employer, and site. EEOC materials identify examples such as accessible facilities, job restructuring, modified schedules, equipment or device changes, policy adjustments, leave, and reassignment to a vacant position when appropriate. These are possibilities to evaluate—not automatic entitlements or a checklist that fits every role. Telework is relevant only when the duties can be performed remotely. The EEOC discusses examples in its employer overview, technical assistance manual, ADA questions and answers, and small-employer guidance.

Compare options against the real barrier and essential functions. For example, a schedule or equipment adjustment may address one person’s limitation in a particular role, while another job may require a different solution. If an initially proposed option is not feasible, identify whether another effective option would work under the site’s conditions.

When can an accommodation be an undue hardship?

Undue hardship means significant difficulty or expense, evaluated in context. Relevant considerations include the accommodation’s cost and the employer’s size, resources, and operations; substantial disruption or a fundamental alteration may also matter. There is no single cost threshold that decides every request. A challenging site condition or expense should be assessed in relation to the employer and the accommodation at issue, rather than treated as a categorical reason to stop the process. The EEOC explains the standard in its employer guidance and technical assistance manual.

If one accommodation would impose undue hardship, consider whether a different effective accommodation would avoid it. The decision should account for effectiveness, actual site feasibility, individualized safety, direct and operational costs, and the employer’s resources. The worker’s preferred option need not be the only option selected, but an alternative must address the relevant limitation effectively.

What should employers document and when should they seek advice?

For a specific request, keep a practical record of the job’s essential functions, the work-related barrier discussed, the site conditions considered, the options explored, the evidence underlying any safety assessment, and the reason for the selected accommodation or any claimed undue hardship. Protect medical information and limit its circulation to those who need it; consult qualified HR or legal advisers about applicable confidentiality requirements and difficult disputes.

The EEOC technical assistance manual is a legacy resource. It provides useful examples, including the temporary-site discussion, but employers handling a live dispute should check current law and obtain jurisdiction-specific advice. Federal ADA Title I is the focus here; state and local laws may impose different or additional duties.
