Construction Dust

Who to Contact About Construction Noise, Dust or Traffic Near Your Home

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For construction or demolition dust and noise affecting your home or a public area, start with your local authority’s Environmental Health Department. Contact the site contractor about mud or debris they have carried onto a public road, the council’s highways department about roads, highways or pavements, and the police when dangerous debris or an immediate traffic danger is not being dealt with.

The detailed statutory-nuisance rules described here apply to England. GOV.UK’s demolition complaint route covers England and Wales. Working hours and site controls can vary because local authorities and planning permissions may impose different conditions, so check the specific council and site rather than relying on a single national timetable.

Use this contact route for the problem you actually have

Problem First contact What that route is for
Dust from demolition or construction affecting your home or a public area Local authority Environmental Health Department Investigation of a potential public nuisance and site controls affecting nearby premises or public spaces.
Construction or demolition noise disturbing neighbours Local authority Environmental Health Department Noise complaints and possible controls on hours, machinery, noise levels and mitigation.
Demolition noise or obstruction of a road or pavement Local council GOV.UK’s demolition complaint route for England and Wales.
Mud or debris deposited on a public road Contractor in charge of the site The contractor should prevent material leaving the site and arrange road cleaning.
Road, highway or pavement condition or obstruction Local authority highways department Road and pavement matters, including obstruction and cleanliness issues that require highway action.
Dangerous road debris that the contractor is not addressing Police An urgent road-safety response; police may need to close the road while it is cleaned.
Immediate road-traffic danger or traffic-control problem Police Road-traffic enforcement and immediate safety concerns.

If more than one problem is happening, make separate reports to the bodies responsible for each part. For example, a site can generate both statutory-nuisance noise and mud on a highway; Environmental Health and the contractor are different first contacts.

Construction dust: report it to Environmental Health

Health and Safety Executive (HSE) guidance directs people who are experiencing dust from a demolition site in a public area to their local authority Environmental Health Department. The same route is appropriate when dust is reaching your home and appears to be creating a public nuisance.

Use your council’s website to find its Environmental Health reporting channel. Explain where the site is, where the dust is travelling, when it occurs and the effect on your property or use of the area. If the dust is also contaminating a road or pavement, notify the contractor and highways department separately; an Environmental Health report does not replace a request for highway cleaning.

What Environmental Health can consider

In England, the council assesses whether a complaint could amount to a statutory nuisance. GOV.UK describes the test as an unreasonable and substantial interference with the use or enjoyment of premises, or an injury to health or a likelihood of injury to health. A complaint being investigated does not guarantee that the legal test will be met or that enforcement will be immediate.

Dust controls may also arise from site-specific permissions or conditions. Ask the council which team handles the report and whether the demolition or construction activity has relevant planning or environmental conditions.

Construction noise: contact the local authority

For demolition or construction noise affecting neighbours, contact the local authority Environmental Health Department. Councils can set or enforce conditions dealing with working hours, plant or machinery, noise levels and measures to reduce noise, depending on the site and the applicable permission or notice.

Check the site’s permitted hours

Do not assume that one national construction-hours schedule applies everywhere. HSE states that many local authorities set operating-time limits, while planning permission may add conditions for the individual site. Ask the council whether the site has planning or noise-control conditions and whether the work is taking place within the permitted hours.

When you report the noise, distinguish ordinary intermittent activity from a recurring pattern, unusually loud machinery, night work or activity outside the hours the council identifies. Give the council enough detail to match your report to the relevant site permission or control.

Traffic noise is a separate issue

England’s statutory-nuisance noise rules do not apply to traffic noise. If the disturbance is caused by vehicles, congestion, unsafe manoeuvres or traffic management on a road, do not automatically frame it as a construction-site statutory-noise complaint. Use the highways department for a highway or pavement issue and the police for a road-traffic or immediate safety issue.

Mud and debris on a public road

For mud or debris carried from a construction site onto a public road, contact the contractor in charge of the site first. HSE says the contractor should prevent mud reaching public areas and arrange for the road to be cleaned.

When to involve the highways department

Contact the local authority highways department for a road, highway or pavement issue, including continuing deposits, an obstruction, or a surface that remains unsafe after the contractor has been notified. Give the precise location and identify the affected road or pavement rather than describing the problem only as “construction trouble.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When the police are the right escalation

If debris is dangerous and the contractor is not dealing with it, contact the police. HSE notes that police may need to close the road while it is cleaned. Use this route for an immediate road-safety risk, not as a substitute for a routine request about site cleanliness.

Prepare useful evidence before you report

The official guidance identifies the responsible bodies and the conditions they may control, but it does not prescribe one universal evidence checklist. These practical details make it easier for the receiving team to identify the site and assess what is happening:

  • Record the full site location, nearby road name and any useful site identifier.
  • Note the date and time of each incident, including how long the noise, dust or obstruction lasted.
  • Describe what happened in concrete terms: dust clouds crossing a boundary, a particular machine, lorries depositing mud, or debris blocking a pavement.
  • Explain how the problem affected you, such as preventing normal use of a room or garden, restricting access, or creating a road-safety hazard.
  • Record whether the problem is recurring, whether it happens at particular times, and whether it has worsened.
  • Keep photographs or video taken safely and from a lawful place. Do not enter the site or place yourself in danger to obtain evidence.

Ask the council which team handles the issue and how it wants supporting material submitted. Keep copies of your report and any reference number so you can identify the same incident in later correspondence.

How to make the report

For dust or construction noise

  1. Find the local council’s Environmental Health reporting page.
  2. Choose the category that most closely matches construction noise, demolition noise, dust or public nuisance.
  3. Provide the site location, incident dates and times, the effect on your home or public area, and any safe photographs or video.
  4. Ask whether planning or noise-control conditions apply, including operating hours, machinery restrictions, noise limits or mitigation requirements.
  5. Use the council’s stated follow-up route if the problem continues, quoting your original reference.

For demolition affecting a road or pavement

  1. Use the local council or GOV.UK demolition complaint route available for England and Wales.
  2. State whether the complaint concerns noise, obstruction, or both.
  3. Identify the road or pavement and explain whether access is blocked, narrowed or unsafe.
  4. Report any separate dust or public-nuisance concern to Environmental Health.

For mud or debris

  1. Contact the contractor or site manager using the site signboard, if one provides a contact.
  2. Describe the exact road or pavement location and the material deposited.
  3. Request cleaning and explain any immediate hazard to pedestrians, cyclists or drivers.
  4. Notify the highways department about a continuing road or pavement issue.
  5. Contact police if dangerous debris remains and requires urgent traffic control or closure.

What the council’s legal test means in England

For an England statutory-nuisance complaint, the question is not simply whether an activity is annoying. GOV.UK says the issue must unreasonably and substantially interfere with the use or enjoyment of premises, or injure or be likely to injure health. Councils must investigate complaints that could qualify, but the outcome depends on the facts and the council’s assessment.

Construction-noise notices can specify operating hours, plant or machinery, noise levels and steps to reduce noise. Those controls are site-specific; a notice for one project does not establish a rule for every project in the area.

Choose the right route in common situations

Dust enters your home during demolition

Report the dust to Environmental Health, giving the dates, times, direction of travel and effect on your property. If dust is also settling on a public road, contact the contractor about preventing it and cleaning the road.

Concrete deliveries leave mud on the highway

Tell the contractor in charge and ask for immediate cleaning. If the highway remains affected, report it to the local highways department. If the mud or debris creates an immediate danger and is not being addressed, contact police.

Workers operate noisy machinery outside the stated hours

Ask Environmental Health whether the site has permitted hours or a noise-control condition and report the dates and times that appear to fall outside them. The council can assess the relevant permission or notice.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Construction vehicles create dangerous traffic conditions

Separate a highway defect or obstruction from a traffic offence or immediate danger. Use the highways department for the former and police for the latter, with the site contractor informed about operational problems where appropriate.

Jurisdiction and limits

The statutory-nuisance explanation in this article is England-specific. The demolition complaint service cited by GOV.UK covers England and Wales. The available official guidance does not establish one national complaint process for every UK nation or one universal set of construction working hours. If you are in Scotland or Northern Ireland, check the relevant local authority’s current process and the conditions attached to the particular site.

For any location, verify the council responsible for the site rather than the council where you work or where the contractor is based. A project can cross administrative boundaries, and the authority responsible for the road may differ from the authority handling an environmental-health complaint.

A short checklist before you submit

  • Have you classified the problem as dust, construction noise, demolition, mud or debris, a highway issue, or a traffic danger?
  • Do you have the site address, affected road or pavement, and dates and times?
  • Have you described the effect on your home, access or public safety?
  • Are your photographs or videos safe and lawfully taken?
  • Have you asked about the site’s planning or noise-control conditions and permitted hours?
  • Have you contacted the contractor, highways department or police as well as Environmental Health when the problem involves more than one responsibility?

For public-nuisance construction dust or noise, the key first step is the local authority Environmental Health Department. Route road cleanliness to the contractor and highways department, and reserve police contact for dangerous debris or an immediate traffic-safety problem.
