New York City generally looks to the property owner next to the sidewalk for the repair, even when a utility company or private contractor caused the damage. The owner’s city-facing duty and the utility’s responsibility for defective work are separate issues. You should document the damage, ask the company that performed the work to repair it, and preserve evidence for a reimbursement request. If a violation notice has arrived, pursue the utility without allowing that notice’s deadline to lapse.
NYC Department of Transportation (DOT) guidance says an owner must document utility-caused damage and contact the company that made it. NYC311 likewise advises keeping receipts and seeking repayment from the responsible utility or private contractor if you have to arrange and pay for the repair. Those instructions provide a practical recovery route, but they do not decide liability or guarantee that the company will reimburse you.

Why the adjacent owner remains responsible to the city
NYC311 states that the owner is responsible for building or repairing the sidewalk next to the property and maintaining it in a reasonably safe condition, regardless of how the defect happened. That owner-facing rule means a sidewalk can be damaged by a permitted utility cut, a private construction crew, tree work, or another event and still generate a violation for the adjacent owner. The city can hold the owner responsible for correcting the condition, and violations may lead to fines or city-arranged work billed to the owner.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesThis is different from deciding who caused the damage. A utility or contractor may have to correct defective work under its permit, contract, or other legal obligations, while the owner remains the person the city expects to keep the sidewalk safe. Contacting the utility does not transfer the violation to that company and does not automatically pause a city deadline.

Who does what after utility-related sidewalk damage?
| Situation | City-facing obligation | Practical repair or recovery route |
|---|---|---|
| A utility or private contractor visibly damaged the sidewalk | The adjacent owner must keep the sidewalk safe and address any violation. | Document the condition and ask the company that performed the work to repair it. If you pay, retain invoices and receipts and seek repayment. |
| A violation notice has been served | The owner generally has 75 days after receiving a Notice of Sidewalk Violation to complete the repair. | Track the 75-day date while pursuing the utility. DOT may arrange the work and bill the owner if the deadline is missed. |
| The permittee or responsible crew is unclear | The owner still must respond to the sidewalk condition. | Use DOT permit information or ask the borough Permit Office about a property permit search. DOT may issue corrective action to the street-cut permittee. |
| The damage appears to have been caused by a City worker or City contractor | The sidewalk condition still needs attention, but the payment dispute follows a different claim process. | DOT’s Sidewalk FAQ directs claims alleging City-caused damage to the Office of the Comptroller within 90 days. |
| No responsible private party can be identified | The owner should continue addressing any notice or unsafe condition. | DOT says that when the responsible party for a defective street cut cannot be identified, DOT will perform that repair. |
What to do immediately after discovering the damage
1. Photograph the entire work area
Take clear, dated photographs before the surface changes. Include wide views showing the building frontage and nearby work, then close-ups of each cracked, lifted, settled, or replaced sidewalk flag. Photograph utility markings, plates, barriers, company names, truck numbers, posted permits, and any disturbed curb or roadway. DOT specifically recommends documenting the damage; a complete record makes it easier to identify the responsible party and prove the condition existed after the work.
2. Build a timeline
Write down when the sidewalk was intact, when utility work began, when the defect appeared, and when the crew left. Save text messages, emails, door notices, work orders, complaint numbers, inspection letters, and photographs in date order. If a Notice of Sidewalk Violation arrives, record the date you received it—not merely the date printed on the notice—because the stated repair period runs from receipt.
3. Contact the company that performed the work
Use the company name on a notice, vehicle, permit posting, or utility bill. Send a written request describing the address, the work date, the damaged flags, and the requested repair. Attach photographs and ask for a written schedule and the name of the responsible claims representative. NYC DOT’s published instruction is to reach out to the company that made the damage for repair. Keep proof that you sent the request and every response.
How to identify the utility or contractor when the crew is gone
Search street-work permit information
NYC DOT’s Street Works Permits information can help connect a sidewalk or roadway excavation to its permittee. Compare the permit location, dates, and type of work with your photographs and timeline. A permit identifies the party authorized to perform work; it does not by itself resolve every reimbursement or contract dispute.

Ask the borough Permit Office to search
NYC311 says the borough Permit Office can search permits issued for the property for a small fee. Ask for the permit number, permittee, work dates, and any available restoration information. If several projects occurred, request records for the full period in which the damage could have occurred and compare each permit’s location to the affected sidewalk flags.
Use DOT’s defective-street-cut process
DOT’s customer-service and inspections guidance explains that the agency may issue a corrective action report to the party that performed a defective street cut. Report the location and provide your photographs, dates, and any permit details through the channels described on DOT’s Customer Service page and its Inspections & Enforcement page. If the responsible party cannot be identified, DOT states that it will perform the defective street-cut repair.
Handling a Notice of Sidewalk Violation
The 75-day repair period
NYC DOT says an owner generally has 75 days after receiving a Notice of Sidewalk Violation to repair the sidewalk. Treat that as an independent deadline. A pending conversation, claim, or promise from a utility does not extend it unless the city gives you a written change or other official direction.
What happens if the deadline is missed
If the owner does not complete the required repair, DOT may arrange for a contractor to perform the work and bill the owner. The city’s contractor process does not eliminate the owner’s opportunity to seek repayment from a utility, but it can make the owner responsible for the city’s charge first. Read the notice for the exact location, violation description, response method, and any inspection instructions.

Hiring a contractor and meeting NYC requirements
Check the home-improvement license threshold
NYC311’s Broken Sidewalk guidance says a sidewalk repair contractor doing work costing more than $200 must hold a New York City Department of Consumer and Worker Protection (DCWP) Home Improvement Contractor License. Verify the contractor’s current license before signing when the project falls above that threshold. The $200 figure is a licensing threshold in that guidance, not a statement that smaller work is exempt from every other rule.
Confirm the sidewalk construction permit
NYC DOT requires a Sidewalk Construction Permit for sidewalk repair and directs owners and contractors to the agency’s construction specifications. Ask in writing who will obtain the permit, submit required documents, arrange inspections, and close out the work. Do not assume that a contractor’s DCWP license substitutes for the DOT permit or that a utility’s original excavation permit covers a later owner-arranged repair.
Use the city’s specifications
Have the contractor review the current DOT specifications linked from the agency’s Sidewalks guidance. The specifications control details such as acceptable construction methods and restoration requirements. The official guidance identifies concrete as the standard sidewalk material, but it does not endorse a particular retail mix or brand.

Paying for a repair and seeking reimbursement
If the utility will not repair promptly and the city deadline requires action, an owner may need to hire a qualified contractor. Obtain a written estimate that separates demolition, disposal, permits, replacement, inspection, and any emergency work. Photograph the condition immediately before construction and again after completion.

Keep the signed contract, license information, permit, inspection records, invoices, canceled checks or card statements, and all correspondence with the utility. NYC311 advises retaining receipts and seeking repayment from the utility or private contractor that caused the damage. Send a documented demand identifying the work, the amount paid, and the evidence connecting the company to the damage. The city guidance does not promise reimbursement; the outcome can depend on the permit, contracts, proof of causation, timing, and the company’s response.

Damage allegedly caused by a City worker or City contractor follows a different claim route from a private utility dispute. NYC DOT’s Sidewalk FAQ directs claims for damage allegedly done by the City to the Office of the Comptroller within 90 days. The 90-day period is the filing period stated in that FAQ, so preserve photographs, dates, notices, and repair records immediately and follow the Comptroller’s current claim instructions. Do not treat a private utility demand letter as a substitute for that city claim.
Decision guide for common fact patterns
You can identify a utility permittee and no notice has arrived
Document the flags, obtain the permit details, and request repair from the permittee. Get a written completion date and inspect the finished work. If the company declines, obtain a compliant estimate and preserve the evidence needed for reimbursement.

You can identify the company but a 75-day notice is running
Send the company the notice and your evidence, but independently schedule the repair early enough to meet the city deadline. Ask the company to coordinate or pay, while keeping control of the deadline and permit obligations.

You cannot identify who made the cut
Check DOT permit information and ask the borough Permit Office about a property search. Report the defective street cut to DOT with photographs and dates. If DOT cannot identify the responsible party, its guidance says the agency will perform that repair; continue following any separate violation instructions you received.
The evidence points to City work
Separate the physical repair decision from the claim decision. Protect the sidewalk and comply with any notice, then use the Comptroller route described in the Sidewalk FAQ within 90 days for alleged City-caused damage.
Common mistakes that create avoidable costs
- Waiting for a utility while ignoring the notice: the 75-day period continues unless the city officially changes it.
- Relying on verbal promises: request a written scope, schedule, and payment commitment.
- Repairing before documenting: once new concrete is placed, evidence of the original defect may be lost.
- Assuming a permit settles liability: a permit helps identify the work party but does not automatically establish reimbursement.
- Hiring without checking credentials: verify the DCWP license when the project exceeds the $200 threshold and confirm the DOT sidewalk permit responsibility.
- Discarding records after completion: keep notices, photographs, permits, estimates, receipts, and correspondence in one file in case the utility or city later questions the work.
What the official guidance does—and does not—decide
The city materials establish a general owner-facing maintenance framework and practical steps for pursuing the party that caused utility damage. They do not determine the result of a particular liability or reimbursement dispute. The answer can turn on the work permit, private contracts, photographs, inspection findings, exact location, timing, and whether the actor was a private utility, another contractor, or a City contractor. For a disputed claim or unusual notice, use the instructions on the current notice and permit records for that property and consider professional legal advice.
