In England, the landlord is responsible for addressing damp and mould, regardless of whether the immediate label is condensation, penetrating damp, rising damp or another type. The cause still determines which repair is needed, but a landlord should not reject a report simply by saying that mould is “condensation” or therefore the tenant’s fault.
Responsibility and deadlines depend on where the property is. This guide explains the England position, the Scottish rules that took effect on 6 October 2026, and practical steps for reporting, documenting and escalating a mould problem. Housing standards and procedures differ in Wales and Northern Ireland, so do not transfer the England or Scotland rules to those nations without checking the applicable local framework.

Who fixes mould in a rented home?
The first question is jurisdiction. The second is the building’s condition and the likely source of moisture. The presence of mould alone does not prove that either the tenant or landlord caused it.

| England | Landlords must address damp and mould and investigate the underlying cause. | The official guidance applies to England; other UK nations have different systems. |
| Scotland | Covered social and private landlords have statutory investigation, reporting and repair timings from 6 October 2026. | Completion rules differ between social and private landlords, and limited exceptions can apply. |
| Wales and Northern Ireland | Use the relevant national housing standards and procedures. | Do not assume England’s deadlines or remedies apply. |
In England, government guidance states: “Irrespective of the type of damp (condensation, penetrating, rising or traumatic), landlords are legally responsible for addressing damp and mould.” That does not mean every repair has the same cause or that a landlord must accept every allegation without inspection. It means the landlord must take the report seriously, assess the conditions and deal with the problem rather than assigning automatic blame.

What the landlord is expected to investigate in England
Condensation is a condition, not a liability verdict
Condensation occurs when moisture produced inside the home cools and turns to water on colder surfaces. Showering, cooking and drying clothes can add moisture, but the result is also affected by ventilation, insulation, heating, room temperature, windows and the building’s general condition. A home with inadequate extraction, cold bridges, defective windows or insufficient heating may develop mould even when occupants use it normally.
Small, reasonable changes in household behaviour may reduce moisture in some homes. They should not be used to avoid checking whether the property has a ventilation, insulation, heating or structural defect. Calling the mould “condensation” does not by itself establish that the tenant caused it or remove the landlord’s obligation to investigate.
Penetrating, rising and other damp
Penetrating damp can result from water entering through a defective roof, wall, window, door, floor or external fitting. Leaking plumbing, gutters, downpipes or tanks can produce similar symptoms. Rising damp involves moisture moving upward through building materials, while accidental or traumatic damp may follow a burst pipe, flood or other event. More than one source can exist at the same time; for example, a leaking window can make a cold room more vulnerable to condensation.
Building repairs and installations
England’s statutory repair duties generally cover the structure and exterior of the dwelling and specified installations. A leaking roof, defective pipework, failed guttering or faulty heating or ventilation system may therefore point to a repair obligation. The appropriate remedy depends on an inspection, not on the colour, location or apparent age of the mould.
What a tenant should do when mould appears
1. Report it promptly and in writing
Contact the landlord or managing agent as soon as you notice mould, damp staining, persistent condensation or a mould odour. Use the normal repair channel and also send an email, letter or other dated message that can be retained. Describe:

Ask the landlord to confirm the inspection date, the suspected source and the proposed repair. Keep a copy of the complete report and any replies.
2. Allow a proper inspection
A landlord may need to inspect the roof, plumbing, ventilation, heating, insulation and affected rooms. Cooperate with reasonable access arrangements, but ask what the visit will cover. A quick wipe-down or a photograph of one wall is not a meaningful investigation where mould is extensive, recurring or accompanied by water damage.
3. Ask for a repair timetable
Request the expected date for investigation, remedial work and any follow-up check. The England tenant-repairs guidance says landlords should tell tenants when repairs are expected. If a contractor treats only the visible patch, ask how the work addresses the moisture source and how recurrence will be checked.
4. Keep paying rent while waiting
Do not treat withholding rent as a routine response to a mould dispute. Continue paying under the tenancy and use the formal repair and escalation routes instead. A rent dispute can create a separate arrears problem without fixing the damp.
Cleaning mould: what is reasonable and what is not
For a very small isolated patch, a tenant may reasonably remove it with an appropriate household cleaner, following the product instructions and avoiding actions that spread spores. That limited expectation does not make the tenant responsible for repairing a leak, replacing a failed extractor or correcting a cold, defective building.

Surface cleaning is not a cure. If water continues to enter or humid air continues to condense on a cold surface, mould can return. Larger areas should be handled by qualified professionals, particularly where the mould is widespread, repeatedly returns, follows major water damage or affects materials that cannot be safely cleaned. Professional removal should happen alongside investigation and repair of the underlying source.

Start with a clear written escalation
If the landlord misses the promised date or provides only cosmetic cleaning, send a further dated notice. Attach the original report, photographs, inspection findings and a concise list of outstanding defects. State the impact on the home and ask for a written plan with dates.
Contact the local council
If the problem is not addressed, contact the environmental health department of the local council. Explain that you have reported damp or mould, provide the landlord’s responses and ask how the council can assess housing conditions. Council involvement can be particularly important where the mould is extensive, there is a leak, or the condition may affect health or safety.
Other routes
Depending on the housing provider and circumstances, further routes can include the Housing Ombudsman or court proceedings. The appropriate route may depend on whether the landlord is a council, housing association or private owner, and on the evidence available. Get independent housing or legal advice before starting a claim so that you understand the relevant procedure and costs.

| Stage | Timing | What it means |
|---|---|---|
| Investigation | Within 10 working days | The landlord must investigate the reported damp or mould. |
| Written summary | Within 3 working days after the investigation | The tenant should receive a written account of findings and proposed action. |
| Start necessary repairs | Within 5 working days after the investigation | Work needed to address the problem must begin within this period. |
For social landlords, the landlord guidance says work to make the home substantially free from damp and mould must be completed within 20 working days from commencement of the work. For private landlords, completion must occur within a reasonable time after the investigation rather than under that same fixed completion period.
The Scottish approach focuses on the root cause. A mould wash alone is unlikely to satisfy the requirement if the damp condition remains capable of causing recurrence. The rules allow exceptions where circumstances outside the landlord’s control prevent compliance with an investigation or commencement period. In that situation, the tenant must be told the reason and expected period, and the landlord must take reasonable practicable steps to minimise damp or mould.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to judge whether a proposed response is adequate
| Proposed response | What to ask | Warning sign |
|---|---|---|
| Wipe or spray the visible mould | What is causing the moisture, and how will recurrence be prevented? | No inspection or repair plan. |
| Increase ventilation | Are fans, vents, windows, heating and insulation working as intended? | The tenant is blamed without checking defective equipment or cold surfaces. |
| Repair a leak | Will damaged plaster, flooring or insulation also be dried and assessed? | The leak is stopped but wet materials and mould are left untreated. |
| Replace an extractor or heater | When will installation, testing and follow-up occur? | The work is promised indefinitely or the system remains unusable. |
An adequate response links the visible mould to a documented investigation, a repair of the source, safe treatment of affected materials and a check that the condition is not returning.
Evidence that helps resolve responsibility
Keep a chronological file rather than relying on memory. Include the tenancy agreement, dated reports, photographs from the same viewpoints, contractor notes, appointment records, humidity or temperature readings if you already have them, and receipts for damaged belongings or temporary measures. Note whether the mould appears after rainfall, in winter, after bathing or near a particular window, pipe or roof line. These observations help an inspector distinguish possible sources without pretending that a tenant can diagnose the building.

Reducing exposure while waiting for repairs
- Keep people, especially children and anyone with respiratory sensitivity, away from heavily affected areas where practicable.
- Do not dry extensive mould by brushing, sanding or aggressively disturbing contaminated materials.
- Use ventilation and heating as designed, provided the equipment is safe and functioning; report faults rather than compensating for them indefinitely.
- Move furniture slightly from visibly cold external walls if that can be done safely, while still reporting the condition.
- Do not paint over active mould or seal a damp surface before it has been assessed.
These steps are temporary risk reduction, not a substitute for the landlord’s investigation and repairs.
Common situations and the likely next step
Mould around a bathroom ceiling
Report the mould and ask for the extractor, window, heating and ceiling or roof above to be checked. Moisture from bathing may contribute, but a failed fan, cold surface or roof defect must not be assumed away.
Mould behind furniture on an external wall
Photograph the area, note whether the wall feels cold or damp and report it. The inspection may need to consider insulation, ventilation, heating and water penetration. Moving furniture alone does not establish responsibility.

Report the timing and affected location immediately, with photographs if safe. Ask for the roof, gutters, pointing, windows and external drainage to be inspected before cosmetic redecoration.
Mould after a burst pipe
Report the incident, protect belongings where possible and ask how drying, damaged materials and mould treatment will be coordinated after the leak is stopped. A single cleaning visit may not deal with moisture trapped in floors, walls or insulation.
A very small isolated patch
Document it and report it even if you clean it. If it returns, spreads or is accompanied by damp staining or an odour, request an inspection rather than repeatedly treating the surface.
Key takeaway
For an English rented home, the landlord must address damp and mould and investigate what is causing it; the tenant’s job is to report the condition promptly, provide access and take reasonable temporary precautions. In Scotland, the 6 October 2026 rules add specific investigation, written-summary and repair-start timings. If the landlord does not act, preserve the evidence and escalate through the local council and, where applicable, the Housing Ombudsman or courts. The correct remedy is the one that removes the moisture source, not merely the one that makes the mould less visible.
