Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →For a council tenant, start with the council’s housing repairs service. The council normally remains responsible for landlord repairs, including the home’s structure, supplied fixtures, safe gas and electrical installations, communal areas and fire-safety work. A builder or warranty provider may also have duties for construction defects, but a warranty does not automatically transfer the council’s repair responsibility to you. The correct route depends on your tenancy, the defect, your council’s repairs policy and the warranty documents for your particular home.
Who normally fixes a defect?
A new-build council home can involve three separate relationships: you are the tenant, the council is usually your landlord, and a builder or developer may have contractual or warranty obligations. Those relationships can overlap. The existence of a builder warranty does not by itself decide who must make your home safe or keep it in repair.

The council as landlord
GOV.UK’s Council housing: Repairs and maintenance guidance says the council is responsible for the property’s structure, making sure gas and electricity appliances supplied with the home work safely, maintaining shared parts and dealing with fire-safety responsibilities. Your tenancy agreement and the council’s local repairs policy determine how those duties are applied to a particular item, including the target time for attendance.

Tenants are generally expected to deal with minor items and damage they or their visitors cause. GOV.UK gives examples such as curtain or shower rails and replacement keys. A council may recharge a tenant where the evidence shows tenant-caused damage, but that is different from refusing a landlord repair simply because the house is new.

The builder or developer
The builder may have to correct a defect under the home’s handover or defects process, a building contract, or a warranty. This route is particularly relevant to workmanship or construction failures identified soon after completion. The policy will define what counts as a covered defect, the evidence required and the period in which the builder must respond.
The warranty provider
A warranty provider does not necessarily attend every repair. Its role depends on the policy and the stage of cover. Under NHBC Buildmark, for example, the builder is responsible during the initial builder-warranty period; later insurance cover applies only to defined risks and parts of the home. Check who is named as policyholder and who is entitled to claim: it may be the council, another landlord, an owner or a resident.
How responsibility is divided in practice
| Problem or route | First contact | Who may have the underlying duty | What to check |
|---|---|---|---|
| Leak, structural movement, failed supplied fixture or unsafe installation | Council repairs team | Usually the council as landlord; a builder or warranty may reimburse or remedy a construction failure | Tenancy terms, repairs policy, urgency classification and any defect schedule |
| Snag or workmanship problem within the builder’s defect period | Council and, if instructed by the policy, the builder | Builder under the defects process or warranty, while the council’s landlord duties continue | Handover documents, reporting deadline, technical standard and builder complaint process |
| Defined defect during the insurance part of a warranty | Named policyholder or claimant identified in the policy | Warranty provider, subject to the policy’s exclusions and limits | Certificate, insured parties, covered elements, claim deadline and evidence requirements |
| Damage caused by the tenant or visitors | Council, if a repair is needed | Tenant may be liable for the reasonable cost under the tenancy | Cause of damage, inspection record and recharge policy |
| Communal-area or fire-safety issue | Council or managing landlord | Usually the landlord or responsible building manager | Whether the area is shared, the emergency procedure and any immediate hazard |
This table is a route-finding aid, not a substitute for your own tenancy and policy. A council-owned property may have arrangements that differ from another council’s homes.

Why a warranty does not replace the council’s repair duty
The Housing Ombudsman’s decision in London & Quadrant Housing Trust (L&Q) (202223130) illustrates the principle. In that housing-association case, the landlord’s agreement covered the structure and supplied fixtures. The landlord could pursue the warranty for a construction defect, but it still had to keep the home in repair. The Ombudsman stated: “It is important to note that any warranty period does not replace the landlord’s obligations.”
That decision is an example rather than a ruling on every council tenancy. It supports a practical approach: report the problem to the council even when you believe the builder is at fault. The council may coordinate with the builder or recover its costs, but you should not be left without a repair route while those parties argue about liability.
NHBC Buildmark: what the two stages mean
NHBC describes Buildmark as ten-year warranty and insurance cover for new-build homes. It is normally split into a builder-warranty period followed by an insurance period; it is not a promise that every snag, cosmetic imperfection or later repair will be paid for.

| Stage | Usual duration | Responsible party under NHBC’s guidance | Limits |
|---|---|---|---|
| Builder warranty | Usually two years from the policy start date shown on the certificate | The builder, not NHBC, rectifies covered problems arising from failure to meet NHBC requirements | Coverage depends on the policy and the technical requirements; contact the builder promptly |
| Insurance cover | The following eight years, making ten years in total | NHBC may assess defined defects affecting covered parts, subject to the policy | Only specified risks and elements are insured; exclusions, thresholds and evidence rules apply |
The two-year period is a usual Buildmark term, not a universal statutory defect period for all council homes or all warranty products. Use the date and wording on your own certificate. During the builder period, NHBC says the builder—not NHBC—is responsible for rectifying covered failures. If the builder does not fulfil its obligations, NHBC may be able to offer a resolution service after you have completed the builder’s complaints process and received its final written response.
How to report a defect correctly
- Use the council’s repairs channel first. Report the issue to the housing repairs team as soon as you notice it. Use the council’s urgent or emergency number where there is an immediate danger, major leak, loss of essential services or a fire-safety concern.
- Describe the defect precisely. State what is wrong, where it is, when it began, whether it is getting worse and any effect on safety, health, heating, water or security. Explain whether the problem affects a shared area as well as your flat or house.
- Make a written record. Use the online form, email or letter where practical, and keep the submission, date, repair reference, photographs and replies. Note every visit, inspection finding, promised action and missed appointment.
- Ask for the applicable documents. Request the repairs policy, the tenancy clause, any new-home defects or handover procedure, the warranty provider and policy number, and the name of the party authorised to make a claim. These details are specific to your address.
- Follow any builder process without abandoning the council route. If the council gives you a builder contact or the policy requires direct notification, send the same factual report to the builder and keep proof of delivery. Ask the council to confirm what it will do if the builder does not attend or the defect creates a hazard.
- Protect evidence without creating danger. Take dated photographs or video, keep damaged components if safe, and do not carry out permanent alterations that could hide the cause. Take reasonable temporary steps to prevent further damage, but tell the council what you did.
- Check the outcome. After the visit, ask what repair was diagnosed, who will complete it, the target date and how you will be told if the appointment changes. Report recurrence as a new update linked to the original reference.
When the defect is damp, mould or a serious hazard
Serious hazards require the council’s landlord duties to be considered regardless of a warranty. GOV.UK’s guidance on Awaab’s Law sets out applicable duties and timeframes for social landlords dealing with qualifying damp and mould hazards. Describe visible mould, persistent condensation, leaks, respiratory effects or unsafe temperatures and ask the council to record the issue as a potential health and safety hazard. Do not wait for a builder’s warranty decision before reporting conditions that could harm occupants.
For gas, electrical or fire risks, use the emergency route given by the council and follow immediate safety instructions. If you smell gas, leave the property and use the national emergency process rather than waiting for a routine appointment.

What if the council tells you to contact the builder?
A council may ask you to notify the builder because the home is within a defects period, or it may arrange a joint inspection. That request does not automatically remove the council’s own repair obligations. Ask for the instruction in writing and for confirmation of:
- the policy or tenancy provision being relied on;
- the defect period and its end date;
- who will make the home safe if the builder cannot attend promptly;
- the council’s target date and escalation contact; and
- whether the council will submit or support a warranty claim.
If the builder’s appointment is missed or the proposed remedy fails, update the council with the evidence and request a landlord repair decision. Keep separate records for the council case and the builder case so that a warranty dispute does not obscure a missed council repair.
Escalating an unresolved problem
Council repair and complaint procedures
Use the council’s published repairs escalation and formal complaints stages when it does not attend, repeatedly patches a defect, misclassifies an urgent hazard or fails to explain responsibility. A complaint should identify the original repair reference, dates, photographs, the effect on occupants and the remedy you seek. Ask for a written decision and the next stage if you remain dissatisfied.

Builder complaints and NHBC resolution
For a builder defect, follow the builder’s complete complaints process. Under NHBC’s stated process, its resolution service is conditional on reaching the end of that process and obtaining the builder’s final written response. Submit the policy certificate, inspection reports, photographs, correspondence and the exact remedy requested. The later insurance stage has its own coverage tests; a rejected builder claim is not automatically an insured claim.
Ombudsman and other schemes
The appropriate ombudsman depends on what you are complaining about and where you live. A landlord repair or complaint normally follows the social-housing complaints and ombudsman framework for the relevant UK nation. A developer complaint may fall under the New Homes Ombudsman scheme if the developer and matter meet that scheme’s requirements. The New Homes Ombudsman is not established here as a replacement for the council’s landlord process. Confirm jurisdiction before submitting a case, and complete any required internal complaint stages.
Situations where the answer can change
Leasehold, shared ownership or a purchased home
This article is aimed at a person renting a council home. If you bought the property, hold a lease, or have shared ownership, the lease and service-charge structure may allocate windows, roofs, communal systems and internal repairs differently. The policyholder on the warranty may also be different. Use the lease, landlord or managing-agent instructions rather than assuming the council-tenant rules apply.

Different UK nations
The explanation uses England-focused GOV.UK and social-landlord material. Scotland, Wales and Northern Ireland have different housing legislation, repair standards and complaint routes. Your local authority’s policy and the law applying to your address control the outcome.
A home managed by someone other than the council
Some council-owned homes are managed by an arms-length organisation or another landlord. Check the name on your tenancy and rent statements. Report the defect to the organisation that owes the landlord obligations, while retaining any council contact details for escalation.
Documents to keep together
- Tenancy agreement and repairs policy;
- new-home handover, snagging or defects schedule;
- warranty certificate, policy wording and policyholder details;
- repair references, emails, letters and appointment notices;
- dated photographs, videos and notes of damage or health effects; and
- inspection reports, builder responses and complaint decisions.
Keeping one chronological file makes it easier to show when the council was notified, what was promised and whether the builder or warranty process is being used alongside—not instead of—the landlord repair route.
