Who Is Responsible for Fixing Damage Caused by Road Construction?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Often, the contractor or utility responsible for the work must repair damage it caused, but the road agency, project contract, permit, and local law determine who handles the claim and who ultimately pays. Start with the agency that owns or maintains the road, identify the project and the company or utility performing the work, and ask for the applicable restoration obligations and claims deadline. A government agency’s oversight role alone does not establish liability for your particular loss.

Why the answer depends on the project

“Road construction” can describe resurfacing, drainage work, bridge work, sidewalk construction, utility excavation, or a private project in a public right-of-way. Each may involve a different road owner, contractor, permit holder, contract, and set of legal rules. The same visible damage—such as a cracked driveway, flooded yard, broken curb, rut, or failed pavement—can therefore lead to different responsible parties.

As an Amazon Associate I earn from qualifying purchases.

Responsibility usually turns on five questions:

  • Who owns or maintains the road?
  • What project or permit authorized the work?
  • Who physically performed the excavation or construction?
  • What caused the damage: the work itself, inadequate precautions, or a pre-existing condition?
  • What do the project contract, utility permit, local ordinance, and applicable state law require?

Federal Highway Administration (FHWA) materials provide useful examples for federally funded and federal-land projects, but they do not create one nationwide claims rule. A local road, toll facility, county road, or city street may be governed by different contracts and procedures.

Who to contact first

Find the road owner or operator

Identify the agency responsible for the road where the damage occurred. Depending on the location, that may be a state department of transportation, county, city, toll authority, special district, or another public road operator. State DOTs generally oversee design, construction, maintenance, and operations for state roads, but responsibilities are distributed differently across states and portions of the network may be managed by other agencies.

Use the agency’s road-maintenance or construction-contact channel, not only the general public-works number. Report the exact location, the date you first observed the damage, the type of damage, and the nearby project name, work-zone sign, contractor logo, or utility marking. Ask which office administers claims for that project.

Identify the project participants

Ask the road agency for the project identification number, prime contractor, relevant subcontractor if known, and any utility permit holder. For a utility cut, the permittee may be more important than the paving contractor because the permit can assign restoration duties to the utility owner or excavating party.

Request the contract or permit provisions concerning property protection, pavement restoration, inspection, warranty, and claims. You may not receive every document immediately, but asking for the controlling terms helps establish which process applies.

When a construction contractor is responsible

On projects covered by the FHWA Federal Lands Construction Manual, the contractor must protect adjacent public and private property from damage caused by construction operations. When the contractor’s work or failure to take reasonable precautions causes damage, the contractor is expected to repair, rebuild, restore, or otherwise make good that damage.

FHWA’s FP-24 federal project specifications provide another example. Section 107.05 requires the contractor to indemnify and hold the government harmless from claims for injury or property damage resulting from construction operations or negligent contract performance, and it requires liability insurance for the specified obligations. Those provisions apply to projects governed by that specification; they are not a universal rule that makes every road contractor automatically liable.

The facts still matter. A contractor may dispute whether its work caused the loss, whether the damage existed before the project, whether a third party caused it, or whether the claimed repair is related to the construction. The project’s acceptance status, inspection records, photographs, change orders, and state-law rules can also affect the outcome.

Typical contractor-caused damage

  • A truck or piece of equipment strikes a fence, wall, mailbox, tree, or building feature.
  • Excavation undermines an adjacent driveway, sidewalk, retaining wall, or private drainage feature.
  • Construction traffic breaks pavement outside the agreed work area.
  • Failure to control runoff or protect an excavation causes flooding, erosion, or sediment damage.
  • Materials, debris, or an unprotected trench damage public or private property.

Report these conditions to both the road agency and the prime contractor. The agency may direct the contractor’s corrective work, while the contractor’s insurer or claims representative may handle payment or repairs.

What the road agency’s role means—and does not mean

For federal-aid projects, 23 CFR 635.105 assigns the state highway agency responsibility for project construction and adequate supervision even when the state arranges for a local or other federal agency to perform the work, subject to the regulation’s conditions. That is an oversight and administration rule. It does not, by itself, prove that the state must pay a particular property-damage claim.

An agency may inspect work, approve traffic control, or administer the contract while the contractor remains responsible for damage caused by its operations. Conversely, an agency, municipality, or other owner may have direct duties under its own contract, maintenance policy, or state law if the damage resulted from its conduct or from a condition it legally controlled. Do not assume that naming the government agency automatically resolves the claim in your favor.

When the agency may become the practical point of resolution

The road agency is often the best starting point when you cannot identify the contractor, when several parties worked at the location, when the defect affects public safety, or when you need the project records. It can identify the responsible parties, document the work limits, inspect the condition, and explain the formal claim route. That administrative role is different from an admission of legal liability.

Utility excavation and pavement cuts

Utility work can follow a different responsibility model from ordinary roadway construction. FHWA’s utility-cut model ordinance places ongoing repair and maintenance duties on the owner or agent that excavates or causes excavation in the right-of-way. If that designated party does not perform required repairs, the agency may make the repairs and recover its costs under the model language.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The model ordinance is not proof that a particular city or county enacted those exact terms. The local ordinance, permit, franchise agreement, and restoration standards control. FHWA utility-relocation material also states that utilities are responsible for operating and maintaining their facilities, and for damage to the road caused by the utility, while the road agency regulates activity in its right-of-way.

Questions to ask about a utility cut

  • Which utility or excavating company pulled the permit?
  • What restoration period and pavement standard does the permit require?
  • Was the cut inspected, and did the agency issue a correction notice?
  • Is the failure located within the utility trench, at its edges, or elsewhere?
  • Does the local ordinance allow the agency to repair first and recover costs from the permittee?

A utility may have hired a separate excavation or paving contractor. Notify the utility owner, the road agency, and the permit contact so the parties can allocate responsibility under their agreements.

Responsibility by common scenario

Situation First contacts What the cited FHWA materials support Important limits
Contractor operations damage adjacent property Road agency and prime contractor The Federal Lands Construction Manual assigns property-protection and restoration duties to the contractor. FP-24 assigns contractor obligations for claims arising from construction operations or negligent performance on covered federal projects. The contract, acceptance status, causation, claimant’s legal status, and state law may change the result.
Federal-aid work performed through a local agency State highway agency and local road owner Under 23 CFR 635.105, the state highway agency retains project-construction responsibility and must ensure adequate supervision when performance is arranged through another agency. Oversight does not by itself establish government liability for a specific loss.
Road surface fails after utility excavation Road agency and utility owner or permit holder FHWA’s model ordinance assigns repair and maintenance duties to the owner or agent causing excavation and permits agency repair with cost recovery. The model is not an enacted local rule; check the actual ordinance and permit.
Damage appears tied to a utility facility or its work Utility and road agency FHWA states that utilities maintain their facilities and are responsible for road damage caused by the utility, while the road agency regulates right-of-way activity. Investigate which party caused the damage and which local rules apply.

How to submit a stronger damage claim

  1. Record the condition promptly. Take dated, wide-angle photographs showing the road, project limits, signs, driveway or property boundaries, and the damage. Add close-ups with a ruler or other scale where useful.
  2. Describe the connection to the work. Note when the damage was absent or changed, what construction activity occurred, equipment routes, excavation locations, drainage changes, and any conversations with workers or inspectors.
  3. Notify the road owner in writing. Include the exact location, date, contact information, a concise description, photographs, and a request for the project number and claims procedure. Ask for confirmation that the report was received.
  4. Notify the contractor or utility permittee. Send the same factual notice to the identified company or utility. Avoid guessing about fault; identify the condition and the work you believe may be related.
  5. Request the controlling documents. Ask for applicable restoration clauses, permit conditions, inspection contacts, warranty terms, and the required claim form or notice method.
  6. Obtain repair estimates. Get itemized estimates from qualified contractors. Keep invoices, receipts, rental costs, temporary protection expenses, and records of any emergency work.
  7. Track every communication. Keep emails, letters, claim numbers, inspection dates, names, and promised follow-up. Send a short written recap after phone calls.
  8. Follow the stated deadline exactly. Government claims may require a particular form, recipient, delivery method, or notice period. The sources cited here do not establish a nationwide deadline, so ask the responsible agency and check the law of the relevant state or locality.

If the damage presents an immediate hazard—such as an open excavation, unsafe pavement, exposed utility, or blocked drainage—report it as an emergency through the agency’s hazard channel as well as submitting the property-damage notice.

Evidence that helps establish causation

A claim is stronger when it shows a before-and-after change and a plausible physical link to the work. Useful evidence includes dated photographs from before construction, survey or inspection records, utility-cut locations, rainfall or drainage observations, equipment and delivery routes, witness statements, and contractor or agency notices. Keep damaged materials until an inspector has seen them when practical.

Separate the cost of repairing construction-related damage from unrelated upgrades. An estimate that replaces an entire driveway with a higher-grade design may invite a dispute if the original feature could have been repaired. Ask the estimator to identify the work required to return the property to its pre-damage condition and to explain any code-required changes.

Deadlines, insurance, and legal advice

There is no single nationwide notice period or remedy for an individual road-construction claim established by the materials cited here. Public-entity claims can be subject to special notice statutes, short filing periods, administrative forms, immunity rules, and limits on damages. Private contracts and utility permits may impose their own notice and documentation requirements.

Ask the road agency whether a government-claim form is required, where it must be delivered, and when it is due. Ask the contractor or utility for its claims or insurance contact, but do not rely on an insurer’s informal acknowledgment as proof that a legal deadline has been extended.

Consider advice from a lawyer licensed in the relevant state when the damage is substantial, a deadline is close, ownership or causation is disputed, or the agency denies the claim. A lawyer can analyze state and local law, contract terms, governmental-immunity issues, evidence, and available remedies. No party should promise reimbursement before those facts and rules are evaluated.

What to do if responsibility is disputed

Request a written explanation identifying the factual basis for the denial and the provision the agency, contractor, or utility is relying on. Ask whether an inspection, reinspection, or joint meeting is available. Compare the denial with the project limits, permit conditions, photographs, and repair estimates.

If several parties contributed, preserve claims against each while they investigate. For example, a utility may have caused a weak trench restoration, a paving contractor may have performed defective patching, and the road agency may control inspection or warranty enforcement. Responsibility can be divided rather than assigned to one organization.

Do not authorize permanent work that destroys important evidence when an inspection is pending, unless safety requires immediate action. If emergency repairs are necessary, photograph the condition first, keep removed materials where feasible, and retain detailed invoices.

A practical checklist

  • Road owner or operator identified.
  • Project number, contractor, and utility permittee requested.
  • Damage photographed with dates and location context.
  • Written notice sent to the agency and likely responsible company or utility.
  • Contract, permit, restoration, warranty, and claim instructions requested.
  • Itemized estimates, invoices, and temporary-protection costs preserved.
  • Claim deadline and required delivery method confirmed.
  • Legal advice obtained if the loss is significant or the deadline is near.

Frequently Asked Questions

Can I make a claim before the construction project is finished?

Yes. Report the damage as soon as you can and ask whether the agency wants an interim inspection or a final-condition claim. Early notice helps document causation, but it does not waive any formal notice or filing requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if I do not know whether the road is state, county, or city owned?

Give the location to the nearest public-works or transportation agency and ask it to identify the road owner or maintenance authority. The agency can usually redirect the report and identify the project administrator.

Should I repair dangerous damage before receiving permission?

Protect people and property first. For urgent hazards, notify the agency immediately, photograph the condition before work when safe, use reasonable temporary measures, and keep all receipts. Ask the agency how it wants emergency repairs documented.
