Which EPA Permits Do I Need Before Starting a Construction Project?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single EPA permit required for every construction project. Your obligations depend on the work, the site, what leaves the site, emissions from stationary equipment, and which agency has authority where you are building. Before mobilizing, screen at least three areas: construction-stormwater coverage, Clean Water Act Section 404 authorization for dredge or fill, and Clean Air Act New Source Review (NSR) permits for qualifying stationary sources. Other programs may apply if the project involves injection wells, hazardous waste, or a federal funding or approval decision.

EPA does not issue every permit. Most states administer National Pollutant Discharge Elimination System (NPDES) stormwater permits; the U.S. Army Corps of Engineers (Corps) generally handles Section 404 decisions; and state, tribal, territorial, or local agencies may administer other programs. The steps below are a federal screening guide, not a project-specific determination.

What decides whether your project needs an EPA-related permit?

Permit duties follow environmental activities, not the fact that a project has a building permit. A local grading approval or building permit does not substitute for federal environmental authorization. The decisive facts are:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Total soil disturbance, including all phases in a common plan of development or sale.
  • Where stormwater will discharge and whether the site is in a state, territory, tribal area, or federal jurisdiction with its own permitting authority.
  • Whether excavation, grading, or fill will enter streams, wetlands, or other waters of the United States.
  • Stationary equipment or facilities that will emit regulated air pollutants.
  • Waste generation, treatment, storage, disposal, or underground injection.
  • Federal funding, permits, licenses, or other agency actions connected with the project.

Identify these facts during design. Waiting until clearing or equipment installation can create an unauthorized discharge or construction start, forcing schedule changes and possible enforcement.

Federal permit pathways at a glance

Project activity Potential authorization Typical decision-maker Key timing or threshold
Clearing, grading, or excavation that disturbs land and discharges stormwater NPDES construction-stormwater permit coverage Authorized state, tribe, or territory in most places; EPA in some jurisdictions and on most land in Indian Country Generally 1 acre or more of disturbance, including smaller sites in a common plan that will ultimately disturb 1 acre or more
Dredging or placing fill in jurisdictional waters or wetlands Clean Water Act Section 404 permit, unless an exemption applies U.S. Army Corps of Engineers or an approved state or tribal program Authorization is generally required before the discharge
Constructing or modifying a qualifying stationary source of air pollution Clean Air Act New Source Review preconstruction permit Applicable state, local, tribal, or EPA air-permitting authority Before construction when the applicable NSR program requires it; applicability depends on source, emissions, location, and implementation rules
Injecting fluids underground Underground Injection Control authorization EPA or an authorized state or tribal program Applies to covered injection wells and activities, not ordinary building work
Generating, treating, storing, or disposing of hazardous waste RCRA requirements and, where applicable, permits Often an EPA-authorized state program; requirements vary by activity and location Determine duties from the waste stream and facility activity

1. Construction stormwater: the most common federal screening issue

When coverage is triggered

Construction-stormwater NPDES coverage is generally required when construction activity disturbs at least 1 acre and stormwater is discharged. EPA examples include clearing, grading, and excavation. A site smaller than 1 acre can still be covered when it is part of a common plan of development or sale that will ultimately disturb at least 1 acre. Count the entire plan, not merely the first phase or the area shown on a single work order.

The 1-acre figure is a regulatory threshold, not a universal EPA-issued permit. Most states administer NPDES stormwater programs. EPA remains the permitting authority in some states and territories and on most land in Indian Country. A project crossing state, tribal, territorial, or other jurisdictional boundaries may require coordination with more than one authority.

Identify every operator

Before filing, determine who is an “operator.” EPA generally treats an operator as a party with control over construction plans and specifications or day-to-day site activities needed to ensure permit compliance. The owner, developer, general contractor, and another party may each qualify, depending on contracts and actual control. Assign responsibilities in writing so the stormwater plan, inspections, corrective actions, and reporting have accountable owners.

EPA’s 2022 Construction General Permit process

Where EPA is the permitting authority and the project is eligible for the 2022 Construction General Permit (CGP), the operator must complete several steps. The permit’s conditions, plus any applicable state, tribal, or territorial requirements, control the work.

  1. Confirm jurisdiction and eligibility. Verify that EPA, rather than an authorized state, tribe, or territory, administers NPDES at the site and that the project fits the CGP.
  2. Complete environmental eligibility reviews. Address the permit’s Endangered Species Act and historic-property requirements before requesting coverage.
  3. Prepare the SWPPP. A Stormwater Pollution Prevention Plan describes how erosion and sediment controls, pollution-prevention practices, stabilization, dewatering, and other permit requirements will be implemented. EPA states: “A SWPPP outlines how you plan to implement erosion and sediment controls and meet other requirements of the permit on your construction site.”
  4. Submit the Notice of Intent (NOI). EPA uses its electronic reporting system. For a new site, the 2022 CGP lists an NOI deadline of at least 14 calendar days before construction activities begin.
  5. Wait for effective coverage. Coverage generally begins 14 calendar days after EPA receives a complete NOI, unless EPA delays or denies authorization. The NOI filing alone is not authorization; use the permit’s stated effective date and conditions in your schedule.

Controls and limited waivers

Federal construction-stormwater requirements include effective erosion and sediment controls and pollution-prevention measures. The federal construction-and-development rules also address stabilization, dewatering, and discharges such as uncontrolled concrete washout. The applicable permit determines the detailed controls, inspection, maintenance, and reporting duties.

Some small construction activity—disturbing 5 acres or less—may qualify for a waiver in limited circumstances, such as a low erosivity factor or qualifying water-quality analyses. “Small” does not automatically mean exempt. Confirm the waiver criteria with the authority administering the site’s permit and retain the supporting analysis.

Permit status to verify for a 2026 project

EPA’s current information states that the 2022 CGP expires on February 16, 2027. EPA published a proposed replacement permit in August 2026, but that proposal was not final at the time of publication. Check the operative permit, electronic filing system, and deadlines when setting a 2026–2027 construction schedule.

2. Wetlands and other waters: Section 404 authorization

What activity requires review

If the project will discharge dredged or fill material into waters of the United States—including potentially jurisdictional wetlands—Clean Water Act Section 404 generally requires authorization before the discharge unless a statutory or regulatory exemption applies. Examples include development fill, infrastructure, water-resource projects, and mining. “Near water” is not the legal test: jurisdiction depends on the specific aquatic resource and the rules in effect for the project.

How the Corps and states handle permits

The Corps generally administers day-to-day Section 404 permitting and decides individual and general permit applications. An approved state or tribal program may administer the program in assumed waters. EPA establishes or interprets environmental criteria, reviews individual applications, and can prohibit or restrict disposal in defined areas.

General permits cover categories expected to have minimal adverse effects when their conditions are met. An individual permit is used for potentially significant impacts and requires a project-specific review. Do not choose between them by acreage alone; the resource, discharge, cumulative effects, and applicable permit conditions matter.

Screen the site before design is fixed

  1. Have streams, wetlands, and other aquatic resources identified early enough to influence the site plan.
  2. Ask the Corps or the authorized state or tribal program whether a jurisdictional determination is needed.
  3. Redesign to avoid and minimize impacts where practicable.
  4. Determine whether the remaining work fits a general permit or requires an individual permit.
  5. Plan mitigation and obtain authorization before placing dredged or fill material.

A wetland delineation, jurisdictional determination, avoidance and minimization plan, mitigation proposal, and permit type all depend on project facts and current jurisdictional rules. Treat each as a project-specific decision.

3. Air emissions: New Source Review before construction

When NSR can apply

Clean Air Act New Source Review is a preconstruction program for certain new stationary sources and modifications to existing sources. Applicability depends on the source category, projected emissions, location, and the federal and state implementation requirements that govern that area. A temporary mobile machine is not automatically a stationary source, while a fixed plant, process line, boiler, or similar emissions unit may be.

Inventory proposed emissions units and estimate pollutants before ordering or constructing them. Ask the applicable air-permitting agency whether a permit, an exemption, or another preconstruction authorization is required. Include modifications to an existing facility; NSR can be triggered by a change, not only by a brand-new site.

Can work start before an air permit?

Do not rely on a blanket rule. EPA’s August 2026 guidance discusses, case by case, construction activities that may proceed before an NSR permit and describes an intended 2026 rulemaking to revise the definition of “begin actual construction.” The policy is evolving. Obtain a current, project-specific determination from the permitting authority and follow any restrictions in the applicable rules or permit. A grading start that seems unrelated to an emissions unit can still affect how the agency views the construction sequence.

4. Other conditional federal programs

Underground Injection Control

UIC requirements cover the construction, operation, permitting, and closure of injection wells used to place fluids underground for storage or disposal. Ordinary foundations, utility trenches, and site drainage do not by themselves create a UIC permit obligation. Screen the program if the project includes a covered injection well or injection activity.

Hazardous waste under RCRA

Waste generation, treatment, storage, and disposal can create duties under the Resource Conservation and Recovery Act. Subtitle C programs are often administered by states under EPA authorization, and the requirements depend on the waste and the facility activity. A construction project does not receive a universal “RCRA construction permit”; characterize waste streams and ask the authorized program which generator, storage, transporter, or disposal rules apply.

NEPA and a federal connection

National Environmental Policy Act review can arise when a federal agency takes an action, provides funding, or issues an approval connected with the project. NEPA is not a general EPA construction permit for every private development. Identify the lead federal agency and its current review requirements when federal funding, land, permits, or approvals are involved.

A practical permit-screening workflow

  1. Map jurisdiction. Record the state, tribal or territorial status, local governments, EPA region, Corps district, and any federal land or agency connection.
  2. Define the common plan. Calculate total disturbance across all phases, not only the first clearing package. Mark every proposed stormwater discharge path and receiving water.
  3. Document control. List owners, developers, contractors, subcontractors, and consultants. Determine who controls plans, specifications, and day-to-day compliance activities.
  4. Check aquatic resources. Identify streams, wetlands, and other waters before finalizing grading, roads, utilities, or outfalls. Obtain the Corps or authorized-program view on jurisdiction and Section 404 coverage.
  5. Inventory emissions. List fixed combustion, processing, storage, and other potential emissions units. Provide equipment specifications and emissions estimates to the air agency before construction or installation.
  6. Screen conditional programs. Ask whether the work includes injection wells, hazardous-waste activities, federal funding or approvals, or other regulated discharges.
  7. Build the schedule around authorization. Allow time for design changes, SWPPP preparation, NOI notice periods, Corps or air-agency review, public notices where applicable, and the actual effective date. Do not start a regulated discharge or permit-triggering construction activity early.
  8. Track conditions during construction. Assign inspection, maintenance, reporting, recordkeeping, and corrective-action duties to named operators and keep permits and plans available to the field team.

Common mistakes that delay projects

  • Counting only the first phase: A 0.8-acre package can be covered when the full common plan exceeds 1 acre.
  • Assuming EPA is always the issuer: An authorized state, tribe, or territory may be the NPDES or UIC authority, and the Corps usually decides Section 404 applications.
  • Treating an NOI as approval: Under the EPA CGP, coverage generally becomes effective 14 calendar days after a complete NOI is received, subject to delay or denial.
  • Starting “just site work” before an air decision: NSR policy about activities before permit issuance is changing; obtain the agency’s current determination.
  • Calling every wet area jurisdictional—or none of them: Jurisdiction must be evaluated for the particular aquatic resource and current legal framework.
  • Using a building permit as environmental clearance: Local construction approval and federal or state environmental authorization are separate decisions.
  • Assuming a small project is exempt: Stormwater waivers have specific eligibility conditions, and other programs may still apply.

What to have ready when you contact agencies

Agency review is faster and more reliable when your inquiry includes a clear site map, total disturbance by phase, common-plan description, grading and drainage plans, receiving waters, wetland or stream information, proposed fill quantities, equipment and emissions data, ownership and contractor control structure, waste and injection details, and any federal funding or approval documents. Ask for written confirmation of the permitting authority, applicable permit or general-permit number, effective date, and activities that must wait.
