Keep a dated record of every shift and preserve proof of both the work you performed and the pay you were promised or received. For a U.S. construction worker, the most useful file contains daily start and stop times, unpaid meal periods, jobsite and employer details, the agreed rate or pay basis, pay stubs, schedules, timecards, and messages about hours or wages. Compare your log with each wage statement using the employer’s defined workweek, not merely the calendar week. This article describes the federal Fair Labor Standards Act (FLSA) baseline; state law, worker classification, project funding and prevailing-wage terms can add different requirements.
Build one personal record for every shift
A contemporaneous log is often the clearest way to show what happened when an employer’s timekeeping or payroll record is incomplete. The U.S. Department of Labor (DOL) tells workers to keep the employer’s name, address and phone number and the hours worked. Its worker guidance states: “Your employer must keep records of all wages paid and of all hours worked, regardless of where the work is performed (and regardless of immigration status).” That employer duty does not eliminate the value of keeping your own copy.

Information to enter before you forget it
- Date and jobsite: identify the project, address or recognizable location, and the contractor or employer for whom you worked that day.
- Start and stop times: record when you began and ended work, including early setup, cleanup or required meetings.
- Meal periods: note the beginning and end of any unpaid meal break. If you worked through it or were interrupted, describe what work occurred.
- Total hours: calculate the day’s hours and identify any time spent on a separate activity, such as a required task before or after the main shift.
- Pay basis and rate: write the promised hourly rate, day rate, piece rate or other basis, plus the date and source of any change.
- Overtime or special pay: mark hours you believe exceed the applicable threshold, a different rate, a bonus, or piecework amount without assuming that your label determines the legal calculation.
- Who can confirm it: list a foreperson, coworker, delivery driver or other person who was present, when appropriate.
Make entries at the end of each shift or as soon as practical. Do not rewrite a past entry to make it look contemporaneous. If you discover an error, preserve the original, identify the correction and date, and explain why you changed it.

Pay terms
Keep texts, emails, offers, notices, signed agreements and handwritten notes that state your hourly rate, day rate, piece rate, deductions, travel terms, bonuses or a later change. Record who communicated the term and when. A verbal promise can be difficult to prove, so make a neutral written confirmation after the conversation, such as: “Confirming that the rate for the framing work beginning Monday is $___ per hour.” Save the response and do not edit the original message.

Wages actually received
Save every pay stub or wage statement, check image, direct-deposit record and pay-period date. Note gross wages, straight-time and overtime amounts if shown, additions, deductions and net pay. A bank deposit normally shows only the amount deposited; it does not explain the hours, rate or deductions used to calculate it. Keep the statement that supplies that calculation.
Work corroboration
Retain schedules, clock-in or clock-out screenshots, daily reports, job assignments, delivery logs, permitted photographs showing the project date, and messages arranging shifts. Keep names and contact information for people who can confirm the work, but do not pressure anyone to change a statement. Store copies somewhere you can access away from the jobsite, such as a personal email account or secure drive, subject to your employer’s confidentiality rules.
Choose a tracking method you can use on every jobsite
Federal FLSA rules do not require one particular format. DOL guidance says an employer may use a time clock, a timekeeper or worker-written times, provided the system is complete and accurate. The practical test for your personal method is whether you can enter every shift, preserve the file and retrieve it later.

No commercial logbook or particular app is necessary. Pick the method you will actually use, and use the same date and time convention throughout a pay period.
Compare your records with payroll by workweek
At each payday, reconcile your personal log to the wage statement for the relevant pay period. Overtime analysis uses the employer’s defined workweek, which may not run from Sunday through Saturday and may differ from the dates printed on a biweekly pay statement. Ask payroll or the supervisor, in writing, which day and time the workweek begins if you do not know.
- Gather the period: place your daily log, schedule, timecard or clock records, pay statement and any rate-change message together.
- Sort by workweek: group shifts according to the employer’s stated workweek, even when a pay period contains parts of two workweeks.
- Total each day: subtract only meal periods that were actually unpaid and entirely free of work. Flag disputed travel, setup, cleanup or waiting time rather than silently deleting it.
- Check the rate: compare the rate or other pay basis in your log with the rate shown on the statement and the rate promised for that job.
- Check the arithmetic: compare regular hours, overtime hours, piecework, bonuses, additions, deductions, gross wages and net wages.
- Record the difference: write the exact date, workweek, hours or rate that does not match and retain the source documents.
Federal employer records generally include the day and time the workweek begins, daily and weekly hours, pay basis and rate, straight-time and overtime earnings, additions or deductions, total wages, pay date and pay period. If the employer uses a fixed schedule, exceptions in which you worked more or fewer hours should be recorded.

Handle common construction-time questions carefully
Travel, loading and preparation
Record when you reported, where you were sent and what you did, including loading tools, mandatory meetings, cleanup or moving between jobsites. Whether particular travel or preparatory activity is compensable depends on the facts and applicable federal or state rules. A complete log lets a labor agency or adviser make that determination instead of relying on an incomplete timecard.
Meal breaks and interrupted breaks
Write the actual break times. If a foreperson called you back, you answered a work call or you continued monitoring equipment, note the interruption and the task. Do not convert an interrupted break into a clean unpaid deduction merely because the schedule listed one.
Piece rates, day rates and mixed pay
For piecework, record units completed, the rate per unit, hours worked and any guaranteed minimum. For a day rate, record the amount promised and the hours covered. If you received different rates for different tasks in one workweek, identify the task, hours and rate separately. The calculation of regular and overtime pay can be technical; preserving the underlying figures is more useful than guessing the final amount.

Subcontractors and worker classification
Construction workers may be employees, independent contractors or engaged through multiple contracting layers. Classification affects which protections and records apply. Keep the legal name and contact details of every entity that directed your work or paid you, copies of invoices or 1099-related paperwork if used, and messages showing supervision, schedule and rate. Do not assume that a label on a contract settles classification under every law.
Public projects and prevailing-wage terms
Funding source, a project’s contract and a prevailing-wage or collective-bargaining requirement can impose additional recording or wage rules. Save the project name, contract or wage-rate notice supplied to you, classification shown for your trade, fringe-benefit information and any certified-payroll notice you receive. Federal FLSA records are a baseline, not a substitute for a project-specific review.
Keep an organized dispute file
When figures do not match, prepare a short dated summary instead of sending a long, unstructured message. Include:

- a list of attached records with their original dates.
Ask the employer or payroll contact for the time and wage calculation in writing. Keep your request factual and retain the response, even if the employer denies an error. Do not surrender your only original. If you provide a copy, mark it as a copy and keep the source in your personal file.
Know the federal retention guidance—and its limits
DOL guidance says employers generally should keep FLSA payroll records, including collective-bargaining agreements, for at least three years. Wage-computation records such as time cards, wage-rate tables, schedules and records of additions or deductions generally should be kept for two years. Those are employer retention periods, not a complete statement of how long a worker has to bring a claim. Keep your own records for as long as needed to document a possible dispute, and seek prompt advice if a filing deadline may matter.
State wage-statement rules, limitation periods, record-access rights and retaliation protections vary. The absence of a particular item on a pay stub does not by itself establish a violation in every state, and a federal deadline cannot be assumed without knowing the claim and location.
Where to seek help if the discrepancy remains
If a written payroll request does not resolve the issue, possible assistance routes include the DOL Wage and Hour Division and the labor office in the relevant state. DOL states that its discussions with workers are free and confidential. Procedures and jurisdiction differ, so provide the agency with your employer’s legal name, jobsite, dates, records and a concise calculation.
If you fear retaliation, have immigration-related concerns or may be near a filing deadline, explain that concern when seeking official or qualified local help. Do not delay while trying to perfect your spreadsheet; a dated, honest log with the records you already have is more useful than a reconstructed account made months later.
