Stop the machine, protect people, and notify the rental provider immediately. Do not keep operating a disabled, unsafe, malfunctioning, or warning-light-equipped machine, and do not authorize repairs or transport it until the provider gives instructions. Then document the failure, confirm whether a replacement or service call is coming, and get the effect on rental charges in writing.
The exact remedy depends on your signed rental agreement, the equipment, your location, and the cause of the failure. The contract examples discussed here are current United States terms; they are not a universal rule for every rental.

1. Make the site safe before you make the phone call
A breakdown can create a second hazard: an excavator with a failed hydraulic system may drop a load, a lift may become unstable, or a machine stopped on a roadway may expose workers to traffic. Treat the equipment as unsafe until the rental provider or a qualified person confirms otherwise.
- Stop operating immediately. Shut down using the manufacturer’s normal emergency procedure if it is safe to do so. Do not continue “just to finish the lift,” drive the machine back to the yard, or bypass an interlock or warning system.
- Keep people clear. Establish an exclusion zone around moving parts, suspended loads, electrical hazards, hot surfaces, leaking fluids, unstable ground, and traffic. Follow your site emergency plan and your competent-person procedures.
- Stabilize only what you are trained and authorized to stabilize. Lower attachments or loads only when the operator’s manual and the conditions make that action safe. Never climb under raised equipment or attempt an improvised support.
- Call emergency services first when necessary. If anyone is injured, trapped, exposed to a serious hazard, or threatened by fire, electrical contact, or a major spill, use the site emergency plan and call the appropriate emergency number before handling the rental company notification.
U.S. rental terms commonly require the customer to stop use and notify the lessor when equipment is damaged, disabled, unsafe, malfunctioning, involved in an accident, or showing warning lights. One U.S. rental service agreement states: “Should the Equipment be involved in an accident, become unsafe, malfunction or require repair, Customer shall immediately cease using the Equipment and immediately notify” the rental company. The wording in your own agreement controls.

2. Notify the rental provider with usable facts
Use the emergency or service number printed on the rental agreement, dispatch ticket, delivery paperwork, or equipment label. Make the first report by phone when the situation is urgent, then send a written message through the provider’s required channel so there is a time-stamped record.
Information to have ready
- Rental agreement, dispatch, or contract number.
- Equipment identification number, make and model, and hour-meter reading.
- Exact jobsite address, access instructions, and a contact who can meet a technician.
- Date and time the problem began, whether it happened during a specific task, and the last known normal operating condition.
- Symptoms: loss of power, unusual noise, overheating, fluid leak, tire damage, electrical fault, movement problem, or a displayed warning light or code.
- Operating conditions, including load, grade, weather, ground conditions, attachments, and whether another vehicle or object was involved.
- Any injury, property damage, spill, near miss, theft, or suspected vandalism.
Do not diagnose beyond what you observed. Say “the boom stopped responding and the hydraulic-temperature light came on,” rather than assigning blame or declaring that a particular part failed. Ask the representative to repeat the next action, the expected arrival or replacement time, and the name or ticket number for the call.
Written notice after the call
Send a concise email or portal message that records the time of the phone report and the provider’s instructions. Some U.S. terms require prompt phone notice for an accident, loss, theft, or damage followed by a written report containing the requested details. Missing a notice deadline can complicate a later dispute, so use the shortest deadline stated in your contract.

Documentation helps establish what happened and when, but never put yourself in danger to obtain it. From a safe location, photograph the equipment, warning display, attachment position, visible damage, fluid on the ground, tire or track condition, and surrounding work area. Preserve the original files and note their time and location if your system supports it.
- Write down the equipment ID, hour-meter reading, date, time, and operator.
- Record the task in progress and the load or material involved.
- List warning lights, fault codes, noises, smells, smoke, leaks, and control responses.
- Identify witnesses and preserve relevant radio traffic, inspection forms, telematics records, and daily reports.
- Save the rental provider’s call log, emails, work order, technician notes, and instructions about securing or returning the unit.
This is practical recordkeeping, not a universal contractual checklist. Your agreement may require additional forms, an incident report, or immediate access for inspection.

4. Follow the provider’s direction on repair, replacement, or return
Do not assume a technician will come to the site, that a replacement is guaranteed, or that you should take the machine back yourself. The provider may dispatch a field technician, ask you to return the unit to a branch, arrange a similar machine, or remove the equipment and end the agreement. Confirm which path applies before moving anything.
| Situation in the contract | Possible provider remedy | Conditions to verify |
|---|---|---|
| Failure during normal operation | Repair the equipment or supply reasonably similar working equipment if available. | How the contract defines normal operation; whether a similar unit is actually available; who pays transport and setup. |
| Poor mechanical condition not attributable to the customer | Repair or suitably replace the unit within a reasonable time during normal working hours, sometimes tolling the rental period while it is down. | Required notice, access for inspection, what counts as “reasonable time,” and whether the agreement instead permits removal and termination. |
| Customer-caused damage, misuse, neglect, or prohibited operation | Charge the customer for repair, maintenance, loss of use, or other amounts stated in the agreement; a replacement may be chargeable. | The provider’s inspection findings, damage-waiver terms, operator qualifications, and any excluded conduct. |
| Tire or tube problem | Responsibility may remain with the lessee even when other mechanical failures are handled by the lessor. | Whether tires and tubes are expressly excluded and what repair authorization is required. |
| Return required after failure | Rental charges may stop only after the unit is returned in the required manner and timeframe. | Return location, transport instructions, condition requirements, and any stated deadline. |
These are contract patterns, not promises. A provider can only supply a replacement that it has available, and “similar” may not mean identical capacity, attachment, reach, or fuel type. Before accepting a substitute, confirm that it is suitable for the lift plan, ground conditions, access route, emissions requirements, and operator training.
5. Determine who pays by identifying the cause
Responsibility usually turns on cause, not simply on who had possession of the machine. Agreements commonly distinguish ordinary mechanical failure from misuse, abuse, neglect, improper operation, failure to follow the manual, unauthorized modification, or failure to perform customer maintenance.
Facts that support a normal-failure determination
- The machine was used within its rated capacity and the manufacturer’s instructions.
- The operator was authorized and trained for that equipment.
- Required inspections, fluid checks, charging, and cleaning were performed and recorded.
- The failure occurred without impact, overload, contamination, or prohibited attachment.
Facts that can shift costs to the customer
- Overloading, operating on unsuitable slopes or ground, or using the wrong attachment.
- Ignoring warning lights, continuing after overheating, or bypassing safety devices.
- Unauthorized repairs, parts, welding, software changes, or adjustments.
- Neglecting contract-required maintenance, refueling, charging, cleaning, or winterization.
- Collision, vandalism, theft, tire or tube damage, or loss of the equipment where the agreement assigns that risk.
Do not concede liability during the first call and do not authorize a paid repair based on a general online rule. Report the facts, ask the provider which contract provision it is applying, and request the inspection findings and estimated charge in writing. If the cause is disputed, preserve photos, operator statements, inspection records, and the machine’s condition before any non-emergency work begins.
6. Check whether rental charges continue during downtime
There is no universal rule that rent stops the moment a machine fails. The agreement may toll the rental period while the unit is unavailable, end charges after a required return, provide a replacement instead, or continue charges when the failure is customer-caused.

Some U.S. terms state that, for a normal-operation failure, the lessor’s sole remedy is termination of rental charges accruing after the failure, subject to returning the equipment to the store within 24 hours. Other terms describe repair or suitable replacement within a reasonable time, toll the rental period while the machine is down, or allow removal and termination with a refund treatment for the unexpired term, less amounts owed for customer-responsible damage or maintenance. A separate agreement also conditions the end of further charges on returning the equipment within 24 hours.

Those 24-hour conditions are specific to the agreements that contain them. They should not be generalized to every rental, and the clock may depend on when the failure occurred, when notice was given, and when the provider instructed you to return the unit.
Questions to get answered in writing
- What exact time ends billable rental charges?
- Must the equipment be returned within a stated period, and who arranges or pays for transport?
- Does downtime toll the rental period while a technician is working?
- Will a replacement carry a new rate, delivery fee, minimum rental period, or different insurance requirement?
- What charges remain payable for fuel, cleaning, damage, tires, maintenance, or lost accessories?
Continue to preserve the equipment and follow the contract while the billing question is resolved. Do not simply stop payment; dispute an incorrect invoice through the notice method in the agreement and attach your call records and written instructions.
7. Do not repair, move, or return the machine without authorization
A well-intended repair can turn a covered failure into customer-caused damage, create a safety incident, or make it impossible to determine the original fault. Unless the rental provider expressly authorizes a specific action, do not remove guards, open hydraulic or electrical systems, install parts, add fluids other than those clearly required by the operating instructions, weld, tow, or attempt a field repair.
Ask whether the provider wants the machine left in place, isolated, loaded for transport, or moved by an approved contractor. Confirm the required tie-down, lifting, towing, and access procedures. If the machine blocks a public road or creates an immediate danger, use trained personnel and the site emergency plan while keeping the provider informed.

8. Handle accidents, spills, theft, and injuries as separate events
A mechanical failure and an incident may trigger different duties. For an accident, injury, property damage, theft, or significant spill:
- Provide emergency care and call emergency services when required.
- Secure the area and prevent additional exposure.
- Notify the rental provider immediately using the contract’s incident number.
- Notify your site owner, prime contractor, insurer, and regulators when your safety plan, permit, or law requires it.
- Preserve the scene and records except where changes are necessary to protect life or prevent further damage.
- Submit the written report requested by the rental provider, using factual observations rather than speculation.
Do not move evidence merely to make the site look orderly, and do not admit fault on behalf of your company before the facts and contract responsibilities are established.
9. Keep the project moving without compromising the contract
Once the unit is secured, identify the work that is actually blocked. A replacement may not be the best answer if another owned machine, a different attachment, or a revised sequence can keep crews productive without violating the lift plan or site controls.
Evaluate a replacement safely
- Match rated capacity, reach, height, dimensions, ground pressure, and attachment compatibility.
- Check that the operator is trained and authorized for the substitute model.
- Reissue or revise lift plans, traffic controls, utility clearances, and daily hazard analyses when the equipment changes the risk profile.
- Confirm delivery access, fueling or charging requirements, emissions restrictions, and return condition.
- Get the rate, start time, minimum term, transport fees, and responsibility for the failed unit in writing.
Coordinate the schedule
Tell the superintendent, owner, subcontractors, and affected trades whether the work is paused, resequenced, or dependent on a replacement. Record standby labor, remobilization, and schedule effects according to the project’s notice provisions. A rental agreement may limit recovery for consequential losses even when it provides a repair or replacement remedy, so check both the rental contract and the prime contract before promising a delay claim.

11. Review these contract clauses before the next rental
Before accepting a machine, identify the sections that will control a breakdown:
- Malfunction, defect, accident, and stop-use requirements.
- Notice method, emergency number, written-report deadline, and access obligations.
- Repair, replacement, removal, and return procedures.
- Downtime tolling, charge termination, refund language, and any 24-hour return condition.
- Customer maintenance, fuel, charging, cleaning, tire, tube, and consumables duties.
- Damage waiver exclusions, indemnity, insurance, loss-of-use charges, and consequential-loss limitations.
- Authorized operators, manufacturer instructions, prohibited uses, and inspection requirements.
- Dispute, governing-law, and invoice-contest procedures.
Give operators a one-page contact sheet with the equipment ID, rental agreement number, emergency service number, and the instruction to stop work and call. Verify that daily inspections and hour-meter readings are retained where the agreement or your safety program requires them.
Bottom line for a broken rental machine
Stop use, protect the area, notify the rental provider promptly, and preserve clear facts about what happened. Let the contract and the provider’s inspection determine whether the unit is repaired, replaced, returned, or charged to your company. Never assume that downtime is free, a substitute is guaranteed, a 24-hour return rule applies, or a field repair is permitted until those points are confirmed in writing.
