If your builders’ merchant cannot supply an agreed material, do not accept a vague “out of stock” answer or approve a substitute on site. Get the exact stock position and a dependable date in writing, search the wider supply chain, have any alternative checked against the design and regulations, then record the price, programme and responsibility in a written variation. If the trader cannot provide the agreed goods or an acceptable alternative, review your cancellation and refund rights before paying more.
1. Establish exactly why the material is unavailable
“Out of stock” can describe several different situations, and each has a different solution. Ask the merchant to confirm whether the product is temporarily unavailable, allocated to existing orders, discontinued, delayed by the manufacturer, or held at another branch. Request the answer by email or on the order record, not just by telephone.

Ask for the product code and the complete specification, including size, strength or grade, colour, finish and pack quantity. Confirm how many units are physically available, the earliest dispatch or collection date, the delivery charge, any minimum order and how long the quoted price will remain valid. A date described as an estimate should be labelled as such; do not let an unverified promise become the project programme.
The Construction Leadership Council (CLC) has stressed that accurate, timely communication reduces frustration and warned suppliers against delivery promises they cannot achieve. Give the merchant a realistic deadline for your decision and ask what event would move the date—for example, a confirmed manufacturer shipment rather than an unallocated forecast.

Questions to send in writing
- Is the exact product code still manufactured?
- Is stock reserved for my order, or merely expected?
- How many units are available now and where are they located?
- What is the earliest dependable delivery or collection date?
- What haulage, crane, pallet or storage charges apply?
- Can the price, specification and delivery date be held until I decide?
- What happens to my deposit if the date is missed or the product is discontinued?
Keep the response with your quotation, order confirmation and payment record. This creates a clear reference if the delay later affects the contract with your builder.
2. Search every realistic source before changing the specification
Call other branches of the same merchant with the identical product code, then contact competing merchants. Ask the manufacturer or its authorised distributor where current stock is held and whether it can be transferred. Availability is not uniform across the network. The Builders Merchants Federation (BMF) represents a UK and Ireland network of 1,020 members in its 2026 site snapshot, so a local shortage does not prove that the product is unavailable nationally.
Historical market information is useful only as context. In its statement of 18 September 2024, the CLC reported generally good availability but two-to-three-week lead times or allocations for some aerated blocks, Class B engineering bricks and concrete roof tiles. That statement cannot establish what any branch has today; obtain a live written quote before relying on it.

Compare supply routes on the same basis
| Route | When it helps | Checks before commitment | Typical exposure |
|---|---|---|---|
| Another branch of the current merchant | The product is available elsewhere in the same network. | Transfer charge, reserved quantity, batch and collection or delivery date. | Stock may be allocated to another order before transfer is confirmed. |
| Competing local or regional merchant | The original supplier has no credible date. | Exact product code, specification, haulage, returns and account terms. | Different terms or batch can create colour, fit or warranty issues. |
| Manufacturer or authorised distributor | Merchants have no stock but the factory or distributor does. | Minimum order, lead time, unloading, warranty route and who contracts with you. | You may become responsible for transport, storage and damage claims. |
| Technically approved substitute | The original item cannot arrive within the programme. | Designer or building-control approval, complete datasheet and written variation. | Unapproved changes can affect compliance, performance and future claims. |
3. Decide whether a substitute is technically acceptable
A similar-looking product is not automatically interchangeable. Give the proposed alternative’s current datasheet, declaration of performance and certification to the builder, designer, structural engineer or building-control professional who is responsible for that part of the work. Obtain written approval before ordering or installing it.
The review should cover every property that could affect safety, compliance or service life:
- Dimensions and tolerances: Check length, width, thickness, joint size and fixing pattern. A small dimensional difference can alter setting-out, openings and quantities.
- Strength or load rating: Confirm compressive strength, structural grade, span rating or imposed-load capacity where relevant.
- Thermal performance: Compare declared thermal conductivity, U-value contribution and any effect on the approved energy calculation.
- Reaction to fire: Verify the required classification for the location, including cavity, boundary and protected escape conditions.
- Moisture behaviour and compatibility: Check water absorption, vapour movement, movement joints, fixings, mortars, membranes and adjoining materials.
- Certification and warranty: Confirm that approvals remain valid for the intended use and that the manufacturer will support the assembled system.
- Appearance: For visible brickwork, tiles, cladding or paving, check colour, texture, profile and batch matching. A later batch may not match an earlier delivery.
The Federation of Master Builders’ homeowner guidance advises discussing alternative options with your builder when a material is unavailable or costs have risen. That discussion is a starting point, not a technical approval: the person responsible for the design must confirm that the alternative is suitable.
When a substitute should be rejected
- The supplier cannot provide a complete datasheet or traceable certification.
- The proposed product has lower strength, a different fire classification or unknown thermal performance.
- It changes a detail already approved by building control, a warranty provider or a structural engineer without their written consent.
- It cannot be matched to materials already installed, leaving a visible or water-tightness defect.
- The only reason to choose it is that it is cheaper or arrives sooner, while quality or customer service would be compromised.
The FMB specifically warns against choosing a cheaper or faster option if it compromises quality or customer service. If no compliant substitute exists, keep the original specification and re-plan the work rather than forcing an unsuitable product into the build.

4. Re-price and re-plan through a written variation
Do not rely on a verbal agreement that “the difference will be sorted later.” Before the substitute or new supplier is ordered, issue a written variation or contract update. Citizens Advice says a home-improvement contract should address timings, tidying up, materials, equipment, subcontractors and payment; keep a record of the job details alongside the written contract.
The variation should identify:
- the original product and the proposed product, with manufacturer and product code;
- the reason for the change and who approved its technical suitability;
- the new unit price, quantity, tax, haulage, off-load, storage and disposal costs;
- who pays any increase or receives any saving;
- the confirmed delivery or collection date and what is merely an estimate;
- which work can proceed while waiting and any revised completion milestone;
- who carries the risk of delay, damage, non-delivery, defects and warranty claims;
- what happens if the substitute is rejected on delivery or fails inspection.
Have all affected parties sign or clearly accept the variation: client, main contractor, designer where relevant and the supplier if its terms are changing. Attach the datasheet, approval email and revised quotation. A dated document prevents a later dispute about whether the client, builder or merchant authorised the change.
5. Consider buying from another source yourself
Buying direct from another merchant or a manufacturer can release the programme, but agree the arrangement with the builder first. Decide who owns the materials from payment through delivery, who books and pays for unloading, where they will be stored, who inspects them, and who bears the risk of theft, weather damage or incorrect quantities.

If you purchase under your own name, you may need to pursue the supplier directly for a defect or shortage; the builder’s normal merchant account may not protect you. Conversely, buying the goods yourself can ensure that you own them if the contractor fails, which Citizens Advice identifies as a possible advantage. Record the arrangement in the contract rather than assuming that possession on site proves ownership.

Practical checks before a direct purchase
- Confirm that the delivery vehicle can access the site and that a competent person will be present to unload it.
- Provide a dry, secure storage area that will not damage the product or breach manufacturer instructions.
- Count packs, photograph labels and inspect visible damage before signing the delivery note.
- Keep invoices, batch numbers and certificates for the handover and warranty file.
- Do not open or mix batches until the builder has confirmed that the quantity and appearance are acceptable.
6. Protect the programme while you wait
Ask the builder to separate tasks that depend on the missing item from work that can proceed safely. For example, preparation, excavation, service routes, setting-out or procurement of fixings may continue while a manufactured component is delayed, but only if the revised sequence does not create rework or expose unfinished work to weather.
Update the programme with the merchant’s written commitment and a contingency date. Confirm who pays additional visits, plant hire, storage, protection or remobilisation. A nominally free delivery can be expensive if the site team and equipment are waiting without productive work.
Give the client regular, factual updates: what is confirmed, what is uncertain, the decision deadline and the effect on completion. The CLC’s emphasis on accurate and timely communication applies equally to the builder’s client relationship. Never promise a completion date that depends on unallocated stock.

7. Escalate wrong, defective or non-delivered materials
If the delivered goods are wrong, damaged, defective or not fit for the stated purpose, notify the trader in writing promptly. Describe the product, quantity, delivery date and defect; attach photographs and the delivery note; state the remedy you want; and give a realistic date for a response. Keep the goods available for inspection unless safety requires isolation.

Which? summarises the Consumer Rights Act position that materials supplied as part of building work should be of satisfactory quality, as described and fit for purpose. The exact rights and remedies depend on whether you contracted as a consumer or business, who supplied the goods, the contract terms and the current law. Do not allow a disputed delivery to be incorporated into the building before responsibility is clear.
If the agreed goods or services cannot be supplied and no acceptable alternative exists, the Office of Fair Trading’s home-improvement guidance supports cancellation and refund of prepayments in that circumstance. A deposit is not automatically lost simply because the merchant or contractor cannot supply what was agreed, but the precise entitlement depends on the contract, trader status and applicable law. Ask for the contractual basis of any proposed deduction and obtain independent advice if the amount is significant.
A proportionate escalation sequence
- Send a written notice identifying the failure and the remedy requested.
- Allow the response period promised in the contract, or a reasonable period if none is stated.
- Escalate to the merchant’s manager or formal complaints process and copy the contractor or client affected by the delay.
- Preserve quotations, variations, photographs, delivery records and proof of payment.
- Seek advice from a relevant trade body, Citizens Advice or a solicitor before terminating a contract or withholding a disputed payment.
8. A decision framework for the client and builder
Use the following order when the original product is delayed:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- Wait: Choose this only when the merchant has confirmed an achievable date and the programme, cost and site conditions can absorb it.
- Source elsewhere: Select this when the same specification is available with a dependable delivered cost and acceptable warranty route.
- Substitute: Select this only after technical approval and a signed variation covering price, programme and risk.
- Cancel or terminate the affected order: Consider this when supply is impossible or the only alternatives are unacceptable; check the contract and refund consequences first.
Compare each option against exact specification, certification and warranty, delivered price, earliest dependable delivery, minimum order and returns, storage and unloading, colour or batch matching, and responsibility for delay or failure. The fastest quote is not the best option if it creates a compliance problem or transfers unmanageable risk to the site.
What current market information can—and cannot—tell you
Industry conditions change faster than published statements. A July 2026 industry statement reported 1.6% construction-output growth in the three months to April and forecast a 2%–2.5% sector decline in 2026, while noting generally good availability across most building materials. Read that as market context, not evidence that a particular branch has your product. The statement is available at the Tile Association. Your decision should still rest on a live, written stock allocation and delivery commitment.
